HomeMy WebLinkAbout10.07.1986October 7, 1986 Hagerstown, Maryland 21740 The Regular Meeting of the Board of County Commissioners of Washington County was called to order at 9:00 a.m. by the President, Ronald L. Bowers, with the following members present: Vice President Richard E. Roulette and Commissioners R. Lee Downey, John R. Salvatore and Martin L. Snook. INVOCATION AND PLEDGE OF ALLEGIANCE The Invocation was delivered by Commissioner Bowers followed by the Pledge of Allegiance to the Flag by the full Assemblage. PROCLAMATION - EMPLOY THE HANDICAPPED MONTH Motion made by Commissioner Snook, seconded by Salvatore to Proclaim the month of October 1986 as Employ the Handicapped Month in Washington County, urging all citizens to recognize the advantages of hiring the handicapped. Unanimously approved. Commissioners Bowers read the Proclamation and presented a copy to Peggy Martin and Ann Wilson. PROPOSAL TO CREATE COMMISSION FOR WOMEN Kandyce Douglas, a Maryland Commission for Women member, along with Mrs. Fetterhoff, appeared before the Commissioners as spokespersons for a group of women advocating the establishment of a county women's commission. They said that the commission would serve as a source of information and referral for local women and identify, research and help find solutions to problems women encounter. The Commissioners expressed general approval of the concept and said that they would have to seek enabling legislation before a commission could be established. APPOINTMENT TO CHILDREN'S COUNCIL Motion made by Commissioner Salvatore, seconded by Roulette to appoint Richard Martin to serve as a member of the Washington County Children's Council for a three (3) year term. Unanimously approved. APPOINTMENT TO AREA AGENCY ON AGING ADVISORY COUNCIL Motion made by Commissioner Snook, seconded by Roulette to appoint Paul Burroughs to serve as a member of the Area Agency on Aging Advisory Council for a term to expire January 1989. Unanimously approved. ADDITIONAL FUNDS FOR MEMORIAL RECREATION CENTER ROOFING PROJECT Motion made by Commissioner Downey, seconded by Roulette to approve of additional work in the amount of $4,382 on the Memorial Recreation Center Roofing Contract, and to appropriate the funds over budget for this project from Capital Contingency. Unanimously approved. CHANGE ORDERS - HALFWAY PARK SWIMMING POOL Motion made by Commissioner Downey, seconded by Snook to approve of Change Order #4 in the additional amount of $1,105 and the overrun on the alarm on the fill valve in the amount of $575.00 on the contract with Callas Contractors, Inc. for the Halfway Park Swimming Pool project. Unanimously approved. MINUTES OF MEETINGS ON SEPTEMBER 15 & 16, 1986 Motion made by Commissioner Downey, seconded by Roulette to approve of the Minutes of the County Commissioners Meetings on September 15 and 16, 1986, as amended. Unanimously approved. RENEW STATE WORK CREW AGREEMENT Motion made by Commissioner Roulette, seconded by Snook to renew the agreement with the State for a Maryland Correctional Training Center work crew to work on county projects, and to request a second crew for this purpose. Unanimously approved. FORGIVE SANITARY COMMISSION DEBT - HIGHFIELD WATER SYSTEM Motion made by Commissioner Roulette, seconded by Salvatore to forgive the debt of $90,802.11 owed by the Sanitary Commission for legal fees and interest on a $400,000 loan in connection with the Highfield Water System, and to make an appeal to the State Department of Health for reimbursement of the $44,574 in legal and condemnation costs since the state mandated the county's takeover of the system. Unanimously approved. OCTOBER 7, 1986 MINUTES, CONT'D. ADVANCE TO SANITARY COMMISSION - KEEDYSVILLE/SHARPSBURG SEWER PROJECT Motion made by Commissioner Roulette, seconded by Salvatore to advance up to $50,000 to the Sanitary Commission to enable prompt payment of invoices for design services for the Keedysville/Sharpsburg sewer project, with this money to be repaid upon receipt of funds from either HUD or the State. Unanimously approved. LOAN TO MAUGANSVILLE FIRE COMPANY Motion