period?
The Historic Preservation zone has been amended twice since the last CLG report, first to
adjust the time and response requirements for approval of permit applications and a second
time to incorporate a new zoning district, Rural Village, that will generate Historic District
Commission review of construction permits. The Rural Village zone was created and
adopted by the Board of County Commissioners on 7/12/05 as part of a comprehensive
rezoning of the rural areas of Washington County to implement a 2002 Comprehensive
Plan.(Current text of HP and RV districts enclosed)

Has the commission amended its design guidelines since the last reporting period?
The Commission has not amended its design guidelines since the last report. Staff has
created a draft of new design guidelines to compliment the currently used Secretary of the
Interiors guidelines but other priorities have prevented their completion and adoption.

Has the commission amended its rules of procedure since the last reporting period?
No, the HDC bylaws have not been amended,

Has the commission amended its criteria for the designation of sites, structures and
districts?
No the designation criteria have not been amended. The criteria for designation are included
in the text of the HP zone included to address # 2 above

Can archaeological sites be designated under the Commission's ordinance?
It is possible but has not occurred to date.

No new HP zones have been designated: However, creation of the Rural Village district
created new areas for HDC permit review. There are 10 RuralVillages where HDC permit
review is required for new construction. Maps of those districts are provided.

Qualified Preservation Review Commission

Membership requirements are included in the text of the Historic Preservation zone in the
zoning ordinance, They were amended in the 1990's to comply with requirements in Article
66B

Number of vacancies and the duration of each: There are currently no vacancies. When
appointments expire the member remains until a replacement is appointed in order to prevent
a vacancy of any duration.

minutes of each meeting.
6. Educational training attended by member: Hershey, Lakin, Viar, Izer and Stinson attend
annual MD Preservation Conference. Stinson attends seminar on Vernacular Architecture in

1. Number of survey forms produced: No additional survey forms were produced during this
period.
2. Usability of survey:
a. Where is it housed? Washington County's Inventory of historic properties is housed
in the County Planning Department where staff to the HDC is located. Records of
properties with the Historic Preservation overlay zoning district and coordination of
plan review are also kept in the Planning Department. A copy of the inventory is also
available in the Western Maryland Room of the Washington County Free Library.
b. Is it accessible to the public? Yes, it is available to the public upon request.
c. How and when is it updated? The inventory is updated when funds are available
jointly from County Commissioners budget and matching CLG funding. Inventory
can also be updated through property owner initiative. Historic Preservation zoning
overlays are initiated by property owners and approved by the County
Commissioners through the formal rezoning process
3. Exchange and update of data:
a. Does the SHPO have a duplicate of the CLG survey? Yes

1. How are regular meetings advertised: The HDC regular meeting date (1st wednesday of
every month) is included in the adopted bylaws which are on record among the Acts,
Ordinances and Resolutions in the land records of Washington County. The regular meeting
date is also posted on the County's website. Parties with business before the Commission are
notified of meetings by letter.

a. How are minutes recorded? A recording secretary attends each HDC meeting,
takes notes and operates a tape recorder. Summary minutes are prepared and
provided at the following meeting for adoption by the HDC.
b. Are transcribed drafts circulated for corrections? There is no transcription of the
taped meeting. Minutes are presented to the HDC for revision and approval.
c. Who reviews and approves the minutes? Staff prepares the minutes. The HOC can
revise and approve.
d. Where are the corrected minutes housed? On file with other commission
documents in the Planning Department.
e. Are minutes available to the public? Yes
4. Notification of Commission hearing to Applicants: HDC hold public meetings not
hearings.

HISTORIC DISTRICT COMMISSION
FOR WASHINGTON COUNTY
SEPTEMBER 1, 2004
A and B: CALL TO ORDER AND ROLL CALL
The regular monthly meeting of the Historic District Commission was called to order by staff
member Steve Goodrich on Wednesday, September 1, 2004 at 7:02 pm. in Conference Room 1A
of the Washington County Administrative Annex Building. Members present included: Michael
Gehr, Frank Artz, Don Corbett, Jane Hershey, Merry Stinson and Carla Viar. Also present was
Dori Nipps, County Commissioner and staff member Debra Eckard.
C. MINUTES
The minutes from the June 2, 2004 meeting were presented. A motion was made by Frank Artz to
approve the minutes as presented and seconded by Jane Hershey. The minutes were unanimously
approved without any corrections.
D. COMMUNICATIONS AND BILLS — None
E. UNFINISHED BUSINESS
Draft Design Guidelines for Historic Preservation Districts: Steve Goodrich opened the
discussion stating that the funding from the Maryland Historical Trust was withdrawn because he
was unable to meet certain reporting and schedule requirements; however, he will be developing
the guidelines for the Commission's review. Mr. Goodrich has been reviewing guidelines from
different communities, cities, and small towns to prepare a document that will be conducive to the
needs of the Historic District Commission.
Mr. Goodrich first stated that the purpose of the guidelines will help guide and support decisions
made by the Historic District Commission when reviewing applications. These guidelines will

