ATTACHMENT - ORDINANCE INFORMATION SHEET
1. Have you revised the local Ordinance?
Washington County's Historic Preservation zoning designation, which also creates the
HDC and contains design guidelines applicable within the district, is contained in the County
Zoning Ordinance and was written to comply with Article 66B in effect at that time (Adopted
10/7/86). Additional, but minor, amendments were made 9/22/87 upon advice from MHT in
anticipation of application for CLG approval. CLG designation was approved in 1991.
Washington County is familiar with the 1995 amendments to 66B which need to be
amended into the local ordinance. A proposal for amendment was discussed at several regular
meetings during 1995 and 1996 and met with strong concerns from members with agricultural
backgrounds. Amendments have been delayed but are to be scheduled for public hearing on June
12, 2000 and adopted soon thereafter. Amendments will address four general areas where
Washington County's current ordinance is different due to the '95 amendments to 66B:
1. definitions for appurtenance and environmental setting, district, demolition and
routine maintenance.
2. membership requirements - at the time of adoption in 1986 Washington
County's membership requirements were stricter than 66B by referring to the CLG
membership requirements. The amendment is expected to provide specific criteria for
demonstrated special interest, specific knowledge and professional or academic training.
3. design guidelines - The Washington County ordinance already directs the
Historic District Commission to adopt review guidelines, has pre -1995 66B standards
included and refers to The Secretary's of the Interior's Standards. The difference appears
to be that guidelines are now required and should also include new construction.
4. routine maintenance, farming and landscaping are specifically excluded from
review authority.

Jane Hershey is an active preservation advocate with an extensive list of
appointments to a variety of boards and commissions whose duties and
goals are often preservation oriented. In the Washington County
community her name is synonymous with historic preservation. She is
also the owner of Rose Hill Manor, a National Register listed property.
(P) Charles Highbarger is a retired high school history teacher with a
demonstrated interest in preservation.
Frank Artz is a lifelong farmer and collector of historic artifacts and owner of
historic survey listed properties. He is also a founding member of an
organization that is currently developing an agricultural museum.
(P) Bruce Johnston is a licensed engineer and currently City Engineer for the City
of Hagerstown.
2, The Commission's criteria are included in the adopted by-laws and the Historic
Preservation overlay zone, the ordinance that creates the commission and assigns its powers and
duties. They mirror the CLG membership guidelines that were in effect at the time of CLG
approval in 1990.
3. Three terms expired during this reporting period. Frank Artz, Henry
Bonebrake and Bruce Johnston were reappointed.

Renovators Roundtable II training in June 1999.
Category C
1. This periods CLG project resulted in the completion of National Register nomination
forms the four rural communities of Pen Mar with 50 contributing structures, Fairplay with 22
contributing structures, Tilghmanton with 82 contributing structures and Highfield.
2. New survey forms are kept in the•MHT library, the HDC's offices in the
Washington County Planning Department, The Washington County Public Library, The
Washington County Historical Society library, and where applicable, the Historical Society of the
surveyed town or community. The Planning Department also keeps copies of the Surveys of all
the incorporated towns in the County except Hagerstown. These are also kept at the Public
Library along with copies of all survey forms completed since 1975. The 1975 survey forms kept
at the public library are currently being copied by volunteers in order to have a complete set
located in the County Planning Department and the Historical Society Library. The collections
are protected via the normal security measures used for public buildings and are accessible upon
request of the general public through an employee of that particular location. They are not
available for general circulation. They are most often stored in filing cabinets or in binders on
shelves. They are accessible to the handicapped as the buildings are accessible to the
handicapped. The collections are not in audio form or braille. The collection is indexed
numerically and alphabetically if of a town or recognized village. They may be updated upon the
owners initiative. There is no scheduled for updates although additional survey and site
identification is a form of update.
Category D
1. The HDC meetings are held on the first Wednesday of each month, a date that
is set in the Commission's adopted by-laws which are recorded in the County Court House along
with all other applicable laws for public scrutiny. The meeting is not routinely advertised in any
media. Those having business before the Commission are notified individually, preferably by
letter but frequently, due to time constraints, the notice is by telephone. All public meetings held
in the County Administration Building, including the HDC, are posted in the lobby of the
building. The meeting is open to the public.
3. All meetings are taped. Staff composes minutes from notes and tape following
meeting for presentation at the next available meeting for adoption by HDC. Occasionally, HDC
makes corrections before adoption.
4. Notices to applicants are mailed as soon as possible after receipt of application.
Most often applications are received only a few days before meeting agendas are prepared and a
phone call is more efficient to notify applicant. Most often, the applicant is the only recipient.
On occasion a contractor may be copied. In rare cases another review agency whose requirement
might be affected by Commission action (building permits, floodplain or Planning Commission)
will receive copy of notice or results. All HDC correspondence is kept on file in HDC offices in
the Washington County Planning Department.
5. Applicants are most often present during meeting when decision is made.
Decisions are often in response to a building permit application. These responses are entered
into computerized permit processing and tracking system and which serves as the record of
action on the application. All agencies that are part of the review process have access to the
computerized information. The details are also part of the Commission's minutes. When
applicants want hard copies of responses for their files, copies of computerized information is
provided. On the rare occasions when no permit application is involved, letters are composed
and sent as soon as possible after the meeting when decision is made. (For example tax credit
applications).
6. All are contained in the text of the Historic Preservation Overlay zone as part
of the Zoning Ordinance, adopted by-laws or Tax Credit Ordinance. They are all on file with
"Acts, Ordinances and Resolutions" recorded in the County Court House. Also available from
staff at HDC offices upon request.
Category E
3. All 3 applications were considered at the same Historic District Commission meeting.
All 3 were also considered at the same County Commissioner's meeting. It took 2 meetings to
complete the local review of the applications.
Part II
Category A
2. The HDC has an annual operating budget funded by appropriation from the County's
general fund by the Board of County Commissioners. CLG funds are applied for and
approved/not approved on a yearly basis for specific projects that are not operating costs. Staff
salaries are not part of the HDC budget. Staff also has responsibilities to the Planning
Department and Commission that fund salaries. Large expenditures, such as for training and
CLG projects, are first approved by the HDC. Routine expenditure such as memberships,
supplies or reimbursement of travel expenses are handled by staff. Staff also approves payment
of invoices from consultants performing CLG projects. New memberships would be approved
by HDC first and then renewed routinely by staff.
A budget summary for the reporting period in the form of the 13th month report
indicating total budget for each line item and expenditures is enclosed.
Category B
1. The FY -98-99 CLG project was Phase II of the Rural Community Survey. Its purpose
was to summarize and document the development history of the rural communities of Pen Mar,
Highfield/Cascade, Fairplay and Tilghmanton and distinguish between contributing and non-
contributing structures within a defined community boundary. The project generated four
National Register nomination forms, one for each community, including photographs and a
summary report. The project is determined to be successful as it was completed within the
budget, on time and produced the information desired which will be very useful in Washington
County's future planning activities.

