MINUTES OF THE HISTORIC DISTRICT COMMISSION FOR WASHINGTON COUNTY October 4, 2023 The Washington County Historic District Commission held its regular monthly meeting on Wednesday, October 4, 2023 at 7:00 p.m. in the Washington County Administration Complex, 100 W Washington Street, Room 2001, Hagerstown, MD. CALL TO ORDER AND ROLL CALL The Chairman called the meeting to order at 7:00 p.m. Commission members present were: Greg Smith, Chairman, Lloyd Yavener, Michael Lushbaugh, Ann Aldrich, Vernell Doyle and Brianna Candelaria. Staff members present were: Washington County Department of Planning & Zoning: Meghan Jenkins, GIS Coordinator and HDC Staff member and Debra Eckard, Administrative Assistant. MINUTES Motion and Vote: Mr. Yavener made a motion to approve the minutes of the June 7, 2023 meeting as presented. The motion was seconded by Mr. Lushbaugh and unanimously approved. NEW BUSINESS RZ-23-007 – 13215 Smithsburg Pike Ms. Jenkins reported that the consensus of the HDC to support the rezoning request for the application of the Historic Preservation overlay for property located at 13215 Smithsburg Pike was forwarded to the Planning Commission. The Planning Commission held its public input meeting on Monday, October 2nd at which time the Commission recommended approval of the request to the Board of County Commissioners. A public hearing is scheduled with the BOCC on Tuesday, November 7th. Ms. Jenkins noted that Ms. Aldrich was present at the Planning Commission’s public input meeting as well as Mr. Jefferson Boyer, President of the Smithsburg Historical Society. Both spoke in favor of the proposed request. Ms. Jenkins explained that the urgency for this request is because the front wall of the dwelling has sunk. This issue needs to be addressed immediately. She further explained that the dwelling sits within a flood plain and once repairs begin, the structure must be brought up to current Flood Plain Ordinance standards. However, if the HP overlay is in place before repairs begin, the Flood Plain Ordinance requirements will not be required. Modern flood plain requirements would greatly jeopardize the historic integrity of the dwelling. Ms. Aldrich stated a portion of this structure dates back to the 1700s. Section 106 Consultation: Project No. WA489C21 – I-70 Bridge Nos. 2111003 and 2111004 over CSX Ms. Jenkins presented a letter from MDOT SHA stating the above referenced project will have no effect on historic properties. Motion and Vote: Ms. Aldrich made a motion to concur with MDOT SHA’s finding that there will be no effect on historic properties for the above referenced project. The motion was seconded by Mr. Lushbaugh and unanimously approved. 2040 Comprehensive Plan Ms. Jenkins introduced the 2040 Comprehensive Plan for discussion and comments on the Historic Element. The following comments were provided by members of the Commission. • Update the Washington County Historical Trust section. Ms. Jenkins will work with Ms. Aldrich on this section. • Building Codes section (page 54) needs clarification as to the structure’s listing with the State or local body as historic. Does this mean the structure must be on the MIHP or will the HP overlay also qualify? Ms. Jenkins will clarify this requirement with someone from the Building Codes department. • The comprehensive plan needs to be more explicit with the Rural Villages being adopted (which Villages still need surveys completed). • Make sure that incentives are explained clearly to allow for the use of more than one applicable program. Ms. Jenkins stated that comments are being accepted until the end of October. An interactive site is available on the web where you can also make comments. She gave a brief overview of the comprehensive plan information meetings that have been held across the County and invited members to attend the final two meetings that will be held on October 10th at Smithsburg Town Hall and October 25th at the Williamsport Fire Company Banquet Hall. OTHER BUSINESS Staff Report • Staff Reviews - Ms. Jenkins provided a written summary. • The Architectural Fieldwork Symposium will be held on March 28, 2024 (instead of October). • An invitation to the Heart of the Civil War Heritage Area Year in Review was included in the agenda packet. This event will be held on November 1st at the Weinberg Center in Frederick. • A copy of “The Field Guide for the Semiquincentennial Making History at 250” was distributed to members. Ms. Jenkins will be serving on this committee and asked members to think about ways to participate in this event or any significant information that should be considered to the Committee. • CLG 4 Year Evaluation Results – Ms. Jenkins provided a copy of the evaluation sheet. Members questioned how the scores were calculated and where