protect and enhance historic structures, help property owners and designers in planning projects,
preserve the character of the structure, and protect property values. Specific documentation
should be included in the application in order to give the Commission the correct information
necessary to make a fair, reasonable and consistent decision on the appropriateness of changes to
a structure. This information should include a scale drawing of the property, a scale drawing of
existing buildings, and sufficient information detailing the exterior of the structure.
Mr. Goodrich suggested that a change to the Commission's Ordinance needs to be made to include
a Certificate of Appropriateness. All other guidelines that have been reviewed include this
certificate.
There was some discussion concerning the adoption of a priority level rating system similar to the
one used by the City of Hagerstown. In the draft guidelines prepared by Mr. Goodrich, the
language used suggests judging each property on its own merits and own variables. This item
needs more consideration by the Commission.
Other items that need further discussion and consideration include fencing guidelines, materials to
be used in the renovation of a structure and the renovations as they pertain to the public's view of
the structure.
Mr. Goodrich stated that he will include a glossary and zoning maps showing the general
boundaries of historic properties and their relationships to main roadways. There will also be
graphics included in the guidelines.
It was agreed that members could further review the material and report recommendations during
the next meeting.
F
BUDGET
There are no budget items to discuss at this time.
• NEW BUSINESS
1. Interstate 81 widening: The following concerns were discussed with the impending widening
of Interstate 81.
a. The physical location of toll booths are not architecturally consistent with the
historic character of the rural community.
b• There will be a significant increase in noise from acceleration away from toll booths
along National Historic sites.
c. No studies have been completed to consider avoidance routes used by motorists and
the negative impact these routes will have on historic sites and historic roads.
A motion to include these concerns in a letter to the State Highway Administration was made by
Jane Hershey, seconded by Merry Stinson, and unanimously approved. Steve Goodrich will
prepare a letter to the State Highway Administration addressing these concerns.
2. The term of service for Commission members Michael Gehr, Frank Artz, Merry Stinson,
Carla Viar, Eleanor Lakin and Donald Corbett will expire on October 31, 2004. Steve
Goodrich asked the members that were present if they wish to be reappointed to serve another
3 year term. Members responses: Michael Gehr — yes; Carla Viar — yes; Merry Stinson — yes;
Frank Artz — yes; Don Corbett — no. Steve Goodrich will contact Joni Bittner, Clerk, for any
names on a waiting list. All members were asked for recommendations of any persons that
may be interested in serving on the Commission.
H. OTHER BUSINESS — None

There were no items to discuss at this time.

On a motion made by Janes Hershey, seconded by Don Corbett and approved unanimously, the
meeting was adjourned at 8:35 p.m.

