This report, submitted pursuant to the provisions of Article 66B of the Annotated Code, summarizes the activities of the Commission from January 1, 1987 through June 30, 1988. This eighteen month period has been used for the report in order to place it on a fiscal year basis beginning July 1, 1988. In addition to the routine review and approval of subdivisions and site plans, the Commission continued to implement the Comprehensive Plan that was adopted in 1981 although at a reduced rate because of the pressing workload imposed by current activities. The various elements of the Plan worked on by the Commission in 1987-88 are described in this report along with the numerous other tasks undertaken during this eighteen month period. As in the past, the new Work Program that has been formally adopted by the Planning Commission lists all those tasks the Commission hopes to address in the coming year. (incj/ 4 - Jack B. The Comprehensive Plan Less progress was made in 1987-88 on the implementation on the Comprehensive Plan elements than was anticipated when the work program was adopted in January, 1987. The continued implementation of the Plan policies have had to yield to more pressing current activities throughout the year, tasks directly related to development. Nevertheless, there was progress, and the various components of the Comprehensive Plan that were either completed or worked on include the Watershed Study that was fininshed in January 1987, further efforts on Town Growth Area studies with Hancock and Clear Spring, and continued close coordination with the Town of eoonsboro on growth problems of mutual concern to the Town and the County. Through its ongoing review of new development plans in the January, 1987 -June, 1988 period, the Planning Commission has recognized the need for additional developmental controls in the rural areas of the County. Additional growth pressures have become evident, and the Comrunission, in reviewing its work program for the coming year, has established a high priority for the development policies that can assure controlled growth in the rural areas consistent with preserving valuable farm land and the retention of a rural atmosphere. 1 The following is a list of the Comprehensive Plan policies and the current status of them since the start of Plan implementation in 1981. The program was established and is regulated by Agricultural Article, Section 2-501 through 2-515 of the Annotated Code of Maryland. It is administered through a Planning Commission staff member by the Washington County Agricultural Land Preservation Advisory Board, the County Commissioners, and the Maryland Agricultural Land Preservation Foundation of the Maryland Department of Agriculture. The program encourages landowners to voluntarily enter into an Agricultural Land Preservation District in which it is agreed that the land will not be developed for a period of at least five years. In return for that restriction, the landowner receives protection from nuisance complaints and becomes eligible to sell a development rights easement. A landowner may exercise the option of selling a development rights easement to the Agricultural Land Preservation Foundation provided that his offer to sell is recommended by the County's Advisory Board and the County Commissioners. At the local level, the Agricultural Advisory Board will review and rank easement applications, assigning point values to such items as farm size, soil quality, and development pressure indicators on its easement checklist. Each farm's total point value will assist the Board in determining which farms to recommend for easement purchase and in what order of priority. The Board of County Commissioners makes the final local decision based on Advisory Board recemnendations and data gathered at the required public hearing. If purchased by the State of Maryland, the easement will remain effective in perpetuity. ci I The total acreage of productive farmland in preservation districts dropped again in 1987 from 3,897.75 acres to 3,865.71 acres. No new preservation district applications were received in 1987. However, one application was approved in the first six months of 1988. Final action was taken on the applications as noted below. In April, 1987, the County Commissioners agreed to commit locally collected Agricultural Transfer Taxes to the Preservation Program. An exact amount will not be specified until a later date. This current Plan has been the first major update since the Solid Waste Management Study was accomplished in 1982. Major changes brought about by State regulations and new laws have significantly altered the community's approach to solid waste disposal. Although landfilling has proven to be the most economical means of solid waste disposal to date, with the advent of landfill liner and leachate collection system requirements imposed by the State, other alternatives now need to be explored. Initial estimates place the cost of landfilling between $300,000 and $500,000 per acre using geomembrane liners and leachate collection and treatment systems. These costs make it necessary for the community to investigate alternative methods of solid waste disposal, one of which may be incineration. Meetings with Frederick County, Carroll County, and Howard County officials have been held in the first half of 1988, and further dialogue among the officials of the four counties is expected on this subject. New State legislation has made recycling a, mandatory requirement throughout the state. Washington County must prepare a Solid Waste Recycling