July Meeting
There aren't any applications that need Commission action this month so the July
meeting is canceled. There are a few items that you need to be informed about.
A. I've heard unofficially that our CLG project, Phase II of the Rural Community
Survey, was approved by MHT. I have also received the Commission's approved budget for
next year. The County Commissioners did not approve the increases as submitted. Next year's
budget is exactly the same as this year. There was no increase for the CLG project nor was
anything approved in the Tuition Assistance line item. The requested and approved versions are
enclosed for your review. We won't be able to pursue Phase II as originally submitted or
(unofficially) approved due to the reduction in the budget request for the project. It will need to
be scaled back. When I receive "official" word from the MHT the commission will need to
review the project for adjustments.
B. You may recall that I also submitted a long range strategic plan to the County
Commissioners for the HDC. You discussed and approved the proposal during the April
meeting. I am enclosing a copy of what I submitted for the HDC and a copy of what appears in a
draft of the version of the Washington County, MD Long Range Strategic Operating
Summary FY 1999 - 2004.
C. The brochure from the National Preservation Institute is enclosed because it includes
many applicable seminars for Commission members or staff. In the future I may ask you to
approve funds to attend one or several.
D. We've received a complimentary copy of the book History on the Line as a benefit
of membership in the National Trust for Historic Preservation. I'll keep it in the "Preservation
Library" for anyone who wants to borrow it.
E. I think the letter from the Funkstown Planning Commission is self explanatory. I
need to arrange a meeting with a representative to review their standards. There is the potential
for this to generate more tax credit applications.

A & B CALL TO ORDER AND ROLL CALL
The regular monthly meeting of the Historic District Commission was called to order by
Chairman Richard Bachtell at 7:00 p.m. on August 5, 1998 in the first floor conference room of
the Washington County Administration Building in Hagerstown, Maryland. Members present
were Charles Highbarger, Jane Hershey, Michael Gehr, Henry Bonebrake, Frank Artz and Bruce
Johnston. Planning staff member Steve Goodrich and secretary Beth Shifler were also present.
County Commissioner John Shank were absent.
C MINUTES - January & April, 1998
Steve Goodrich distributed minutes from the January and April meetings. Charles
Highbarger made a motion to approve the minutes which was seconded by Jane Hershey. The
motion was unanimously approved.

1. Rural Community Survey Phase II
was advised that the Maryland Historical Trust has
maximum amount available from the State based ,c project total cost estimated at $ 20,00
and -a 60/40 matching ratio., The Commission's budget contains $ 4,940 approved by the Board
of County Commissioners for the project (reduced from the requested $ 8,000). Phase II has

been approved and the project is planned to start in September. The communities proposed to be
surveyed, in order of preference, are Pen Mar/ Highfield/ Cascade and Fairplay/Tilghmanton.
2. Funkstown Historic District Zoning
Members were informed that Funkstown has created a historic district and contacted
Steve Goodrich for information regarding the relationship between the district , the County's
HDC and property tax credits. Steve noted that he has not yet spoken with the Funkstown
Commission members. He suggested that meeting with them and/or attending one of their
meetings would be a good first step. No action was taken.
G NEW BUSINESS
1. Rural Community Survey Phase III for FY 99-2000
The application deadlines for CLG projects is approaching and the FY '99 project needs
to be discussed. Steve Goodrich izresented a proposal to�aY� phase II,Io f the Rural Commute
Survey focus on the Hopewell_V_alley/Newgate.planned industrial area. During some of the
initial area analysis the Maryland Historical Trust has expressed concern for the effect of large
scale development on remaining historical resources of a potential rural community in the area.
The MHT has said in correspondence (included in the agenda) that it wants an analysis of
whether there was, in fact, a rural agricultural community in the area prior to approval of
additional State funding of development. The Historic District Commission requested more
information and was interested specifically in why the County rather than a developer would
fund a study. Jane Hershey made a motion to table the matter of selecting areas for Phase III
until further information is available. Bruce Johnston seconded the motion. The motion was
unanimously approved by the Commission.
2. Training Opportunities
A grant was approved for the HDC to obtain CLG approved training. The Commission
members discussed training options and would like to continue the second part of the
Renovator's Roundtable slide show to meet the CLG training requirements.
3. New member suggestions
Commission members Frank Artz and Henry Bonebrake indicated their interest in
reappointment.