NOVEMBER 3, 2004
A and B. CALL TO ORDER AND ROLL CALL
The regular monthly meeting of the Historic District Commission was called to order by Chairman
Michael Gehr on Wednesday, November 3, 2004 at 7:00 p.m in Conference Room 1A of the
Washington County Administrative Annex Building. Members present included: Jane Hershey,
Eleanor Lakin, Merry Stinson, Carla Viar, and David Wiles. Also present was Dori Nipps,
County Commissioner and staff members Steve Goodrich and Debra Eckard.
ADDITIONS TO AGENDA
Steve Goodrich made a request to add three additional items to the evening's agenda. Items were
as follows: 1) Update on French Lane property, 2) Rezoning application that has an inventory
site on it, and 3) Election of Commission officers at the December meeting. Merry Stinson also
made a request to add an additional item to the agenda: update on the Todd Bowman property. A
motion to add these items to the agenda was made by Jane Hershey, seconded by Merry Stinson,
and the motion passed unanimously.
C. MINUTES
The minutes from the September 1, 2004 meeting were presented. A motion was made by Merry
Stinson to approve the minutes as presented and seconded by Eleanor Lakin. The minutes were
unanimously approved.
D. COMMUNICATIONS AND BILLS
Steve Goodrich presented for the Commission's information the MAHDC Newsletter, "Forum
Journal" and the "Preservation" magazine.
E. UNFINISHED BUSINESS
1) Draft Design Guidelines
Steve Goodrich distributed the second draft of the Design Guidelines dated November 2004.
This draft includes several new items: a section addressing Routine Maintenance -
definitions, examples and maintenance of exterior architectural features; a Glossary and Table
of Contents have been added; and a section addressing Demolition has been added. Steve has
asked the Commission members for their input concerning both the first draft and the second
draft of the Design Guidelines.
Items also suggested by the members that should be addressed in the Guidelines would be
fencing and a section on the types of new engineered materials acceptable for restoration
projects of historical sites.
Maps and photos will also be included within the Guidelines once the text has been finalized.
2) Reappointments and Recommendations for new members
The following members were reappointed by the Board of County Commissioners to serve the
following terms: Michael Gehr (one year) and Carla Viar, Eleanor Lakin and Merry Stinson
(three years). New appointment: David Wiles (two years). The Commissioners decided to
stagger the appointments so that all members' terms would not be vacated at the same time.
Steve Goodrich reported that we are still in need of one Commission member. All positions
had been filled; however, John Kvach who had also been appointed to a two year term, has
moved out of the state, thereby leaving one position unfilled. All interested applicants from
the Commissioner's office have been exhausted. Merry Stinson had one suggestion for a new
member, Sandy Izer, and will contact Ms. Izer to see if she would be interested in serving on
the Commission. Commissioner Dori Nipps informed the members that candidates can apply
on-line. Steve Goodrich reminded all members that there are certain background
requirements within the Zoning Ordinance that must be met by Commission members. Steve
included a copy of these specific requirements in the agenda package sent to the Commission
members.
At this time, Carla Viar expressed her concern for continuing education requirements. She
has suggested training for Commission members on a yearly basis. Steve Goodrich stated that
he does send out brochures on seminars and training sessions periodically to the members.
There is however, a limited budget for such training and workshops.
F. BUDGET
FRENCH LANE — Steve began by reminding the Commission members that there is an item in
their budget for the stabilization project on the French Lane property. Items that were to be
completed came from the Historic Structural Report that was funded with CLG monies received in
Fiscal Year 2002. With approval from the Board of County Commissioners, Steve applied for and
received State grant monies for this project. One condition of acceptance of the money was for the
State of Maryland to obtain an easement on the property thus allowing the State to approve any
work or changes to maintain the historic integrity of the structure. When the grant agreement was
presented to the Board of County Commissioners for their approval and signature a few weeks
ago, the Board decided it no longer wanted to be restricted by the required easement, and
therefore could not accept the grant funds. However, the BOCC will provide contingency funds
equal to the amount of the grant so the project may continue as planned. Buildings, Grounds and
Parks will be responsible for overseeing and/or performing the work necessary to stabilize the
structure as outlined,
Discussion then focused on a proposed use for the property. Commissioner Nipps felt that the
County Commissioners would look to the HDC to provide some type of recommendations
concerning the future use of this property. Some suggestions would be a small museum, a linear
park, a restoration laboratory for training sessions for restoration at the site, an on -going
demonstration project, office space, or headquarters for a county agency. Two more options
offered was a curatorship whereby the tenants would restore the property using their own funds or
selling the property. There is a major limitation on the property due to access (stream crossing in
one direction or crossing private property in another direction).
G. NEW BUSINESS
1) Demolition Permit #2004-08940, 11111 Lakeview Drive
Steve Goodrich presented an application for a demolition permit for 11111 Lakeview Drive in
Hagerstown owned by Lakeside Partnership. This structure is included in the County's
Historic Site Inventory. Susan Grandville, Property Manager for Lakeside Partnership,
presented pertinent information and photographs of the structure as it appears now. Ms.
Grandville stated that three rooms on the first floor of the structure are currently used for
offices by Lakeside Partnership. Plaster on the second floor is falling down and the roof is
beginning to collapse thereby exposing the ceiling on the third floor. There are also numerous
holes in the roof and ceiling. Debris from inside the chimneys of the nine fireplaces within the
structure is falling thereby making the fireplaces inoperable, A minimal amount of asbestos
was found in the basement around the pipes thereby making the basement unusable and traces
of asbestos were also found in several layers of linoleum on the floors. Plans for the area
where the structure now stands are to create a parking lot. The office would be moved to a
new structure built elsewhere on the site.
Lakeside Partnership has owned the property for approximately 15 years and has made only a
minor investment to make access into the building safer by repairing sidewalks and installing
railing. Lakeside Partnership was aware of the building's historical status when it was
purchased; however, they have not put any money into the necessary maintenance or upkeep
of the structure. The structure is architecturally beautiful and has many redeeming qualities.
A motion to recommend opposition to the demolition of the structure was made by Eleanor
Lakin, seconded by Jane Hershey and motion passed unanimously. The Commission
recommended that the Lakeside Partnership develop a plan to re -use the building and begin to
make repairs so that damage to the building does not get any worse due to unnecessary
neglect.
2) PC -04-006 — The Preserve at Glen Erin (WA -I-248)
There will be consultation on Friday, November 5, 2004 concerning the proposal sent to the
Washington County Planning Department. There is an inventory site on the parcel but not
within the area that is proposed to be developed. The inventory site has a good buffer area
from the development. The Commission did not feel there was any negative effect to this site.
No other comments at this time.
3) RZ-04-008 — H. B. Mellott Estates (WA -H-149)
Steve presented a rezoning application from H. B. Mellott Estates for an Industrial Mineral
Overlay designation to be placed on 50 to 60 acres of additional property acquired for their
quarry at Beaver Creek. An historic inventory site is located on this property, but has been
abandoned for at least 5 years. The inventory form (WA -H-149) was distributed during the
meeting. A rezoning hearing before the Washington County Board of County Commissioners
is scheduled for Monday, November 15, 2004, with a 10 day written comment period after the
hearing. Merry Stinson would like the Commission to be able to visit the site before the
house is torn down and asked Steve to make the necessary arrangements.
A motion was made by Merry Stinson to recommend that the structure should be documented,
and if eventually removed, H. B. Mellott Estates would re -use the materials or offer them for
sale. The motion was seconded by Carla Viar and unanimously passed.