Plan by July 1, 1990 and must implement that Plan by 1994. The law requires that all communities of 150,000 population or less recycle a minimum of 15% of its solid waste stream. It is expected that the Planning Commission will be given the responsibility for the preparation of this new Recycling Plan. 8 Town Growth Area Studies Work began in May, 1988 on the Town Growth Area Study for Hancock. Progress is being made as of this writing, and through the continuation of monthly meetings it is expected that a report and review between the Town of Hancock and County officials can be expected by the end of the calendar year. Word is still being awaited from the Town of Clear Spring on that community's preference for a Town Growth Area Study. No final response has been received to date. Close cooperation continues with the Town of Boonsboro in the area of growth management, and it is expected that the development of infrastructure policies for the cost sharing of such installations between government and developers can resume shortly and be completed within the next several months. The Planning Commission established a cooperative agreement with the Town of Smithsburg during this report period for the exchange of site plans and other development plans that would be of mutual interest to the two governmental bodies. A Town Growth Area boundary for Smithsburg, as for Boonsboro, was established in 1986. 9 Renewed Urban Growth Area Study In an effort to keep on top of changes in the community since the orignial adoption of the Urban Growth Area Study in 1983, the City of Hagerstown Planning Commission and the Washington County Planning Commission have agreed to initiate a new study as a continuing effort in this direction. The two Commissions met in March, 1988 and discussed the subjects of Eastern Boulevard, the development of a new Urban Growth Area Study, the Highway Interchange Study currently underway by the County, the Condontowne/Regional Park development plans, as well as other items of mutual concern. Following that meeting, a new Urban Growth Area Study Committee was appointed with two members from each of the two Commissions plus staff. Elected officials from Funkstown and Williamsport were invited to send representatives and to participate in the effort. It is expected that within the next six months to a year the Study Committee will report to the Commissions and to the governing bodies with appropriate growth management recommendations. 10 Highway Interchange Study Through a series of meetings with the Economic Development Commission throughout the summer of 1987, the Planning Commission established a concept for the reclassification of the current HI district. it has long been agreed that the current HI classification carries with it the potential for conflict since all uses of a residential, business, and industrial nature are permitted. In order to eliminate this conflict, while still providing the latitude for commercial and industrial development near the interchanges, the Planning Commission proposed and received approval from the County Commissioners a new HI -1 and HI -2 classification concept. The Planning Commission then met in June of 1988 with the Airport Commission to discuss development proposals of mutual interest to both Commissions during which time the new proposed HI-1/HI-2 concept was explained to the Airport Commission. As of this writing, it is expected that the first public hearing for the reclassification of the existing HI lands will take place in the near future. In all, the HI lands comprise 11,000 acres throughout the County around seventeen interchanges. 11 Antietam Battlefield Buffer Study In May of 1987, Secretary for the Department of State Planning, Constance Lieder, met with the Planning Commission to discuss proposed steps in order to assure control of commercial development that may take place in the area of the Antietam Battlefield. This concern stemmed fran the Governor's response to the recent rezoning of the land known as the Grove Farm. Secretary Lieder proposed that a consultant study be undertaken for the purpose of analyzing the potential for the second -home market and the potential for commercial recreation within the South County area, while at the same time establishing sane protective measures for the Battlefield. Subsequent to the Secretary's visit, a Committee was appointed by the Board of County Commissioners, and meetings have been held monthly in order to establish a protective buffer around the Battlefield. That Study is nearing completion, and it is anticipated that a presentation will be made to the Planning Comnission and to the elected officials in the near future with recommendations for zoning changes necessary to enhance the historic character of this area and to protect it from commercial intrusion. 12 Water Supply Ordinance In the summer of 1987, the Board of County Commissioners directed the Planning staff to prepare a Water Supply Ordinance for the purpose of specifying minimum water supply requirements for fire fighting in rural and suburban areas where adequate water supplies do not exist. That Ordinance has been prepared and was taken to public hearing on June 7. The basic elements of the Ordinance, similar to the Ordinance used by Carroll County, provide for adequate and reliable water supply systems for fire fighting purposes in those suburban areas of the County where industrial and commercial development is taking place and has been occuring over the past several years. The Ordinance provides for the review of construction plans by the Office of the State Fire Marshal and is designed to assure maximum protection for both property and life in those areas where public water supplies do not exist. The Ordinance is currently under consideration by the Board of County Commissioners. 