H OTHER BUSINESS
1. The Long Range Strategic Plan and Budget
Commissioner members were reminded that they had approved a concept for a Long
Range Strategic plan in the early part of 1998. It proposed that the HDC be more aggressive and
pro -active in all aspects of preservation activity including community education, incentives and
districts, advising government and full time staff. Steve Goodrich prepared a formal plan which
was submitted to the County Commissioners for inclusion in the County's Long Range Strategic
Plan and also included a proposed budget to implement the Plan. The HDC was provided a copy
of the version that appeared in the draft of the County's Strategic Plan which does not include
any of the increased activity as proposed. The Plan shows the Commission maintaining the
status quo with a static budget. Members were reminded that the long range planning effort is
expected to be evaluated on a yearly basis at the same time that budgets are prepared.

September Meeting
There isn't any business that requires the Commission's attention this month. The
September meeting is canceled.
There are a few items enclosed for your information. During the August meeting I
suggested that the next area to be considered for rural community survey work be the one that is
proposed for industrial development between Hopewell Road and MD Rt 63. MHT has
requested the analysis prior to any further funding of development in the area. The Commission
had many questions about the proposal. Bob Arch has agreed to attend a meeting, probably
October's, to explain the proposal in more detail.

The regular monthly meeting of the Historic District Commission was called to order by
Chairman Richard Bachtell at 7:00 p.m. on October 7, 1998 in the first floor conference room of
the Washington County Administration Building in Hagerstown, Maryland. Members present
were Charles Highbarger, Jane Hershey, Michael Gehr, Bruce Johnston and Frank Artz.
Planning staff member Steve Goodrich and County Commissioner John Shank were also present.

seconded the motion. The motion was unanimously approved.

3. St. Mark's Episcopal Church National Register Application
Karl Sanford and Mr. Boyd were in attendance representing the Church and to answer
questions for the Commission. Mr. Sanford explained the history of St. Mark's congregation, its
relationship to St. James School and the design and construction of the building. He noted the
building remains largely in -tact, even with the sacristy addition, which is in the same style and
designed to not disturb the original fabric. Following a brief discussion, Henry Bonebrake made
a motion to recommend nomination of St. Mark's Episcopal Church for listing in the National
Register of Historic Places under Criterion C, noting that the property derives its primary
significance from being an intact and representative example of "frontier" Gothic architecture
without regard for the religious doctrine practiced within the building, addressing criteria
consideration A. Frank Artz seconded the motion. The motion to recommend nomination was
unanimously approved.
4. Rural Community Survey Phase III - application
Steve Goodrich explained the included one page "Cover Sheet" of the application for
CLG funding of Phase III of the Rural Community Survey, the same project discussed in the FY
2000 budget request. The sheet was provided for information.
5. Demolition Permits - #98-9628 -10426

Mr. Ted Weaver was in attendance representing Sharpsburg Pike LLC. The property is
south of Colonel Douglas Drive and the I-70/MD 65 interchange. There are four structures
scheduled to be demolished for construction of a Cracker Barrel and Waffle House restaurants
and a motel. Two are identified in the Historic Sites Survey as sites WA -I-499 & 500. The
properties are not occupied. The zoning on this property HI -1. Michael Gehr made a motion to
recommend no objection to the demolition permits based on the opinion that there is no
significant architectural value in the buildings and that they are typical of many others found
elsewhere and in better repair in the community. Frank Artz seconded the motion. Unanimously
approved.

staff member Steve Goodrich at 7:00 p.m. on February 3, 1999 in the first floor conference room
of the Washington County Administration Building in Hagerstown, Maryland. Members present
were Bruce Johnston, Michael Gehr, Henry Bonebrake, Frank Artz, Jane Hershey and Charles
Highbarger. Also in attendance was County Commissioner William Wivell. Chairman Richard

1. Rural Community Survey, Phase III - Hopewell Valley Economic Development Area
(FY `99- '00 CLG application)
A copy of the complete application that was due to the Maryland Historic Trust on
January 29, 1999 was provided to the Commission. There was a brief discussion on the
submitted application but no further action was necessary since the project was approved
previously.
G. NEW BUSINESS
1. Demolition Permit -#98-9990-14735 Citicorp Drive (Kammerer house -site #WA -I-013)
#98-9991-14735 Citicorp Drive (related barn to Kammerer house)
Merle Elliott, representing the Hagerstown -Washington County Industrial Foundation,
the owner of the property, was present to discuss the application for demolition of the Kammerer
house and a possibly related barn. Mr. Elliott stated that the property is in a significant state of
disrepair and that CHIEF has made numerous attempts to secure a party or organization to
purchase the house and barn. The contractor, Allegheny Wrecking, is ready to complete the
demolition of both the house and barn. Several questions were asked by the members of the
Commission and also Merry Stinson in the audience regarding the need to remove the house and
the plans for use of the site that require it to be demolished. Mr. Elliott said that removal of the
house was a condition of an existing contract of sale between the Foundation and Citicorp. He
also revealed that Citicorp was agreeable to having the house relocated to the "rear" portion of
the site, nearest US Rt.. 11. The Foundation has hired Architectural Historian Paula Reed to
record the house before and during the disassembly.
Following additional brief discussion, Bruce Johnston made a motion that the
Commission present no opposition to approval of permit #98-9991 for demolition of the barn
because there appears to be no documented relationship with the Kammerer house and because it
has already been significantly altered. Michael Gehr seconded the motion. The motion was
unanimously approved.
Frank Artz made a motion that the Commission be opposed to the demolition permit for
the dwelling. Jane Hershey seconded the motion. There was a significant amount of discussion
on the motion including the lack of planning prior to this point, the difficulties of converting the
structure for a useful and business related purpose, the uncertainty of the ability of any individual

