SUMMARY OF THE HISTORIC DISTRICT COMMISSION AND HISTORIC ADVISORY COMMITTEE JOINT WORKSHOP December 1, 2021 The Washington County Historic District Commission and the Historic Advisory Committee held a joint workshop meeting on Wednesday, December 1, 2021 at 5:30 p.m. at the Washington County Administrative Complex, 100 W. Washington Street, Room 2001, Hagerstown, Maryland. CALL TO ORDER AND ROLL CALL The HDC Chairman called the meeting to order at 5:35 p.m. Historic District Commission members present were: Greg Smith, Chairman, Lloyd Yavener, Vice Chairman, Ann Aldrich, Vernell Doyle, Michael Lushbaugh, and Kourtney Lowery. Historic Advisory Committee members present were: Linda Irvin-Craig and Ralph Young, Co-Chairpersons, and Tom Clemens. Staff members present were: Washington County Department of Planning & Zoning: Jill Baker, Director; Meghan Jenkins, GIS Coordinator and HDC Staff member; and Debra Eckard, Administrative Assistant. Demolition Permit Review Procedures Discussion Ms. Baker gave a brief history of the draft demolition permit review policy. This policy was first presented by the HAC to the Board of County Commissioners in 2019. At that time, the BOCC requested input from the Washington County Planning Commission. Unfortunately, the Planning Commission did not provide any feedback to the proposed policy changes. Subsequently it was presented again to the BOCC earlier this year at which time the County Commissioners suggested that they should hold a workshop meeting with the HAC and HDC. It was decided that a joint workshop with the HDC and HAC should be held prior to meeting with the Commissioners in order to provide a united proposal. Two topics of discussion that need to be focused on are the delayed review period and premature demolition and fines. Ms. Aldrich expressed her opinion that the permitting process needs to be reversed so that a demolition permit cannot be issued before development plans are approved. She asked if there is a way to reverse the process and hold the demolition permit on historic structures until all other permits are approved. Ms. Baker stated there is not a way to reverse the process because the demolition permit is its own independent process and is not necessarily associated with a development project. She noted that included in the Design Guidelines, which will be approved by the HDC independent of the BOCC, staff is proposing a requirement that when a demolition permit is applied for, the applicant must have a case file number from MHT. This will ensure that MHT will be able to review the application and comment on the historic structures prior to demolition. Ms. Aldrich asked if MHT’s requirements for documentation will be cited in the Design Guidelines. Ms. Jenkins stated that MHT’s standards and guidelines for architectural and historical investigations would be a suggestion in the Guidelines. It will not be a requirement since it can be quite costly to have a professional assessment completed. This could be a deterrent for people to apply for a demolition permit and go thru the process whereby the HDC can make comment and provide alternatives to the property owner, such as reuse, rehabilitation or salvaging of materials. Currently in the Zoning Ordinance and in Maryland State Law, there is a requirement for the HDC to render a decision within 45 days of receipt of a “completed application”. There currently is no demolition application with the HDC; there is only the permit application. There was a brief discussion regarding the definition of a “completed application”. Members suggested defining the “completed application” in the HP zone. One suggestion would be to consider the application completed when it is presented for the first time to the HDC during its monthly meeting. That would give the HDC 45 days to review the application and work with the applicant to find alternatives to demolition. There was some discussion as to whether a public hearing could be incorporated into the process to give the public an opportunity to comment or give testimony on the history of a property, potential environmental impacts, etc. If a public hearing could not be integrated, members suggested having a way to get public comment. Ms. Baker explained that public comment is only used when there is going to be an amendment or a change in the use of a property that is not expected. For example, a change in zoning on a specific parcel of land. She reminded members that we are discussing a building permit and noted that the County does not take public comment on a building permit. Ms. Baker expressed her concern that by taking public comment, we would give the public a false sense of hope when we cannot deny the demolition permit. The HDC’s authority is only for the support or non-support of a demolition permit. The HAC would like to be included in the review process when the HDC receives the “completed application”. It was suggested that the HDC agenda packet should be sent to the HAC at the same time it is sent to the HDC members. Consensus: Define “completed application” in the Design Guidelines. It was decided that the Chairman of the