improvements could be made. Ms. Jenkins will follow-up with MHT. • Historic Resource Tax Credit Ordinance Update - Ms. Jenkins reported the County Attorney’s office has the final draft and is checking it for legal sufficiency. Some clarification is need on the Rural Village. ADJOURNMENT Mr. Lushbaugh made a motion to adjourn the meeting at 7:55 pm. The project area is located north of National Pike (US HWY 40) and bounded by agricultural land on all sides, with residential and commercial development located a short distance to the east. The property is accessed from a long private drive extending north from National Pike (Exhibit 1). The project area is situated on gently rolling terrain with higher elevations on broad ridge landforms in the east and north and lower elevations in bottomlands in the south and east (Exhibit 2). A tributary of Conococheague Creek flows west through the project area with drainage to the southeast. The vegetation within the project area consists primarily of agricultural fields under active cultivation. Several buildings are currently standing within the project area, including a farm complex located near the center of the property, which has been recorded with the Maryland Inventory of Historic Properties (MIHP) as a historic resource (Exhibit 3). The buildings are a historic farm complex originally built prior to the mid-19th century and are currently occupied. Maryland property records indicate the current house at the farm complex was constructed in 1774. A 20th century dwelling adjacent to the farmstead is excluded from the project area. KNOWN CULTURAL RESOURCES IN OR NEAR THE PROJECT AREA The following discussion of previously recorded cultural resources within and near the project area was established by using the Maryland Historical Trust’s (MHTs) online Maryland’s Cultural Resource Information System (MEDUSA) and other online sources. Twenty architectural resources have been previously recorded within an approximate one-mile radius of the project area (Table 1); no archeological resources have been recorded within a one-mile radius of the project area. WA-I-336, the Kershner-Burkholder Farm, is located within the central portion of the project area. The farmstead dwelling is a two-story stone building typical of early- to mid-19th century vernacular houses of Washington county (Plates 1-2). WA-I-336 has not been evaluated for listing in the National Register of Historic Places (NRHP). 12440 Burkholder Lane - Cultural Resources Site Assessment WSSI #MD2043.02 – November 2022 Page 3 Of the seventeen architectural resources recorded within a one-mile radius of the property, one is eligible (WA-I-868) for listing in the NRHP. MHT Resource WA-I-868 (16612 National Pike), located one mile southeast of the center of the project area, dates to the mid-19th century and was deemed significant for its architecture as a 19th century vernacular dwelling under Criterion C, and under Criterion A for its association with the National Road in the village of Huyett during its heyday. The remaining eighteen architectural resources have not been evaluated for listing in the NRHP. ARCHEOLOGICAL SITE PROBABILITY The following presents an assessment of the probability that archeological sites will occur within the study area. This assessment has not been field verified. The probability for locating pre-contact Native American sites generally depends on the variables of topography, proximity to water, and internal drainage. Sites are more likely on well-drained landforms of low relief near water. If prehistoric sites are present on the ridge tops or ridges, they are likely to be confined to the plow zone and are not likely to require work beyond the recordation done at the Phase I level. Plowing disturbs the context of the Native American artifacts, thus reducing the information potential of a particular site. The project area is considered to have at high probability of containing Native American archeological materials based on the presence of low relief, well- drained topography on both sides of the tributary stream within the property, as well as low-lying bottomlands which would have been attractive to early settlement and seasonal resource exploitation. The probability for the occurrence of historic period sites largely depends upon the history of settlement in the area, the topography, and the proximity to historic roads. Historic maps offer insight into habitation of the vicinity; however, the absence of structures on historic maps does not eliminate the possibility of an archeological site being present within the property, as it was common for tenant, slave, and African American properties to be excluded from these maps. The project area has a high probability of containing 18th, 19th, and 20th century archeological materials, particularly related to the farmstead in the center of the property and potentially along the historic roadbed that passes through the property. CONCLUSIONS AND RECOMMENDATIONS Cultural resources studies of the project area may be required under federal or state ordinances or regulations and may involve a Phase I archeological investigation (as the property has a high probability of containing archeological sites). As the property contains buildings over 50-years in age, a Phase I architectural reconnaissance level investigation of the existing historic buildings on the property may also be needed. 