or group to rehabilitate the structure or to obtain funds for rehabilitation, the negative impacts of
moving the structure, the pre existing agreement between Citicorp and the Foundation and all of
the unsuccessful efforts to retain the building to date that Mr. Elliott enumerated. Upon a vote,
the motion failed with Frank Artz and Jane Hershey in favor and Bruce Johnston, Michael Gehr,
Henry Bonebrake and Charles Highbarger opposed. Richard Bachtell abstained as he was not
present for the full discussion.
Bruce Johnston made the motion that the Commission present no objection to demolition
permit # 98-9990. Charles Highbarger seconded the motion. Michael Gehr offered an
amendment to the motion to include documentation of the building before and during the
demolition, which was accepted. The motion was approved with Johnston, Gehr, Bonebrake and
Highbarger voting in favor and Artz and Hershey opposed.
There was a significant amount of discussion following action on the permits including
the lack of effect of the policy and suggestions for additional efforts to protect historic structures.
There was general consensus that the efforts to "save " structures should begin long before they
are threatened.

the meeting was adjourned at 9:00 p.m.

1. National Register nomination - Johann Ludwig Kammerer house
The presentation began with a reminder of the HDC's role in the process due to the status as a
Certified Local Government. The applications are received from the MHT and the HDC and County
Commissioners are to provide the local review. The Commission members have been supplied with the
guidance manual known as Bulletin #15 HOW TO APPLY THE NATIONAL REGISTER CRITERIA FOR
EVALUATION. Merle Elliott, representing property owner Hagerstown/Washington County Industrial
Foundation, was present and indicated he neither supported or opposed the application. Applicant Laura
Lutz, a Kammerer descendant and Middleburg/State Line Historical Society member, was unable to attend
the meeting. Merry Stinson and Pat Schooley were in attendance to represent the application and Laura
Lutz. The Kammerer house is proposed for listing in the National Register because of its significance
under Criteria B (association with the lives of significant persons), Criteria C (Architectural/design
significance) & Criteria D (information potential). Merry Stinson provided a brief synopsis noting that the
house is a rare, surviving, intact and dated example of colonial architecture reflecting German stone
building traditions. Kammerer participated in the establishment of European settlements on the Maryland
frontier and arrived from Europe on the same ship as Jonathan Hager. The applicant also believes there is
great potential for the site and graveyard to yield useful information about the past.

Pat Schooley stated that the County Commissioners are making an effort to save this house from
Citicorp's requirement that it be removed before it acquires the property and have presented a proposal to
Citicorp for the building's retention. The County would assume ownership and the responsibility for the
property. The rent would be one dollar a year to the Middleburg/State Line Historical Society. Under this
proposal it would be the responsibility of the Historical Society to secure funds for restoration and the
National Register listing would be a key to that effort.
Commission members were also provided pictures of the property. Following brief additional
discussion of the status of the plan and the demolition permit, Bruce Johnston made a motion to
recommend listing of the Kammerer house in the National Register of Historic Places because it qualifies
under criteria B, C and D. Jane Hershey seconded the motion. The motion was unanimously approved.
Merle Elliott reserved the right as the owner to oppose the application before it reaches the
Governor's Consulting Committee.
2. National Register nomination - Piper House
Merry Stinson was in attendance representing the owners, Mr. and Mrs. John Ray, who were also
present. The application proposes listing in the National Register under Criteria C, the architectural/design
criteria. Ms. Stinson described the building mentioning many original features that remain and noted that it
displays original architectural features from three distinct construction periods and styles.
Charles Highbarger made a motion which was seconded by Henry Bonebrake to recommend listing
of the Piper House in the National Register of Historic Places because it meets Criteria C. The motion was
approved unanimously.
3. Mike Yeakle - 11451 Charles Mill Road (WA -V-037)
Steve Goodrich explained that Mr. Yeakle has a contract to purchase the subject property which is
located in the floodplain. The Floodplain Management Ordinance limits the amount of improvements that
can be made to existing structures in the floodplain. Historic structures are an exception as long as the
improvements do not negate the historic integrity of the property. Mr.
Yeakle is requesting that the HDC evaluate his proposal to improve the building at 11451 Charles Mill
Road which is listed in the County's Historic Sites Inventory as site # WA -V-037 and described as a former
distillery and determine if the integrity will be retained. He does not plan to purchase the building if it
cannot be renovated for reuse. Mr. Yeakle provided photographs of the Charles Mill Road property as well
as before and after photos of his current residence at 13672 Clear Spring Road. It is listed in the survey as
site #WA -V-093 and was also in a severe state of disrepair and damaged by fire. The pictures showed his
renovations and attempt to retain the historic fabric. Bruce Johnston made a motion to advise the applicant
and the Department of Permits and Inspections that although specific improvements have not
been enumerated the Commission is comfortable that Mr. Yeakle's plans for renovation of the Charles Mill
Road structure, if in the same manner as those to his current residence shown in the photographs provided,
would retain the historic integrity of the building. Michael Gehr seconded the motion. The motion was
unanimously approved.

