The program also keeps partners posted on issues of concern throughout the year, serving as an "early warning system" for anything in Annapolis that may affect Hagerstown or Washington County. As in the past, the Coalition will hire a lobbyist to help us advocate for our state -level agenda during the 2022 General Assembly session. In addition, we have scheduled our "Day in Annapolis" for Wednesday, January 26, 2022, where Coalition members come to Annapolis to meet with our state decision makers to talk about our community and issues of concern. The day concludes with a Washington County, "We Mean Business" reception, highlighting the strengths of our region and the value we bring to Maryland. Of course, given Covid, these plans may need to be modified a bit, as they were in 2021. The lobbying process starts in the summer when the Coalition partners decide on the list of community priorities; we appreciated your willingness to join us in crafting that agenda. Again this year, we will ask the partners to participate financially, and the Chamber will manage the program. The Coalition is asking the City of Hagerstown to contribute $10,000, as it did last year. Working together, we leverage our collective voice and strengthen our case with decision makers. We hope that you will consider our invitation to participate in the Coalition and that you will work with us to include the County's priorities in the overall legislative agenda. REPORT-IN-BRIEF: The County was approved for ARPA funds of $29,295,023. These funds are to be received in two installments. The first installment of $14,669,749 was received in June of 2021. The next installment is expected June 2022. DISCUSSION: Funds can be utilized by the County to respond to and prepare for COVID-19 activities. All funds must be spent by December 31, 2024. Allowable uses include: - Respond to or mitigate the COVID-19 health emergency or its negative economic impacts, including assistance to households, small businesses, nonprofits, aid for tourism, travel, and hospitality. - To provide essential worker premium pay - Cover revenue loss. - To make investments in broadband, water, or sewer infrastructure Washington County polled the public in July to evaluate top priorities from citizens. The results are below in order of priority: 1. Fire and Rescue 2. Emergency Operations Center 3. Business assistance, including non-profits 4. Premium pay for essential workers 5. REPORT-IN-BRIEF: In May of this year, Washington County was awarded $9,441,971 from the Department of Housing and Community Development (DHCD) under the Emergency Rental Assistance Program. The DHCD has notified all grantees that an additional $24.5 million is available to counties for continuation of ERAP activities. Grantees must submit a Letter of Interest to be considered for funding. The Office of Grant Management would like to submit a Letter of Interest requesting $5,575,500.00. DISCUSSION: In May, Washington County was awarded $9,441,971 in ERAP funding from the DHCD in order to ensure housing stability for families and individuals at risk of and currently experiencing homelessness due to the Covid-19 pandemic. Our subrecipient, the Washington County Community Action Council (WCCAC), has estimated that this award will be fully expended by the end of February 2022. The DHCD has notified all grantees that an additional $24.5 million is being made available for continuing this program, and Grantees must submit a Letter of Interest to be considered for funding. The WCCAC has projected that $5,575,500.00 will be needed to serve 1,534 households between March 2022 (when current funds are expected to run out) and September 2022 (the end of the grant period). The Office of Grant Management would like to submit a Letter of Interest requesting this full amount. If awarded, funds will be added to our existing grant agreement – supplemental funds will not require a subsequent grant application. In addition, the Subrecipient agreement with WCCAC would be amended to reflect the increased funding. FISCAL IMPACT: This request will provide up to $5,575,500.00 in additional funding for the WCCAC to distribute to Washington County residents in need of assistance to pay their rent and/or utilities as a result of the Covid-19 pandemic. CONCURRENCES: Susan Buchanan, Director, Office of Grant Management ALTERNATIVES: Deny request to submit Letter of Interest AUDIO/VISUAL NEEDS: None Board of County Commissioners of Washington County, Maryland Agenda Report Form Open Session Item SUBJECT: EB-4 Short Term Disability Plan Revision PRESENTATION DATE: October 19, 2021 PRESENTATION BY: Laurence “Larry” Etchison, Director of Human Resources RECOMMENDED