13 House Numbering Property numbering continues to be a major effort. Begun late in 1986, the program has thus far been implemented for the postal districts of Highfield, Knoxville (the Sandy Hook area), Keedysville, and Sharpsburg. The Boonsboro district is nearly completed after which work will commence in the Hancock district. It is expected that the entire program will be completed the early part of 1990. Results to date have been gratifying. Actual cases have already occured where the existence of house numbers have facilitated quick response of emergency services. The program involves not only numbering per se but also road name changes where required. This facet of the effort has slowed matters somewhat where property owners are being contacted prior to changing the road name. For the most part, however, the effort has been successful and has received substantial support fran the citizenry. 14 SIGNIFICANT DEVELOPMENTS Throughout 1987 and into the first half of 1988, development proposals were reviewed by the Planning Commission in both concept and final form. Some of those in conceptual form have not resulted in a firm design while others have proceeded through final approval. The following is a summation of those applications of particular significance to the community. Residential Development: Colonial Park East: On March 20,1987, a Preliminary Consultation was held to discuss Colonial Park East, a proposed 189 lot residential subdivision on 67.59 acres zoned RS . The site is located on the north side of US 40 behind the existing Colonial Park subdivision. Access to this new development is proposed off of Colonial Drive and Cornell Ave. A Preliminary and Final Subdivision Plat for Section A of this development consisting of 45 lots was approved on Feb. 24 of 1988. Time frame for the development of the remainder of the subdivision was unknown at the time of this writing. Van Lear Manor: A concept for the development of the remaining lands of Van Lear Manor was discussed at a Preliminary Consultation held on August 20, 1987. Van Lear Manor is a residential subdivision zoned RR, located north of Williamsport between Virginia Ave.(U.S. 11) and Doub Road. The concept plan calls for 139 additional residential lots on 82 acres of land. The site is to be served with public water and sewer. A preliminary and Final 15 subdivision plat for Section 10, consisting of 35 lots, was approved by the Planning Commission on Jan 6, 1988. Foxleigh Meadows: A Preliminary Consultation meeting was held on Oct. 21,1987 to discuss plans for a proposed 210 lot residential subdivision called Foxleigh Meadows. This subdivision, to be developed in 3 phases on a total of 130 acres, is west of Marsh Pike and south of the community of Paramount. The property is split by the Western Maryland Railway. Access to Sections A and B consisting of 187 lots will be by a public street system off of Marsh Pike. The remaining 25 lots will be served by an extension of Keener Road. The final plat was approved on May 5, 1988. Mansoor Shaool: A concept plan for development of a 147 lot residential subdivision located on the north side of Mt. Aetna Road across from the Washington County Regional Park was reviewed at a Preliminary Consultation on April 3,1987. The property is owned by Mansoor Shaool and consists of 186 ac. zoned agricultural, currently being farmed. The plan calls for relocation of Mt. Aetna road, construction of new county roads and a private recreation area in addition to the residential lots. The initial plans called for each lot to have its own private well and septic system. During the consultation , the Washington County Health Department discouraged this concept in order to protect the public health. Mansoor Shaool Cont. The other reviewing agencies also discouraged this concept and urged the developer to pursue the extension of public water and sewer for this project. Following the consultation , the developer approached the County Commissioners concerning cost sharing for the relocation of Mt. Aetna Road. No decision was reached. The developer has also entered into a dialogue with the City Of Hagerstown concerning the extension of public facilities and possible annexation. No application for subdivision of this property had been received as of this writing. Barkdoll Farm PUD: A Preliminary Consultation was held for this proposed development in January, 1988 with the concept plan subsequently being approved by the Planning Commission. This PUD, located west of the Sharpsburg Pike just north of I-70, proposes a mix of residential and commercial development on 56 acres. To date, no application has been made for site plan approval. Troupe Run Mobile Home Park: A Preliminary Consultation for this development was held in 1984, and application for an amendment to the Water & Sewerage Plan was made in the first quarter of 1988. The amendment to the Plan was necessary since a package sewerage treatment plan would be required. Following a public hearing in March, 1988, the Board of County Commissioners found that the proposed change to the Water & Sewerage Plan was not consistent with the 17 adopted Urban Growth Area boundary and its policies. The application was denied. Industrial/Commercial: Teleflex Inc./Washington County Business Park: In November of 