Part I, Category A
2. The Secretary of the Interior's Standards and Guidelines for Rehabilitation are
the HDC's adopted standards.
Category B

(P) Michael Gehr is a licensed Architect with experience with historic buildings
(P) Henry Bonebrake is a licensed Engineer and an owner of a historic survey
listed property
Richard Bachtell is a licensed home improvement contractor and owner of a
historic survey listed property
Jane Hershey is an active preservation advocate with an extensive list of
appointments to a variety of boards and commissions whose duties and
goals are often preservation oriented. In the Washington County
community her name is synonymous with historic preservation. She is
also the owner of Rose Hill Manor, a National Register listed property.
(P) Charles Highbarger is a retired high school history teacher with a
demonstrated interest in preservation.
Frank Artz is a lifelong farmer and collector of historic artifacts and owner of
historic survey listed properties. He is also a founding member of an
organization that is currently developing an agricultural museum.
(P) Bruce Johnston is a licensed engineer and currently City Engineer for the City
of Hagerstown.
2. The Commission's criteria are included in the adopted by-laws and the
Historic Preservation overlay zone, the ordinance that creates the commission and assigns its
powers and duties. They mirror the CLG membership guidelines that were in effect at the time
of CLG approval in 1990.
3. Only one vacancy occurred during the reporting period which was filled in
time for the new member to attend the next meeting. Gerald Ditto's term expired and was filled
by the appointment of Michael Gehr. A resume is attached.

6. Hershey, Ditto and Highbarger attend MHT annual Conference in Frederick
Nov '95 (credited to FY 95-96). All members received MAHDC's Renovators Roundtable
training in July 1997 (credited to FY 96 - 97).
Category C
1. No additional survey forms were produced in FY 95-96. The FY 96-97 CLG project,
Phase I of the Rural Community Survey(Maugansville and Rohrersville) produced 127 capsule
summaries, 16 individual site survey forms at a level better than reconnaissance but not quite
intensive and a National Register level form for each of the two villages.
2. New survey forms are kept in the MHT library, the HDC's offices in the
Washington County Planning Department, The Washington County Public
Library, The Washington County Historical. Society library, and where applicable, the Historical
Society of the surveyed town or community. The Planning Department also keeps copies of the
Surveys of all the incorporated towns in the County except Hagerstown. These are also kept at
the Public Library along with copies of all survey forms completed since 1975. The collections
are protected via the normal security measures used for public buildings and are accessible upon
request of the general public through an employee of that particular location. They are not
available for general circulation. They are most often stored in filing cabinets or in binders on
shelves. They are accessible to the handicapped as the buildings are accessible to the
handicapped. The collections are not in audio form or braille. The collection is indexed
numerically and alphabetically if of a town or recognized village. They may be updated upon the
owners initiative. There is no scheduled for updates.
Category D
1. The HDC meetings are held on the first Wednesday of each month, a date that
is set in the Commission's adopted by-laws which are recorded in the County Court House along
with all other applicable laws for public scrutiny. The meeting is not routinely advertised in any
media. Those having business before the Commission are notified individually, preferably by
letter but frequently, due to time constraints, the notice is by telephone. All public meetings held
in the County Administration Building, including the HDC, are posted in the lobby of the
building. The meeting is open to the public.
3. All meetings are taped. Staff composes minutes from notes and tape following
meeting for presentation at the next available meeting for adoption by HDC. Occasionally, HDC
makes corrections before adoption.
4. Notices to applicants are mailed as soon as possible after receipt of application.
Most often applications are received only a few days before meeting agendas are prepared and a
phone call is more efficient to notify applicant. Most often, the applicant is the only recipient.
On occasion a contractor may be copied. In rare cases another review agency whose requirement
might be affected by Commission action (building permits, floodplain or Planning Commission)
will receive copy of notice or results. All HDC correspondence is kept on file in HDC offices in
the Washington County Planning Department.
5. Applicants are most often present during meeting when decision is made.
Decisions are often in response to a building permit application. These responses are entered
into computerized permit processing and tracking system and which serves as the record of
action on the application. All agencies that are part of the review process have access to the
computerized information. The details are also part of the Commission's minutes. When
applicants want hard copies of responses for their files, copies of computerized information is
provided. On the rare occasions when no permit application is involved, letters are composed
and sent as soon as possible after the meeting when decision is made. (For example tax credit
applications).
6. All are contained in the text of the Historic Preservation Overlay zone as part
of the Zoning Ordinance, adopted by-laws or Tax Credit Ordinance. They are all on file with
"Acts, Ordinances and Resolutions" recorded in the County Court House. Also available from
staff at HDC offices upon request.
Part II
Category A
2. The HDC has an annual operating budget funded by appropriation from the County's
general fund by the Board of County Commissioners. CLG funds are applied for and
approved/not approved on a yearly basis for specific projects that are not operating costs. Staff
salaries are not part of the HDC budget. Staff also has responsibilities to the Planning
Department and Commission that fund salaries. Large expenditures, such as for training and
CLG projects, are first approved by the HDC. Routine expenditure such as memberships,
supplies or reimbursement of travel expenses are handled by staff. Staff also approves payment
of invoices from consultants performing CLG projects. New memberships would be approved
by HDC first and then renewed routinely by staff.
Budget summaries from the past 2 years in the reporting period indicating total budget for
each line item (at top right corner of the page) and accounting of expenses from that item. FY
95-96 budget total was $6000. FY 96-97 budget total was $6000.
Category B
( All remarks below applicable to FY96-97 CLG project, Phase I of the Rural
Community Survey. FY 95-96 CLG application was not funded. There is no project or product
to discuss.)
1.The project was an effort to survey two of the many rural communities in Washington
County to develop a history and document all contributing structures. The end product, prepared
by a consultant under HDC staff and MHT supervision, includes a contextual history of each of
the two communities, a National Register nomination form for each, an index of contributing
structures, a map of the historic community boundaries, eight detailed survey forms for
representative structures in each community, capsule summaries for the remaining structures and
photographs of all identified sites. The project was successful in that a comprehensive and
contextual history is available and all structures in the community are now identified for future
planning purposes.
2. The actual expenditure was equal to the budget for the project. The total budget was
$14,623.84. All of the contracted amount of $9584.00 was reimbursed by MHT. The HDC
budget made up the difference of $ 5,039.84.

HISTORIC DISTRICT COMMISSION

May 7, 1997
A & B CALL TO ORDER AND ROLL CALL
The regular meeting of the Historic District Commission was called to order by Chairman
Richard Bachtell at 7:00 p.m. on May 7, 1997 in the second floor conference room of the
Washington County Administration Building in Hagerstown, Maryland. Members present were
Bruce Johnston, Jane Hershey, Frank Artz and Charles Highbarger. Staff member Steve
Goodrich and secretary Beth Shifler were also present. Absent were Gerald Ditto and County
Commissioner John Shank.
C. MINUTES - April 2, 1997
Frank Artz made a motion to adopt the April 2, 1997 minutes as presented. Jane Hershey
seconded the motion. The motion was unanimously approved.
D. COMMUNICATION AND BILLS
1. Training Opportunities - Tax Credit Workshop
There was a brief discussion about the training opportunity. Steve Goodrich
reminded the commission of the "Tax Credit Workshop" scheduled for June 4th, 1997.
2. Preservation Month Calendar of Events
The materials were provided for information. There was a brief discussion.
E. BUDGET
F. UNFINISHED BUSINESS
1. Rural Community Survey Phase I - status
Steve Goodrich informed the Commission of the status of the Rural Community
Survey Phase I. The County Commissioners awarded the project for the budgeted amount after
removing the public meeting and the preservation strategy items from the project description.
The cost of these two items were over the budgeted amount. The project began April and the
first progress report has already been submitted as well as a draft of the research design.

