Open Session Minutes
February 7, 2023
STATE OF THE COUNTY PRESENTATION
The Commissioners attended the State of the County Presentation at Fountain Head Country Club,
13316 Fountain Head Road, Hagerstown, Maryland 21740, hosted by the Hagerstown-Washington
County Chamber of Commerce.

MOMENT OF SILENCE AND PLEDGE OF ALLEGIANCE
A moment of silence was observed, followed by the Pledge of Allegiance to the Flag by the full
assemblage.
CALL TO ORDER
President John F. Barr called the regular meeting of the Board of County Commissioners of Washington
County, Maryland, to order at 10:03 a.m. with the following members present: Vice-President Jeffrey
A. Cline, Commissioner Derek Harvey, Commissioner Wayne K. Keefer, and Commissioner Randall
E. Wagner ..
COMMISSIONERS' REPORTS AND COMMENTS
Commissioner Cline thanked all who were involved in the State of the County presentation.
Commissioner Cline reported attending the Groundhog Day event held at the Ag Center and the Police
Academy graduation ceremony where six officers graduated.
Commissioner Wagner thanked the staff who were involved in the State of the County presentation.
Commissioner Wagner attended the Police Academy graduation ceremony and an Eagles Scout
ceremony. Commissioner Wagner congratulated his daughter who was just named teacher of the year
at St. Mary's.
Commissioner Keefer thanked the Chamber of Commerce for hosting the State of the County, as well
as the staff involved in putting the presentation together. He requested a consensus to hold an evening
State of the County presentation to increase transparency with the County. Commissioner Keefer
reported receiving contact from retired County employees questioning the Cost of Living Adjustment
(COLA) increase procedures for retirees.
Commissioner Harvey thanked Michelle Gordon, CFO, for her professionalism and assistance in
understanding the budget process. Commissioner Harvey also thanked other County Department heads
for their knowledge and level of professionalism. He reported an upcoming meeting with Earl Stoner,
Director of the Washington County Health Department.
Commissioner Barr thanked Public Relations staff for the video presentation that was put together for
the State of the County. Commissioner Barr also thanked staff for their hard work on the Groundhog
Day event. Commissioner Barr also attended an Eagle Scout ceremony.

John Martirano, County Administrator, thanked staff and all those involved in putting together the State
of the County presentation.
Linda Spence, Business Specialist, Department of Business Development, presented a request for
approval to submit a letter as the Grantee for Foreign Trade Zone #255. The letter is necessary for
inclusion within the service area of Foreign Trade Zone #255 and will allow the Department of Business
Development to apply to the Foreign Trade Zone Board, a Federal organization, for authority to serve
sites located within the County based on trade related needs.
Commissioner Wagner, seconded by Commissioner Keefer, moved to approve submitting the letter as
presented.
Andrew Eshleman, Director, Public Works, shared with the Board the statewide recognition received
for Marty's Mythical Woods Natural Playground located within Marty Snook Park. The County is the
recipient of the County Engineers Association of Maryland's Small Project of the Year award, as well
as the Green Sustainability Project of the Year award by the Maryland Quality Initiative Conference.
Mr. Eshleman noted that while most recipients of these awards have people all across the country
working on their project, the County utilized the talent of its own staff to accomplish the project.
CITIZEN PARTICIPATION
Conrad Shewchuck, 9816 Pembroke Drive, brought a matter of public safety to the attention of the
Board and shared a recent incident involving juveniles trespassing through his neighborhood in the
County causing damage and resulting in stolen property.
YOUTH MERITORIOUS AW ARD PRESENTATION
Nicole Phillips, Grant Manager, Office of Grant Management, presented the Youth Meritorious Award
to Brianna Buskirk, Hancock Middle-Senior High School. Brianna was selected based on her scholastic
achievement, leadership qualities, community service, and other positive contributions to her school
and community.
INTERGOVERNMENTAL COOPERATIVE PURCHASE (INTG-23-0106) -TWO (2) JOHN
DEERE 5105M UTILITY TRACTORS
Brandi Naugle, CPPB, Buyer, Purchasing Department. and Zane Rowe, Deputy Director, Highway
Department, presented a request to purchase two (2) new John Deere 5105M Utility Tractors from
Gladhill Tractor Mart, Inc., of Frederick, Maryland, for a total cost of $152,746.64, and to utilize
another jurisdiction's contract that was awarded by Sourcewell (Contract 110719-JDC) to John Deere
& Company of Cary, North Carolina. The tractors will replace existing mowers, both of which
currently exceed the County's Vehicle and Equipment Types and Usage Guidelines.
Commissioner Harvey, seconded by Commissioner Cline, moved to approve the purchase of two (2)
new John Deere 5105M Utility Tractors as presented. The motion passed unanimously.

