MINUTES OF THE HISTORIC DISTRICT COMMISSION FOR WASHINGTON COUNTY May 7, 2025 The Washington County Historic District Commission attended a public presentation offered by
Preservation Maryland entitled “Researching Your Historic Property” at 5:30 p.m. on Wednesday, May 7,
2025 in the Washington County Public Library, 100 South Potomac Street, Hagerstown, MD. The HDC’s
regular monthly meeting was held immediately following this presentation at the Library.
CALL TO ORDER AND ROLL CALL
The Chairman called the meeting to order at 6:45 p.m.
Commission members present were: Lloyd Yavener, Chairman; Ann Aldrich, Michael Lushbaugh, Justin
Bedard, Tyler Milam, and Greg Smith. Staff members present were: Washington County Department of
Planning & Zoning: Meghan Jenkins, GIS Coordinator and HDC Staff member.
MINUTES
Motion and Vote: Mr. Bedard made a motion to approve the minutes of the April 2, 2025 meeting as
amended. The motion was seconded by Mr. Milam and unanimously approved.
NEW BUSINESS
21431 Leiter Street [2025-01173] Permit Application
Ms. Jenkins presented a non-residential construction permit application for property located at 21431
Leiter Street. Proposed is a 2,046 sq. ft. pavilion on a concrete slab with enclosed heated storage area
and fundraising storage area for the Leitersburg Volunteer Fire Department (Lot 5).
Staff recommends approval of the permit with consideration for the following being addressed with the
site plan (SP-25-012): native vegetative screening should be considered on the property facing Leiter
Street while being sympathetic to the sight distance requirements at the nearby entrance and that
exterior lighting on the building be mounted low, shielded and downward facing to the extent practicable
[meeting site plan and zoning ordinance requirements] and illuminating only the side of the structure
facing the existing fire company building.
Motion and Vote: Ms. Aldrich made a motion to approve the building permit application contingent upon
the site plan including the following notes: native vegetative screening should be considered on the
property facing Leiter Street while being sympathetic to the sight distance requirements at the nearby
entrance and that exterior lighting on the building be mounted low, shielded and downward facing to the
extent practicable [meeting site plan and zoning ordinance requirements] and illuminating only the side
of the structure facing the existing fire company building. The motion was seconded by Mr. Smith and
unanimously approved.
Demolition Permit [2025-01407] 19133 Geeting Road
Ms. Jenkins presented a residential demolition permit for property located at 19133 Geeting Road. The
applicant is proposing the demolition of a 1,224 sq. ft. single-family dwelling including the foundation and
an outbuilding. The structure is on the Washington County’s Historic Sites Inventory; however, there is
very little documentation. The dwelling was described in the inventory as brick encased log; however,
staff visited the site and found the structure to be wood sided with a metal roof and only one of the
chimneys remains with evidence that the others were removed due to variations in the metal roofing. The
owner provided photos that shows a portion of the structure to be log based; however, there is no
evidence of brick. The foundation is fieldstone. A rough floor plan of the interior and narrative discussing
conversion, relocation and plans for demolition were provided by the applicant.
The structures subject to this permit application lack integrity of exterior design elements. The applicant
has indicated that any viable materials are intended for reuse for other purposes on the property. The
structures appear to be unsafe as evidences by lean and deterioration due to exposure. Staff recommends
support of the demolition permit.
Motion and Vote: Mr. Lushbaugh made a motion to recommend approval of the demolition permit as
presented. The motion was seconded by Mr. Bedard and unanimously approved.
OTHER BUSINESS
Town Invitation to Tax Credits
Ms. Jenkins provided members with a copy of a draft letter to be sent to the municipalities inviting them
to a workshop to discuss tax credits and to review a Memorandum of Agreement that would allow the
municipalities to participate in the tax credit program.
Consensus: Members approved the letter with no changes.
Members discussed setting up meetings with the municipalities starting sometime in August. Ms. Jenkins
will send out a Doodle Poll with different dates and times for members to choose the best meeting times
for them.
Preservation Month 2025
· The County Commissioners presented a proclamation on May 6th for Historic Preservation Month.
Members of the Washington County Historical Society were present and accepted the
proclamation.
· The Historic Scavenger Hunt brochure will be promoted online. Ms. Aldrich suggested sending the
brochure to the Board of Education to promote to students.
· John Frye awards will be presented on May 15th.
· Social media posts will continue during the month of May for #WashcoLoveHistoric.
· The Maryland House and Garden Pilgrimage will be held in Washington County on Saturday, June
7th. Correspondence
Ms. Jenkins stated that an invitation to participate in the Environmental Review Process for the proposed
Sheetz Store in Smithsburg on Mapleville Road has been received. Mr. Bedard would like to know if any
archeological surveys have been performed.
Staff Report
· A written report of staff reviews for the past month was provided to members in the agenda
packets.
ADJOURNMENT
Mr. Lushbaugh made a motion to adjourn the meeting at 7:30 pm. The motion was seconded by Mr.
Bedard and so ordered by the Chairman.