MOTION: To approve a revision of EB-4 Short Term Disability Policy authorizing the Director of Human Resources (with the County Administrator’s review and concurrence) to administer end-of-employment actions to Employees who are unable to perform their position’s essential job functions (with or without reasonable accommodation) and who have exhausted all FMLA, Paid Sick Leave and Short-Term Disability Plan Benefits. REPORT-IN-BRIEF: Consistently administering end-of-employment to all Employees who cannot perform their position’s essential job functions (with or without reasonable accommodation) and who have exhausted all FMLA, Paid Sick Leave and Short-Term Disability Plan Benefits shifts the ongoing healthcare cost burden to either the Employee (Long Term Disability Benefits, Personal Assets, etc.) or potentially to Federal and State funded programs (SSDI, Medicaid, ACA, etc.) versus the County’s Citizens and Taxpayers. Therefore, it is prudent to adopt the following revision to the EB-4 Short Term Disability Policy: L. An Employee who has an illness which is expected to continue beyond the Short-Term Disability Benefits Plan period may be eligible for benefits under the County’s Long-Term Disability Benefit Plan. Employees are encouraged to keep the Department of Human Resources informed if they believe that they may require Long-Term Disability Benefit Plan monthly income. Please note that the Director of Human Resources (with the County Administrator’s review and concurrence) will administer end-of-employment actions to Employees who are unable to perform their position’s essential job functions (with or without reasonable accommodation) and who have exhausted all FMLA, Paid Sick Leave and Short-Term Disability Plan Benefits following the issuance of a thirty (30) calendar day notification via USPS Certified Mail. FISCAL IMPACT: On a case-by-case basis, the Employee Health Benefit liability cost savings can be substantial (upwards of over $100,000.00 annually per covered Employee). RECOMMENDED MOTION: Move to relieve Bobcat of Hagerstown, MD from the contract without prejudices for the purchase approved by the Board of County Commissioners of Washington County, August 10, 2021, for the lease/purchase one (1) Bobcat T76 T4 Compact Track Loader for a total cost of $74,053.20. After the award and final lease documents were prepared it was discovered that the submitted documentation did not include the interest or any fees associated to the leasing of the equipment from the leasing company; therefore, the cost of the five-year lease will be $81,909.60. REPORT-IN-BRIEF: On August 10, 2021, the Board of County Commissioners of Washington County approved by resolution the purchase of the lease/purchase one (1) Bobcat T76 T4 Compact Track Loader for a total cost of $74,053.20 from Bobcat of Hagerstown based on the contract awarded by Sourcewell (Contract 040319-CEC). On items over $50,000 a determination to allow or participate in an intergovernmental cooperative purchasing arrangement shall be by Resolution and shall indicate that the participation will provide cost benefits to the county or result in administrative efficiencies and savings. The County will benefit with the direct cost savings in the purchase of the equipment because of economies of scale these contracts have leveraged. I am confident that any bid received as a result of an independent County solicitation would exceed the spend savings that the HGAC and Omnia contracts provide through this agreement. Acquisition of the equipment by utilizing the HGAC Board of County Commissioners of Washington County, Maryland Agenda Report Form and Omnia contracts and eliminating our county’s bid process would result in an administrative and cost savings for the Parks and Facilities Department in preparing specifications and the Purchasing Department facilitating the bid process. REPORT-IN-BRIEF: The Maryland Institute for Emergency Medical Services Systems (MIEMSS) makes available to the EMS community the opportunities for funding for equipment, training and EMS related programs. This special grant program provides funds to get AED’s, monitors defibrillators and upgrades to equipment. Cardiac monitors/defibrillators are utilized to assist in the assessment of cardiac patients and the delivery of critical, lifesaving interventions such as defibrillation, cardioversion and pacing of patients suffering from life threatening cardiac events. DISCUSSION: The Division of Emergency Services was notified by the manufacturer of the Life- Pak 15 Cardiac Monitor/Defibrillators that they have discontinued a replacement part and should a failure of the part occur the existing monitors carried