E., Division Director of Environmental Management RECOMMENDATION: Approve accepting FY24 Community Grant and the attached budget amendment form. REPORT -IN -BRIEF: The Department of Water Quality applied for and received a FY24 Community Grant to replace our existing Supervisory Control and Data Acquisition (SCADA) system. DISCUSSION: The Department of Water Quality applied for and was award a $200,000 grant to replace our existing SCADA system at our wastewater pump stations and treatment plants. The grant will pay for 80% of the cost to replace the existing SCADA system with the maximum amount being $200,000. The estimated project cost is $250,000; therefore, the grant will cover $200,000 and the County will be responsible for $50,000. Funds are available in the current CIP budget. FISCAL IMPACT: By accepting the grant, Water Quality doesn't have to fund the project in its entirety. CONCURRE NCES: NA ALTERNATIVES: Use Water Quality fiords instead of accepting grant. PRESENTATION DATE: November 26th, 2024 PRESENTATION BY: Linda Spence, Financial Programs Administrator , Department of Business and Economic Development; Jonathan Horowitz, Director, Department of Business and Economic Development; Rosalinda Pascual, Deputy County Attorney RECOMMENDED MOTION: Approve the Resolution for acceptance of the State of Maryland’s $1,400,000 Maryland Economic Assistance Authority Fund (MEDAAF), also referred to as the Advantage Maryland loan. REPORT-IN-BRIEF: The State of Maryland Department of Commerce (Department), under the Maryland Economic Development Assistance Authority Fund, has agreed to conditionally loan Lifetime Brands Inc., or an entity acceptable to the Department (the “Company”) to the amount of $1,400,000 from the Maryland Economic Development Assistance Authority Fund (MEDAAF) (the “MEDAAF Loan”). DISCUSSION: The Department of Business and Economic Development is seeking BOCC approval of a resolution to accept the State of Maryland's MEDAAF conditional loan funding and flow that funding to the Company. The MEDAAF Loan proceeds will be used by the Company to lease an approximate 1,027,468 square foot “under development” facility at the former Rhoton Farm site located at 12658 Greencastle Pike (Rt. 63), Hagerstown, Washington County, Maryland (the “Project Site”) where the Company will operate a distribution center. Total costs associated with the Project are estimated to be at least $59,000,000 for construction of the facility, tenant improvements, and machinery and equipment (the “Project Costs”). We further understand the Company will create approximately 236 new permanent full- time “Direct” and/or “Outsourced” employees at the Project Site by December 31, 2028. There is no financial liability to the County. FISCAL IMPACT: No County funding will be expended. CONCURRENCES: n/a ALTERNATIVES: Decline to endorse the MEDAAF resolution. AUDIO/VISUAL NEEDS: n/a Board of County Commissioners of Washington County, Maryland Agenda Report Form Open Session Item SUBJECT: Sole Source Award (PUR-1718) - Self-Contained Breathing Apparatus (SCBA) PRESENTATION DATE: November 26, 2024 PRESENTATION BY: Brandi Naug le, CPPO, Director, Purchasing , Er ic Jacobs, EFO, Assistant Director – Fire/EMS, Division of Emer gency Services. RECOMMENDATION: Motion to authorize a Sole Source procurement of firefighter SCBA from Witmer Public Safety, Inc. of Coatesville, PA for the total sum in the amount of $90,801 based on its quotes d ated July 22, 2024, a nd July 23, 2024. REPORT-IN-BRIEF: DES wishes to apply Section 1-1 06.2(a)(2) of the Code of Public Laws of Washington County, Maryland, to procure the request. This section states that a sole source procurement is authorized and permissible when: The compatibility of equipment, accessories, or replacement parts is the paramount consideration. This request requires the approval of four of the five Commissioners in order to proceed with a sole source procurement. If approv ed, the following steps of the process will occur as outlined by the law: 1 ) Not more th an ten (10) days after the execution and approval of a contr act under this section, the procurement agen cy shall p ublish notice of the award in a newspaper of general circulation in the County, and 2) An appropriate record of the sole sour ce procurement shall be maintained as required. DISCUSSION: On January 25, 2022, $1.6 million from the American Rescue Plan (ARPA) was allocated for purchasing SCBA equipment for volunteer fire and EMS companies in Washington County. This initiative was aimed to standardize SCBA equipment across the county, enhance firefighter tracking, and improve safety. In October 2024, all fire/rescue companies received new portable radios with enhanced technology that included radios integrating with SCBA identifiers. In September 2021, Hancock Fire and Hancock Rescue Squad acquired MSA SCBA but did not receive software updates for radio compatibility. This procurement will ensure that all fire and rescue personnel are on compatible platforms. FISCAL IMPACT: Funding is available in the amou nt of $92,910 from the allocated ARPA funds, specifically set aside for the purchase of replacement SCBA. Seven companies were represented at the pre-bid/teleconference. Twenty-two (22) persons/companies registered/downloaded the bid document online. The Purchasing Department received a request from DWQ regarding the procurement of water service parts. REPORT-IN-BRIEF: The Code of Public Laws of Washington County, Maryland (the Public Local Laws) §1-106.3 provides that the Board of County Commissioners may procure goods and services through a contract entered into by another governmental entity, in accordance with the terms of the contract, regardless of whether the County was a party to the original contract. The County of Mecklenburg in association with Omnia Partners took the lead in soliciting the resulting contract. If the Board of County Commissioners determines that participation by Washington County would result in cost benefits or administrative efficiencies, it could approve the purchase of these bleachers in accordance with the Public Local Laws referenced above by resolving that participation would result in cost benefits or in administrative efficiencies. The County will benefit from direct cost savings in the purchase of these bleacher systems because of the economies of scale this buying group leveraged. I am confident that any bid received as a result of an independent County solicitation would exceed the spending savings that the Omnia Partners contract provides through this contract. Additionally, the County will realize savings through administrative efficiencies as a result of not preparing, soliciting, and evaluating a bid. This savings/cost avoidance would, I believe, be significant.
