(4) The topics discussed, and information presented may deter businesses from
making proposals if done so in open session.
• Discuss whether to recommend supporting certain applications for George
Edwards Fund grant for businesses to expand operations within the County;

To consult with counsel to obtain legal advice on a legal matter.
(7) Board has requested legal advice on drafting contract of sale and negotiating
strategy, as well as pending litigation. Both items are properly discussed in closed
session.

REPORT-IN-BRIEF: During this visit, MACo takes the opportunity to hear about issues and concerns
that the Members may have on state policy issues, MACo’s conferences and events, and so forth. They
usually give a state legislative and budget update, and a look forward to the next session of the General
Assembly, but they are glad to focus on topics that are of specific local interest, as needed. Updates are
given on MACo’s legislative activities, and we look to hear from elected officials about their needs and
interests for the coming year. These visits help inform MACo’s work and are valuable updates and
exchanges for our members.

SUBJECT: Multi-Signature change order for Comprehensive Health care Services for Inmates –
Approval of the Change Order.
PRESENTATION DATE: August 6, 2024
PRESENTATION BY: Major Craig Rowe, Warden, Washington County Sheriff’s Office, Detention
Center.
RECOMMENDED MOTION: Move to approve the Multi-Signature Change Order from
$2,220,805.21 to $2,316,356.08, an increase of $95,550.87 for claims that will be reimbursed by the
State.
REPORT-IN-BRIEF: The Washington County Sheriff’s Office, Detention Division is requesting
approval of the multi-signature change order so that invoices for catastrophic billing can be paid and
then submitted to the State for reimbursement.
DISCUSSION: The contract with PrimeCare Medical, Inc. states in the “scope of work, section W”
that “The Center shall also, upon receiving the appropriate documentation from the contractor, file for
and reimburse the contractor for any funds received from the State of Maryland for any individual
inmate in excess of $25,000 per fiscal year pursuant to Maryland Code, Correctional Services Articles,
Section 9-405.” The detention center must pay these funds out of the budget, then invoice the State of
Maryland in order to receive reimbursement. These are unbudgeted FY24 costs due to not having prior
knowledge of what inmates and medical conditions would be incarcerated in any given year.
FISCAL IMPACT: There is $122,501.04 remaining on the P.O. and there is funding remaining in the
Detention Center FY24 budget to cover the change without any additional funding needed. In addition
the County will be reimbursed $184,241.53 to the General fund when received from the State.
CONCURRENCES: Purchasing Department
ALTERNATIVES: Deny approval then funds will have to be paid from FY25 which was not budgeted
for.

SUBJECT: Washington County Gaming Commission’s Annual Report and Fiscal Year 2024
Gaming Fund Allocation Announcement

RECOMMENDED MOTION: This presentation is for informational purposes only. No
motion or action is requested.
REPORT-IN-BRIEF: The Washington County Gaming Commission wishes to present their
annual report to the Board of County Commissioners and to announce the Commission’s fiscal
year 2024 funding decisions. In fiscal year 2024, the Gaming Commission had available
$2,414,285.89 for distribution to local charitable organizations and the Volunteer Fire & Rescue
Association. This figure reflects a decrease in revenues of $128,744.45 when compared to the
previous fiscal year. In accordance with State Statute, 50% of the funding received is allocated
to the Washington County Volunteer Fire & Rescue Association and the remaining has been
allocated to charitable organizations in Washington County.
DISCUSSION: In May of 2024, the Gaming Commission received 88 funding applications
from 76 charitable organizations. The total amount of funding requested from those 88
applications was $2,990,534.92. The applications were reviewed and considered by each
Commissioner. After review, group deliberations and a gaming hearing in June, the Gaming
Commission determined appropriate funding allocations based on the published and approved
“Guidelines for Distribution of Gaming Funds” which is consistent with the State Statute
governing the distribution of such funds.
FISCAL IMPACT: There is no fiscal impact to the Washington County general fund.

Communications (911 Center)

RECOMMENDED MOTION: Move to accept and approve the recommended Logo for Emergency
Communications (911 Center).
REPORT-IN-BRIEF: Washington County Emergency Communications (911 Center) is in need of a logo
that aligns with the county's branding guidelines. By request, the new logo should incorporate the following
key elements:
•The American Flag with the thin yellow line, symbolizing our emergency call-takers.
•A map of the Washington County region, highlighting our local community.
•An image of George Washington, reflecting our county's historical significance.
•A call taker’s headset, representing the essential role of our communications staff.
DISCUSSION: The Public Relations & Marketing Department collaborated with the Director of
Emergency Management and Communications to develop the new logo.

