SUBJECT: Discussion of non-profit requests for reduced fees at Black Rock Golf Course

REPORT-IN-BRIEF: To discuss the manner in which non-profit requests for reduced fees are
handled at Black Rock Golf Course.
DISCUSSION: The members of The Board of Directors are seeking clarification as to the decision of
the BoCC during its meeting on May 25th regarding fees for non-profit organizations who submit
requests for reduced rates at the Black Rock Golf Course.

SUBJECT: FY22 School Based Health Center Grant – Approval to Submit Application
PRESENTATION DATE: June 8, 2021

RECOMMENDED MOTION: Move to approve the submission of the grant application for the FY22 School Based Health Center Grant Program to the Maryland State Department of Education in the amount of $200,384 and accept awarded funding.
REPORT-IN-BRIEF: The Washington County Office of Grant Management, on behalf of and
at the direction of the Local Management Board is seeking approval to submit an application to
the Maryland State Department of Education requesting funding for School Based Health
Centers in Washington County.
DISCUSSION: Currently there are two School Based Health Centers in Washington County
which are located at South Hagerstown High School and Western Heights Middle School. The
Centers provide exams, prescriptions, immunizations, nutritional assessments, orders lab work
and assists in the management of chronic conditions such as asthma and diabetes, etc. Meritus
Health is the vendor contracted to provide these services. Funding in the amount of $10,019 is
included in the award for County administrative support.
FISCAL IMPACT: Provides $10,019 for County administrative expenses.
CONCURRENCES: The Local Management Board approves the submission of the proposal
and recommends the acceptance of this award.
ALTERNATIVES: Deny approval for submission of this request

SUBJECT: Office of Problem Solving Courts Discretionary Grant – Approval Accept Awarded
Funding
PRESENTATION DATE: June 8, 2021

Washington County and Allison Hartshorn, Grant Manager, Office of Grant Management
RECOMMENDED MOTION: Move to approve the acceptance of grant funds in the amount
of $195,000 for Circuit Court Office of Problem Solving Courts Discretionary Grant.
REPORT-IN-BRIEF: The Office of Problem-Solving Courts Discretionary Grant is to assist
with the operational expenses and ancillary services of the Drug Court Program. These grant
funds will be used to operate the Adult Drug Court Program which will provide supervision and
access to services for court involved, substance dependent participants. The program will reduce
substance using and criminal behavior while increasing positive community involvement and
overall individual and family functioning. These grant funds will allow better access to justice
and treatment services by assisting with transportation, providing frequent drug and alcohol
monitoring, case management support services, educational and vocational access, and
numerous other services.
DISCUSSION: The Office of Grant Management has reviewed the grant application. Matching
funds are not required for this program. In the case that these anticipated grant funds are not
awarded, the Circuit Court Drug Court would request that the Washington County
Commissioners cover the cost for wages and benefits for the Coordinator's position. Other
program services such as transportation assistance, trainings, would be eliminated unless other
local or state grant funds could be secured. Drug testing would be limited to the number of tests
allowed by individual participant's insurances.
FISCAL IMPACT: Provides $195,000 for the Drug Court Program

SUBJECT: Request for Approval for Drug Court Case Manager Position
PRESENTATION DATE: June 8, 2021

County, Jennifer Bricker, Drug Court Coordinator, Circuit Court for Washington County
RECOMMENDED MOTION: Move to approve the Drug Court Case Manager position and for the
position to be filled by appointment of the Administrative Judge of the Circuit Court.
REPORT-IN-BRIEF: The Office of Problem-Solving Courts Discretionary Grant has provided
approval for funding for a part-time Case Manager for the Adult Drug Court program. The Case
Manager will be responsible for the facilitation of access to services and resources, and the monitoring
of progress toward goal attainment for the participants of the Circuit Court Drug Court program.
DISCUSSION: The Human Resources department has worked with the Drug Court Coordinator to
create the Drug Court Case Manager Job Description. The Case Manager position would be a county
position, funded through the Office of Problem-Solving Court’s Drug Court Grant. The grant will
currently cover the position equivalent to a Grade 12, Step 1 on the county salary scale at a maximum
of 32 hours per week and with no benefits. The grant funding may increase later for this position at a
full-time salary with benefits, based on the growth of the Drug Court program.
FISCAL IMPACT: The Drug Court Case Manager Position would be Grant funded through the
Office of Problem-Solving Courts through the Administrative Office of the Courts. Currently if the
County approves a salary increase for employees greater than an approved salary increase for state
employees, the county pays the difference in salary that is not covered by the awarded grant. There
would be no costs to the county at this time, but the only costs incurred by the county in the future
would be if this practice continues.