2. Historic District Commission/Historic Advisory Committee evaluation -status
Steve Goodrich mentioned to the Commission that he will be attending the next
Advisory Committee meeting, which will be held in June to further discuss the County
Commissioners request for evaluation and possible realignment of duties among the two boards.
3. Renovators Roundtable - status
It was reported that the City of Hagerstown Preservation Design District
Commission is interested in participating in the Renovators Roundtable workshop. It will be
planned for the June meeting unless there is other business to conduct. The City commission
will share the cost. This training will meet the "once yearly" CLG training requirement for all
members who attend.
G. NEW BUSINESS
1. TC-97-001-Bikle, 102 W. Irvin Avenue, Hagerstown
A similar application was submitted in 1996 by the Bikles and was disapproved.
The Commission determined that all of the items on the list were maintenance rather than
improvements eligible for tax credit. The current application is almost identical to the one
disapproved in 1996 with the exception that new gutters are included. After a brief discussion
Frank Artz made a motion to disapprove the application because all of the items, including the
new gutters, are considered routine maintenance, not improvements, and are therefor not eligible
for tax credits. Charles Highbarger seconded the motion. The motion was unanimously
approved.
2. The Year 2000 - Washington County Historical Society

3. Shull subdivision in the AO -1 zone
Steve Goodrich reported on a proposed subdivision by the Shulls and indicated
that the Commission may be involved in the future because the property is located in the
Antietam Overlay Zone. The Commission's involvement would be at the building permit stage
because its authority extends to the exterior appearance of residential structures. That type of

review can not be made at this time but he has already recommended that notes indicating the
Commission's authority be placed on the plat for the knowledge of potential buyers. APCWS is
also proposing to purchase the land. The subdivision may be an alternate plan for the Shull's if
the sale doesn't occur.
4. National Register nomination - Hoffman Farm
The Commission discussed nomination of the Hoffman Farm to the National
Register of Historic Places. The application indicates eligibility under Criteria A(association with
events that have made a significant contribution to the broad patterns of our history) and Criteria
C ( significance of architectural design/construction). The Commission had a lengthy discussion
of the information contained in the application as it relates to the guidance for reviewing such
applications in the National Register Bulletin #15 How to Apply the National Register
for Evaluation. The Commission noted the clear connection to the Battle of Antietam, military
medical history, slave culture and the collection of buildings representing a variety of styles,
methods, materials and dates of construction all retaining integrity to convey their significance.
The application notes the buildings' "remarkable" condition. Bruce Johnston made a motion to
recommend nomination to the National Register of Historic Places because as the application
clearly documents the property is eligible under Criteria A and C. Jane Hershey second the
motion. The motion was unanimously approved.

The regular monthly meeting of the Historic District Commission was called to order by Chairman
Richard Bachtell at 7:00 p.m. on April 2, 1997 in the second floor conference room of the Washington County
Administration Building in Hagerstown, Maryland. Members present were Frank Artz, Jane Hershey, Bruce
Johnston, Henry Bonebrake, Charles Highbarger, and Gerald Ditto. Staff member Steve Goodrich and secretary
Beth Shifler were also present. Absent was County Commissioner John Shank.
C. MINUTES - March 5, 1997
Bruce Johnston made a motion to adopt the March 5, 1997 minutes as presented. Jane Hershey
seconded the motion. The motion was unanimously approved.

There was a brief discussion about training opportunities. Steve Goodrich reminded the
commission of the CLG workshop "Beyond the Building" scheduled for Saturday, April 12, 1997.
Steve Goodrich also reported that MAHDC had finally determined a reduced price of $50 each for the
Renovators Roundtable sessions when presented for Commission members only to meet their CLG training
requirements. After a brief discussion Frank Artz made a motion to purchase the Renovators Roundtable I,
consisting of four sessions to present at a later meeting. Jane Hershey seconded the motion. The motion passed
on a unanimous vote. Bruce Johnston suggested that the Hagerstown Preservation Design District Commission
be contacted to see if it was interested in participating and sharing the costs.

Rural Community Survey Phase I -status
Steve Goodrich informed the Commission of the results of the pre -bid meeting for this CLG
funded project. He reminded them that only two qualified bidders were identified and they have subsequently
submitted a joint bid for the project that is well over the available budget for the project. The Commission had
a lengthy discussion on how to complete the project and stay within the budgeted amount which included
requesting funding participation from Maugansville and Rohrersville, doing only one village or eliminating
various individual tasks from the project with the public meetings and protection strategies identified
specifically. It was the general opinion that the cost exceeding the budgeted amount was due to the extra
requirements of the MHT as a condition of funding. Henry Bonebrake made a motion to ask the Maugansville
Historical Society if they are able to fund the shortfall. Charles Highbarger, Frank Artz, Gerald Ditto and
Richard Bachtell were in favor, Jane Hershey and Bruce Johnston opposed. The motion passed. Other options
to be pursued were to complete the project as originally submitted (without the preservation strategies) request
additional funds from the MHT or survey only one village. The Commission was not interested in requesting
additional funds from the County Commissioners.
2. Historic District Commission/Historic Advisory Committee evaluation - status
A brief discussion was held. Steve Goodrich noted he will attend one of the Historic Advisory
Committee meetings and report further progress at a later date. Paulette Sprinkle is acting chair on the Historic
Advisory Committee.
G. NEW BUSINESS
1. TC-97-001 - Bilde, 102 W. Irvin Avenue, Hagerstown
This item was withdrawn from the agenda by the applicants in order to supply additional
information.
2. 97-1741 Antietam Gallery storage building
This application is the AO -2 zone where the commission has authority over the exterior
appearance of commercial and other non-residential structures. Antietam Gallery'is proposing to -place -a storage
building on the rear of the property. The storage shed will be 14' x 28in size and 6' high. The Commission
was supplied with a site plan showing the location of the proposed shed to the rear of the existing building.
Steve Goodrich reported from his site visit that at least a portion of the shed would be visible from MD RT 34
approaching from the east. The Commission also had a product description sheet including a picture of the
shed. Bruce Johnston made a motion to approve the application as submitted. Richard Bachtell seconded the
motion. The motion was unanimously approved.

1. Rural Community Survey Phase I - Consultant selection
The Commission was updated on the status of the project. The County has
requested submission of Qualifications and Experience from interested parties. From these it is
determined who is qualified to perform the project. Two consultants have been qualified,
Woodward -Clyde and Paula Reed and Associates. In the near future they will be sent the
Request for Proposal and asked to submit their Technical and Price proposals from which the
final selection will be made. He also mentioned that one consultant disputed his disqualification
based on MHT comments which resulted in the two letters distributed with the agenda.

2. Potential Members
The names of George Anikis and William Sheppard were provided by the
Commissioner's office as potential new members. HDC has been asked if there are any other
suggestions to fill the vacancy created by the expiration of Mr. Ditto's term or if there are any
remarks or recommendations on the names submitted. Henry Bonebrake suggested Mike Gehr
with Bushey- Feight Architects . Jane Hershey was reappointed since her term also expired.
By consensus, Commission members indicated that either name would be acceptable. Mr
Goodrich indicated that he would request a resume from Mr. Sheppard and Mr. Gehr, if he is
interested in appointment,
3. Historic District Commission/Historic Advisory Committee evaluation
The Commission received a letter from the County Commissioners resulting from
previous discussions regarding. the overlapping and sometimes vague division of responsibilities
and authorities of the Historic District Commission and the Historical Advisory Committee. The
letter requests that each group evaluate itself and its assigned duties and then meet to discuss
their various roles. The County Commissioners are requesting recommendations to improve the
performance of the various duties and preservation in the community. The Commission had a
brief discussion and indicated that its duties are very clear since they are enumerated in the
Zoning Ordinance. The Commission felt it was necessary to meet with the Historical Advisory
Committee to understand their role before any recommendations could be made.
G. NEW BUSINESS
1. Preservation Week
The Commission was reminded that the second week of May is designated as
Preservation Week, a nationally recognized event. Information regarding the City of
Hagerstown's proposed activities and a request for information for the Maryland's Calendar of
Events were provided. The Commission was advised that planning of any activity for that week
should begin soon but that staff time would not be available. The effort would have to be by
Commission members.
2. County Goals for 1997
A copy of the minutes from the County Commissioner's December 19, 1996
meeting were provided that included a statement of the Board's goals for 1997.

Enclosed with the agenda is a copy of the 1997 meeting schedule and the Maryland Association
of Historic District Commissions Newsletter. Commission members received a copy of Insert #11, an
addition to the MAHDC handbook which is in the Planning office. It contains information regarding
maintenance vs rehabilitation, a subject recently discussed. Also provided was a copy of the Table of
Contents from the Cultural Resources Management publication received as a benefit of National Trust
membership.