HDC and the Co-chairpersons of the HAC will exchange e-mails to discuss the premature demolition permit and fines. Baker, Director Washington County Dept. of Planning & Zoning MINUTES OF THE HISTORIC DISTRICT COMMISSION FOR WASHINGTON COUNTY December 1, 2021 The Washington County Historic District Commission held its regular monthly meeting on Wednesday, December 1, 2021 at 7:00 p.m. at the Washington County Administrative Complex, 100 W. Washington Street, Room 2001, Hagerstown, Maryland. CALL TO ORDER AND ROLL CALL The Chairman called the meeting to order at 7:00 p.m. Commission members present were: Greg Smith, Chairman, Lloyd Yavener, Vice Chairman, Ann Aldrich, Vernell Doyle, Michael Lushbaugh, and Kourtney Lowery. Staff members present were: Washington County Department of Planning & Zoning: Jill Baker, Director; Meghan Jenkins, GIS Coordinator and HDC Staff member; and Debra Eckard, Administrative Assistant. MINUTES Motion and Vote: Ms. Aldrich made a motion to approve the minutes of the November 3, 2021 meeting as presented. The motion was second by Mr. Yavener and unanimously approved. OLD BUSINESS Pole Barn Review Policy Ms. Jenkins presented a draft of the pole barn review policy that was requested by Commission members. A copy of the draft will be attached to these minutes. Members had no changes or comments. Motion and Vote: Ms. Aldrich made a motion to approve the policy as presented. The motion was seconded by Mr. Yavener and unanimously approved. NEW BUSINESS Demolition Permit 2021-04892 – 20463 Jefferson Boulevard Ms. Jenkins presented for review a demolition permit application for property located at 20463 Jefferson Boulevard. The property owners, Mark and Patricia Clegg, and Jonathan Harris of Total Home Improvements were present at the meeting. The applicant is proposing to demolish a lean-to addition on the right side of the tea house (WA-I-283). This is an early 20th century structure; however, the date of the portion to be demolished is unknown. The door (and windows surrounding it) on the tea house is a notable architectural feature that should be retained, if possible. It appears that the lean-to addition is sitting directly on the ground which has caused a lot of rot and decay on the siding. Several windows are damaged or rotted. Discussion and Comment: Mr. Lushbaugh asked if removing the lean-to would cause any damage to the tea house. Mr. Clegg believes there will be no damage to the original structure. Mr. Harris stated that all of the siding will be replaced on the tea house as well as many other improvements will be made. The property owners intend to keep the door with surrounding windows. Ms. Aldrich encouraged the applicant to retain the original siding in order to keep the architectural character of the tea house. Ms. Aldrich asked if the windows will be re-purposed. Mrs. Clegg said they will be kept and re-used if possible; however, they must meet building code requirements. Members provided several suggestions for reuse of materials. Motion and Vote: Mr. Lushbaugh made a motion to support the demolition of the lean-to addition as presented. The motion was seconded by Ms. Aldrich and unanimously approved. Certified Local Government FFY 21 Annual Report Ms. Jenkins presented a draft of the FFY21 Annual Report for the Certified Local Government. This report includes the goals for the coming year and continuing education of the members. Discussion and Comments: There was a brief discussion regarding the education trainings and sessions. Ms. Jenkins will verify that this section is updated and complete. Motion and Vote: Ms. Aldrich made a motion to approve the FFY21 Certified Local Government Annual Report with the modifications as discussed. The motion was seconded by Mr. Lushbaugh and unanimously approved. OTHER BUSINESS Staff Report • Staff Reviews: Ms. Jenkins stated a written report was provided with the agenda packets. • Staff Updates: o Dickinson Property – MHT does not keep a contractor’s list for documenting properties. MHT has received the file from the consultant for this property, MHT File #202104484. MHT will reach out to the HDC for comments on this application. Following a brief discussion, members decided they would like to see the application and any new information that is submitted. o MAHDC Training will be held on December 7th from 6 to 8 pm. This is an optional training. o CAMP training is scheduled for December 6th and 8th from 9 am to 1 pm. o Design Guidelines are still a work in progress. Staff is hoping to have the new draft available for the January meeting. o 21612 Jefferson Boulevard – This property changed ownership at the same time the historic structure was demolished so we are still trying to find who the new owners are. Staff continues to check on this matter. o Food for Thought – Meghan made a presentation to this group regarding the HDC Demolition permit process. o Town of Sharpsburg – Ms. Jenkins reported that the municipalities, excepting the City of Hagerstown because they have an HDC equivalent, do not qualify for County tax credits per the Ordinance. County tax credits can be applied on properties with the