made by Commissioner Roulette, seconded by Snook to accept the recommendation of the Fire & Rescue Loan Committee and lend Maugansville Fire Company $75,000 from the revolving loan fund for the purchase of a new engine. Unanimously approved. CHANGE EFFECTIVE DATE OF ANIMAL CONTROL ORDINANCE Motion made by Commissioner Roulette, seconded by Salvatore to accept the recommendation of the S.P.C.A. and change the effective date of the Animal Control Ordinance adopted on September 30, 1986 to January 1, 1987. Unanimously approved. RENAME COUNTY ROADS Motion made by Commissioner Roulette, seconded by Snook to rename the portion of old Route 66 in he Smithsburg area that the county recently received from the state, Frank's Run Road. Unanimously approved. Motion made by Commissioner Roulette, seconded by Downey to rename Black Rock Road #2, Meadow Glade Drive, subject to concurrence by all the property owners on the road. Unanimously approved. ECONOMIC DEVELOPMENT COMMISSION REPORT Leroy Burtner, Executive Director, and Richard Hopkins, Chairman of the Economic Development Commission, appeared before the Commissioners to submit a report on the results of the Commission's efforts from 1983 to 1986. The document showed that 2,417 new jobs have been created in Washington County and $114.9 million invested in new construction. It also revealed that the combined value of building permits increased by 150% during those years, with 17 new companies locating in the county and 21 existing firms expanding. Mr. Burtner attributed part of his office's success to the national advertising campaign and said that he is looking forward to another successful year. The Commissioners expressed the hope that the report would help convince representatives of Standard & Poor that the county deserves a AA bond rating. They also thanked the E.D.C. officials for a job well done. REZONING CASES RZ 337, 345, 346, 347 and 348 After due consideration of all the matters and facts adduced at the Public Hearing held on September 15, 1986. the comments/testimony submitted in writing within the ten (10) day period following said Hearing and the recommendations submitted by the Planning Commission, the following decisions were rendered: RZ-337 The Executive Director of the Planning Commission announced that this Case had been withdrawn. RZ-348 Motion made by Commissioner Roulette, seconded by Downey to APPROVE of the application of the Board of County Commissioners for a Text Amendment to Section 23.1(f) of the Zoning Ordinance that would reduce standards for area and lot requirements for schools on the basis of enrollment, and to adopt the findings of fact of the Planning Commission in this Case as the findings of fact of this Board. Unanimously approved. RZ-345 Motion made by Commissioner Salvatore, seconded by Roulette to APPROVE of the application of Davis, Renn & Shrader, Inc. for the reclassification of land located North of Wolford Avenue, west of Greenmount Avenue consisting of 1.13 acres from the present RU (Residential, Urban) classification to RU - PUD (Residential, Urban - Planned Unit Development) classification, and to adopt the findings of fact of the Planning Commission in this Case as the findings of fact of this Board. MOTION made by Commissioner Roulette, seconded by Salvatore to Table the Vote on the aforegoing Motion until it is determined if there is legal access to this parcel. Unanimously approved. OCTOBER 7, 1986 MINUTES, CONT'D. RZ-346 & 347 Motion made by Commissioner Roulette, seconded by Downey to APPROVE of the application of the Board of County Commissioners for a Text Amendment to Article 20 and Sections 25.4 and 27.3 of the Zoning Ordinance to provide for Historic Preservation Districts, including the amendments proposed by the Planning Commission this date, and to adopt the findings of fact of the Planning Commission in this Case as the findings of fact of this Board. Unanimously approved. Motion made by Commissioner Roulette, seconded by Salvatore to APPROVE of the application of the Board of County Commissioners for a Map Amendment to the Zoning Ordinance