Frank Artz stepped down as a Commission member for the duration of the discussion on this
matter. During the October 2, 1996 meeting the Commission presented no objection or comment on the
application due to the lack of information on the ultimate use of the property. HDC expected that
additional information may be available from the hearing and tabled the matter. The Planning
Commission and the County Commissioners held a joint hearing on November 18. The applicant's
presentation made no mention of removing any of the buildings. Steve Goodrich asked if the
Commission wished to change its position from the October meeting or formally respond with no
comment.
There was a lengthy discussion about the zoning of adjacent lands and adjacent agricultural
lands. Mr Artz explained how the new zoning related to the four existing houses on the property. His
home and the one next to his, on the north side of Rench Road, are proposed to be rezoned to HI -1. A
tenant house would also be rezoned to HI -1. The other farm house is located on the south side of Rench
Road and east of the railroad tracks and is proposed to be changed to RR. Mr. Artz also discussed his
desires to keep his home and an area surrounding it of approximately 35 acres in its present state. . The
Commission and. staff discussed the various steps and requirements of the rezoning process and the
legalities and limitations of the impending rezoning decision.
Jane Hershey made a motion to recommend to the Planning Commission and County
Commissioners that the two farm complexes listed in the Historic Sites Survey on the north side of
Rench Road and a surrounding area of 35 acres should receive the HP overlay zone. The motion died for
lack of a second.
Gerald Ditto made a motion to comment on the application as follows: As an organization that is
responsible for historic matters the Commission should offer its opinion. The Commission recommends
that the Historic Preservation overlay be applied to the three historic houses with a minimum amount of
acreage to comply with zoning requirements. Henry Bonebrake seconded the motion. The motion was
passed unanimously. Frank Artz abstained from voting.
G. NEW BUSINESS
1. FY 97 CLG application -Rural Community Survey Phase II
Steve Goodrich brought to the Commission's attention that the application for FY 1997 CLG
projects would be due soon. He assumed that Washington County's application would be Phase II of the
Rural Community Survey, Phase I being the current year's project. Gerald Ditto made a motion which
Charles Highbarger seconded, to submit Phase II of the Rural Community Survey as the FY 1997 CLG
project. The motion was passed unanimously.
2. BRIDGE MARKER STATUS
Steve Goodrich provided a list of the names of the 12 bridges that would have historic markers
installed in the next two to three weeks, He reminded the Commission that the markers were paid for
with a grant from the Bowman Board.

3. LETTER TO SURVEY PROPERTY OWNERS
The project was initiated by Pat Schooley several years ago to correspond with owners of
historic properties to offer assistance in maintaining their old buildings and still comply with building
codes. Pat Schooley was in attendance to discuss the revised proposed content of the letter. She said the
Washington County Historical Society has arranged for a trained volunteer to work with people between
1:00 - 4:00 pm on Wednesday afternoons. She suggested a few changes in the text. The Commission
discussed where the budget for the paper, envelopes and postage will come from. The issue of who the
letter is signed by and where the resulting calls will be directed is still unresolved. Charles Highbarger
made the motion to support sending the letter to the property owners and also to seek County
Commissioner input on the use of volunteers to receive the calls and the signature. Jane Hershey
seconded the motion. The motion passed unanimously.
Additional discussion developed regarding Mrs. Schooley's earlier comment that Terry Headley
of the Herald Mail newspaper expressed interest in printing the entire Historic Sites Survey listing
including the names and addresses of the owners. Several members expressed concern for security,
privacy and the newsworthiness of that effort. Gerald Ditto made a motion to convey to the newspaper
the Commission' opinion that the list should not be printed with names and addresses. Henry Bonebrake
seconded the motion. The motion was passed with Ditto, Bonebrake, Artz and Highbarger in favor and
Hershey opposed..

The regular monthly meeting of the Historic District Commission was called to order by Staff member Steve
Goodrich at 7:00 p.m. on October 2, 1996 in the second floor conference room of the Washington County
Administration Building in Hagerstown, Maryland. Members present were Henry Bonebrake, Frank Artz, Jane Hershey
and Gerald Ditto. Secretary Beth Shifler was also present. Absent were Richard Bachtell, Bruce Johnston, Charles
Highbarger and County Commissioner John Shank.
C. MINUTES - JULY 3, 1996
Frank Artz made a motion to approve the July 3, 1996 minutes, Jane Hershey seconded the motion. The
motion was unanimously approved. Gerald Ditto asked for additional information about the leave of absence for
Richard Bachtell.
D. COMMUNICATIONS AND BILLS
Secretary of the Interior's Standards for Treatment of Historic Properties
The Commission had a brief discussion on the brochure that was sent with the agenda. It explains the. four
different but related approaches to the treatment of historic properties, preservation, rehabilitation, restoration and
reconstruction. A video tape further explain the Standards has been purchased which Steve Goodrich recommended
that all members review.

Members were reminded of the October 12th seminar in Easton which would fulfill their once yearly training
requirement.
RZ-96-06 (Hershey)
The matter was placed on the agenda to keep the Commission informed of cases they had participated in. This
application to removed the Historic Preservation Overlay from the majority of Hershey Property with the exception of
four +/- acres around the house was approved by the County Commissioners.
G. NEW BUSINESS
Demolition Permit 96-7049 (Nelson)
The application is for demolition of a structure, a two story log house, which is listed in the Historic Sites
Survey as site # WA -III -069. Mr. and Mrs. Nelson attended the meeting. Jane Hershey asked several questions about
why they chose to demolish the house. Mr. Nelson said that it was in poor condition with uneven floors, non -weather
tight windows and a foundation in need of extensive repairs. He stated it cost over $1,000 to heat last winter, and noted
health problems. Mr. Nelson said an estimate to fix the foundation was $10,000. They are planning to locate a mobile
home on the property. After further discussion Henry Bonebrake made a motion to recommend that an effort be made
to find a third party that would be interested in reusing the material or moving the structure intact prior to issuing the
demolition permit. seconded the motion. Upon a vote Henry Bonebrake, Frank Ariz and Gerald Ditto
voted in favor of the motion
and Jane Hershey opposed.

Frank Artz stepped down as a Historic District Commission member but remained in attendance to answer
questions for the Commission regarding the subject rezoning case. He owns the property jointly with other family
members. The proposed zoning is HI -1 and RR, Rural, Residential. Following a brief discussion the Commission,
by consensus had no objection or comment on the proposal since very little information was available on the ultimate
use of the property. Gerald Ditto moved and Jane Hershey seconded a motion to table the matter until the November
Th meeting. The motion was approved with Frank Artz abstaining.

workshop on Tax Incentives to be - held -in Easton; -Maryland-son
October 12. Attendance would satisfy the CLG training requirement.
We are into a new fiscal year so everyone needs at least one
training session. If you can not attend this one, the annual State
Preservation Conference will be in November and would also satisfy
the training requirement. I think it will be in Annapolis this
year. The easiest way to register would be for each member to send
their own form with the $10 fee. The confirmations. can be sent to
your home address. There are sufficient funds in the budget to
reimburse everyone for the registration fee. Reimbursement for
travel expenses and overnight stays would be limited. Be sure to
keep a record of your confirmed registration.
For those that plan to attend the workshop, I will see you
there. I've agreed to participate in the panel discussion on
Rehabilitation Tax credits with other County staff members.

The regular monthly meeting of the Historic District Commission was
called to order by Chairman Richard Bachtell at 7:00 p.m. on July 3, 1996 in
the second floor conference room of the Washington County Administration
Building in Hagerstown, Maryland. Members present were Bruce Johnston, Frank
Artz, Henry Bonebrake and Jane Hershey. Senior Planner Stephen Goodrich and
Secretary Beth Shifler were also present. Absent were Gerald Ditto, Charles
Highbarger and County Commissioner John Shank.
Richard Bachtell excused himself from the meeting at 7:20 p.m.
C. MINUTES - JUNE 5, 1996
Jane Hershey made a motion to approve the June 5, 1996 minutes, Henry
Bonebrake seconded the motion. The motion was unanimously approved.

A copy of the approved '96-'97 budget was distributed with the agenda.
The total allotment is the same amount as last. year, $6,000.00

LAND PRESERVATION AND RECREATION PLAN UPDATE comments
After the June meeting Steve Goodrich mailed a copy of the Land
Preservation and Recreation Plan to all Commission members for their review
prior to making further comment. Aside from updating the list of National
Register sites there were no additional recommendations for changes.
G. NEW BUSINESS
Richard Bachtell said that because of business and personal schedules
over the next eight months, he intended to resign from the Historic District
Commission. He said he would be interested in being re -appointed at some time
in the future. Jane Hershey suggested taking a leave of absence rather than
resignation. Mr. Bachtell said it would be acceptable to him if it was to the
Commission. Following a brief discussion Mr. Bachtell requested that the
Commission consider his request for a leave of absence. Jane Hershey made a
motion to approve Richard Bachtell's request for an eight month leave of
absence. Henry Bonebrake seconded the motion. It was unanimously approved.
PERMIT # 96-4611 (CLARA BEE SIGN IN THE AO -2 ZONE)
The permit application is to place an off the premises outdoor
advertising sign in the AO -2 zone. Lester Mason was in attendance to answer
questions the Commission may have for him. The sign is a duplicate of the one
in the front of the Clara Bee Gift Shop which the Commission reviewed and
approved approximately a year ago. The sign will be 4'X 4' and is to be on
the east side of the Sharpsburg Pike just north of Taylor's Landing Road.
There is an existing Red Byrd sign nearby. Mr. Mason noted that the Board of
Zoning Appeals has granted approval for 0' front yard setback and a waiver of
the minimum 200' distance between outdoor advertising signs. Henry Bonebrake
moved to
approve the
application as
presented. Bruce Johnston seconded the
motion.
The motion
was unanimously
approved.
A brief discussion followed regarding limiting the number of signs in
the overlay zone.
PERMIT # 96-1082
This permit for repairs to the Midthun's property which was damaged by
fire was originally approved at the Commission's April meeting. The approval
was conditioned on the owners choice of cedar roof shingles. Mr. John Hering
from Hill Restorations indicated the owners have changed their minds and now
wish to use fiberglass shingles, for fire safety reasons. There have been no
tax credits granted for this property. Bruce Johnston made a motion to
approve the request change from the cedar shingles to the Tamco 45 year slate
finish fiberglass shingles. Henry Bonebrake seconded the motion. The motion
was unanimously approved.

by Jane Hershey to approve the May minutes with the noted revision.