REPORTS TO: County Administrator and the
GENERAL DEFINITION OF WORK:
Under the general direction and supervision of the County Administrative Judge or his designee and the
Court Administrator, the Drug Court Case Manager will be responsible for the facilitation of access to
services and resources and the monitoring of progress toward goal attainment for the participants of the
Drug Court program(s) in Washington County.
ESSENTIAL FUNCTIONS/TYPICAL TASKS:
(These are intended only as illustrations of the various types of work performed. The omission of specific
duties does not exclude them from the position if the work is similar, related, or a logical assignment to
the position.)
1.Major responsibilities include facilitating access and making referrals to ancillary services, developing
individualized case plans, and monitoring participants’ progress toward case plan goals.
2.Act as a liaison between the program participants and partnering service agencies.
3. Prepares and maintains reports, case records, and progress summaries on all program participants.
4.Participates in pre-court staffing meetings with Judicial Officers and staff to convey case specific
updates, review case plans, and determine further information/action needed for participant success.
5.Performs related work as required.
KNOWLEDGE, SKILLS AND ABILITIES:
1. Knowledge and experience with regard to case management and local ancillary services.
2.Knowledge of criminal justice services and clinical levels of care.
3.Ability to facilitate problem solving in daily operations.
4.Ability to communicate effectively, to facilitate meetings, give presentations, and foster a spirit of
teamwork with partnering agencies.
5.Ability to exercise a high degree of confidentiality, judgment, tact, diplomacy and competence in
dealing with judges, attorneys, court personnel, service providers and the public.
6.Ability to apply statutory requirements and to understand and comply with state and federal
confidentiality laws concerning medical treatment.
7.Excellent interpersonal and writing skills and ability to maintain good long-term working relationships
within and outside the Judiciary.
EDUCATION AND EXPERIENCE:
1.Bachelor’s Degree from an accredited college or university in public or court administration,
management, criminal justice or other human service-related field.
2.Three years of progressively responsible case management experience to include project or program
management, in the field of addictions, human/family services, health services, public safety or law
enforcement.
3.Experience and knowledge of the operations of both the District and Circuit Court systems of
Maryland (preferred).
4.Working knowledge of the Maryland Rules and procedures.
A comparable amount of training and experience may be substituted for the minimum qualifications.
PHYSICAL REQUIREMENTS:
Must have the use of sensory skills in order to effectively communicate and interact with other employees
and the public through the use of the telephone and personal contact as normally defined by the ability to
see, read, talk, hear, handle or feel objects and controls. Physical capability to effectively use and operate
various items of office related equipment, such as, but not limited to a, personal computer, calculator,
copier, and fax machine. No significant standing, walking, moving, climbing, carrying, bending, kneeling,
crawling, reaching, and handling, pushing, and pulling.
SPECIAL REQUIREMENTS:
Possession of a valid driver’s license.

SUBJECT: Bid Award (PUR-1499) - Grounds Maintenance for Various County Departments

Superintendent, Black Rock Golf Course and George Sweitzer, Assistant Superintendent, Black

RECOMMENDED MOTION: Move to award the contract to the responsible companies with
the responsive lowest bids that meet the specifications for each chemical item (as indicated on the
Bid Tabulation Summary). Tie bids were received for Item Nos. 13, 20, 27, 28 and 35; therefore,
it is required that the chemicals be awarded based upon drawing lots in public, pursuant to Section
2.9 of the Washington County Procurement Policy Manual.
REPORT-IN-BRIEF: The County accepted bids on May 5, 2021. The Invitation to Bid (ITB)
was advertised on the State of Maryland’s (eMMA) “eMaryland Marketplace Advantage” web
site, on the County’s web site, and in the local newspaper. Fifteen (15) persons/companies
registered/downloaded the bid document on-line. Four (4) bids were received, one of which was
determined to be non-responsive. This contract provides the needed chemicals for the Black Rock
Golf Course, County Highway Department and Department of Water Quality; the City of
Hagerstown may utilize the contract. The contract term is one (1) year tentatively commencing
July 1, 2021 and ending June 30, 2022.
Bidders were declared Non-Responsive if: A Bidder submitted two (2) prices for one (1) item,
and/or if a Bidder submitted a substitute (equivalent) chemical that was not on the list of approved
chemicals, and/or if a Bidder submitted the wrong unit of measure pricing, and/or the bidder
submitted their bid on the wrong forms.