H. OTHER BUSINESS
A discussion developed regarding information Mrs. Schooley provided to the Commission earlier
in the meeting indicating a survey listed log house (WA -I-178) at 19933 Mt. Aetna Road was demolished
prior to review of the permit by the Commission or issuance of the permit by the Permits Department.
During the discussion the Commission expressed extreme concern and frustration for the current incident
and the general lack of means to prevent or delay the needless loss of historic structures. The discussion
ended with consensus that a letter to the Board of County Commissioners should be drafted requesting
appropriate action regarding the unpermitted demolition and the opportunity to discuss the larger issue of
preservation.

Washington County Administration Building in Hagerstown, Maryland. Members present were

were Bruce Johnston and County Commissioner William Wivell. Planning staff members Steve
Goodrich and Beth Shifler were also present.
C. MINUTES
Charles Highbarger noted that the February, 1999 minutes indicate he was neither absent
or present, when in fact he was present. He is noted as voting on several motions later in the
meeting. It was also noted that Henry Bonebrake was present at the February meeting but his
participation in the voting regarding Demolition permit # 98-9990 is not indicated. Jane Hershey
made a motion to approve the February minutes with the noted changes and the March minutes
as presented. Michael Gehr seconded the motion. The motion was unanimously approved. (The
text of the February 1999 minutes has been revised accordingly.)

1. Historical Marker status
Commission members were informed of the status of the installation of historical markers
at various locations. Steve Goodrich reported that 37 of the 40 markers received have been
installed. Members were provided with a comprehensive list.

2. Rural Community Survey Phase II status
The consultant selection and bidding process has been concluded for the project and the
contract has been awarded to the firm of Taylor & Taylor from Brookville, Pennsylvania. There
were only two bidders and less than $1,000 difference in the bids. The project will begin
immediately.
3. Draft letter to Board of County Commissioners
Steve Goodrich presented a draft of a letter to the Board of County Commissioners
stating the Commissions concerns regarding the demolition of the Mt Aetna Road house ,
demolition permit policy and the County's philosophy of preservation in general. The resulting
discussion revealed members did not feel the letter was forceful enough and did not make its
concerns clear. By consensus the members agreed they would review the draft further and come
to the next meeting with suggestions for a new draft.

1. Demolition permit #99-01179 - 19933 Mt. Aetna Road (WA -I-178)
The structure was demolished before the HDC could review the demolition permit. The
matter was placed on the agenda in order to provide the members the survey information about
the building and a copy of the permit application. There was discussion about proper application
of the permit review policy and procedures and whether the information on the application was
correct or misleading but the Commission concluded no further action would be useful.
2. Demolition permit #99-01496 -21659 Leitersburg/Smithsburg Road (WA -I-200)
Further information and review after the item was listed on the agenda indicates that
Commission review is not necessary. The demolition is to remove a modem concrete block
structure but to retain an original stone foundation and brick chimney to be included in new
construction. No further action was necessary.
3. Demolition permit #99-01755 - 17046 Snyder's Landing Road (WA -II -461)
Further information and review after the item was listed on the agenda indicates that
Commission review is not necessary. It has been determined that a 1978 chicken house will be
demolished and not any survey listed properties. No further action was necessary.
4. Subdivision Plat #S-99-013 - Lot 1, for the estate of James Stoner
This subdivision plat containing a survey listed complex of buildings was provided for
Commission information. No action was necessary in light of no indication of demolition.

5. Forum - "PRESERVATION AND PROGRESS"
Members were informed of the genesis of the meeting and encouraged to attend. It is
expected that the information generated from public input will be useful in future commission
planning activities.
6. Letter of support - Hancock Tollhouse restoration project
Steve Goodrich asked if the Commission would provide a letter of support for a grant
application from the Town of Hancock to the Maryland Historical Trust to restore a National
Road Tollhouse near Hancock. The request came from Joe Kuhna, Community Development
Specialist in the Planning Department who is coordinating the application. Jane Hershey made a
motion to provide a letter of support for the project. Charles Highbarger seconded the motion.
The motion was unanimously approved.
7. Permits Department handout.

The regular monthly meeting of the Historic District Commission was called to order by
Staff member Steve Goodrich at 7:05p.m. on May 12,1999 in the first floor conference room of
the Washington County Administration Building in Hagerstown, Maryland. Members present
were Charles Highbarger, Frank Artz, Jane Hershey and Bruce Johnston. Michael Gehr arrived
at 7.30. Absent were Chairman Richard Bachtell, Henry Bonebrake, County Commissioner
William Wivell, and secretary Beth Shifler.

Steve Goodrich reported that the County Commissioners approved the budget for FY2000
as submitted.
F. UNFINISHED BUSINESS
1. Draft letter to Board of County Commissioners
Steve Goodrich presented a draft of a letter the HDC requested that he prepare expressing
concerns regarding recent demolitions and poor communication. Michael Gehr made a motion
to table this item until the June meeting. Jane Hershey seconded the motion. The motion was
unanimously approved.