TC-96-02 640 SECURITY ROAD (RAY & JACKIE SNOUFFER)
Mr. and Mrs. Ray Snouffer were present. The Commission was
reminded that the Snouffers attended the April meeting and
requested preliminary review of their plans to put a new standing
seam metal roof on the building and also to rehabilitate the
fascia, soffit and gutters. the Commission decided by a vote at
that time that the proposed work should be considered restoration

and preservation and not routine maintenance. The Commission also
determined that the work would be consistent with the Secretary of
the Interior's Standards if completed as presented.
The Commission was provided "before and after" photographs.
Steve Goodrich noted a minor correction t the application where it
should have been indicated that the property is "located inside the
municipal limits of Hagerstown" rather than "located in an HP
zone". Mr. Snouffer said that the project proceeded exactly as he
had described it would during the April meeting. The final cost
was $22,936.50. The existing aluminum H -channel panel roof,
installed in 1948, was removed and replaced with a standing seam
terne metal roof and painted a dark blue-green to match paint
drippings in the attic, believed to be the color of a previous
roof. All fascia, soffit and gutters were repaired and repainted
when possible and replaced only where necessary with like material
and design.
Mr. Bonebrake made a motion to approve the application as
submitted for a 10s tax credit as being consistent with the
Secretary of the Interior's Standards for Rehabilitation. Mr.
Highbarger seconded the motion which was unanimously approved.
LETTER UPDATE
The County's Land Preservation and Recreation Plan required by
the Md. Office of Planning is ready to be updated again. Planner
Bill Stachoviak is requesting the Commissions input to update the
plan. A copy of the draft will be mailed to the Commission members
and the matter can be discussed at the July meeting.
RZ-96-05
Jane Hershey stepped down from her position as a Commission
member for the duration of the discussion on RZ-96-05. The subject
application was submitted by Jane Hershey as the property owner.
It is a rezoning request to remove the HP overlay zone from all but
4.05 acres of this 105 acres parcel. The rectangular area which is
to retain the HP overlay contains the existing historic brick
dwelling and is located in the middle of the farm. Mrs. Hershey
supplied the boundaries of the area to be rezoned. The remainder
is proposed to retain the underlying Agricultural zone. Mrs.
Hershey said the reason she has applied to have the HP removed is
because she intends to apply for an agricultural preservation
district and the two designations are not allowed to overlap.
After a brief discussion the Commission voted unanimously in favor
of recomending the application because removal of the HP overlay
will have no effect on the uses allowed or not allowed on the
property, the text of the HP overlay specifically states it should
not be placed on large areas of vacant land and the historic
structures will retain the HP overlay. The motion was made by
Henry Bonebrake and seconded by Frank Artz.

CLG PROJECT
Steve Goodrich reminded the Commission that it had been
advised last month that the CLG project had not been approved
because of a low ranking and the lack of funds. He has been
advised that additional funds have been made available and the
Rural Community Survey project will now be funded by the MHT. MHT
has suggested that the project be changed slightly to focus more on
the villages as a unit and less on the capsule summaries for each
building. On a motion by Gerald. Ditto, seconded by Jane Hershey,
the Commission voted unanimously to proceed with its project as
initially submitted and consider the MHT's suggestions for next
years application.

Highbarger to approve the April minutes. The motion was

ORDINARY MAINTENANCE/PRESERVATION
The Commission continued its discussion from previous months
in an effort to develop definitions and guidelines to distinguish
between ordinary maintenance and preservation. Charles Highbarger
suggested that a requirement for engineered drawings could be part
of the difference between preservation and maintenance. Henry
Bonebrake added that restoration should include a requirement to
provide evidence of the feature's past existence. Other factors
suggested that could help define the differences were the use of
like material versus a substitute and the length of time a property
has gone without maintenance due to the neglect of a previous
owner.
Steve Goodrich reported that it is not an unusual practice of
other Historic Commissions to require property owners to come
before a Commission for approval of any change to the exterior of
a building in a historic district not just when a building is
needed. Those Commissions issue what's called a Certificate of
Appropriateness. This approach would take changes to the Zoning
Ordinance. The Commission decided by consensus that it would
continue the discussion in subsequent meetings.

DRAFT OF LETTER TO COUNTY COMMISSIONERS
The Commission continued the discussion of a letter it wanted
to write to the Board of County Commissioners regarding the HDC's
role in the County's preservation activities and philosophy and
direct and timely notice of approvals of various project that
affect the HDC or should be it's responsibility. The letter was
prompted by recent requests from Pat Schooley about prioritization
of the survey and contact with property owners.
The Commission debated the benefits of assuming one of two
positions: suggesting a certain position on County preservation
policy and asking for the support of the Board of County
Commissioners or stating the HDC position and indicating the
intention to pursue it. The Commission concluded that it needed to
formulate it's own position and plans before approaching the Board
with it.
For clarity, Steve Goodrich summarized his understanding of
the HDC's position as wanting to be visible and active advocates,
doing more than just regulation. It should be presented in a way
that highlights the benefits to the entire community. At this time
the HDC wants to assume the responsibility for determining what
should be done to promote preservation rather than asking others
what should be done.
This, once again, led to a discussion of a Comprehensive
Historic Preservation Plan. Steve Goodrich informed the Commission
that the CLG project for Maugansville and Halfway was not approved
this year because there is not enough money available in the CLG
program to fund all applications submitted. The project did not
rank high on the State's priority list. CLG Administrator
Elizabeth Hughes said that it is a good project and was a good
application; it simply does not rank as high as some other types of
projects. She suggested other projects that would have higher
priority such as a Comprehensive Historic Preservation Plan. The
Commission decided not to vote on the matter this month because it
was not listed on the agenda and members not present didn't have
the opportunity to decide to attend to discuss the subject.
G. NEW BUSINESS
PRELIMINARY CONSULTATION PC -96-004 (BOWMAN-LIGHTNER)
Steve Goodrich passed out information about the subject
Preliminary Consultation for the Lightner property and noted that
the matter was not listed on the agenda. It is presented as
information only with no request for action at this time. The
existing dwelling on the property is listed in the Historic Site

Survey as site number WA -I-377 and is known as "Garden of Eden"
Bowman is proposing to keep the house on the property and
rehabilitate it for use as office space for this business which
will be storage and maintenance of storage trailers and portable
office trailers. He said there are no plans to demolish the
building. They were provided a copy of the survey information.

session titled "Renovators Roundtable'r-to be held on May 18th in
Baltimore City. It would meet the members yearly training
requirement if attended. It is the same "Renovators Roundtable"
HDC was advised of by the representative from Maryland Association
of Historic District Commissions. Steve Goodrich is looking into
the details of presenting the same program sponsored locally by HDC
and possibly the Hagerstown Commission. It is a prepared package
of scripts, tapes and slides the Commission purchases the right to
use for $500.00. It is then the local responsibility to provide
local speakers who use the supplied information. The
representative from the Association said they are considering
offering a training package for Commissions only which would cost
much less.

A & B CALL TO ORDER AND ROLL CALL
The regular monthly meeting of the Historic District
Commission was called to order by Chairman Richard Bachtell at 7:00
p.m. on March 3, 1996 in the second floor conference room of the
Washington County Administration Building in Hagerstown, Maryland.
Members present were Charles Highbarger, Frank Artz, Henry
Bonebrake, Jane Hershey and Bruce Johnston. Staff member Steve
Goodrich and Secretary Beth Shifler were also present. County
Commissioner John Shank was absent. Gerald Ditto arrived at 7:10
p.m.
C. MINUTES - MARCH 3, 1996
A motion was made by Henry Bonebrake and seconded by Gerald
Ditto to approve the December minutes. The motion was unanimously
approved.
A motion was made by Gerald Ditto and seconded by Frank Artz
to approve the March minutes. The motion was unanimously approved.

The various items listed under this heading were provided for
information only and required no discussion or action.

There were no expenditures reported for the past month.
F. UNFINISHED BUSINESS
HISTORIC SITE SURVEY PROPERTY OWNER NOTIFICATION COSTS
The Commission had requested that Steve Goodrich draft a
letter to the County Commissioners requesting direct correspondence
when the Board made decisions affecting the Commission's areas of
responsibility. The draft was presented to the HDC for review.
The letter also requested a confirmation of the County's position
on preservation matters. Several members suggested various changes
to the draft. After a lengthy discussion Henry Bonebrake suggested
that each member review the letter and return at the next meeting
with changes that can be incorporated into a final draft. Mr.
Bonebrake made a motion to that effect. Frank Artz seconded the
motion. The motion was unanimously approved.