SUBJ: Invitation for Workshop and Review of Memorandum of Agreement
To Whom It May Concern:
In April of 2024, the Board of County Commissioners (the “BOCC”) repealed the “Ordinance to
Provide Property Tax Credits for Improvements to Specified Historic Structures in Washington County,
Maryland,” the (“Original Ordinance”), and reenacted it with amendments as the “Washington County
Historic Properties Tax Credit Ordinance,” (the “Revised Ordinance”). The Original Ordinance did not
contain language allowing municipalities to participate in this tax credit program. The Revised
Ordinance allows for such participation under certain circumstances. Section 1.04 of the Revised
Ordinance establishes and defines how municipalities can qualify. In order for a municipality to qualify
under the Revised Ordinance, Section 1.04 requires the municipality to employ exterior design review
requirements that are equivalent to those in place by the Washington County Historic District
Commission (the “Commission”). The Revised Ordinance also allows a municipality to qualify by passing
an ordinance or by delegating permit review authority to the Commission through a recorded
Memorandum of Agreement (“MOA”).
This tax credit program is voluntary for the property owner. However, a citizen is only eligible
for the tax credit as long as the property is located in a “Qualified Municipality” under Section 1.04 of
the Revised Ordinance.
County staff has received numerous requests from property owners within your municipal limits
to participate in these tax credits and would like to discuss executing an MOA between the municipality
and the BOCC in accordance with Section 1.04 of the Revised Ordinance. Attached is a draft MOA for
your review. If the MOA is not acceptable, the HDC would note that there is an additional way to qualify
by amending your local ordinance.
The Commission would like to meet with municipal representatives on July 2nd, 2025 at 5:00
p.m. to discuss any questions regarding the Revised Ordinance or the proposed MOA and receive
feedback before presenting a final MOA to the BOCC and municipalities for signature.
We hope you will join us for this workshop to provide your municipality’s feedback and we look
forward to offering these voluntary property tax credits within your municipal limits with the qualifying
method that best supports your goals for historic preservation. If you are unable to attend the
workshop, you may provide comments or ask questions via mail to Department of Planning and Zoning