What was requested?

that the Public Relations and Marketing Department create a new logo
within Washington County’s branding guidelines for the Emergency
Communications Center (911) and include the following:
ü The American Flag with the thin yellow line that represents
emergency call-takers.
ü A map of the Washington County region.
ü George Washington
ü Call taker’s headset.

selections from the Emergency Management and Communications Director are shown below.

SUBJECT: Bostetter Property-Sewer Service and JSSA Amendment
PRESENTATION DATE: August 8, 2024

RECOMMENDED MOTION: Move to approve First Amendment to JSSA to provide for sewer
service to Bostetter Property.
REPORT-IN-BRIEF: County and City staff have negotiated the attached amendment to the JSSA to
provide for sewer service to the Bostetter Property.
DISCUSSION: Bostetter Group, LLC owner of real property, with an address of 17601 Broadfording
Road (the “Property”), granted an easement for the County to run sanitary sewer line across the Property,
and negotiated an option to connect to said sewer line. Bostetter Group exercised its option. In the
interim, the Property was annexed into the City of Hagerstown, requiring an Amendment to the Joint
Sewer Service Area Agreement to account for and accommodate the provision of County sewer service to
a parcel within the corporate limits of the City of Hagerstown. Through discussions with Bostetter
Group’s attorney, Jason Divelbiss, the BOCC gave preliminary approval for staff to draft and negotiate an
amendment to the JSSA.

AMENDMENT TO THE
JOINT SEWER SERVICE AREA AGREEMENT
FOR THE PROVISION OF SANITARY SEWER SERVICE
BY AND BETWEEN
THE CITY OF HAGERSTOWN, MARYLAND AND
THE BOARD OF COUNTY COMMISSIONERS OF WASHINGTON COUNTY,
MARYLAND
AMENDMENT No. 1
WHEREAS: The City of Hagerstown, Maryland (the “City”) and the Board of County
Commissioners for Washington County, Maryland, (the “County) entered into a
Joint Sewer Service Area Agreement for the Provision of Sewer Service on
February 14, 2022 (the “Agreement”); and
WHEREAS: Paragraph 16 of the Agreement, entitled “Amendments,” provides that “Any
modification or revision to this Agreement shall be made by formal writing and
adopted by resolution or other formal enactment by the City and the County.
Amendments shall be effective for, and consistently applied to, all Joint Sewer
Service Areas as originally approved in Paragraph 15 of this Agreement and to all
Joint Sewer Service Areas subsequently approved by the parties in future
amendments to Paragraph 15 of this Agreement.”; and
WHEREAS: it is the intention of the City and County to amend the Agreement to include
additional property to the area served by Joint Sewer Service , as set forth in this
Amendment No. 1.
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. It is agreed that the approval, execution and signing of this Amendment No.
1 does not in any way modify, amend, alter, revoke, invalidate or revise
any term, condition, or provision of the Agreement referred to except as is
hereinafter provided.
2. It is agreed and recognized by the parties that they are bound by all of the
terms and conditions referred to in the Agreement and any subsequent and
duly executed amendments thereto.
3. This Amendment No. 1 revokes and replaces Exhibit A of the Agreement
with a revised geographic area map Exhibit A and dated _________, 2024,
attached hereto.
4. Section 15, entitled “Joint Sewer Service Areas,” is amended with the
addition of the following sanitary sewer service area:
(a) Parcel 453, Tax Map 37, located at 17601 Broadfording Road,
containing 81.55 acres as shown on Exhibit B, attached hereto (the

“Property”). The Property is located within the municipal
boundaries of the City of Hagerstown. The Property is also depicted
as the green area on Exhibit A
(b) The Property shall be known as the Inside Joint Sewer Service Area.
5. The Inside Joint Sewer Service Area shall be subject to City Inside Joint
Sewer Rate to be promulgated by the Mayor and City Council prior to
connection to the system.
6. As to the Inside Joint Sewer Service Area, it is agreed and recognized by
the parties that the County shall invoice the City monthly per the County’s
wholesale rate schedule, which may be from time to time amended, for all
metered wastewater. Invoicing for the Property shall be accomplished
using the wastewater flow meter to be installed at the Pump Station for the
Property. It is further agreed that the meter, to be purchased and installed
by the Owner/Developer, shall be owned and maintained by the City.
7. The Property is subject to the same requirements of application, review and
approval for wastewater service as all other prospective Joint Sewer service
customers covered by Agreement.
8. Sewer allocations for the properties inside the Joint Sewer Service Area
and the Property are not guaranteed by the County. Sewer allocation
availability will be on a “First Come First Serve” basis and will be subject
to the most current County policies and practices, as they may change from
time to time for all customers served, or to be served, by the County’s
wastewater plant and sewer collection system.
9. Sewer allocations for the properties inside the Joint Sewer Service Area and
the Property are not guaranteed by the City. Sewer allocation availability
will be on a “First Come First Serve” basis and will be subject to the most
current City policies and practices, as they may change from time to time
for all customers served, or to be served, by the City’s wastewater plant