ORDINARY MAINTENANCE/PRESERVATION DEFINITIONS
Richard Bachtell informed the Commission that he and Frank
Artz and Henry Bonebrake had met to formulate definitions for
ordinary maintenance and preservation. After discussing the
various options and problems with a specific definition the
subcommittee felt it may be better to have a general guideline and
develop and continually update a list of examples that are or are
not maintenance or preservation. Steve Goodrich suggested the
Commission bring their individual lists to the May meeting.
Richard Bachtell, Frank Artz and Henry Bonebrake will meet again
before the May meeting.
G. NEW BUSINESS
CLG EVALUATION
The Maryland Historical Trust's evaluation of the Commission's
performance under CLG guidelines for the fiscal year '94-'95 was
enclosed for Commission review. Steve Goodrich noted that the HDC
attained an adequate rating on an adequate/inadequate scale.
Gerald Ditto noted that the MHT's evaluation of members who
have met the training requirements is incorrect and that he had
also attended the seminar in Frederick in November 1995. The
evaluation noted the lack of standards used in acting upon
demolition permits. Mr. Ditto felt that the Trust should be
advised of the difference in the Commission's authority when
reviewing demolition permits and construction permits in the HP and
AO zones. There are no standards to use for demolition permits
because it is not a regulatory or binding decision.
Steve Goodrich said that the distinction was made in the
original CLG application and that he had intended to remind them
again and have the evaluation amended to reflect that. By
consensus the Commission agreed that a letter should be sent to
formalize the needed corrections in the evaluation. The evaluation
is the first received from MHT even though two reports have been
submitted.
CLG TRAINING - APRIL 20, 1996 SEMINAR
Steve Goodrich asked if anyone was interested in attending the
seminar in Crownsville. The subject is demolition by neglect and
economic hardship. No members were able to attend on this date.

POTENTIAL TAX CREDIT APPLICATION - 640 SECURITY ROAD
Mr. Snouffer, the owner, is requesting guidance prior to
submitting an application tax credits and was present to answer any
questions the Historic District Commission may have for him. He
is looking for a determination that his plans to remove the
aluminum panel roof and replace it with a historically correct
standing seam tern roof, painting it a color which closely matches
the original deep blue-green color and repairs to the fascia and
soffit are considered restoration or preservation rather than
routine maintenance and therefore eligible for a property tax
credit. The City of Hagerstown will not require building permits
for these activities and therefore there is•.no -review at that
level. The property is located in its own historic district within
the city limits.
Steve Goodrich reviewed the Secretary of the Interiors
Standards and cited several that, in his opinion, would be
applicable in this case.
#2 "The distinguishing original qualities or character of a
building, structure or site and its environment shall not be
destroyed. The removal or alteration of any historic material or
distinctive architectural features should be avoided when possible.
#4 "Changes which may have taken place in the course of time are
evidence of the history and development of a building, structure,
or site and its environment. These changes may have acquired
significance in their own right, and this significance shall be
recognized and respected.
#6 "Deteriorated architectural features shall be repaired rather
than replaced, whenever possible. In the event replacement is
necessary, the new material should match the material being
replaced in composition, design, color, texture and other visual
qualities. Repair or replacement of missing architectural features
should be based on accurate duplications of features, substantiated
by historic, physical or pictorial evidence rather than on
conjectural designs or the availability of different architectural
elements from other buildings or structures."
The Guidelines also contain specific recommendations for various
situations and the following from the roofing section is also
pertinent.

RECOMMENDED: Identifying, retaining and preserving roofs -and their
functional and decorative features -that are important in defining
the overall historic character of the building. This includes the
roof's shape, decorative features and materials as well as its size
color and patterning.
Mr. Snouffer spoke briefly of the historic value of Graystone Manor
with the Commission. He also provided pictures of the building
showing the roof and needed repairs.
Bruce Johnston made a motion that the Commission's opinion at this
time, based on the information presented, is that the proposed
roof, fascia and soffit work on 640 Security Boulevard is
restoration and preservation, not routine maintenance, and the
manner in which it is proposed to be performed is consistent with
the Secretary of the Interior's Standards and Guidelines,
specifically standards 2, 4 & 6 (described above). Henry Bonebrake
seconded the motion. The motion was unanimously approved.
DEMOLITION PERMIT FOR CES EXPANSION - WA -I-338
The building on the site of the proposed expansion of CES is
listed in the Historic Sites Survey as site #WA -I-338. It is a
stucco covered, two story, stone dwelling known as the Baker farm.
Mac Davis, representing Davis, Renn & Associates, Inc. said that
new parking and stormwater management will be constructed where the
house is located. He also provided pictures taken earlier that
day. The front and rear wall have collapsed. The remainder of the
building is in a severe state of disrepair. Steve Goodrich
confirmed this from his own, site visit.
Bruce Johnston made a motion to not object to the demolition.
Gerald Ditto seconded the motion. The motion was unanimously
approved.
BUILDING PERMIT IN AO -1 ZONE #96-1082 (K. & L. MIDTHUN)
Mr. John Smith of Hill Restoration & Construction, Inc., was
present and is the contractor for Mr. and Mrs. Midthun who plan to
repair the damage to the structure from the March 3, 1996 fire.
The property is zoned AO -1, listed in the Historic Sites Survey as
#WA -II -262, known as the Belinda Springs Hotel site and is also
listed in the National Register. The application is only for the
roof repairs at this time. There will be an additional plan review
for the rest of the structure. Mr. Smith said the fire started in
the chimney area and burned both roofs. He said his company was
hired to restore the dwelling to its prior condition. Mr. Smith
passed out pictures for the Commission to review. He plans to

replace and repair materials to like and kind which means the use
of cedar shake shingles and cedar siding.
Charles Highbarger made the motion to approve the permit as
presented indicating cedar shake shingles and the cedar siding and
returning the structure to its pre -fire condition which is
consistent with the Secretary of the Interior's standards for
rehabilitation, specifically item #6 which states "Deteriorated
architectural features shall be repaired rather than replaced,
whenever possible. In the event replacement is necessary, the new
material should match the material being replaced in composition,
design, color, texture, and other visual qualities. Repair or

The regular monthly meeting of the Historic District
Commission was called to order by staff member Steve Goodrich at
7:00 p.m. on March 6, 1996 in the second floor conference room of
the Washington County Administration Building in Hagerstown,
Maryland. Members present were Gerald Ditto, Jane Hershey, Frank
Artz, Henry Bonebrake and Charles Highbarger. Richard Bachtell
arrived at 7:20 p.m.. Absent was member Bruce Johnston, County
Commissioner John Shank and Secretary Beth Shifler.
Steve Goodrich introduced Mr. Richard Janney to the Historic
District Commission. Mr. Janney is a representative of the
Maryland Association of Historic District Commissions Board of
Directors. Steve reminded the Commission of its membership and the
yearly visit from the Association to say in touch and talk about
common interests.

FY' 97 BUDGET REQUEST
Steve Goodrich reported that the HDC budget request for FY
'96-'97 was due in the Finance Department by February 2, 1996.
Since there was no meeting before that date the request was
submitted on schedule with the same figures as last year's budget,
$6,000.00. The Commission was asked to either vote to affirm the
budget request as submitted or make adjustments and submit a
revised request. Gerald Ditto made a motion to approve the budget
request for FY 96-97 as submitted. Charles Highbarger seconded the
motion. The motion was unanimously approved.
F. UNFINISHED BUSINESS
HISTORIC SITE SURVEY PROPERTY OWNER NOTIFICATION COSTS
During the December meeting the Commission had a lengthy
discussion about a proposal to contact by mail all property owners
of sites listed in the Historic Sites Survey to help confirm
current ownership and as another attempt to educate owners about
the benefits of preservation. At the end of the discussion the
Commission and Commissioner Shank were interested in the cost of
such a notification. Steve Goodrich reported this evening the cost
would be approximately $1,700.00.