DECEMBER 8, 2004
A and B. CALL TO ORDER AND ROLL CALL
The regular monthly meeting of the Historic District Commission was called to order by Chief
planner Stephen T. Goodrich on Wednesday, December 8, 2004 at 720 p.m. in Conference Room
lA of the Washington County Administrative Annex Building. Members present included: Jane
Hershey, Merry Stinson, David Wiles and Eleanor Lakin (via telephone). Also present was Dori
Nipps, County Commissioner and staff member Debra Eckard. Chairman Michael Gehr, and
Carla Viar were absent.
C. MINUTES
The minutes from the November 3, 2004 meeting were presented. A motion was made by Merry
Stinson to approve the minutes as presented and seconded by Jane Hershey. The minutes were
unanimously approved.
D. COMMUNICATIONS AND BILLS
I) WASHINGTON COUNTY HISTORICAL TRUST LETTER RE: BARNES ROAD
BRIDGE
Steve Goodrich presented a letter for the Commission's information that was addressed to
Gary Rohrer, Director of Public Works, from the Washington County Historical Trust, Inc.
concerning the Barnes Road Bridge. WCHT offered its opinions on retaining and repairing the
Barnes Road Bridge based in part on evaluations of Dr. Abba Lichtenstein, a consulting bridge
engineer. The copy was apparently provided for the HDC. According to Commissioner Nipps,
there are several issues addressed within this letter which are in question at this time.
Commissioner Nipps explained that the County would like to replace this bridge to make it wider
to accommodate larger vehicles (such as farm equipment) and to eliminate the weight limitations
currently in effect on the bridge. There was discussion on the purpose of the Commission
receiving the letter and it was noted that there is no request for support or approval. It was also
noted that if, in the permitting process prior to construction the MHT would need to determine
National Register eligibility, the HDC would be asked to comment on the matter at that time.
Steve Goodrich suggested that Gary Rohrer would have more information on the project and the
factors that lead the County to determine that the bridge should be replaced. Members requested
contact with Mr. Rohrer to determine if he would be available to attend an.upcoming meeting and
provide this information. Merry Stinson asked if the 106 assessment has been conducted to
determine the bridge's eligibility in the National Register. Steve will contact Mr. Rohrer and if
the Assessment has been completed it will be provided.
E. UNFINISHED BUSINESS
i) STATUS OF BOWMAN PERMITS #2002.09083 AND 09084, PORCHES AT 7202
DAM #4 ROAD
Steve Goodrich presented a brief history for new members concerning this item. These
permit applications as well as drawings for two proposed porches were brought to the HDC for
approval. The property located at 7202 Dam #4 Road is located within an Historic Preservation
zone where building permits require HDC approval. The first drawings were incomplete and the
HDC requested more information before it could determine if the proposed construction should be
approved. At a later date the Commission was advised that the porches had already been
constructed. When notified the applicants presented photographs of the porches as constructed as
a substitute for the requested drawings to approve the building permits which had not been issued.
In October of 2003 the applicants were advised that building permit enforcement proceedings
would begin if the requested information was not provided. No further action was taken by the
building permits department. Steve Goodrich reported that the Permits & Inspections Department
has been requested to inspect the site to determine if the porches have been removed or remain.
2) RZ-04-008 - H, B. MELLOTT ESTATES
A letter was sent to H. B. Mellott Estates following the November meeting indicating the
HDC 'S recommendation that if the house located on this site of proposed additional mining needs
to be demolished, that it should be thoroughly documented and photographed. HDC also
recommended that the structure should be dismantled and parts made available to interested
parties for use in restorations of other historic buildings. Steve Goodrich reported that a furnace
of archeological interest was reported to be located on the site also and he included in the letter a
reservation of rights to further comment on the application. A few members of the HDC would
like to tour the site to visit the furnace and also the historic house located on the site.

G. NEW BUSINESS
DESIGN REVIEW FOR PERMIT #2004.11073, 5834 DUNKER CHURCH ROAD
Owner Eleanora Poffenberger was present for the review of this permit application., Mrs.
Poffenberger proposes to enclose an existing lean-to built on a concrete slab. The structure is
located in the Antietam Overlay -1 zone which requires building permit approval for all structures.
The building is not considered an agricultural building and not exempt from HDC review. Mrs.
Poffenberger proposes to cover the building with T- 111 siding and add three garage doors to the
side of the building facing south toward the Sharpsburg Pike. The building will be used to store
farm machinery and will not have a driveway coming into the building. Members were provided
location maps of the site, photographs of the existing building and drawings to show the proposed
siding and garage doors. During a brief discussion Commission members indicated the siding
would be compatible with the vertically oriented board siding of other enclosed portions of the
building. The current metal roof would remain unchanged. The Commission suggested that a
different style garage door, rather than the proposed one which had a residential appearance,
would be more appropriate. Mrs. Poffenberger had no objection to this change. An appropriate
substitution was found in the Holmes garage door catalogue catalog.
Merry Stinson made the motion to approve the application as proposed using the T-111
siding but to change the doors.(as shown on the drawings provided by the owner) and to substitute
the doors shown on page 9, design # 5 or 6 of the Holmes garage door catalog (supplied by the
owner). The motion was seconded by Eleanor Lakin and unanimously approved.
H. OTHER BUSINESS