Historic Properties Tax Credit Ordinance
Draft Memorandum of Agreement
MEMORANDUM OF UNDERSTANDING FOR HISTORIC PRESERVATION TAX CREDIT ELIGIBILITY
BETWEEN THE TOWN OF _______________ AND THE BOARD OF COUNTY COMMISSIONERS OF WASHINGTON COUNTY, MARYLAND
This Memorandum of Understanding for Historic Preservation Tax Credit Eligibility (the “MOU”) is made this ____ day of _______________, 2025 (the “Effective Date”) by and between the Town of __________________, a Maryland municipal corporation (the “Town”), and the Board of County Commissioners of Washington County, Maryland, a body corporate and
politic and a political subdivision of the State of Maryland (the “County”), for Historic
Preservation Tax Credit Eligibility for the purpose of making certain properties within the County eligible for a historic preservation tax credit where the property qualifies as a historic structure, and where the property is located in a qualified municipality as further explained this MOU. The Town and the County may collectively be referred to as the “Parties.”
RECITALS A. On April 23, 2024, the County enacted Ordinance 2024-23 (the “Ordinance” or the “Tax Credit Ordinance”), an ordinance designed to further expand a 1990 County
ordinance which granted a County property tax credit to certain historic structures
located in specifically defined districts within the County. B. The purpose of the Tax Credit Ordinance is to expand its eligibility to all citizens within the County who possess Historic Structures which may be eligible for a
property tax credit.
C. The Tax Credit Ordinance provides that a Historic Structure situated within a “Qualified Municipality” may qualify for the property tax credit granted by the Ordinance.
D. A “Qualified Municipality” is defined as a municipality with exterior design requirements that are equivalent to those established by the Historic District Commission.
E. A municipality may also become a “Qualified Municipality” if the municipality
executes a Memorandum of Understanding whereby the municipality grants permit review authority to the Historic District Commission. NOW, THEREFORE, in consideration of the foregoing Recitals, each of which is
incorporated in and made a substantial part of this MOU, and other good and valuable
consideration, the receipt and sufficiency of which are hereby acknowledged by the Parties, and intending to be legally bound, the Parties hereby covenant and agree as follows:
1. Consistent with Section 1.04b(i) of the Tax Credit Ordinance, a municipality may become a Qualified Municipality by granting permit review authority to the County’s
Historic District Commission.
2. The Town hereby agrees to grant the Historic District Commission the authority to review and apply exterior design review requirements to applicants seeking property tax credits for their Historic Structures.
3. The Historic District Commission agrees to review applications for properties located within the Town, and to use the same exterior design review standards that it uses for all Historic Structures within the County.
IN WITNESS WHEREOF, the Parties have caused this MOU to be duly executed and
delivered.

This property totaling 188 acres is also permanently preserved through the Rural Legacy Program (RLP). RLP seeks
to protect farmland and open space which contains significant agricultural, environmental and cultural/historic
features. The Maryland Department of Natural Resources (DNR) funds the program and protects land mainly with
the use of permanent easements. However, the Board of County Commissioners (BOCC) of Washington County is
the holder of RLP easements. For more information on land preservation programs in the County, including the RLP,

Our Historic District Commission (HDC) Chair, Lloyd Yavener, chose his house on Main Street, Rohrersville, for his
favorite historic structure this year. "Eliza Easton built it in 1900 because she wanted a modern house and was tired
of the old farm house. I think it's a lovely Victorian example."
Lloyd has been on the HDC since 2021 and this year he became the chair. He is a licensed attorney with an interest
in the preservation of historic structures.

"This house is historically known as "Stone Field". The original house was built in 1760 and was then known as
"Peter Mong's cabin". Another part of the house was added in 1810. Much like the Hager House, part of this house is
built over a spring. Historic preservation is exceedingly important to safeguard the workmanship of skilled artisans

Stone Field is a recent Historic Preservation Overlay property. This overlay is applied through a rezoning process at
no charge to the property owner. Once the overlay is applied, the structures involved are eligible for more flexibility
in local ordinances such as the Building Code and Floodplain ordinances. The Historic District Commission does
have permit review in these areas as well. Most importantly, for those restoring historic resources, these overlays
are also eligible for tax credit programs!

Historic District Commission(HDC) Member Brianna Candelaria has chosen to again highlight Antietam Farm (Gum
Tree Farm) as her favorite historic resource for Preservation Month but this year she wanted to share a photo of the
house. Brianna completed extensive research on the property to gather documentation sufficient for a National
Register nomination during her pursuit of a Masters degree. She also just loves this historic rural farmscape and the
many others in the County.
Brianna has been on the HDC since 2022 and she has a Masters of Historic Preservation from University of
Maryland. She was also a former National Lead for Interpretation with the Bureau of Land Management.

Washington County re-launches "Love Historic" Campaign for Historic Preservation Month 💛💛
In honor of Historic Preservation Month in May, Washington County is excited to once again launch the "Love
Historic" campaign. The campaign invites citizens to share photos of their favorite historic structures or sites in
Washington County to be featured on the county's website and social media platforms.
To participate in the "Love Historic" campaign, individuals are asked to visit www.washco-md.net/preservation-
month to fill out a simple online form. All entries must include a photo of the structure or site, along with a brief
description of why it is meaningful to the participant.
Photos will be shared on the Washington County website and across social media throughout May to celebrate
Historic Preservation Month, offering a unique opportunity to showcase the county's historical gems. Participants
are encouraged to use the hashtag #washcolovehistoric when sharing their submissions on social media.