HP (Historic Preservation) or AO (Antietam Overlay) zoning districts. County tax credits could extend to the municipalities (per the BOCC minutes) that have an equivalent zoning to the HP zone, which includes adopting language of the HDC, and the ability to approve or deny permits for historic structures. There was a brief discussion that the HDC could perform the reviews for the municipalities under an MOU; however, there are several outstanding projects that need to be considered before we could consider this idea. There have been several demolitions of structures included on the MIHP in recent years both in and out of these growth areas. The goal of the HDC is to ensure that a dialogue exists prior to a demolition application involving these resources and to hopefully minimize these demolitions through collaboration with property owners. The HDC would encourage property owners interested in retention of their MIHP resources to consider the County’s Historic Preservation Zoning Overlay (HP Overlay). This Overlay persists through changes in ownership and provides property owners the ability to apply for local historic preservation tax credits for qualifying exterior projects or new construction in the amount of 10% or 5% respectively. These tax credits are available if the work follows the Secretary of Interior’s Standards for Rehabilitation. The HDC highly encourages that interested property owners place this overlay if they wish for the historic structure to have more protections during comprehensive plan and project reviews in the future as well. We understand that the project may require an Engineering Access Permit from the Maryland State Highway Administration (MDOT SHA). Therefore, we have assessed the effects of the undertaking on historic properties in accordance the Maryland Historical Trust Act of 1985, as amended, State Finance and Procurement Article §§ 5A-325 and 5A-326 of the Annotated Code of Maryland. As noted in your correspondence, NorthPoint Development proposes to construct two large warehouses with internal roadways, parking, and stormwater management ponds. Construction of the industrial buildings will necessitate the demolition of one property included in the Maryland Inventory of Historic Properties (MIHP) known as the J.R. Fridinger Farm (MIHP No. WA-004). The Trust believes that this property is eligible for listing in the National Register of Historic Places. According to Article §§ 5A-325 and 5A-326 of the Annotated Code of Maryland, demolition of properties listed in the Maryland Register of Historic Properties/National Register of Historic Places constitutes an adverse effect that requires consultation and development of feasible and practicable means to avoid, mitigate, or satisfactorily reduce the adverse effect. After reviewing the proposed plans, the Trust has determined that the project must complete additional avoidance and mitigation measures to satisfactorily reduce the project’s adverse effects. It appears that the existing tenant/spring house may not be impacted by the proposed construction activities. We strongly recommend NorthPoint Development explore options to retain and incorporate the tenant/spring house into the proposed development. Finally, the Trust has determined that the project’s adverse effect will be satisfactorily reduced by NorthPoint Development carrying out the following mitigation measure: MIHP Addendum Form for the J.R. Fridinger Farm (MIHP No. WA-004) • NorthPoint Development will complete an Addendum to the existing MIHP record for the J.R. Fridinger Farm (MIHP No. WA-004). The Addendum will provide an updated architectural description and historic context for the property and include high quality digital photographic documentation of structures and landscape prior to the commencement of demolition and construction activities. Photographs should include images clearly showing all facades of primary buildings, all accessory buildings and structures, all significant landscape features, and the Mr. Joe Franek, P.E. Photographs must be either traditional black-and-white images prepared in accordance with the Standards and Guidelines for Architectural and Historical Investigations in Maryland (2019), or digital images prepared in accordance with the standards for submission of digital images (Appendix B in the Standards and Guidelines). NorthPoint Development will provide digital photo files, a photo key plan, photo log and the MIHP Addendum form to the Trust for review and acceptance. Please sign the concurrence line provided at the end of this letter if you concur with the Trust’s stipulation and provide the Trust and the MDOT SHA with copies. If NorthPoint Development does not agree with these stipulations, further consultation will be necessary to conclude the historic preservation consultation. Inclusion of this signed letter with the MDOT SHA Access Permit application is evidence that NorthPoint Development agrees to satisfactorily comply with Article §§ 5A-325 and 5A-326 of the Annotated Code of Maryland and also satisfies the responsibilities of MDOT SHA under the Maryland State historic preservation law.