A and B. CALL TO ORDER AND ROLL CALL
The regular monthly meeting of the Historic District Commission was called to order by Chairman
Michael Gehr on Wednesday, February 2, 2005 at 7:05 p.m. in Conference Room 1 of the
Washington County Administrative Annex Building. Members present included: Jane Hershey,
Eleanor Lakin, Merry Stinson, Carla Viar, David Wiles and Sandra Izer. Also present was
Conunissioner Dori Nipps and staff members Steve Goodrich and Debra Eckard.
C. MINUTES
The minutes from the December 8, 2004 meeting were presented. A motion was made by
Eleanor Lakin to approve the minutes as presented, seconded by Jane Hershey and unanimously
approved. -
D. COMMUNICATIONS AND BILLS
Steve Goodrich presented a letter, for the Commission's information, from the State Highway
Administration addressing the proposed improvements on Maryland Route 66 at the CSX Railroad
crossing. It is the determination of the SHA that the implementation of this project will have no
impact to standing historic structures since there are none within the Area of Potential Effect or
APE. No action was necessary.
E. UNFINISHED BUSINESS
BARNES ROAD BRIDGE
At the December 8, 2004 meeting, Steve Goodrich presented a letter to the Commission (for
informational purposes only) from the Washington County Historical Trust regarding the Barnes
Road Bridge project. This letter expressed the opinion of Dr. Lichtenstein, an engineer hired by
the WCHT, that the bridge could and should be rehabilitated and preserved on B ames Road. A
discussion developed and many questions were unanswered due to information that the HDC did
not have concerning the project.
Mr. Gary Rohrer, Director of the Department of Public Works, was present at this meeting to give
the Commission more information and answer questions regarding the Barnes Road Bridge
project. Mr. Rohrer began by explaining that the County does give serious consideration to
retaining historic structures whenever possible. He discussed the process for determining which
historic structures can be rehabilitated and which structures need to be replaced. A detailed
analysis based on the uniqueness of each structure as well as the financial aspects of each project
is examined very closely. If a structure is rehabilitated, determinations are made as to how long
the structure will last, future maintenance costs and will the repairs solve the problem. Many other
agencies are also involved in this decision such as the State Highway Administration, Federal
Highway Administration and the Environmental Protection Agency. At this point, Mr. Rohrer
presented materials (attached) in the form of a power point on paper as well as photographs of the
bridge. For this particular bridge, a critical factor in the analysis was the inability of the bridge to
carry the load that is expected of it and to handle the increased traffic projected over the next
several years. Projections concerning the amount of increased traffic use are in dispute.
Other concerns and differences of opinion between the County and Dr. Lichtenstein include the
pronounced vertical hump in the bridge deck, the substandard geometric approaches, inadequate
clearances, crash worthiness of the parapet walls to sustain the impact of a vehicle and the ability to
attach barriers to the bridge. Mr. Rohrer believed that many of these factors could not be adequately
addressed to maintain public safety with retention of the existing bridge. Extensive evaluations have
been done and there are no known cures that will provide a cost effective extension of usefulness and
provide the needed level of public safety.
After Mr. Rohrer's presentation, some discussion and questions developed. Commission members
asked about core testing, other concrete arch bridges in the County , the deterioration of the concrete
Mr. Gehr ended the discussion by stating that no comments and/or recommendations have been
requested from the Commission at this time. No action was needed or taken.

The discussion began with Steve Goodrich giving a brief history of this case. In 2002, the Bowmans
submitted permit applications for construction of two porches on the rear of the house which is located
in the Historic Preservation tone and therefore needed Historic District Commission approval for the
building permit applications. After the first review of these applications in January 2003, the
Commission requested more detailed and accurate information from the Bowman. This information
was not provided. In July 2003, the Commission was advised that the porches had been constructed
without the Commission's approval and without building permits. Photographs were provided of the
porches. The Commission used those photographs as substitutes for the detailed drawings it had
previously requested and disapproved the designs because they were not an appropriate for this
building. The owner was advised of the disapproval and the need for additional submittals for design
review and approval. In November 2004, Merry Stinson questioned the status of these porches. An
inspector from the Permits and Inspections Department visited the property and photographed the
porches that are now existing on the building. The porches that were constructed without approval and
subsequently photographed and disapproved had been reconstructed with revised balusters and hand
rails. The Commission has never given their approval to this construction; however, the permits have
been closed out since all building codes have been complied with. Merry Stinson requested contact
with the Maryland Historical Trust to see if the B owmans have applied for a state tax credit.
Carla Viar made a motion that the Commission again disapprove the permit applications #2002-09083
and 2002-09084 for the porches at 15910 Chaney's Neck Road because the new construction is not
consistent with the HDC's adopted guidelines, the Secretary of the Interior's Standards for
Rehabilitation. As new construction there was no evidence provided that they are an accurate
duplication of an historic features that did or would have existed on the building. The new
construction is also not clearly distinguished as a contemporary addition. The motion to disapprove is
also based on the lacktmpliance from the owners with the permitting procedures and HDC approvals
as evidenced by the photographs of the existing porches. The motion was seconded by David Wiles
and unanimously approved.
LAKESIDE DEMOLITION
Steve Goodrich reported that the Planning Commission also recommended denial of the proposed
demolition.
F. BUDGET
Steve Goodrich presented a copy of the proposed budget for FY '06. The budget shows a decrease of
$9,590. Mr. Goodrich has taken out the $10,000 for the French Lane rehabilitation because it will not
be needed in FY 06. Mr. Goodrich increased the item for dues and subscriptions to $400.00 from
$290.00; travel expenses increased from $100.00 to $200.00 to help defer the costs of travel to training
workshops; and an increase in the tuition assistance from $400.00 to $600.00. Total budget request for
this year is $11,260.
Jane Hershey made a motion to approve the budget as presented, seconded by Carla Viar, and
unanimously approved.
G. NEW BUSINESS
Mr. Goodrich began by providing the Commission with a copy of the Tax Credit Ordinance for
Washington County. The County provides a credit on property taxes based on the amount of money
spent on the restoration or preservation or improvements to historic properties. The criteria for
reviewing tax credits are: 1) location in an historic district (Historic Preservation zoning in the County
or a town designated district), 2) determination that the expenses are for improvements, restoration, or
preservation rather than maintenance and 3) completion according to the secretary of the Interior's
standards.
TC-05-001: 102 WEST IRVIN AVENUE, HAGERSTOWN- PHILIP BIKLE
Mr. Goodrich presented before and after photographs of the property. Mr. Bide informed the
Commission that they have restored the roof to its original form after contacting 11 contractors. The
cost of this item was $18,017. They have received a tax credit from the Maryland Historical Trust. A
copy of this approval was requested by the Commission for their records.
Merry Stinson made the motion to approve the request for a tax credit indicating that is qualified as
restoration and was done according to the guidelines asthe applicants has replaced the roof with like
materials and design.. The motion was seconded by Jane Hershey and unanimously approved.
TC 05 002 112 BROADWAY HAGERSTOWN — JUDITH AND MARK MCLEAN
Mr. Goodrich reviewed materials presented to the Commission at the beginning of the meeting for
their use in reviewing the tax credit application. The first document is from IRS Publication Form 530
describing the definition for improvements, a copy of the Secretary's Standards describing the
treatment for preservation, restoration, reconstruction and rehabilitation with detailed definitions, and
the three pages from the applicant's Maryland Historical Trust "Certification of the Completed
Rehabilitation". The State has approved tax credits for this property, their file numbers 2000-202;
2002-520 and 2003-604. All 13 items need to be examined individually for approval. Photographs
were also provided.