FISCAL IMPACT: Funds are budgeted for the chemicals in various expense operating accounts.

SUBJECT: FY 2022 Program Open Space Annual Program

RECOMMENDED MOTION: Move to approve the Annual FY 2022 Program Open Space
(POS) project list as presented and recommended by the Washington County Recreation and
Parks Advisory Board.
REPORT-IN-BRIEF: As per POS guidelines, each year the Board of County Commissioners
is required to adopt the annual POS Program.
DISCUSSION: The various municipalities, Board of Education, Hagerstown Community
College as well as the County submit projects for consideration for inclusion in the annual POS
Program. Based upon anticipated available funds a program is developed giving consideration to
County parks and recreation priorities, community benefit, and the priority ranking of the project
sponsor. The Recreation and Parks Advisory Board voted unanimously at its 5/6 meeting to
recommend the proposed schedule to the Board of County Commissioners for adoption. After
adoption by the Board of County Commissioners, notification is provided to the sponsors as to
which projects have been included in the program along with approval letters. This then allows
the sponsors to apply for funding to Maryland Department of Natural Resources after July 1.
FISCAL IMPACT: Washington County will receive $1,131,771 in FY22 Program Open Space
Funds. Since Washington County has met its local acquisition goal in the current approved Land
Preservation, Parks, and Recreation Plan 25% of the FY22 apportionment must be used for
acquisition projects while the remaining 75% may be used for acquisition or park development
projects. Parkland acquisition projects are eligible for 100% POS reimbursement, while
development projects require a minimum 10% local funding match. As of May 1, the County has
an unencumbered POS balance of $728,562.

REPORT-IN-BRIEF: The project was advertised in the Herald Mail, on the County’s website,
and on the State of Maryland’s website, “e-Maryland Marketplace Advantage (eMMA).” Two (2)
bids were received and opened on Friday, May 14, 2021, as listed below.

DISCUSSION: The existing steel communication tower requires an extension to expand public
safety communication coverage following construction of the addition to the Barbara Ingram
School for the Arts building. The project is a 90 consecutive calendar day contract with an
anticipated Notice to Proceed in June 2021 and a completion date in September 2021. The bid
documents include liquidated damages in the amount of $500.00 per calendar day for work beyond
the completion date.
FISCAL IMPACT: The project will utilize Capital Improvement Plan Urban Improvement
Project funding (BLD094).

RECOMMENDED MOTION: Move to award the bid for the Frog Eye Road Bridge Replacement
contract to the lowest responsive, responsible bidder, C. William Hetzer, Inc. of Hagerstown in the amount
of $744,955.75.
REPORT-IN-BRIEF: The project was advertised in The Herald Mail, on the County’s website, and on
the State of Maryland’s website, e-Maryland Marketplace Advantage. Ten (10) bids were received on
Wednesday, May 26, 2021 as listed below and further detailed on the attached bid tabulation.

The bids have been evaluated and the low bid is in order. The engineer’s estimate is $750,000.
DISCUSSION: The project involves the replacement of a one-lane steel beam bridge with a precast
reinforced concrete box culvert that will accommodate two-lanes of traffic (one lane in each direction).
Construction will also involve placement of cast-in-place concrete endwalls, asphalt paving, and traffic
barrier installation.
The project is a 180 consecutive calendar day contract with an anticipated notice to proceed in June 2021
and a completion date in December 2021. The bid documents include liquidated damages in the amount of
$500.00 per calendar day for work beyond the completion date. There are no road closures associated with
this work. Public notices will be made and road work signs posted prior to the start of work.
FISCAL IMPACT: This is a budgeted Capital Improvement Plan (CIP) project (BRG087).
Total expenses are estimated at $799,955.75; including $744,955.75 for the proposed bid award, $35,000
for inspection/testing/utilities/right-of-way and $20,000.00 for construction contingency.
CONCURRENCES: Budget and Finance (Fiscal Impact)
ALTERNATIVES: This is the most cost effective and practical alternative. The structure is in poor
condition and in need of replacement.