12440 Burkholder Lane - Cultural Resources Site Assessment WSSI #MD2043.02 – November 2022 Page 4 If impacts to Waters of the United States are planned in association with the development of the project area, the U.S. Army Corps of Engineers (USACE) can require a Phase I cultural resources investigation in order to comply with Section 106 of the National Historic Preservation Action of 1966 (as amended) during the Clean Water Act permitting process. If the development project involves any other federal funding, loans, permits, and/or licenses, the Phase I cultural resources investigation could also be required by the federal agency associated with the undertaking (HUD, FCC, FHA, etc.). Any form of financing, permitting, or licensing at the state level could trigger a Phase I cultural resources investigation under the Maryland Historical Trust Act of 1990 (Article 83B, Sections 5-617 and 5-618 of the Annotated Code of Maryland). Under these two scenarios, the Phase I cultural resources investigation would be subject to review by the Maryland Historical Trust. Depending upon the nature of the planned development, a Phase I cultural resources investigation may not be required by local, state or federal agencies. We recommend conducting such an investigation after determination of the necessity for the Phase I investigation has been made. LIMITATIONS This report evaluation is based on the recorded and reports noted and described above. Our review and memo have been prepared in accordance with generally accepted guidelines. Conclusions presented herein are based upon our review of available information, and/or professional judgement. Last Updated: 03-12-2004 - - -- ABSTRACT WA-I-336 Kershner-Burkholder Farm Huyetts Vicinity private 19th Century This two story, three bay stone house, frame bank barn and outbuildings provide an example of a 19th century Washington County farm group. The type of masonry displayed in construction of the house, its exterior woodwork and general form all suggest that it was built during the second quarter of the 19th century. Constructed of native limestone, the house reflects pro- minent regional traditions. M>st stone houses in Washing- ton Cotmty date from before 1850. A Maryland Historical Trust OulT) worksheet was completed for the site in 1974. The worksheet noted one house, along with one smokehouse and one large ban. The worksheet noted that the buildings were in excellent condition and that the property contained approximately 166.66 acres. While the worksheet did not suggest a recommendation for the site, it did note that the significance of the site ::##.c::Bcb¥|:fhgeact#:°[ut#e¥teoenx::n;:rt:fth:tehho°u:::;:fab£::nat[et:r::ic±ie£§:#etrefa:Xm¥]:o::,Yu:hh=grth°£: house, appear to have been common in this area. House This circa 1831, two-story, five-bay, side-gable, Georgian style, five-course American-bond brick house rests on a rusticated- limestone foundation with one central-interior five-course American bond brick chimney and two interior-end five-course American-bond brick chirmeys with corbelled caps. The roof is covered in asphalt shingles with metal gutters and downspouts with a decorative cornice. There is a one-story, full-width, wood porch under a hipped roof supported by tapered, painted- white wood colums with ionic capitals. One wood step leads from the porch to the front yard. Sash, double-hung, 6/6, wood- frame windows flanked by painted-white wood shutters are typical on the fapade and elevations with sash, double-hung, 4/4, wood-frame windows in the gable ends. The entrance on the fapade consists of two single-leaf, wood-panel doors with lights with three-light transoms. There is a two-story, two-bay, side-gable, Flemish-bond brick addition attached to the rear (east) elevation resting on a Flemishlbond brick foundation with a basement with one interior-end Flemish-bond brick chimney. The roof is covered in asphalt shingles. There is a one-bay, poured-concrete stoop. One poured-concrete step leads from the stoop to the yard. Sash, double-hung, 1/1, wood-frame windows flanked by painted-white wood shutters are typical on the addition.