STATUS - FUNKSTOWN HISTORIC RESOURCE INVENTORY
The Funkstown Historic Resource Inventory, which was the CLG
FY'95 project is complete. Steve Goodrich said he would be
attending the Funkstown Council meeting on March 11 to present the
final report to the Town. Copies of the survey will also be kept
in the Planning Department, the Western Maryland Room of the
Washington County Free Library, the Historical Society and in the
County Housing Department.
G. NEW BUSINESS
TAX CREDIT APPLICATION #TC-96-01 102 W. IRVIN AVE.
The owners, Philip and Nida Bikle, have requested a County
property tax credit for expenses to improve 102 W. Irvin Avenue
which is located in Hagerstown's Oak Hill Historic District. The
expenses total $5,358.21 for rehabilitation of the front porch
columns and repairs, rehabilitation or replacement of a cellar door
and steps, screen door, trellis, garage door, rear porch steps,
fence, gutters and drain tiles. Pictures were presented to show
before, during and after work.
The Commission discussed the difference between regular or
normal maintenance which is not eligible for tax credits and
restoration, preservation or improvements which are. Charles
Highbarger made a motion to disapprove the application because the
activities included are normal maintenance items that any property
owner would have to perform whether they were in a historic
district or not. Frank Artz seconded the motion. The motion to
disapprove #TC-96-01 was approved with Highbarger, Artz, Bachtell
and Bonebrake voting "aye" and Hershey and Ditto voting "no".
BUILDING PERMIT IN AO -1 ZONE - DAVID L. WYAND #96-0689
David L. Wyand has applied for a permit to construct a 2 car
detached garage next to his residence which is located in the AO -1
zone of the Antietam Overlay Zone. Mr. & Mrs. Wyand were in
attendance to answer questions on their permit. The proposed
garage will be brick on the front and brown siding on the sides and
rear, just like the existing house. The Commission had a scale

drawing of the house and proposed garage as well as a plan view of
the lot and building locations. Henry Bonebrake made a motion to
approve the application as presented because it is consistent with
the Commission's guidelines contained in Section 20.6 a, b and c of
the Zoning Ordinance. The garage does not alter the exterior
features of the existing dwelling and design is compatible with the
other structures on the site which are not historic. Gerald Ditto
seconded the motion. The motion was unanimously approved.
SEMINAR - THE NATIONAL HISTORIC PRESERVATION ACT, SECTION 106
REVIEW AND UPDATE FOR PRACTITIONERS
Steve Goodrich requested the Commission's approval to spend
$210.00 to attend a one day seminar conducted by the National
Preservation Institute titled The National Historic Preservation
Act, Section 106: Review and Update for Practitioners in Washington
D.C. on July 17, 1996. Richard Bachtell made the motion to approve
the funds. Jane Hershey seconded the motion. The motion was
unanimously approved.
H. OTHER BUSINESS
Mr. Richard Janney commented on several of the items that the
Commission had discussed or acted upon during the meeting and
offered advice based on his experience as a Commission member in
Sykesville, MD. The comments included the maintenance/restoration
issue, reference to guidelines when making decisions, and various
training resources.- He mentioned specifically a videotape called
"Built by Design", the "Renovators Roundtable" and an upcoming
seminar from MHT on demolition by neglect. He offered the
resources of the MAHDC to assist the Commission in any area it
could identify.

DECEMBER 6, 1995
A & B CALL TO ORDER AND ROLL CALL
The regular monthly meeting of the Historic District
Commission was called to order by staff member Steve Goodrich at
7:00 p.m. on December 6, 1995 in the second floor conference room
of the Washington County Administration Building in Hagerstown,
Maryland. Members present were Charles Highbarger, Frank Artz,
Jane Hershey and Henry Bonebrake. County Commissioner John Shank
and Secretary Beth Shifler were also present. Absent were Gerald
Ditto and Bruce Johnston. Richard Bachtell arrived at 7:10 p.m.
C. MINUTES - NOVEMBER 1, 1995
Charles Highbarger noted he was present on November 1, 1995
but the minutes do not reflect it.
A motion was made by Frank Artz and seconded by Jane Hershey
to approve the minutes of November 1, 1995 with a correction to
indicate Mr. Highbarger's presence. ----The motion was unanimously
approved.
D. COMMUNICATIONS AND BILLS
Attachments for the items listed under this heading on the
agenda were provided for information only. No action was necessary
or taken.
E. BUDGET
Steve Goodrich indicated expenditures during the past month
were for the Annual Statewide Preservation Conference in Frederick,
a total of $165.66. Jane Hershey, Frank Artz, Gerald Ditto and
Charles Highbarger attended.
F. UNFINISHED BUSINESS
MARSH MILL NATIONAL REGISTER NOMINATION
Commission members were informed that the Board of County
Commissioners concurred with HDC's recommendation of approval of
the National Register Nomination for the Marsh Mills complex on
Tuesday, December 5, 1995.
SURVEY PRIORITIZATION
During the November meeting the Commission had a discussion
and questions regarding a presentation Pat Schooley made to the
County Commissioners about prioritization of the sites in the
Historic Sites Survey. The Commission questioned the need and
meaning of the priorities and requested further information. Pat
Schooley explained that the prioritization would use the same
scheme of letters A through G that the MHT uses to code multiple
resources on a site indicating their level of integrity and
significance. She said the Commissioners requested an additional
notation to indicate when the structures or site no longer existed.
There were questions and discussion about who would use the
designation and for what purpose. Steve Goodrich made it clear
that there was no County government agency that he was aware of
that intended to use them for regulation purposes.
The discussion turned to the volunteer effort to update and
correct the historic information being entered into the computer.
Pat Schooley said they would soon be ready to generate mailing
labels to contact all of the property owners and provided a draft
of the letter for the Historic Commission to review. Steve
Goodrich was asked to find out the cost of the project to contact
these property owners.
ORDINARY MAINTENANCE/PRESERVATION DEFINITIONS
During the November meeting the Commission was supplied
several examples of how other communities define routine
maintenance and various other terms in order to clarify eligible
activities for tax credits.
TEXT AMENDMENT TO HP ZONE
The Commission was provided copies of the current text of the
HP zone with possible changes made necessary due to recent
legislative changes to Article 66B. Steve Goodrich pointed out
that the changes that will have a real effect on this Commission
are some changes to membership requirements and the need for design
guidelines for new construction and rehabilitation. There was a
brief discussion but made no decisions were made.
G. NEW BUSINESS
FY '96 CLG PROJECT -RURAL COMMUNITY SURVEY
Jane Hershey moved and Frank Artz seconded a motion to submit
the same Rural Community Survey project as the Historic District
Commissions FY'96 CLG project as was submitted for FY'95. The
motion was unanimously approved.

The regular monthly meeting of the Historic District Commission was
called to order by staff member Steve Goodrich at 7:00 p.m. on November 1,
1995 in the second floor conference room of the Washington County
Administration Building in Hagerstown, Maryland. Members present were Gerald
Ditto, Bruce Johnston, Frank Artz, Henry Bonebrake and Jane Hershey.
County Commissioner John Shank was also present. Absent was Secretary Beth
Shifler. Richard Bachtell arrived at 7:45 pm.
C. MINUTES - SEPTEMBER 13, 1995
A motion was made by Frank Artz and seconded by Jane Hershey to approve
the September 13, 1995 minutes. The motion was approved with all members
voting in favor except Charles Highbarger who abstained.
D. COMMUNICATION AND BILLS
Steve Goodrich reminded the Commission that the statewide annual
preservation conference will be held on Friday and Saturday, November 3rd and
4th in Frederick. Gerald Ditto, Jane Hershey, Frank Artz and Charles
Highbarger are registered and will meet the training criteria for this year.
Also on Saturday, November 4th, Hagerstown will be holding a public
input workshop as the beginning of the process to update its Comprehensive
Plan. Commission members or a representative were invited.
E. BUDGET
There have been no expenditures from the budget.
F. UNFINISHED BUSINESS
National Register Nomination - Marsh Mills
Steve Goodrich reminded the Commission of the past activity on the
application. It was received from the Maryland Historical Trust without the
normal 60 review period. The County was unaware of its responsibility to
notify the owners of various local meetings until the last minute. The Hites
and Bell -Andrews did not attend the Commission meeting when this application
was first discussed and listing was not recommended. Mrs. Bell -Andrews did
attend the County Commissioners meeting when the Board took no action and
requested that the application be reconsidered by the HDC with the owners
present. The matter was scheduled a second time on the HDC October agenda.
A quorum was not present at that meeting and no action was taken. The matter
was then rescheduled for November.