FFY '05 CLG PROTECT - PHASE IV RURAL COMMUNITY SURVEY
The application for CLG funding was due on December 31, 2004. Steve Goodrich re -submitted last
year's application for Phase IV — Rural Community Survey. The funding scheme is the same as the
previous submittal, $15,000 from the Trust and a commitment of $10,000 locally in cash, and $3,500 in
in -kind money which is for monitoring the project consultant and for the Purchasing Department for the
bidding process. Total Project cost is $28,500.
Jane Hershey made a motion to approve the CLG budget and project as presented, seconded by Sandra
Izer, and approved unanimously.

C. MINUTES

D. COMMUNICATIONS & BILLS
1) S.H.A. Maintenance Facility — Parkhead
Mr. Goodrich presented a letter and maps from the State Highway Administration
proposing the construction of a new salt barn at their maintenance facility at Parkhead,
near Pecktonville. The State Highway Administration has determined that the
construction of this facility would have no effect on historic resources in that area.
After some discussion, Merry Stinson made a motion to have Mr. Goodrich prepare a
letter to be sent to the State Highway Administration expressing the HDC's concern for
construction on previously undisturbed areas and to recommend that if any
archaeological resources are encountered during construction that they be recovered and
curated. Copies of this letter should also be sent to the Maryland Historical Trust and the
Hagerstown Historical Trust. Seconded by Carla Viar. Unanimously approved.
2) Training Resources
Mr. Goodrich presented a copy of the "Historic Preservation the Process and the Profit"
seminar brochure for the Commission's information. He also presented a copy of the
Maryland Association Historic District newsletter detailing the Annual State Conference
to be held in May. Both of these seminars would provide the required training for HDC
members. If there are any members interested in attending the State Conference, there
are funds available in the Commission's budget.
G. NEW BUSINESS
1) Permit #2005.01655, 4621 Harper's Ferry Road
Mr. Goodrich presented Permit #2005-01655 for construction of a garage at 4621
Harpers Ferry Road, Sharpsburg, Maryland to the Commission. This property is' located
in the Antietam Overlay District as described in the Washington County Zoning
Ordinance under Article 20A and is subject to the regulations of Article 20, Historic
Preservation District, Section 20.6. Mr. Albert L. Hetzel, Jr., the applicant and owner of
the property was present. Mr. Hetzel presented photographs of the existing house
constructed in 1999. He stated that the garage will be constructed using the same color
and type of siding and shingles to match the house. Mr. Hetzel presented the proposed
product specifications from 84 Lumber showing the windows (30 x 30", manufactured by
MW Windows), garage doors (manufactured by GADCO), siding (manufactured by
CertainTeed), and roof samples (rustic Virginia slate). The Commission received the
plan and all four elevation drawings with the Agenda.
Carla Viar made a motion to approve the permit application based on consistency with
the Secretary of Interior's Standards for Rehabilitation and the recommendations for new
additions and that the construction will not adversely affect the integrity of the historic
district and its environment. Seconded by Jane Hershey. Unanimously approved.
2) PC -05-003, Mt, Aetna Farms PUD (revised concept plan)
Mr. Goodrich presented information for the proposed Mt. Aetna Farms PUD located
north of Robinwood Drive and Yale Drive. This concept plan is proposing 1,431
dwelling units on 220 acres. This application was previously reviewed by the
Commission in June 2003; however, the concept plan has been revised and several
changes have been made to the plan. There is an existing historic structure (WA -I-439)
located on this site. In 2003, the HDC recommended that the concept plan be adjusted to
provide an appropriately sized lot on which to retain, rehabilitate and re -use the existing
buildings and that they be secured from the weather and vandalism to be protected until
such time as the structure can be re -used.
Commissioner Nipps stated that sewer service for this development is a serious issue.
Sewer service would need to be approved by the City of Hagerstown which is currently
under a consent order from the MDE. The developer has requested that this site be
annexed into the City of Hagerstown; however, this development is not contiguous with
the City and therefore cannot be annexed at this time. School capacity issues are another
major concern for this development.
Jane Hershey made a motion that the Commission reiterate its position from the June
2003 comments. Seconded by David Wiles. Unanimously approved.
H. OTHER BUSINESS
1) Barnes Road Bridge
Mr. Goodrich provided Gary Rohrer's response to Merry Stinson's request for
information on the next oldest concrete arch bridge (after Barnes Road Bridge) in the
County. Mr. Rohrer's response stated that the County's inventory of structures does not
include an accumulative list of dates, but he referenced the book "Historic Bridges of
Maryland" which lists the 1907 concrete arch structure over the Conococheague River.
2) Bowman Property
Mr. Goodrich has contacted the Maryland Historical Trust regarding the Bowman
property. A written formal request must be made in order to receive copies of any
information submitted to the Trust for tax credits but he was informed that there have
been applications on Maryland tax credits. Mr. Goodrich has also sent a letter to the
Bowman's regarding the non-compliance with HDC standards and specifications for
rehabilitation of an historic structure within an HP zone.
Discussion: Commissioner Nipps suggested implementing fines for non-compliance of
the Zoning Ordinance regulations for the construction/rehabilitation of properties
designated within an HP zone.
3) 112 Broadway Tax Credit Application
Ms. Izer expressed concern regarding the approval of some items listed on the tax credit
application presented,. for the property located at 112 Broadway in February. Ms. Izer
stated that she has contacted the Maryland Historical Trust regarding the replacement of
the front wooden columns with fiberglass columns. The applicant stated on the
application sent to the Maryland Historical Trust that the columns were replaced with
"in -kind" columns. The Maryland Historical Trust is investigating the application at this
time. Mr. Goodrich stated that Staff will review the minutes and tapes from the February
meeting.