on various emergency r esponse apparatus’ in the County would be inoperable and unrepairable. At the October 13, 2020, Board of County Commissioners meeting two of the four devices were approved to be replaced. Two remaining devices still need to be replaced. The new devices funded by the grant would replace existing devices that are assigned to EMS 1812 (Sharpsburg) and 1801 (Deputy Director Chisholm). The Office of Grant Management has reviewed the grant funding guidelines. There is dollar-for- dollar match requirement associated with this funding request. FISCAL IMPACT: Provides $27,617.61 for the Division of Emergency Services. The match ($27,617.61) associated with this grant will be covered by the Emergency Services operating FY22 budget. RECOMMENDED MOTION: Approval of Smithsburg Library as third Early Voting center in Washington County. REPORT-IN-BRIEF: HB745, effective October 1, 2021, alters the number of early voting centers required in each county and requires a county with at least 100,000 registered voters but fewer than 200,000 registered voters to have three early voting centers. DISCUSSION: Washington County currently has just under 99,000 registered voters. Because of the new election law, Washington County is required to have two (2) Early Voting centers. We believe registration will be over 100,000 by the June 2022 Election and will continue to increase. We requested and received approval in our FY22 Budget for the rental and staffing of 2 additional Early Voting centers. FISCAL IMPACT: No fiscal impact. HOGAN, JR., Governor Ch. 43 – 1 – Chapter 43 (House Bill 745) AN ACT concerning Election Law – Early Voting Centers – Number Required FOR the purpose of altering the number of early voting centers certain counties are required to establish; clarifying the process by which one additional early voting center may be established in a county in excess of the number required to be established by law; clarifying the process by which early voting centers are designated in a county; requiring a local board of elections to take into account certain factors when determining the location of an early voting center; and generally relating to early voting centers. BY repealing and reenacting, with amendments, Article – Election Law Section 10–301.1 Annotated Code of Maryland (2017 Replacement Volume and 2020 Supplement) SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, That the Laws of Maryland read as follows: Article – Election Law 10–301.1. (a) Except as provided under Title 9, Subtitle 3 of this article, during any regularly scheduled primary or general election a voter may vote: (1) in the voter’s assigned precinct on election day; or (2) at an early voting center in the voter’s county of residence on any early voting day in accordance with this section. (b) (1) Each county shall have at least one early voting center established in the county as prescribed in this subsection. [(2) A county with fewer than 125,000 registered voters shall have one early voting center established in the county. (3) A county with more than 125,000 registered voters but fewer than 200,000 registered voters shall have three early voting centers established in the county. (4) A county with more than 200,000 registered voters but fewer than Ch. 43 2021 LAWS OF MARYLAND – 2 – 300,000 registered voters shall have four early voting centers established in the county. (5) A county with more than 300,000 registered voters but fewer than 450,000 registered voters shall have seven early voting centers established in the county. (6) A county with more than 450,000 registered voters shall have eleven early voting centers.] (2) A COUNTY WITH FEWER THAN 50,000 REGISTERED VOTERS SHALL HAVE ONE EARLY VOTING CENTER ESTABLISHED IN THE COUNTY. (3) A COUNTY WITH AT LEAST 50,000 REGISTERED VOTERS BUT FEWER THAN 100,000 REGISTERED VOTERS SHALL HAVE TWO EARLY VOTING CENTERS ESTABLISHED IN THE COUNTY. (4) A COUNTY WITH AT LEAST 100,000 REGISTERED VOTERS BUT FEWER THAN 200,000 REGISTERED VOTERS SHALL HAVE THREE EARLY VOTING CENTERS ESTABLISHED IN THE COUNTY. (5) A COUNTY WITH AT LEAST 200,000 REGISTERED VOTERS BUT FEWER THAN 300,000 REGISTERED VOTERS SHALL HAVE FIVE EARLY VOTING CENTERS ESTABLISHED IN THE COUNTY. (6) A COUNTY WITH AT LEAST 300,000 REGISTERED VOTERS BUT FEWER THAN 400,000 REGISTERED VOTERS SHALL HAVE SEVEN EARLY VOTING CENTERS ESTABLISHED IN THE COUNTY. (7) A COUNTY WITH AT LEAST 400,000 REGISTERED VOTERS BUT FEWER THAN 500,000 REGISTERED VOTERS SHALL HAVE NINE EARLY VOTING CENTERS ESTABLISHED IN THE COUNTY. (8) A COUNTY WITH AT LEAST 500,000 REGISTERED VOTERS BUT FEWER THAN 600,000 REGISTERED VOTERS SHALL HAVE 11 EARLY VOTING CENTERS ESTABLISHED IN