Paula Reed was in attendance to represent Mr. & Mrs. Bell Andrews and tc
answer questions the Commission may have about information contained in thel
application.
There was a lengthy discussion regarding the nomination. Topics covered
included; some member's satisfaction with the previous Commission decision;'
the ownership of the "complex" split between two owners; the owners consencj
to the listing; the house and remains of the mill meeting criteria C while]
many other structures within the boundary are modern or modified and have(
lost their integrity; the condition and integrity of other structures in the
County already listed on the National Register; requiring modification of the
current application; the effects of listing on owners and access to the site?
by others; NR listing not only for the exceptional but also for the typical]
(as long as integrity is present); local significance being as important asi
national significance and the benefits of a site visit.
Henry Bonebrake made a motion to request that the application bed
modified to point out more strongly the non-contributing structures and focus'''.
on the merit of the stone house and the remains of the mill. Bruce Johnston';
suggested a modification or withdrawal of the motion. Mr Bonebrake withdrew;
the motion.
Bruce Johnston subsequently made a motion to recommend the listing of!
the Marsh Mills complex in the National Register as described in the current!
application noting that the significance and pristine condition of the stone)
house and existence of the mill remains are the resources that meet Criteria!
C and therefore indicate listing is warranted. The motion includes ai
specific statement that the other structures within the district boundaries!
as described on the application are non-contributing since they are of modern!
construction or have been extensively modified. Jane Hershey seconded the,
motion. The motion was approved with Johnston, Hershey, Artz, Bonebrake and',
Highbarger voting in favor and Ditto opposed.
G. NEW BUSINESS
Gerald Ditto raised concerns about the County Commissioners' meeting)
Tuesday evening, October 31, 1995, in Clear Spring. A presentation was made,
to the County Commissioners by Pat Schooley with regard to the Historic Site
Survey. Mr. Ditto's concern was for the fact that the HDC has the
responsibility for maintenance of the survey and it appeared that another)
organization was requesting permission from the County Commissioners without
notice to or input from HDC. Mr. Ditto reminded those present that HDC had',
been asked to advise on the prioritization of the survey several years ago.'.
The request raised many questions regarding the purpose of prioritization,'',
the completeness of the survey, the effects a priority would have on property;
rights and input from property owners. After some discussion there appeared
to be no clear understanding of the request before the County Commissioners!
or their resulting action. Commissioner Shank asked Steve Goodrich to look
into the matter for clarification. I

1. Revisions to article 66B
Last year the Commission was asked to comment on proposed changes tc
Article 66B dealing with Historic Area Zoning and Historic Commissions that
were under consideration by the 1995 session of the Maryland legislature.
Although HDC opposed the changes, they were approved. Commission members
were provided with copies of the new text. It will require changes to the
County's HP and AO zones in the Zoning Ordinance.

The regular monthly meeting of the Historic District Commission was called
to order by Chairman Richard Bachtell at 7:00 p.m. on September 13, 1995 in the
third floor conference room of the Washington County Administration Building in
Hagerstown, Maryland. Members present were Henry Bonebrake, Bruce Johnston,
Gerald Ditto, Jane Hershey, and Frank Artz. Staff member Steve Goodrich and
Secretary Beth Shifler were also present. Member Charles Highbarger and County
Commissioner John Shank were absent.
C. MINUTES - AUGUST 9, 1995
A motion was made by Jane Hershey and seconded by Gerald Ditto to approve
the August 9, 1995 minutes as presented. All members voted in favor of the
motion except Bruce Johnston who abstained because he was absent from the August
9 meeting. The motion passed.
D. COMMUNICATIONS AND BILLS
Attached to the agenda were copies of the correspondence that resulted from
the Commission's actions on the Paul Stitzel and Harry Lai Preliminary
Consultations. They were provided for information.
E. BUDGET
There have been no expenditures out of the budget.

Rural Community Survey - CLG 95-96

G. NEW BUSINESS
1. Hagerstown's New Comprehensive Plan
The Historic District Commission received an invitation to participate in
a workshop conducted by the City of Hagerstown in preparation of a new
Comprehensive Plan. Bruce Johnston noted that the meeting date has changed from
September 23rd as noted to Saturday, November 4th. It will last for half the
day. Bruce Johnson will attend for the City of Hagerstown on transportation
matters. A brief discussion followed. The Commission noted that since the date
has changed there is time to discuss the matter in more detail and determine if
it wished to present a formal comments.
2. Parcel File Historic Data
Steve Goodrich informed the Commission that the Planning Department's
computer files have been modified by the addition of 4 new screens to accept data
from the Historic Site Survey. The information with the agenda is the key to the
data entry codes and corresponds exactly to the data contained in the survey
files. He also said this capability was in response to requests from the
preservation community via Pat Schooley and approved by the Board of County
Commissioners. The Department is looking for personnel to enter the data.
3. National Register Nominations: Rufus Wilson Complex
Marsh Mills.
Steve Goodrich began the discussion on this item by reminding the
Commission of it's Certified Local Government status. It includes the
responsibility of officially participating in the nomination process by making
recommendations on the applications along with the Board of County Commissioners.
He explained that the normal 60 day local government review period was not
available due to complications at the Trust. The need and ability to notify
owners of this meeting was also compromised. Two of the three owners were
notified by telephone at the last minute. None of the property owners were
present during the meeting. The Trust advised that the County should proceed
through the process as well as we could.

The Wilson complex is located along the route of the original National
Turnpike (14293 Rufus Wilson Road) near where it crosses the Conococheague Creek.
It contains a large second empire style mansion which was remodeled by Wilson
from an original 2 1/2 story limestone house dating to 1850, also built by
Wilson. The complex also contains a brick store and post office, ca. 1880, a
bank barn and carriage house. According to the application, the complex is
eligible for the National Register under Criteria A, association with events that
have made a significant contribution to the broad patterns of our history,
Criteria C, embodying distinct characteristics of a type, period or method of
construction and criteria D, yielding or likely to yield information important
in prehistory or history.
The Commission's discussion of the Wilson Complex focused on its
association with the National Road. As the application notes, it was
established, prospered and was modified all because of the association with the
Turnpike and the business from travelers on it. The Turnpike is noted as very
significant in local, State and National history as it encouraged and facilitated
westward expansion and travel.
Criteria C was also discussed in light of the complex's ability to
represent a significant type or style of architecture (limestone construction and
second empire style), for the way it was originally constructed or crafted, and
also for the way it was adapted at a later period illustrating changing taste,
attitudes, and uses over a period of time.
Based on the above discussion Bruce Johnston made a motion to recommend
nomination of the Rufus Wilson Complex to the National Register of Historic
Places because it is consistent with Criteria A. Jane Hershey seconded the
motion. The motion was approved unanimously.
Marsh Mills (Haley's Mill, Speilman Mill)
This site is located at 17426 and 17432 Spielman Road in the Fairplay area.
It contains a stone house, mill ruins, a barn, cooper shop and an altered,
possible log house. The application is presented as eligible for listing under
Criteria C, having distinctive characteristics of a type, period or method of
construction. The application focuses on the stone house as an excellent example
of regional vernacular architecture, the fact that it is very intact and that it
is dated to the end of the period when stone dwellings were constructed in the
area(1760-1840).
A discussion followed highlighting such factors as the significance of
stone dwelling construction and the milling industry in Washington County
history, the effects of listing on the ability to make changes to the property
and the changes already made including the front porch addition, removal of an
interior wall, the modern barn on the original foundation and the mill ruins.
There was also discussion about the tentative description of the four square
house containing remnants of a log house. There was also discussion of Criteria
C citing the numerous examples of eligible and non -eligible examples in the
publication.
In light of the fact that Criteria C indicates that major changes to
architectural features can make a site not eligible for listing and the changes
that have occurred on the subject site, Gerald Ditto made a motion to not
recommend nomination of this site to the National Register. Frank Artz seconded
the motion. The motion passed with Gerald Ditto, Henry Bonebrake and Frank Artz
voting in favor, Jane Hershey and Bruce Johnston opposed and Richard Bachtell
abstaining.

H. OTHER BUSINESS
1. Addition of a sign at the Sharpsburg Pharmacy
A proposal to add a sign on the Sharpsburg Pharmacy. arrived after the
agenda was distributed. The Sharpsburg Pharmacy is located on the north of Route
34, west of Sharpsburg. The Commission approved the exterior appearance of the
building in the Antietam Overlay Zone several years ago. The sign consists of
the word "Pharmacy" in 15° black plastic non -illuminated letters attached to the
front of the building with aluminum studs. No other information was available
due to the late submittal.
Jane Hershey made a motion to approve the sign. Henry Bonebrake seconded
the motion. In the discussion, Gerald Ditto stated he would like to see more
information on the building before he made his decision. He said he would like
to know the sign's exact location on the building and if there are any other
signs existing. It was noted that all other applications have been reviewed with
such information available. Jane Hershey withdrew her motion. Bruce Johnston
made a motion to table the application pending receipt of additional information.
Frank Artz seconded the motion. The motion was approved unanimously.
Establish Guidelines for Maintenance, -'Preservation and Restoration
Richard Bachtell reminded the Commission that it had discussed creating
guidelines for distinguishing between regular maintenance, restoration and
preservation. A brief discussion followed with Steve Goodrich noting that some
information had been gathered. He said that he felt the National Register
nominations would take up a large part of the meeting and he elected to delay
distributing the information until the next meeting.
3. Steve Goodrich reminded Commission members of the request from the
August meeting for their ideas or suggestions for projects to use ISTEA funds.
The Commission decided to consider them further and make suggestions at the
October meeting.