Cheney's Neck Road
Mr. Goodrich presented a copy of the letter that was sent to Todd and Tracey Bowman in
February 2005. Mr. Goodrich also stated that he has had several discussions with Mr. Dan
DiVito, Director of Permits and Inspections and Ms. Angela Smith, Deputy Director of Permits &
Inspections regarding the course of actions that can be taken to resolve this issue. They have
stated that court proceedings would be the next step to resolve this matter; however, due to the
lack of significant documented evidence and the length of time that has passed, this course of
action is not recommended. Mr. Gehr recommended sending a certified letter to the Bowman's
stating that the correspondence of February 15th is the Commission's final decision unless new
plans are submitted before the next HDC meeting on May 4, 2005. Copies of the correspondence
should be sent to the Board of County Commissioners and the Maryland Historical Trust,
Ms. Viar made a motion to recommend that the Bowman's property records be "flagged" so if
historic district property tax credits are applied for in the future this issue will arise again.
Seconded by Ms. Izer. Unanimously approved.
Barnes Road Bridge Correspondence
Mr. Goodrich presented a copy (for informational purposes only) of the letter written by Mr. Gary
Rohrer responding to the Washington County Historical Trust's letter of November 5, 2004. This
correspondence is for informational purposes only.
TC-05.001,112 Broadway (Follow-up)
Mr. Goodrich stated that he has contacted Mr. Colin Ingraham of the Maryland Historical Trust
regarding the column replacement issue at 112 Broadway. Mr. Ingraham stated that the trust
believed the columns were going to be replaced "in -kind" and if they had known they were
•
replaced with fiberglass columns, the credit would have been denied. However, sihce this
application was reviewed three years ago, the time limit has passed for the Trust to pursue any
kind of action.

Mr. Goodrich presented information for the Annual State Conference stating that there are funds
available for any member planning to attend.
G. NEW BUSINESS
Demolition Permit #2005-02780, 21101 Twin Springs Drive
Mr. Goodrich presented Demolition Permit #2005-02780 for property located at 21101 Twin
Springs Drive and identified in the Washington County Historic Sites Survey as site #WA -I-095.
When a permit is applied for on a property listed in the Inventory, the application must be
presented to the Historic District Commission for review and comment. If the Historic District
Commission recommends denial of the permit application, it must then be presented to the
Washington County Planning Commission for their review and comment. Mr. Goodrich
introduced Mr. Sandy, the contract purchaser, and Mr. Palmer, owner of the property. Mr. Sandy
presented photographs of the property proposed for demolition and photographs of the houses in
the surrounding area. Mr. Sandy owns and lives in the adjacent property to the east. He plans to
demolish this structure and is proposing to construct a cape cod or a colonial style house on the
property. Mr. Sandy stated that the original logs within the current structure are infested with
termites. No report was available. Mr. Sandy also stated that he has not had the structure
inspected by a structural engineer.
Ms. Izer presented information regarding the history of the structure, which served as Luther
Bett's general store from 1863 until the early 1900's. Ms. Izer and Ms. Stinson recommended
that Mr. Sandy obtain information regarding tax credits for rehabilitation of historic properties.
Mr. Goodrich stated that the County offers a 10% credit on property taxes for any work done on
the outside of the structure according to the Secretary of the Interior's Standards. Maryland
offers a 20% income tax credit for interior and exterior rehabilitation. There are also Federal tax
credits available. In order to receive the County and State tax credit, the property must have the
Historic Preservation zoning. Ms. Stinson volunteered to visit the property with Mr. Palmer to
obtain more information regarding the architectural history and current condition of the structure.
Mr. Gehr suggested selling or donating the historic components of the structure. Commissioner
Nipps stated that Rural Heritage Museum is organizing a Rural Village at the Ag Center using
donations of historic structures.
Ms. Stinson made a motion to recommend denial of the demolition permit based on the
significance of the structure as stated in the Washington County Historic Sites Survey for Site
WA -I-095 and its importance in maintaining the character of the Rural Village of Chewsville.
Mr. Gehr added to the motion that if the demolition permit is issued, the structure should be
documented before it is demolished and all parts should be donated for re -use. Ms. Viar added to
the motion that this recommendation is made based on the lack of significant information to
justify demolition. The motion and its additions were seconded by Ms. Izer. Unanimously
approved.
PC -05-011, Artz Property
Mr. Goodrich presented a preliminary consultation for the Artz property located on Rench Road.
There are inventoried historic structures located on adjacent properties and a forest buffer
between these two properties.
Ms. Izer made a motion to recommend that the planting area between the Artz property and the
former Brethren Church be maintained as a buffer area. Seconded by Mr. Wiles. Unanimously
approved.
DP -05-001 Black Rock PUD Final Development Plan
Mr. Goodrich'presentedthe final development plan for the Black Rock PUD located on the north
side of Mt. Aetna Road. Mr. Goodrich stated that the Snavely Farm houses, previously proposed
for demolition, have been retained on their own lots.
Ms. Stinson made a motion to commend the developer for setting aside the two historic houses on
their own lots for purchase and rehabilitation and to recommend that the existing barn be set aside
on its own lot, Seconded by Ms. Viar. Unanimously approved.