1. National Register nomination - Good -Hartle Farm
Merry Stinson prepared the application for the owners, the Wagners, and was present to
answer questions. The Wagners were not in attendance. The application was submitted for
consideration under Criteria C, the design/construction criterion. Merry Stinson briefly described
the structure. Following discussion Jane Hershey made a motion to recommended listing in the
National Register of Historic Places because the main dwelling retains much of its original
fabric, is a rare example of log construction from Washington County's settlement period and is
an example of improvements, construction techniques and materials typical of the agricultural
community of the various periods. Charles Highbarger seconded the motion. The motion was
unanimously approved.
2. Permit #99-02486 - 5403 Mt. Briar Road (improvements to survey structure in
floodplain)
Mr. and Mrs. Madden, the owners, were in attendance to answer questions for the
Commission. The house is located in a floodplain. The County's Floodplain Management
Ordinance limits the amount of improvement that can be made to structures in the floodplain
except when considered historic and the proposed improvements will not negate the historic
designation. The house is listed in the County's Historic Survey as site number is WA- II -270.
The Maddens propose to add a porch to the house. The Commission had drawings of the
proposed addition and photographs of the dwelling at the time of the survey and its current
appearance. Bruce Johnston made a motion that the Commission's opinion should be that the
proposed porch addition will not have an adverse impact on the historic significance of the
structure or site. The motion was seconded by Charles Highbarger. The motion is unanimously
approved.
Demolition permit #99-02553 -14735 Citicorp Drive (Smokehouse on Kammerer
house site WA -I-013)
The Commission briefly discussed the issue of grave sites on the property as presented in
two pieces of correspondence. Bruce Johnston made a motion to present no opposition to
issuance of the demolition permit based on the lack of concete evidence of existing gravesites
and a recommendation that an effort be made to find a suitable location, such as the Agricultural
Education Center, where the building could be reconstructed. Frank Artz seconded the motion.
The motion was unanimously approved.
4. Demolition permits #99-02773, 02774, 02775 -19619 Cresap Drive (WA -I-198)

proposing
to remove the two dwellings

spring house so they can build a new home. Mr. Perini spoke to the Commission of the various
efforts made to retain the buildings. He said that at one time they had planned to construct a new
home nearby on the parcel. Additional refinement of the plan revealed that the location of the
existing structure was the best location for the new home and therefor the need to have it
removed. He investigated the option of rehabilitating the existing structure but felt it was too
expensive. There was also uncertainty about restoration in light of the advanced deterioration.
He also said retaining the structures on the site presented a safety issue. He said he has also
offered to allow salvage of the materials and requested input from the local historical society and
the Maryland Historical Trust. Charles Highbarger made a motion to present no opposition to all
three demolitions . Bruce Johnston seconded the motion noting the owners analysis of the
rehabilitation feasibility, safety concerns and salvage offers. The motion was approved with
Charles Highbarger and Bruce Johnston voting in favor, Frank Artz and Jane Hershey opposed
and Michael Gehr abstaining due to his late arrival.
5. RZ-99-007 - HP overlay zone (Larry and Pat Younker, 15435 Dellinger Road)
Mr. and Mrs Younker have submitted a rezoning application for approval of the Historic
Preservation overlay zone. This property is on Dellinger Road and the Commission recently
recommended listing Cedar Grove in the National Register of Historic Places. Jane Hershey
made a motion to recommend the HP Overlay on Cedar Grove. The motion was seconded by
Michael Gehr and unanimously approved.
6. RZ-99-009 - HP overlay zone (Todd and Tracey Bowman, 7661 Dam #4 Road)
Mr. and Mrs Bowman have also submitted a rezoning application for approval of the
Historic Preservation overlay zone. The property is located at 7661 Dam #4 Road and is known
as Woodburn or Woburn. Information submitted with the application indicates the property's
association with former Washington County Circuit Court Judge Thomas Buchanan and an
unusually fine design for a rural area dating to the early 19th century. Jane Hershey made a
motion to recommend approval of the Historic Preservation Overlay for the property. Bruce
Johnston seconded the motion. The motion was unanimously approved.
It was noted that the Bowmans have clearly stated their intention to pursue the HP
Overlay in order to be eligible for the property tax credits for restoration. Mr. & Mrs. Bowman
plan to start renovations before the HP Overlay decision is made. There is the potential for a lot
of work to be completed before the HP Overlay is applied and therefore not subject to the HDC
review. Staff is waiting to hear from Richard Douglas, County Attorney, regarding the
Bowmans eligibility for credits for work completed prior to the HP zone approval. (At a later
date Attorney Douglas determined that there was no prohibition to allowing credit for work
started prior to the HP designation as long as it is in place at the time of the application for tax
credits and the work is determined to meet the applicable standards at that time. This mirrors the
State's position.)

7. Demolition Permit #99-03058, 17816 Rench Road (WA -I-1263)
Frank Artz stepped down as a Commission member for the duration of this discussion as
he is also the applicant. He described the structure as "sitting in the middle of the field" and
noted it may have formally been a tenant house to his farm. He said it was his plan to
disassemble the structure to move and reassemble at the Ag Center. Bruce Johnston made a
motion to not oppose the demolition based upon the proposal for reconstruction. Charles
Highbarger seconded the motion. The motion was unanimously approved. Frank Artz abstained.