to add underlying zones to parcels with existing "HP" designation, with the exception of parcel #249 owned by Gerald Downs, and to adopt the findings of fact of the Planning Commission in this Case as the findings of fact of this Board. Unanimously approved. BID OPENING - NORTHERN AVENUE/FOUNTAINHEAD ROAD INTERSECTION IMPROVEMENTS Bids for improvements to the Northern Avenue/Fountainhead Road Intersection were publicly opened and read aloud. Firms participating in the bidding and their proposals were as follows: WOCAP Energy Resources, Inc. - $101,046.50, Wolfe Brothers, Inc. - $119,592.50. The bids will be reviewed by appropriate officials prior to a decision being rendered. TAX CREDITS TO RURITAN AND CIVIC ASSOCIATIONS Motion made by Commissioner Salvatore, seconded by Roulette to grant tax credits on county property taxes to the following Ruritan and Civic Associations: Ruritan Club Inc., Pleasant Valley 81.39 Ruritan Club Rohrersville Inc. 663.59 Rohrersville Ruritan Club Inc. 1,060.47 Leitersburg Ruritan Club Inc. 395.65 Ruritan Club Inc. CREATION OF WASHINGTON COUNTY NARCOTICS TASK FORCE Ken Long, States Attorney, and Andy Norman, Senior Assistant, appeared before the Commissioners to propose the creation of a Washington County Narcotics Task Force to combat drug problems in the area. They said that the NTF would be comprised of city and county police officers under the direction of a governing board, with Mr. Norman acting as exclusive prosecutor. City of Hagerstown Officials, Police Chief Clinton Mowen and Sheriff Glenn Bowman indicated their approval of the proposal, as did the County Commissioners. The States Attorney introduced resolutions for consideration by the Mayor & Council and the County Commissioners which would formally institute the above proposal. RESOLUTION APPROVING AGREEMENT CREATING THE WASHINGTON COUNTY NARCOTICS TASK FORCE Motion made by Commissioner Roulette, seconded by Snook and unanimously adopted to pass a Resolution approving an Agreement Creating the Washington County Narcotics Task Force and authorizing the President of the Board to execute said Agreement and any other documents necessary to effectuate the purposes and intent thereof. RESOLUTION APPROVING AGREEMENT REGARDING FORFEITURE OF CONTRABAND AND DISTRIBUTION OF PROCEEDS Motion made by Commissioner Downey, seconded by Salvatore and unanimously adopted to pass a Resolution approving an Agreement Regarding Forfeiture of Contraband and Distribution of Proceeds in connection with Controlled Dangerous Substances Laws and authorizing the President of the Board to execute said Agreement and any other documents necessary to effectuate the purposes and intent thereof. OCTOBER 7, 1986 MINUTES, CONT'D. ALLOCATION TO HJC FOR BASEBALL COMPLEX Motion made by Commissioner Snook, seconded by Salvatore to allocate up to an additional $9,500 to the Hagerstown Junior College for improvements to the baseball complex since these facilities are used by the community, and to appropriate said funds from Capital Contingency. Unanimously approved. ADDITIONAL ALLOCATION TO PURCHASE VEHICLES Motion made by Commissioner Salvatore, seconded by Roulette to allocate additional funds in the amount of $2,966 for the purchase of vehicles in the Plumbing and Permits Department, since bids on these vehicles came in over budget, and to appropriate said funds from Operating Contingency. Unanimously approved. CONVENE IN EXECUTIVE SESSION Motion made by Commissioner Salvatore, seconded by Roulette to convene in Executive Session at 12:15 p.m. in regard to personnel, property and legal matters, pursuant to the Authority contained in Article 76(A), Section 11(a)(6 & 7) of the Annotated Code of Maryland. Unanimously approved. RECONVENE IN REGULAR SESSION Motion made by Commissioner Snook, seconded by Roulette to reconvene in Regular Session at 12:30 p.m. Unanimously approved. EMPLOY PART-TIME INFORMATION SPECIALIST Motion made by Commissioner Roulette, seconded by Downey to employ Melinda Whittington in the position of part-time Information Specialist at the I-70 Center to fill an existing vacancy.