THE COUNTY. (9) A COUNTY WITH AT LEAST 600,000 REGISTERED VOTERS SHALL HAVE 13 EARLY VOTING CENTERS ESTABLISHED IN THE COUNTY. [(7)] (10) In addition to the early voting centers required in this subsection, each county may establish one additional early voting center if the State Board, in collaboration with: (I) FIRST, the local board, and the governing body of the county agree to establish an additional early voting center; AND LAWRENCE J. HOGAN, JR., Governor Ch. 43 – 3 – (II) THEN, THE STATE BOARD APPROVES THE ESTABLISHMENT OF THE ADDITIONAL EARLY VOTING CENTER. (c) (1) No later than 6 months before a primary election, the State Board, in collaboration with the local board in each county, shall, SUBJECT TO THE APPROVAL OF THE STATE BOARD, designate each early voting center in that county. (2) A LOCAL BOARD SHALL TAKE INTO ACCOUNT THE FOLLOWING FACTORS WHEN DETERMINING THE LOCATION OF AN EARLY VOTING CENTER: (I) ACCESSIBILITY OF THE EARLY VOTING CENTER TO HISTORICALLY DISENFRANCHISED COMMUNITIES, INCLUDING CULTURAL GROUPS, ETHNIC GROUPS, AND MINORITY GROUPS; (II) PROXIMITY OF THE EARLY VOTING CENTER TO DENSE CONCENTRATIONS OF VOTERS; (III) ACCESSIBILITY OF THE EARLY VOTING CENTER BY PUBLIC TRANSPORTATION; (IV) ENSURING EQUITABLE DISTRIBUTION OF EARLY VOTING CENTERS THROUGHOUT THE COUNTY; AND (V) MAXIMIZING VOTER PARTICIPATION, INCLUDING THROUGH THE USE OF COMMUNITY CENTERS AND PUBLIC GATHERING PLACES AS LOCATIONS FOR EARLY VOTING CENTERS. (d) Each early voting center shall be open for voting as follows: (1) beginning the second Thursday before a primary or general election through the Thursday before the election; and (2) during the following hours: (i) in a presidential general election, during the hours between 8 a.m. and 8 p.m. each early voting day; and (ii) in all other elections, during the hours between 10 a.m. and 8 p.m. each early voting day. (e) Each early voting center shall satisfy the requirements of § 10–101 of this title. (f) Beginning 30 days prior to each early voting period the State Board and each Ch. 43 2021 LAWS OF MARYLAND – 4 – local board shall undertake steps to inform the public about early voting and the lo cation of early voting centers in each county, including: (1) a series of public service media announcements; (2) mailings to all registered voters in each county; and (3) other measures as appropriate. (g) Except as expressly provided in this section, any provision of this article that applies to voting on election day also applies to early voting. (h) The State Board shall adopt regulations and guidelines in accordance with the requirements of this section for the conduct of early voting. SECTION 2. A. Considerations for Early Voting Centers. A local board shall consider the following factors when determining the location of an early voting center: (1) Accessibility of the early voting center to historically disenfranchised communities, including cultural groups, ethnic groups, and minority groups; (2) Proximity of the early voting center to dense concentrations of voters such that: (a) If a county has one or two early voting centers, 50 percent of the registered voters in the county live within 10 miles of one of the proposed early voting center; or (b) If a county has three or more early voting centers, 80 percent of the registered voters live within 5 miles of one of the early voting centers; (3) Accessibility of the early voting center by public transportation; (4) Ensuring equitable distribution of early voting centers throughout the county; (5) Maximizing voter participation, including through the use of community centers and public gathering places as locations for early voting centers; (6) Accommodate long lines of voters, including how voters waiting in line are protected against inclement weather; and (7) Has parking facilities sufficient for early voting taking into consideration the normal business activities of the proposed early voting center B. Requirements for Early Voting Centers. A local board shall propose early voting center locations that: (1) Allow a local board to install the required telecommunication needs; (2) Are of sufficient size and layout to conduct early voting, including adequate access to electricity; (3) Are accessible or can be made accessible for voters with disabilities; (4) Can store voting equipment and supplies in a secure location during non-early voting hours; (5) Have sufficient and reliable heating and air-conditioning capabilities; and (6) Can accommodate a no electioneering zone as required by Election Law Article, §16-206, Annotated Code of Maryland, exit polling as required by COMAR 33.07.08, and electioneering outside of the no electioneering zone.