We love to see an interest in our historic resources. Just a quick search of Medusa, Maryland's Cultural Resource
Information System, finds this house is actually part of a survey of historic resources done for Maugansville which

Its a contributing structure to the Maugansville survey, which means its a structure that dates to the period of
significance for the survey and the building retains historic character to convey and contribute to the overall
districts historic character. A property can have its own individual survey or be part of a district survey or both!

Historic District Commission (HDC) member Greg Smith shares his pick for Preservation Month | Old Forge Farm.
"My favorite county historic property is the Old Forge Farm. The house was built in 1762 during the French and
Indian War, and it is the oldest known dated structure in the county. The large addition also dates from prior to
1800. For over 260 years this dwelling has been occupied and cared for. At various times during its history
sympathetic and productive use has seemed doubtful, but always it has passed to an owner who invested
something of themselves to keep the home healthy and happy." Read more about Old Forge

Greg lives in the Smithsburg area and has been with the HDC since 2020. He is a currently working as a nurse but
also has a degree in architecture from Virginia Tech. His areas of interest include architectural history, preservation

Historic District Commission (HDC) member Ann Aldrich has chosen the Saylor House as her historic resource
highlight for Preservation Month. Ann, a board member of the Washington County Historical Trust of Maryland, has
been the lead coordinator of the restoration of the Saylor House, as well as Historic Restoration Workshops for
citizens to learn hands-on preservation skills.
Ann has been a member of the HDC since August of 2018. She has a Master of Professional Studies in Sustainable
Landscape Design and is a former USDOI - Bureau of Land Management employee. She has an interest in historic
preservation of buildings and landscapes.

Last year Historic District Commission (HDC) member Michael Lushbaugh chose to highlight Wilson Bridge (left
photo) over the Conococheague for Preservation Month and this year he has chosen the only other 5 span stone
arch bridge in the county, Price's Mill Bridge (right photo), west of Cearfoss on Route 58.
"The bridge is in an obscure location with the new bridge towering just to the south. While driving over the new
bridge one has to glance to the north and downward to see Price's Bridge...After the bridge closed - deterioration has
endured - but yet being over 200 years old it still stands...What a wonderful feeling it was to stand on that bridge and
feel the history that will be lost if we don't to everything possible to preserve this wonderful piece of Washington
County History."
Did you know the County has 25 stone arch bridges it maintains through bridge inspections and rehabilitation
projects. There are approximately 40 stone arch bridges total here across various jurisdictions. Price's Mill bridge's
maintenance and rehabilitation have been a challenge for funding due to it's size, access, location and the majority
of bridge funding from State and Federal sources being restricted to bridges with vehicular traffic.
Mr. Lushbaugh has been on the HDC since July of 2020. He has an interest in historic preservation of buildings and
structures.

day. These groups support individuals through their yearlong programming, exhibits and general knowledge. Let's
see how many (State or local groups, museums, etc.) we can tag in the comments with a mention of why they are so

Historic District Commission co-chair Justin Bedard wanted to share Fort Ritchie for his pick during Preservation
Month. Its not too far from his Smithsburg area home for a scenic run around the former base. The property's
revitalization efforts include a museum and the incorporation of many local businesses through adaptive reuse.
Justin has been a member of the HDC since 2023 and he brings a professional background in Archaeology to the
Commission. He's passionate about archaeological resources and their protections.

As our newest member on the Historic District Commission (HDC) Tyler Milam brings a wealth of knowledge through
his academic and professional background in Architecture and Architectural Design and Urbanism. He wanted to
highlight this stone building which he has driven by for as long as he can remember. "I love the stone construction
and it's placement amongst the trees and overlooking the Antietam Creek. It reminds me of Scotland and seems to
say, "it's time to travel again".

May is Preservation Month! Last year the Board of County Commissioners adopted changes to the Historic
Preservation Tax Credits for the County. These changes mean a higher percentage of property tax credits are
available for qualifying rehabilitation expenses as well as expanded qualifying areas. You can find more information