SUMMARY
HISTORIC DISTRICT COMMISSION
June 1, 2005
The Historic District Commission held its regular monthly meeting on Wednesday, June 1, 2005
at 7:00 p.m. in Conference Room 1 of the Washington County Administrative Annex. The
following members were present: Jane Hershey, Sandra Izer and David Wiles. Also present was
County Commissioner Dori Nipps and staff members Stephen T. Goodrich and Debra Eckard.
The following members were absent: Merry Stinson, Eleanor Lakin, Michael Gehr, and Carla
Viar.
Because a quorum was not present a formal meeting could not be held. However, the members
who were present gave their recommendations for the Agenda items that were presented.
Demolition Permit #2005-03008 -13722 Village MM Drive
Mr. Goodrich presented a demolition permit for a barn located at 13722 Village Mill Drive,
located within the Freedom Hills development. The previous owner, Mr. Gene Albert, had a
preliminary consultation for the development of this property several years ago. At that time, the
HDC reviewed the concept plan that showed proposed lot lines going through the existing house
and a road going through the existing barn. The Commission recommended a new lot layout to
retain all of the farm complex buildings on individual parcels so they could be sold and
rehabilitated. Mr. Albert changed the concept plan and put the farm house on a separate lot and
the first phase of the development was started. The property has recently been sold to Mr.
Farhad Memarsadeghi, Admar Custom Homes. The new developer is ready to move forward
with the next phase of development which includes construction of the proposed road through the
barn. The developer is also proposing to demolish the farm house; however, a formal permit
application has not been made.
Comments: Ms. Izer noted that the post and beam construction of the barn is a significant
architectural i feature for structures within Washington County. She would like to see the
proposed plan be revised to retain both the house and the barn.
Ms. Hershey stated her recommendation for denial of the demolition permit.
Mr. Wiles stated his recommendation to save both the house and the barn and to deny the
demolition permit.
Commissioners Nipps stated that the HDC has made recommendations to other developers to
save structures listed on the Historic Register. Numerous developers have restored historic
homes within their developments. She recommended that the developer reconsider renovating
and rehabilitating the structures within this development.
Mr. Goodrich stated that he will present to the Planning Commission, the opinions of the HDC
members present this evening and reiterate the previous recommendation to save the entire farm
complex.
National Register Nomination — Ridenour Farm
Mr. Goodrich presented an application for nomination to the National Register of Historic Places
for the Ridenour Farm located on Hopewell Road.
Ms. Hershey, Ms. Izer, and Mr. Wiles recommended approval of the nomination based on criteria
"c" of the Registration Form which states the following: "Property embodies the distinctive
characteristics of a type, period, or method of construction or represents the work of a master, or
possesses high artistic values, or represents a significant and distinguishable entity whose
components lack individual distinction."

Dear Sir or Madam:
You have applied for a permit to demolish a three story dwelling being used as an office for
Lakeside Park, located at 11111 Lakeview Drive, that is identified in the Washington County Historic Sites
Survey as site # WA -I-370 (a copy of the information is enclosed for your use). In accordance with
Washington County policies, the Historic District Commission (HDC) must have the opportunity to review
and comment on the proposed demolition prior to the permit issuance. The Planning Commission may
also be provided the opportunity to comment if the HDC is opposed to the demolition.
This letter is to inform you that the application has been scheduled on the Historic District
Commission's October 6, 2004 agenda. The meeting begins at 7:00 pm in Conference Room "A" in the
Washington County Administrative Annex Building located at 80 West Baltimore Street in Hagerstown.
You are encouraged to attend. The Commission is likely to have questions regarding the need for
demolition. If you are not able to attend you may provide written material that would explain and support
the need for demolition or send a representative. If the Historic District Commission is opposed to the
demolition it will be necessary for the Planning Commission to review the application also. The next
available meeting is scheduled for November 1, 2004 at 7:00 pm in the same location.

Dear Ms Grandville:
In late September you applied for a permit to demolish the two story brick building that
serves as the offices for Lakeside Mobile Home park. The structure is listed in
Washington County's Historic Resources Inventory as site # WA -I-370. As required by
County policy, the application was referred to the Historic District Commission and
reviewed during its November 3, 2004 meeting.
At that time you provided the Commission with current photographs of the building and
described its current state of disrepair. You mentioned specifically the sagging roof,
holes in the roof, deteriorating chimneys, falling plaster and asbestos in the insulation and
flooring materials. You also mentioned it was the owners intention to remove the
building and install parking in the location and that the office would be established in a
new building elsewhere on the site.
The HDC expressed its concern for the proposed demolition of the structure listed in the
resource inventory with obvious architectural value and an apparent lack of maintenance
that has lead to the current state of disrepair. The Commission unanimously passed a
motion to recommend opposition to the demolition permit.
According to the adopted policy, when the Commission recommends opposition there is
additional review by the Planning Commission. This review has been scheduled for the
Planning Commission's December 6, 2004 meeting to be held in the conference room of
the County Administrative Annex building located at 80 West Baltimore Street in
Hagerstown. The meeting begins at 7 pm. It is advisable that a representative for
Lakeside Partnership be present for the discussion in the event the Planning Commission
may have questions regarding the application.