1987, a subdivision plat and site plan was reviewed and approved for a 99,000 sq.ft. building on a 17 acre parcel located in the Washington County Business Park. The site is being developed by Teleflex Inc. for the purpose of manufacturing and distribution of steering con- trols for power boats. An estimated 125 people will be employed by this business. Xerxes Corp./70-81 Industrial Park: During the fall of 1987, a subdivision plat and site plan was reviewed and approved for Xerxes Corporation. The proposed 65,000 sq.ft. building located on 20 acres in the 70-81 Industrial Park will house a facility for the manufacturing of fiberglass storage tank. Standard Acoustical Products/Washington County Business Park: Also located within the Washington County Business park is a proposed building on 9 acres to be developed by Standard Acoustical Products. A site plan for this building was approved by the Planning Commission in Oct.,1987. The proposed building is to be constructed in two phases. It will consist of 10,000sq.ft. to be used as an office and warehouse for Standard Acoustical, with the remaining 40,000 sq.ft. to be divided into sixteen, 25 ft. wide warehouse bays to be leased. Hagerstown Travelers' Plaza and AC & T Truck Stop: A concept plan was approved by the Planning Commission in September, 1987 for a truck stop, or travelers' plaza, to be constructed on a site west Hagerstown between Md. Rt. 144 and Md. Rt. 40 just east of I-81. A site plan was submitted following the concept plan approval, but agency approvals have not yet been received. In October, 1987, a similar proposal was received from the AC & T firm for a truck stop in the vicinity of I-70/Md. Rt. 63. A Preliminary Consultation was held and the concept plan approved by the Commission. No application has yet been received for that development. Hagerstown Junior College Atheletic Complex: The site plan for this development was reviewed by the Commission and approved in January, 1988. Childrens' Village: Childrens' Village, a non-profit organization, submitted its concept plan and site plan in March, 1988 and received approval from the Commission for this facility that is designed to educate children in in various aspects of safety. Located on the Board of Education property on Mt. Aetna Road between the Dual Highway and Robinwood Drive, the site is located on five acres and will become an on -going function of the community's educational system. 19 Water and Sewerage Plan A major update (biennial) of the Washington County Water and Sewerage Plan was undertaken in 1986. The public hearing and final adoption were concluded in 1987. The Maryland Department of Health and Mental Hygiene approved the updated Plan on June 19, 1987. Even though the 1986-87 effort was comprehensive, four amendments to the Plan were proposed in 1987. The first amendment (WS -87-1) was an administrative one which permitted use of an abbreviated amendment procedure. The changes to correct the design capacity of the Boonsboro Wastewater Treatment Plant were made based on more accurate data. Three additional changes, each of a different nature, were heard in public hearing on October 27, 1987. An amendment for the International Salt Company (WS -87-2A) was for the purpose of adding the company's name to the list of NPDES permits contained in the Plan. A large amount of community reaction to the salt pile stored on the site caused the County Commissioners to delay action on this request. WS -87-2B was a request from the Washington County Sanitary District to establish a new Water and Sewer Service Area around the southern Washington County village of Sandy Hook. These services are an attempt to correct long-standing inadequate health facilities. The third case considered during the October hearing was the Sideling Hill Interpretive Center. Again, new Water and Sewer Service Areas are to be created, this time to serve a new scenic overlook and interpretive center on U. S. Route 48 at the top of Sideling Hill. WS -87-2B and C were approved by the County Commissioners on November 10, 1987. 20 A final amendment request (WS -87-3) was submitted in late 1987. The proposal was to establish a new Sewer Service Area for the package treatment plant that was to serve the Troupe Run Mobile Home Park near Martins Crossroads. The fact that the proposal was inconsistent with the Washington County Comprehensive Plan lead to its disapproval in March, 1988. The Planning Commission staff continues to collect data and proposals to be included in the next scheduled update, which will be due in mid 1989. 21 Historic District Commission Since its initial appointment in 1986, the Historic District Commission (HDC) has made significant progress in its effort to promote historic preservation in Washington County. According to its bylaws, the Commission now meets regularly on the first Wednesday of each month. The Commission maintains contact with the County government and the community through a Planning Commission staff member. The HDC spent a great deal of its time in 1987 refining and proposing modifications to Article 20 - "HP" Historic Preservation District of the Zoning Ordinance. Significant additions include reference to the "Secretary of the Interior's Standards for Rehabilitation and Guidelines for Rehabilitating Historic Buildings" as a basis for the review of building permits. Several new definitions were also added. The amendments were approved in September of 1987. The Historic District Commission and the County Commissioners also sponsored map amendments when it was determined that three parcels were incorrectly designated "HP" in 1973. The amendment was approved in December. The Commission did more then concentrate on zoning matters in 1987. It has begun the research phase of a proposal to permit County property tax credits for designated historic properties. Architectural guidelines with a sensitivity for the styles of Washington County have also been discussed. 