DISCUSSION: The pavement maintenance & rehabilitation program for hot mix asphalt applications
involves pavement preservation, repair, and rehabilitation. This contract covers 10 miles of paving
involving superpave hot mix asphalt overlays, patching, full depth reclamation, and permanent pavement
markings.
The contract follows standard State Highway Administration provisions for monthly liquid asphalt price
adjustments as used in prior years. The project is a 125 consecutive calendar day contract with an anticipated
notice to proceed in July 2021 and a completion date in November 2021. The bid documents include
liquidated damages in the amount of $500.00 per calendar day for work beyond the completion date.
Motorists may experience some minor delays as a result of lane closures but there are no major road closures
associated with this work. Public notices will be made and road work signs posted prior to the start of
work. The road list will be posted on the County’s website for reference.

bid award, $100,000 for inspection/testing, $100,000 for construction contingency, and $100,000 for
asphalt adjustment costs.

RECOMMENDED MOTION: Motion to award a contract for Stop Loss Insurance to the
responsive, responsible proposer, Highmark of Pittsburgh, PA who submitted a total annual
premium for Option 2 of $951,035.04 with specific stop loss @ $175,000 per claimant.
REPORT-IN-BRIEF: Stop-Loss policies are insurance that protects the plan from significant
claim costs associated with individual members (specific) or for the entire group (aggregate).
Currently, the Board of County Commissioners of Washington County, Maryland has as top loss
policy with Sunlife that limits the medical and prescription drug plan costs to a maximum of
$175,000 per member per year.
The Request for Proposal (RFP) was advertised on the State’s “eMaryland Marketplace
Advantage” (eMMA) web site, on the County’s web site, and in the local newspaper. Direct notice
of the solicitation was e-mailed to nine (9) potential providers of the insurance.
Proposals were received before the deadline on April 23, 2021, from six (6) companies that are
providers of Stop Loss Insurance.

FISCAL IMPACT: Funds are available in the FY22 health insurance budget.

RECOMMENDED MOTION: Move to approve the submission of the grant application for the
FY22 Sex Offender Compliance and Enforcement Maryland Grant to the Governor’s Office of
Crime Control and Prevention in the amount of $30,348 and accept funding as awarded.
REPORT-IN-BRIEF: The Washington County Sheriff’s Office plans to utilize the funding
provided to fund the salaries of two part-time civilian employees, who assist the Sex Offender
Registrar with the register/re-register of sex offenders, while also conducting compliance checks
of employment as well as home addresses.
DISCUSSION: The Office of Grant Management has reviewed the grant funding guidelines.
Matching funds or in-kind support is not required for this program. This grant is annually recurring
and there are no unusual conditions or requirements attached to the acceptance of the grant.
FISCAL IMPACT: If awarded the grant reduces costs associated with the Sex Offender
Registration Program by $30,348. If funding was lost the Sheriff’s Office would work on a budget
proposal for the Board of County Commissioners to either hire one additional full-time employee
or to try to maintain the two part-time positions. Deputies may possibly be used to verify address
checks while the Registrar continued with the registrations and re-registrations.

SUBJECT: PUBLIC HEARING - Agricultural Preservation Easement Rankings FY 2022

RECOMMENDED MOTION: Move to approve the priority ranking of Agricultural Land
Preservation Easement applications as recommended by the Agricultural Land Preservation Advisory
Board and to forward the top 12 applications to the Maryland Agricultural Land
Preservation Foundation (MALPF).
REPORT-IN-BRIEF: The purchase of permanent land preservation easements through the
Maryland Agricultural Land Preservation Program (MALPP) is the largest part of Washington
County’s rural preservation strategy. All applications are ranked by the local Agricultural Land
Preservation Advisory Board using the adopted Priority Ranking Formula which assigns points for
such things as quality of soils, proximity to other preserved lands, agricultural status, economic
viability, and relationship to other land use areas in the County.
DISCUSSION: Following review and consideration of public comment from this public hearing,
Commissioners are requested to approve the top 12 applications to be forwarded to the MALPF
Board. Easements are purchased in order from the priority list until funds are exhausted.
Maryland law requires MALPF and the County to maintain confidentiality of financial information
and rankings for our easement applicants until the end of an annual easement acquisition cycle.
Therefore, only the County Commissioners have the Excel spreadsheet of rankings by the Ag Board.
The public copy lists only the names of applicants.
FISCAL IMPACT: No impact to County General Fund. The County will have an opportunity to
contribute locally collected Agricultural Transfer Taxes and Real Estate Transfer Taxes in the Fall
2021. Local and State funds are combined (60% State and 40% County) to fund the matching portion
of the program.
CONCURRENCES: The Agricultural Land Preservation Advisory Board has approved the
rankings of these applications and the limit of 12 applications being forwarded to MALPF.
