SUBJECT: Public Hearing to Adopt for implementation and enforcement the Maryland
Swimming Pool and Spa Standards, w hich incorporate therein the 2021 International Swimming
Pool and Spa Code.

RECOMMENDATION: To hold a public hearing fo r the proposed adoption of the Maryland
Swimming Pool and Spa S tandards, which incorporate therein the 2021 International Swimming
Pool and Spa Code.
REPORT-IN-BRIEF: The Standards, which incorporate the International Swimming Poo l a nd
Spa Code, were pr eviously included in the ARF for the Public Hearing for 2021 Bu ilding code
adoptions. Because the Swimming Pool and Sp a Standards/Code are new and there were n o
local amendments being proposed, it was mistakenly omitted fr om the public notice for the
February 27th hearing and did not have its own individual proposed ordinance included. We are
obligated to implement a nd enforce these Standards pe r COMAR 09.12.56.05 with or without
local amendments. This proposed adoption is simply to encapsulate that state-level requirement
and was intended to be adopted with the other building codes adopted in February. These
Standards establish minimu m requirements to provide a reasonable level of s afety, health,
property protection and general welfare by regulating and controlling the design, construction,
installation, quality of materials, location and maintenance or us e of pools and spas.
DISCUSSION: The proposed ordinance has be en drafted for the Board’s consideration, public
notice and implementation.

AN ORDINANCE TO ADOPT AND ENACT THE MARYLAND SWIMMING POOL
AND SPA STANDARDS, INCORPORATING THE 2021 INTERNATIONAL SWIMMING
POOL AND SPA CODE, AS PROMULGATED BY THE INTERNATIONAL CODE
COUNCIL
RECITALS
Pursuant to MD Code, Public Safety §12-1205, the Board of County Commissioners of
Washington County, Maryland (the “Board”) adopts the Maryland Swimming Pool and Spa
Standards, under MD Code, Public Safety Title 12, Subtitle 12. Per Code of Maryland Regulations
09.12.56.05, the Maryland Swimming Pool and Spa Standards incorporates therein the 2021
International Swimming Pool and Spa Code (ISPSC 2021), as promulgated by the International
Code Council.
These Maryland Swimming Pool and Spa Standards establish minimum requirements to
provide a reasonable level of safety, health, property protection and general welfare by regulating
and controlling the design, construction, installation, quality of materials, location and maintenance
or use of pools and spas.
A public hearing was held on July 16, 2024, following due notice, pursuant to MD Code,
Local Gov’t §§ 9-105 and 13-901. Public comment was received, reviewed, and considered
concerning the adoption of the 2021 International Swimming Pool and Spa Code, as promulgated
by the International Code Council as the Maryland Swimming Pool and Spa Standards (COMAR
09.12.56).
NOW, THEREFORE, BE IT ORDAINED that the Maryland Swimming Pool and Spa
Standards, incorporating therein the 2021 International Swimming Pool and Spa Code, as
promulgated by the International Code Council, is enacted.
Adopted this ____ day of ___________ 2024.
Effective the 26th day of July, 2024.

SUBJECT: Request for Concurrence/Approval of Airport’s application for a Small Community
Air Service Development Program Grant.
PRESENTATION DATE: 07/16/2024

RECOMMENDED MOTION(S):
• Motion to provide Airport Director with approval to submit Small Community Air
Service Development grant application, sign related paperwork, and if awarded, accept
grant funds and issue related purchase orders.
REPORT-IN-BRIEF: Seeking $325,000 in federal funds to be paired with $125,000 in local
matching dollars to enhance, improve and expand air service development-related marketing
efforts. Funds would be used to promote the airport’s air service under a 2-3-year grant period
(TBD). Application will be worded to provide the flexibility needed to market the existing
Allegiant service, but also to help incentivize new Allegiant frequencies or routes (and promote
them if they materialize) and additionally, if any new entrant air carriers are interested in the
market, this could potentially also become part of an incentives package for them. We will
mention that over the multi-year grant period, service may change in scale and destinations, yet
this marketing program will support the airport’s air service.
DISCUSSION: Small Community Air Service Development Program Grant (SCASDP).
Related to the U.S. Department of Transportation’s FY2023 (BY2024) Notice of Funding
Opportunity DOT-OST-2023-0066. Applications are due July 25, 2024, and are submitted on
Grants.gov. Staff proposes to collaborate with Volaire Aviation, Inc. (HGR’s Air Service
Development Consultants) to produce a grant application and to assemble numerous letters
demonstrating broad-based support.
Public private partnerships: To date, a commitment of $75,000^ as a cash contribution has been
received from the Visit Hagerstown Convention & Visitor’s Bureau to supplement the airport’s
annual $50,000 spend on airline-related advertising. Additional letters of support demonstrating
commitments for discounted rates from several marketing partners have been received along
with letters from U.S. Congressman Trone, State Senator McKay, the Maryland Aviation
Administration’s Regional Aviation Assistance’s Director, our local chamber of commerce and
business community.

Proposing an expenditure of $450,000 across three years, tripling the available budget to
promote the available airline service at HGR.
^Conditional on grant award.
FISCAL IMPACT:
• The airport will incur no additional cost for Volaire’s assistance with preparing the grant
application.
• The airport will not be pledging or committing any more of its advertising funds than it
already does ($50,000 annually) as airport cash funds toward this effort.
• Additional dollars will be local, non-airport cash funds ($75,000 – CVB) paired with
discounted service commitments from marketing partners, which shall be classified as
“in-kind contributions” in the grant documents.
CONCURRENCES: Airport Advisory Commission
ALTERNATIVES: HGR does not elect to apply for this grant, becoming a missed opportunity
to pull down available federal funds that could increase our air service marketing/advertising
budget and capabilities, enhancing prospects, attractiveness and competitiveness when compared
with other cities also seeking air service.

SUBJECT: Agriculture – Faces of Farming Presentation

RECOMMENDED MOTION: N/A
REPORT-IN-BRIEF: “Faces of Farming” is an agricultural-focused video marketing campaign that
will showcase two local Washington County farms every month, for one year. The “Faces of Farming”
marketing videos will be showcased on the County’s website, as well as Facebook and other social
media platforms, and will target a new industry and highlight a local farmer from that specific
agricultural industry.
DISCUSSION: Washington County’s agricultural business represents the backbone of the County’s
landscape. With almost 900 operating family farms and $167,907,000 in market value of products sold,
agriculture is the cornerstone of Washington County’s economy. The “Faces of Farming” marketing
campaign will aim to educate residents in Washington County, along with the surrounding States and
Counties, about the economic impact of the Ag industry. Additionally, these videos will be used for
agricultural education to numerous streams around Washington County, such as, 4-H and FFA (Future
Farmers of America) meetings, Ag Expo and Fair, and they will be available on the Washington County
Ag App and website.