10. 10. All sewer infrastructure on the Property shall be offered for transfer
and dedication by the Owner/Developer at no cost to the City. All sewer
infrastructure on the Property shall be built to City Standards and shall
include all infrastructure needed to collect, meter, and convey wastewater
from the Property to . the wastewater pump station connection for the
Property. The County wastewater collection system shall be constructed
using the existing 6” flushing connection and shall be in accordance with
all County standards and specifications. All Engineering Plans for sewer
infrastructure shall be approved by the City and County.
11. Severability. If any provision of this Amendment No. 1 shall be determined
to be invalid or unenforceable, the remaining provisions of this Amendment

No. 1 shall not be affected thereby, and every provision of this Amendment
No. 1 shall remain in full force and effect and enforceable to the fullest extent
permitted by law.
12. Due authorization. The parties agree and do represent to each other that
this Amendment No. 1 has been approved by each respective legislative
body at a duly constituted public meeting and that the undersigned have
been designated as the duly authorized signatories and representative of
said bodies.

Alpha Space Control Co., Inc. of Chambersburg, PA for line striping of 1,532,710 linear feet at
$.107 a linear foot on various roads within the County in the amount of $164,000.
REPORT-IN-BRIEF: The Code of Public Laws of Washington County, Maryland (the Public
Local Laws) 1-106.3 provides that the Board of County Commissioners may procure goods and
services through a contract entered into by another governmental entity, in accordance with the
terms of the contract, regardless of whether the County was a part to the original contract. Howard
County Maryland solicited the resulting agreement. If the Board of County Commissioners
determines that participation by Washington County would result in cost benefits or administrative
efficiencies, it could approve the purchase of this service in accordance with the Public Local Laws
referenced above by resolving that participation would result in cost benefits or in administrative
efficiencies.
The County will benefit from the direct cost savings in the purchase of this service because of the
economies of scale this contract has leveraged. Additionally, the County will realize savings
through administrative efficiencies as a result of not preparing, soliciting, and evaluating a bid.
Acquisition of this service by utilizing the Howard County Maryland contract and eliminating our
County’s bid process would result in administrative and cost savings for the Highway Department
in preparing specifications and the Purchasing Department.

RECITALS
The Code of Public Local Laws of Washington County, Maryland (the “Public Local
Laws”), § 1-106.3, provides that the Board of County Commissioners of Washington County,
Maryland (the “Board”), “may procure goods and services through a contract entered into by
another governmental entity in accordance with the terms of the contract, regardless of whether
the county was a party to the original contract.”
Subsection (c) of § 1-106.3 provides that “A determination to allow or participate in an
intergovernmental cooperative purchasing arrangement under subsection (b) of this section shall
be by resolution and shall either indicate that the participation will provide cost benefits to the
county or result in administrative efficiencies and savings or provide other justifications for the
arrangement.”
The Highway Department is requesting to utilize the Howard County Maryland Line
Striping Contract (4400004812 / PA-096-2023) with Alpha Space Control Co., Inc., of
Chambersburg, Pennsylvania, for line striping of 1,532,710 linear feet at $0.107 per linear foot on
various roads within the County for the total amount of $164,000.00.

costs for unplanned vehicle replacements. Totaled vehicles were a 2019 Chevy Tahoe and a 2020

SUBJECT: Washington County Circuit Court Renaming Request

RECOMMENDED MOTION: To rename the Washington County Circuit Courthouse the
Andrew F. Wilkinson Washington County Circuit Courthouse and to authorize the erection of new
signage affixed to the building near the Summit Avenue Entrance.
REPORT-IN-BRIEF: The Circuit Court Judges jointly request that Washington County rename
the courthouse in honor of our fallen colleague, the Honorable Andrew F. Wilkinson. Included in
the request is affixing a large approximately 4’ x 8’ bronze naming sign to the wall of the existing
courthouse near the Summit Avenue Entrance.
The request and motion intend that a new courthouse (to be determined) would also be named after
Andrew F. Wilkinson and that the sign be removed and reaffixed to any new courthouse building.
DISCUSSION: A memorial service at the Court House arranged by the Bar Association of
Washington County and attended by the Wilkinson Family will occur on October 16, 2024. It is
requested that the changes occur, and sign be unveiled at the service.
FISCAL IMPACT: To be determined, but not to exceed $50,000. Funds for building façade
enhancement, bronze sign and incidentals from 30-11930-BLD118 Circuit Courthouse
