HISTORIC DISTRICT COMMISSION
FOR WASHINGTON COUNTY
November 1, 2023
The Washington County Historic District Commission held its regular monthly meeting on Wednesday,
November 1, 2023 at 7:00 p.m. in the Washington County Administration Complex, 100 W Washington
Street, Room 2001, Hagerstown, MD.
CALL TO ORDER AND ROLL CALL
The Chairman called the meeting to order at 7:00 p.m.
Commission members present were: Greg Smith, Chairman, Lloyd Yavener, Michael Lushbaugh, Vernell
Doyle and Justin Bedard. Staff members present were: Washington County Department of Planning &
Zoning: Meghan Jenkins, GIS Coordinator and HDC Staff member.
MINUTES
Motion and Vote: Mr. Yavener made a motion to approve the minutes of the October 4, 2023 meeting
as presented. The motion was seconded by Mr. Lushbaugh and unanimously approved.
NEW BUSINESS
11609 Kieffer Funk Road [SP-23-037]
Ms. Jenkins presented a site plan for a proposed solar generating system on property located at 11609
Kieffer Funk Road. The solar array will contain 26,416 panels and 47 inverters as well as a 7 foot fence.
This property is split with zoning designations of RT (Residential Transition) and A(R) (Agricultural Rural).
The solar array is proposed on the portion of property zoned A(R) which is outside the Growth Area. There
are no historic resources adjacent to the proposed solar array; however, there are a few historic resources
close by. None of these sites are eligible for the National Register. There is a family cemetery on the parcel
which contains the dwelling; however, it is not close to the proposed solar arrays.
Discussion and Comments: Mr. Bedard asked if an archeological survey was required by MHT. Ms. Jenkins
said there were no comments regarding an archeological survey included in MHT’s comments but she will
follow up on this question.
Mr. Smith noted there has been a lot of controversary surrounding this project in the past. Ms. Jenkins
stated neighbors were concerned about the visual impacts to their properties. Members noted that most
of the historic structures are surrounded by significant tree cover. The standard note on the plan that the
property contains historic resources is sufficient.
12440 Burkholder Lane, Lot 1 for Martin Property [S-23-058]
Ms. Jenkins presented a subdivision plat for the Martin property located at 12440 Burkholder Lane. A
warehouse and connecting road to Northpoint Development is proposed on Lot 1 (123+/- acres) with the
remaining lands containing the Kershner-Burkholder Farm (MIHP I336).
Discussion and Comments: Ms. Jenkins noted that the County may require the developer to allow space
on the site for future connections to other roads. There was a brief discussion regarding the HP overlay
on the dwelling. Ms. Jenkins stated that was suggested during the preliminary consultation and a letter
was sent to the property owner. Ms. Jenkins noted that during the Dickinson Farm site visit there was a
cemetery mentioned on one corner of the subject property. She will check if an archeological survey will
be completed. Mr. Bedard suggested that an evaluation for National Register eligibility should also be
conducted. The standard note indicating historic resources on the remaining lands should be included on
the subdivision.
OTHER BUSINESS
Staff Report
• Staff Reviews - Ms. Jenkins provided a written summary.
• 2024 Meeting calendar – Ms. Jenkins presented a draft calendar for the 2024 HDC meetings. The
only date of concern was the July 3rd meeting. Members stated they were fine with that date.
• The election of officers will be held during the December meeting. Mr. Yavener will not be in
attendance at that meeting; however, he is willing to continue to serve as the Vice-Chair, if
nominated and elected.
• The draft CLG Annual Report will be available sometime in December. Ms. Jenkins asked members
to please send any training certifications received during the past year and any updated resumes
to her.
• Ms. Jenkins is trying to organize a historic subcommittee to participate in the 250th celebration
committee. She has reached out to the Washington County Historic Society for their participation.
To date, she has two participants from the HAC, Rachel Nichols from HCWHA, Rebecca Conrad
from the Conococheague DAR, Dennis Frey, Kathryn Mackey from the Western Maryland Room
at the Library, and David Wiles with Clear Spring Historic Society. She has also contacted a
representative of the Antietam DAR.
• Historic Resource Tax Credit Ordinance Update – Ms. Jenkins stated the County Attorney is
planning to have his questions and comments back to her next week.
• CAMP Training – Ms. Jenkins announced that CAMP training for next year is scheduled on
February 20th and 21st from 5 to 8:45 pm both evenings. Topics will include: Legal Basics Meeting
Procedures, Standards and Guidelines for Design Review, Community Outreach Alternative
Materials, and Commissions and Local Building Code. This will be a virtual training with other
participants from Maryland and West Virginia.
ADJOURNMENT
Mr. Lushbaugh made a motion to adjourn the meeting at 8:00 pm. The motion was seconded by Mr.
Yavener and so ordered by the Chairman.