F UNFINISHED BUSINESS
1. Rural Community Survey Phase II- status
The Commission was informed that the contract with the Maryland Historical Trust to
secure the funding for the CLG project has been signed. Following a field visit, Trust staff has
suggested revisions to the project to prepare separate survey forms for each of the communities
of Fairplay, Tilghmanton and Pen Mar. Cascade and Highfield will be combined into one
survey form. The results are four forms instead of two and an expected more complete analysis
of each community. The end products are expected to be more useful to all interested parties. A
draft of the Request for Proposal is under development by the Purchasing Department. By
consensus the Commission endorsed the modification to the project format.
G NEW BUSINESS
1. MAHDC Handbook and Tax Credit Manual
The Commission was advised of the receipt of a completely revised Handbook from the
Maryland Association of Historic District Commissions which now includes a manual on a
variety of tax credits and other preservation incentives. Steve Goodrich indicated it appeared tc
be very informative and provided each member with a copy in the agenda. The manual is
available in the Planning Department.
2. Cedar Grove National Register application
Mr. and Mrs. Younker and Paula Reed were in attendance to answer questions for the
Commission. Paula Reed gave a brief description of the property highlighting the detailed
description, significance statement and justifications contained in the application. Cedar Grove
is located on Dellinger Road, south of Williamsport. Following a brief discussion and questions,
Frank Artz recommended that Cedar Grove be nominated for listing in the National Register
under Criteria A & C. Since the original log structure dates to the early settlement period of
Washington County and its changes over time are in -tact, the structure can illustrate important
events in the County's history as well as serve as a record of building traditions and refinements
through the various additions to the structure. Michael Gehr seconded the motion to recommend
nomination. The motion was unanimously approved.

Members were informed of the recent reappointment of Frank Artz, Bruce Johnston and
Henry Bonebrake. It was noted that the County Commissioners apparently honored the HDC's
request to waive its two term limit policy when reappointing Henry Bonebrake.
E BUDGET
1. FY 2000 budget proposal (distributed during meeting)
Steve Goodrich explained that budget requests for FY 2000 are due in the Office of
Budget and Finance by January 29. The proposed budget requests the same level of funding in
all budget line items with two exceptions. The TUITION line item is proposed to include $400
to cover the CLG mandatory training requirement. No funds were approved in this category by
the County Commissioners in the current budget. Next year's CLG project, Phase III of the
Rural Community Survey, is proposed to be funded with $10,000 in the HDC budget and a total
project estimated cost of $32,500, including CLG matching funds. The Commission approved
the project in November of 1998. After a brief discussion, including mention of the Long Range

2. Rural Community Survey Phase III - Bob Arch
Bob Arch, Director of Planning & Community Development attended the meeting to
explain in more detail the request to designate the Hopewell Valley and Ne......industrial . area,
as the focus of Phase III of the Rural Community Survey. After explaining the general
development proposal and activity to date Mr. Arch explained that the Maryland Historical Trust
has requested that the area be evaluated before further development to determine if a rural
agricultural community did or still does exist. Mr. Arch explained that it would be beneficial to
have the report completed prior to future development proposals so that mitigation could be
included and also because the County is in the unique position of being able to cause the entire
area to be studied instead of in a piecemeal manner. Jane Hershey made a motion to designate
the Hopewell Valley/Newgate area as the.focus of the Commission's FY 99 CL.r project Rural
Community Survey Phase III, to, include a determination of the existence of a Rural, Agriculture
Community. Frank Artz seconded the motion The motion was unanimously approved.
G NEW BUSINESS
1. Permit #98-7138 - David Wyand (carport enclosure in the AO -1 zone)
The Wyands were in attendance to answer any questions for the Historic District
Commission. The Wyand's permit application is to convert a carport into a dining room. The
Commission received scale drawings of the proposed work which is located in the Antietam
Overlay Zone. The Commission's authority extends to the exterior appearance of the structure.
After a brief discussion Frank Artz made a motion to approve the application because it is
consistent with the existing building and the Conunission's design review standards contained in
the Zoning Ordinance. Charles Highbarger seconded the motion. The motion was unanimously
approved.

A & B CALL TO ORDER AND ROLL CALL
The regular monthly meeting of the Historic District Commission was called to order by
Chairman Richard Bachtell at 7:00 p.m. on June 2, 1999 in the third floor conference room of
the Washington County Administration Building in Hagerstown, Maryland. Members present
were Henry Bonebrake, Frank Artz, Jane Hershey and staff member Steve Goodrich. Michael
Gehr arrived at 7:30 pm. Absent were Charles Highbarger, secretary Beth Shifler and County
Commissioner Bill Wivell.

1. Draft letter to Board of County Commissioners
The item was deferred from the previous meeting. Members intended to review the draft
that was presented during the May meeting and provide recommendations for additional
revisions. The item was again deferred because all members were not present for the discussion.