22 Another activity that the Historic District Commission participated in was Historic Preservation Week held in May 1987. Also, an HDC member is now representing the Commission's interests and historic preservation in general on the South County Citizens Advisory Committee. The County Commissioners requested input from the Historic District Commission on the specifications for roofing and masonry repairs of the Washington County Court House. As a result of HDC review and comments, the proposed roofing material and design were changed from a prefabricated metal to a manmade slate which the Commission felt was a more appropriate material. 23 Park Planning Park Planning in 1987-88 included a variety of projects and tasks. Much of the first part of the year was devoted to completion of the County Land Preservation and Recreation Plan. The Plan includes an update of the parks, open space, and facility goals of the 1982 Parks Plan, as well as consolidating and summarizing land preservation information, recommendations and goals from the Comprehensive Plan, and other plans and studies. Following public review and Commissioners adoption, the Plan was forwarded to the Department of State Planning in August. Final concept planning for Camp Harding Park was completed early in the year. However, construction was delayed until this year due to scheduling priorities. A comprehensive site analysis and selection study was carried out to determine potential sites for a new County park located north of Hagerstown. The three phase study narrowed down 25 possible sites to nine finalists according to scored site suitability factors. Following on -site analysis, final selection of a park site should be completed this year. Assistance was provided to the Parks Department on several projects, including permit applications for stream bank repair at Devils Backbone and Camp Harding Parks, and a boardwalk design concept and Wildlife Management Plan for use at the Mount Briar Wetland Preserve. 24 The County Fitness Commission was assisted by providing information and cost estimates for fitness trail equipment. Assistance was also provided to the City of Hagerstown in suggesting improvements to Wheaton Park, a City - owned park. Finally, several versions of an open Space Set Aside Text Amendment, recommended for the Urban Growth Area by the Land Preservation and Recreation Plan, were developed. This Subdivision Ordinance text, designed to provide for neighborhood recreational areas in new subdivisions of certain minumum sizes, failed to receive endorsement from the Planning Commission. Since it is specified in the Comprehensive Plan, however, it was forwarded to the Board of County Commissioners for direction. To date, no action has been taken. Several new projects were completed during the first half of 1988. These include an Access Study and Master Plan for Loubs Woods Park, which was completed based on input from the Parks Board and County Arts Council. The Plan recommended specific actions needed to improve accessibility and parking for the arts pavilion and park. Also, an comprehensive evaluation for a land conversion proposal at the Washington County Regional Park was completed and forwarded to the Parks Department. This proposed conversion involves 13+ acres to be exchanged between Daniel Sheedy, developer of Londontowne, and the Board of County Commissioners in order that the developer can construct a road from Section "C" of Londontowne to Mt. Aetna Road. A recommendation of approval was provided by the Planning staff to the Parks Department. 25 Other ongoing projects include concept planning for the regional park recreation area, and the North County Park Study. A public presentation was given in May, 1988 at Hagestown Junior College for the regional park recreation area, and the public responses were forwarded to the County Commissioners and the Parks Board. Action from the Parks Board is presently being awaited. Once final decisions by the Parks Board and the County Commissioners are made, the final concept plan for the recreation area will be completed. The focus of the North County Park Study was redirected by the Commissioners to evaluate possible sites east and south of the County Airport. That effort is currently underway by the Planning staff. New projects include the search for an Agricultural Exposition site. Formerly it was included as part of the regional park on Mt. Aetna Road, but the County Commissioners asked that a new site be located. That effort is underway. Other new projects involve the planning and design of a Veterans' Memorial at Halfway Park, developing cost estimates for tennis court lighting, and providing park concept planning assistance to the Town of Williamsport. W Rezoning Cases Between January, 1987 and June 30, 1988, the Planning Commission acted on forty-six rezoning applications. Twenty-five of these were for map amendments, and twenty-one were for text amendments. Joint hearings with the Planning Commission and the Board of County Commissioners are now being held regularly on a quarterly cycle, or as special hearings are called, in order to provide for efficiency in the hearing process.