SUBJ: Application for Historic Property Tax Credit
Mr. Williamson,
Your property located at 1004 The Terrace in the City of Hagerstown contributes to a qualified
area (WA-HAG-136, Oak Hill District) for the County’s Historic Property Tax Credit. Our office received
your application and has had time to review the information presented. The application will not be
complete and presented to the HDC for approval and determination of credit amount until work is
completed and the following items have been provided:
1. Please forward the Certificate of Appropriateness resulting from a permit and review by the
City of Hagerstown for Design Review for properties in a Historic District. If not required,
please provide a memo from the City of Hagerstown stating such.
2. Any related inspection records from permitted activities for the work should also be
supplied.
3. Please forward any additional detailed quotes as well as invoices/receipts upon completion
of work.
4. Once the project is completed, please provide AFTER photos. Our office will keep these
photos and cannot return them. We do have the BEFORE photos already provided for our
records.
Again, this correspondence acknowledges our receipt of your initial application, and that the property
does qualify to apply for the Credit. Please be sure that work follows the Secretary of Interior’s
Standards for Rehabilitation and Guidelines for Rehabilitation of Historic Buildings as well as the

The Board of County Commissioners presented a proclamation proclaiming May 2023, as Preservation Month in
Washington County. On behalf of the Board, President John Barr presented the proclamation to Meghan Jenkins,
GIS Coordinator in the Planning and Zoning Department for Washington County.

2022.
Thirty-Seven (37) - The overall number of demolition permits issued in 2022.
One (1) - The review area type where the HDC has the ability to deny a demolition permit.
The HDC can only deny a demolition permit, when appropriate, in the Historic Preservation (HP) Zoning Overlays.
All other demolition permits are reviewed to ensure alternatives and mitigation have been explored. Read more

Re: East Water Street Streetscape Improvements

Dear Ms. Dodge:
Thank you for your recent letter regarding the above-referenced project. The Maryland Historical Trust (Trust)
previously commented on the proposed undertaking by letter dated 17 April 2023. We are writing to continue
consultation and provide additional information in accordance with Section 106 of the National Historic
Preservation Act and the Maryland Historical Trust Act of 1985, as appropriate.
As previously established, the Town of Smithsburg proposes a streetscape project along East Water Street that
involves sidewalk and storm drain improvements, replacement of the water main system, and lining or
replacement of the sewer main system along Water Street from Veterans Park to Smithsburg Pike (MD 64).
The project is partially located within the Smithsburg Historic District (MIHP No. WA-IV-259). This historic
district was determined eligible for listing in the National Register of Historic Places in 2004 and contains 162
properties dating to the nineteenth and early twentieth centuries that contribute to the significance of the
district.
Your recent letter inquired about the relevance of a stone arch culvert located in the vicinity of 23 East Water
Street. We have reviewed the photographs included with your project materials and consulted existing survey
documents in our archives. East Water Street was established around 1813-1814 with major alterations during
the 1870s to the elevation of the road in the immediate vicinity of the culvert. It is likely that the culvert dates
to one of these 18th century campaigns. Since it still retains modest integrity, the Trust believes that the stone
arch culvert contributes to the significance of the historic district. Alteration of the structure in a manner
inconsistent with the Secretary of the Interior’s Standards for the Treatment of Historic Properties could result
in an adverse effect finding for this project.
To continue the Section 106 consultation for this undertaking, please submit the following information:
• Please indicate all federal or state funds/permits/involvement to confirm that the project is subject to
Section 106 regulations and/or MHT Act.
• Please provide a more detailed description of the proposed project and include preliminary plans when
available. Be sure to highlight areas of disturbance and specify the proposed streetscape materials (i.e.,
sidewalk, retaining walls, vegetation removal and replacement, etc.). Please endeavor to replace areas
of brick sidewalk in-kind.

Discussion
Buildings and the power of place from the 250th Field Guide were discussed at this mee�ng. Members
were prompted in varying ways to elicit responses regarding this topic. Some of these prompts included:
What are some buildings or places of importance during the founding period? What Federal, State and
Local proper�es are important for the public? What geographic characteris�cs are unique or important
or have changed? What hasn’t been expanded upon or promoted regarding buildings/geography in the
past or is unfinished research/projects?
Poten�al Building/Research Projects for collabora�on:
1. Fort Frederick Focus:
a. 3rd Barracks building reconstruc�on at Fort Frederick was not completed with the
bicentennial. While State owned, a collabora�on with the County to complete the
project or host archaeology at the fort would be beneficial for ci�zens.

a. Washington visited Fort Frederick at least 2 �mes as documented. The CSHD has
discussed commissioning an ar�st ’s rendering/print to show him walking into the
fort.

a. Hundreds were formed on sections of land with 100 "taxables" (males, age 16 and
older and male and female slaves, age 16 and older). Unoccupied land could be
included in these 'tracts' and each was given a distinct name and had a constable
assigned to keep order, much like later Sheriffs. When first established, it probably
consisted of a greater area, but as time passed and the population increased, more
Hundreds would be established from it and the old Hundred would decrease in size.
(This may well be similar to the townships one finds in Pennsylvania today.) These
Hundreds were later replaced with districts which usually were named after the town
it included and/or a district number. In 1777, tax assessments were made on the
value of the real and personal property of the head of the household and the
"taxables" method was no longer used. The Hundreds were gradually phased out
and Districts replaced them.

(Williamsport) and where/what documents were at the �me legal documents.
9. Expand on the history of the naming of the County. Who were the par�cipants in the
pe��on for naming and highlight the �ming of it being named “Washington” so early a�er
the declara�on was signed. This may �e into the land patents and legal documents
discussion because some records may be at Annapolis in the hall of records there as local
Court House wouldn’t have some of the earliest documents.
10. Highlight the Furnaces/early industry. These were basis for large land patents and had
families associated with them which are important to the County’s history. Forges were
important for muni�ons in war effort.