3768 Harper's Ferry Road (improvements to survey structure in floodplain)
Jerry Otzelberger, the property owner, and Wayne McCrossin were in attendance to
further explain the proposal and answer questions for the Commission. Bill Spinrad from the
C & O Canal NHP was also in attendance. Mr. Otzelberger's plan is to restore the structure,
referred to in the Historic Sites Survey material that was provided in the agenda as the Antietam
Village store, to its original appearance. He mentioned that there is a picture of the structure
hanging in the County Court House that shows the appearance of the structure as he intends to

restore it. A portion of the structure is located in the floodplain according to floodplain maps
and a review by the Permits and Inspections Department. The Floodplain Management
Ordinance does not permit significant improvements to structures in the floodplain unless they
are considered historic and the proposed improvements will not detract from the historical
significance. Mr. Otzelberger is before the Commission for a determination that his proposal
will not detract from the historical significance of the building. He brought pictures of some
work that has already occurred showing a new metal roof and some site grading. He again stated
his intention to restore the building to its original appearance as shown in the Court house picture
and mentioned that they had already stabilized the building to prevent further deterioration, that
he intended to use "ghost" marks on the building as a guide to porch replacements and that they
also intended to save a barn, blacksmith shop, corn crib and outhouse.
Henry Bonebrake made the motion to determine that the proposed renovation as
described by the applicant would not significantly alter the historical significance of the
structures including the new roof that has already been replaced. The motion carried the
stipulation that building features are repaired rather than replaced whenever possible and that the
project utilize like material and design throughout. Replacement window sash installed in the
remaining existing frames are included in the motion also. Frank Artz seconded the motion. The
motion was unanimously approved. Michael Gehr abstained from voting because he was not
present for the entire discussion.
2. TRAINING- RENOVATORS ROUNDTABLE II
The remainder of the meeting was devoted to viewing Renovators Roundtable II slide
presentation to meet their training requirements for the year. The sessions were titled
Architectural Character: What is it?, What to Preserve: Settings, fences, gates and porches, What
to Preserve: Windows, and Choosing and Using Design and Construction Professionals.
ADJOURNMENT
The meeting adjourned at 9:30 pm.

Register program as the State Historic Preservation Officer for Maryland. If both the Historic District Commission
and the County Commissioners oppose the nomination, the process will stop unless an appeal is filed with the keeper

The Good -Hartle Farm is recommended for listing in the National Register becausel
it qualifies under Criteria C as a property with historical significance due to its
physical design and construction. The main dwelling is a rare example of log
construction from Washington County's early settlement period (1760's). The addition
of the stone section has allowed the log portion to survive and provide examples of
several construction techniques and materials from the period. The building as a
whole reflects typical changes and improvements made by moderately successful farming
families of the different periods. It is an unusual form for Washington County and
contains many intact examples of period features including an insulated puncheon floo_:
interior moldings and original weatherboard siding. The structures retain sufficient
integrity to allow them to convey their significance.

Washington County has a strong tradition of stone dwelling construction generally
occurring between 1760 - 1840 and heavily influenced by German settlers migrating
south through the Cumberland Valley from Pennsylvania. The Clagett farm is
recommended for National Register listing because it displays design and building
techniques unique to this area and are evidence of the less frequently found
influence of English cultural and building traditions from tidewater Maryland,
Frederick County and northern Virginia. The dwelling is able to convey the
significance of its design and cultural influence due to the high degree of integrity
of the original design and materials.

What Prepare documentation for the communities of Pen Mar/Highfieid/Cascade and Fairplay/Tilghmanton to
National Register standards and intensive level documentation for approximately 8 historic sites and cultural
resources within those communities.

Based on a review of the application, proposal narrative, and the supporting documentation contained in
the application, it has been determined that the proposed HPF project, CLG Educational Set Aside
Program, meets the criteria for categorical exclusion listed in NPS 49, Chapter 11, Section A.4.a(6,11);
b(9); e(5,6,9); and f(2) under 516 DM 6.

Be CERTIFICATION: As the duly authorized representative, I certify that this subgrant will be administered, and work
will be performed under the supervision of a professional meeting appropriate 36 CFR 61 requirements, in accordance with
the Historic Preservation Fund Grants Manual, and the Secretary of the Interior's "Standards and Guidelines for
Identification, Evaluation, and Registration." All documentation required by the Historic Preservation Fund Grants Manual
will be maintained on file for audit and State Program Review purposes. All proposed costs for personal compensation
charged to the Federal or nonfederal share of this subgrant are within the maximum limit Imposed by Chapter 13, Section
B. 34.e. of NPS-49. These costs have been assessed by knowledgeable SHPO staff and found to be within the normal
and customary range of charges for similar work in the local labor market, and appear to be appropriate charges for the
product to be achieved with gra ssistance.

Dear Ms. Cohen:
This is the fifth and final Progress Report for Washington County's FFY 1998 Certified Local
Government project, Rural Community Survey. Phase II (Pen Mar. Highfield/Cascade Fair}plav and
Tilehmanton) covering the period of June and July 1999.
The consultant, David L. Taylor of Taylor and Taylor Associates, submitted draft versions of
the National Register nomination forms on June 15, as scheduled in the project documents. These
drafts were reviewed by MHT and County staff who provided review comments by June 28. The
finished product, including National Register nomination forms (with pictures and proposed
boundaries), slides (to the Trust), contributing building property owner names and address lists and a
Final Project Report were received on July 30 as required by the contract. Although some additional
minor revisions have been requested of the consultant, the forms and report meet the substantive
requirements of the project which is considered complete. Peter Kurtze is in possession of the MHT's
copies of the final product.
The consultant has been paid the full contracted amount of $ 16,250.00. The project cost a
total of $20,410.49 which includes the cash payment to the consultant and $4,160.49 in contributed in -
kind services by County personnel which are documented in attachments to this report. The request for
reimbursement is in the amount of $ 12,000.00, the maximum permitted by our contract even though
60% of project costs exceed that amount.