INTERGOVERNMENTAL COOPERATIVE PURCHASE (INTG-23-0107) -UPFITTING OF
TWO (2) JOHN DEERE 5105M UTILITY TRACTORS WITH MID-MOUNT BOOM MOWER
AND REAR FLAIL MOWER
Brandi Naugle and Zane Rowe presented a request to purchase and have installed two (2) Mid-Mount
Boom Mowers and two (2) Rear Flail Mowers for the upfitting of two (2) New John Deere 5105

Tractors for a total cost of $190,105.28, and to utilize another jurisdiction's contract that was awarded
by Sourcewell (Contract 070821-TGR) to Tiger Corporation of Sioux Falls, South Dakota. The
addition of the booms will allow for the clearing of higher vegetation and for reaching behind guardrails
and out to banks that cannot be reached with side flails.
Commissioner Wagner, seconded by Commissioner Keefer, moved to approve the purchase and
installation of two (2) Mid-Mount Boom Mowers and two (2) Rear Flail Mowers as presented. The
motion passed unanimously.

INTERGOVERNMENTAL COOPERATIVE PURCHASE {INTG-23-0108) -UPFITTING
FOUR ( 4) EXISTING JOHN DEERE 5100M TRACTORS WITH MID-MOUNT BOOM
MOWERS
Brandi Naugle and Zane Rowe presented a request to purchase four ( 4) Mid-Mount Boom Mowers to
upfit four ( 4) existing John Deere 51 O0M Tractors for a total cost of $324,486.64, and to utilize another
jurisdiction's contract that was awarded by Sourcewell (Contract 070821-TGR) to Tiger Corporation
of Sioux Falls, South Dakota.
Commissioner Wagner, seconded by Commissioner Harvey, moved to approve the purchase of four
(4) Mid-Mount Boom Mowers as presented. The motion passed unanimously.

INTERGOVERNMENTAL COOPERATIVE PURCHASE {INTG-23-0109) -CHEVROLET
TAHOES FOR THE SHERIFF'S OFFICE
Rick Curry, CPPO, Director, Purchasing Department, and Alan Matheny, Fleet Logistics and
Commercial Vehicle Enforcement, Sheriffs Office, presented a request to purchase two (2) new
Chevrolet Tahoes, one (1) in the amount of $43,743, and one (1) in the amount of $44,548, for a total
cost in the amount of $88,291 from Hertrich Fleet Services, Inc., of Milford, Delaware, and to utilize
another jurisdiction's contracts that were awarded by the State of Maryland (Contracts #001B2600367
and #001B2600312). The vehicles will replace dated warrant squad vehicles that currently exceed the
County's Vehicle and Equipment Types and Usage Guidelines.
Commissioner Keefer, seconded by Commissioner Wagner, moved to approve the purchase of two (2)
new Chevrolet Tahoes as presented. The motion passed unanimously.

AUTOMATIC EXTERNAL DEFIBRILLATOR PURCHASE FOR WASHINGTON COUNTY
SHERIFF'S OFFICE
Tom Brown, Jr., Director of Emergency Management, presented a recommendation to utilize funds
from the Local Assistance and Tribal Consistency Fund and Capital Improvement Plan (CIP) reserves
and authorize the purchase of 59 Automatic External Defibrillators, including 59 extra device pads, for
a total of $136,075.24, under State contract BPO 001B1600023.

Commissioner Wagner, seconded by Commissioner Keefer, moved to approve the purchase of 59
Automatic External Defibrillators as presented. The motion passed unanimously.
WILLIAMSPORT LIBRARY PLANNING STUDY
Andrew Eshleman, Director of Public Works, Jenny Bakos, Executive Director, Washington County
Free Library, Les Grim, President, L.S. Grim Consulting Engineers, and Brent Feight, President, BFM
Architects, presented an overview of the Williamsport Library Study and requested feedback on the
findings for future project considerations.
CLOSED SESSION
Commissioner Wagner, seconded by Commissioner Cline, moved to convene in closed at 11 :20 a.m.
to consider the acquisition of real property for a public purpose and matters directly related thereto; to
consult with counsel to obtain legal advice on a legal matter; to conduct collective bargaining
negotiations or consider matters that relate to the negotiations; to discuss public security, if the public
body determines that public discussion would constitute a risk to the public or to public security,
including: (i) the development of fire and police services and staff; and (ii) the development and
implementation of emergency plans; and to comply with a specific constitutional, statutory, or
judicially imposed requirement that prevents public disclosures about a particular proceeding or matter,
in accordance with Section 3-305(b) (3), (7), (10), and (13) of the General Provisions Article of the
Annotated Code of Maryland. The motion passed unanimously.
In closed session, the Commissioners discussed upcoming collective bargaining negotiations, a legal
dispute, the potential acquisition ofreal property, and the possible deployment of emergency services
resources.
Present during closed session were Commissioners John F. Barr, Jeffrey A. Cline, Derek Harvey,
Wayne K. Keefer, and Randall E. Wagner. Also present at various times were: John Martirano, County
Administrator; Kirk C. Downey, County Attorney; and Michelle Priebe, Executive Administrative
Assistant.
ADJOURNMENT
Commissioner Wagner, seconded by Commissioner Keefer, moved to adjourn at 12:45 p.m. Tne
motion passed unanimously.