A & B CALL TO ORDER AND ROLL CALL
The regular monthly meeting of the Historic District
Commission, which was rescheduled from August 24, 1995, was called
to order by Chairman Richard Bachtell at 7:00 p.m. on August 9,
1995 in the second floor conference room of the Washington County
Administration Building in Hagerstown, Maryland. Members present
were Charles Highbarger, Frank Artz, Jane Hershey, Gerald Ditto,
and Henry Bonebrake. Staff members Steve Goodrich and Secretary
Beth Shifler were also present. Absent were Bruce Johnston and
County Commissioner John Shank.
C. MINUTES - MAY 3, 1995
A motion was made by Jane Hershey and seconded by Frank Artz
to approve the May 3, 1995 minutes. The motion was unanimously
approved.
D. COMMUNICATION AND BILLS
E. BUDGET
1. Approved FY'95-96 Budget
Following direction from the Board of County Commissioners the
FY '95-'96 budget has been reduced to $6,000 from $7,460. Steve
Goodrich reported that the CLG project for this budget year had not
been approved and the reduction was taken out of that item. The
$6,000 amount was approved by the Board of County Commissioners as
HDC's budget for the coming year.
F. UNFINISHED BUSINESS
1. Preliminary Consultation - Robert Millard
There have been minor changes to the concept plan. The
Commission did not see the need to revise its previous
recommendation.
2. Funkstown Historic Resources Survey - CLG 94-95
This project has been completed. There will be a final review
by the Maryland Historical Trust and possibly some minor revisions.

Recommendations
for
Reuse
The County has finally received reimbursement from the
Historic Preservation Grant in the amount of $8,506.11 for the
Reuse Feasibility Study and the connection to the public sewer
system. It is an appropriate time to remind the County
Commissioners that the building is awaiting the next phase of the
preservation effort and to make recommendations for its reuse. The
Commission had no specific suggestions other than those in the
Report.
G. NEW BUSINESS
1. Tax Credit Application TC-95-03 - 449 North Potomac St.
R & S Inc.
Mr. Robert Cochran, the owner, was present. The original
application, with before and after photographs, was passed around
for the Commission to view. This property is inside the City of
Hagerstown and is included in the Broadway Historic District. The
roof replacement, which accounts for the majority of the expenses
included on the application, does not require approval from the
Hagerstown preservation commission because it does not require a
building permit. It is a 10% credit application for preservation
or restoration (rather than a 5% credit for new construction added
to an existing building). The original roof was slate. Some
smaller roofs on projecting bays still have the original slate
material on them. The new roof material is an asphalt shingle
intended to produce a slate appearance (Colonial Slate by
Certainteed). Mr Cochran's chose this material over an imitation
slate because, in his opinion, it provides a more realistic slate
appearance. The garage was also done and the original roof was
duplicated there as well including exact duplication of the metal
ridge roll. Also included in the application is the duplication of
the wooden roof spires. The entire application amount is
$17,014.20 yielding a credit, if approved, of $1,701.42.

Prompted by remarks from Mr. Ditto and Mr. Artz the Commission
again engaged in the discussion of the indistinct differences
between regular maintenance and improvements and preservation. One
position is that there has been a clear effort to investigate what
the original material was and attempt to find a similar replacement
since the original is prohibitive in cost. The other position is
that all homeowners eventually must repair or replace roofs and not
everyone gets a tax credit for it.
Gerald Ditto suggested that the Commission should establish
some guidelines of what is considered normal maintenance and what
is considered improvement, restoration or preservation.
A motion was made by Jane Hershey and seconded by Charles
Highbarger to approved the application as submitted. The motion
was approved unanimously.
2. Preliminary Consultation - Harry Lai (Manor Church Road)
Site #WA -II -184
The planning staff held a Preliminary Consultation for this
development proposal on August -3.--_-The proposed lot layout was
provided to Commission members with the agenda. The existing
buildings on the site were noted on lot 14 and an existing barn
where a new road is proposed. The complex of buildings is listed
in the Historic Sites Survey as site # WA -II -184. Commission
members were provided copies of the site survey form. It appears
that there will be no attempt to retain the existing buildings
because a road is proposed through one and the others don't comply
with setbacks.
Jane Hershey mentioned that Manor Church Road was at one time
considered for listing on the National Register. She noted the
poor condition of the intersection with the Sharpsburg Pike. Steve
Goodrich responded to several comments about the road network by
saying that all of the new roads would have to be built to County
standards for new roads and improvements may be required on Manor
Church Road.
Forest Conservation Ordinance requirements also apply to this
property and development. Forested buffers between differing land
uses and retention of existing trees and forest around historic
sites are priorities.
On a motion by Charles Highbarger, seconded by Gerald Ditto,
the Commission voted unanimously to make the following
recommendations:

A. Lots 12, 13 and 14 and the road that is proposed to go
through the existing barn should be redesigned to place all of the
existing structures on one lot and in conformance with all
setbacks. Existing stone fences on the site should be preserved
and incorporated into the subdivision design.
B. In complying with the Forrest Conservation Ordinance
retention or additional planting should be given first priority
along the existing tree lines to provide a buffer between differing
land uses and around the existing historic buildings.
C. An additional point of access for the development is
recommended.
3. Recommendation - Cline/Harold Subdivision in AO -2 zone
The Commission was provided a vicinity map, a copy of part of
the zoning map that shows the property inside the AO -2 zone next to
the AO -1 zone and a copy of Section 407 from the Subdivision
Ordinance that gives the Planning Commission authority regarding
placement of houses in the overlay zone. Mr. Arch, the Planning
Director, has requested comment on the need to provide buffering or
placement of the house. Substantial public funds have been
invested in the area and adjacent properties to purchase easements
that limit development to protect the Antietam Battlefield and
farmland. Following a brief discussion Gerry Ditto made a motion
to recommend that no additional buffers or restrictions on the
placement of the dwelling be required. The motion was seconded by
Frank Artz. The motion was unanimously approved.
4. Review, Comment and Recommendation - Proposal to document
Stitzel property
A Preliminary Consultation was held in February for a proposal
to develop 117 lots on the Stitzel property at the corner of
Mercersburg and Barnhart Roads. The buildings on the property are
not listed in Historic Site Survey. There has been much opposition
to the proposal. Many residents in the area believe there is
historical and archeological significance in the site. One of the
earliest owners was the largest slave holder in Western Maryland
with one hundred and eighty eight slaves. Some feel there may be
an unmarked slave cemetery as well as many other undiscovered
artifacts. The concerned residents were able to convince the
Planning Commission that the developer should provide more concrete
evidence about the existence or lack of historic significance of
this property.

The Planning Commission requested documented evidence before
making a decision on whether additional protection for historic
resources was needed. The developer has submitted a proposal to
document the information. While reviewing the proposal the
Planning Commission expressed interest in a "Phase I" evaluation
but was also interested in the HDC opinion of the developers
proposal. It was supplied with the agenda material.
Steve Goodrich passed out a document titled Standards and
Guidelines for Archeological Investigations in Maryland. It was
prepared by the MHT and contains guidelines for Phase I, II and III
archeological investigations that are necessary when state or
federal funds are used in various projects (none are proposed to be
used in this project). It was pointed out that there are
similarities between the consultant's proposal and the MHT
requirements. The largest differences are that the consultant did
not propose any digging and it appears to be much less in depth
than MHT would require. There.was_a lengthy discussion about the
legitimacy of the claims of historic significance on this and other
sites, requiring this evaluation in only selected case rather than
for all development, the parties involved in this and other
development in the area.
Gerry Ditto made a motion to recommend that the Planning
Commission accept the developer's proposal for additional
documentation of the site and reserve the right to request
additional study if the initial report does not satisfy the
Commission's need for information. The motion also includes a
statement of HDC's opinion that the Planning Commission is setting
a dangerous precedent by requiring an archeological and historical
assessment of this site when it has not for any other developments.
HDC is of the opinion that it should be required of all development
or none at all. Frank Artz seconded the motion. Upon a vote,
Gerry Ditto, Frank Artz, and Charles Highbarger voted in favor of
the motion, Henry Bonebrake and Jane Hershey opposed and Rich
Bachtell abstained. The motion passed.
5. Suggestions for Transportation/Historic preservation
Enhancement projects.
ISTEA funds are Federal money given to the states for
transportation and related projects known as enhancements. In the
brochure provided to Commission members that explains the program,
historic preservation projects related to transportation are
eligible. The Planning Director, Mr. Arch, is looking for
suggestions from the Commission for ISTEA projects. Steve Goodrich
mentioned that Price's Bridge is a good example but that it is
already funded. Commission members will provide suggestions at the
September meeting.

6. Demolition Permit #95-4317 - 4904 Porterstown Road
The applicant Kimberly Giffin and owner Richard Ecton were
present to answer questions. County policy requires that
demolition permits for properties listed in the County's Historic
Sites Survey be referred to the HDC for review and comment prior to
issuance. The subject property is included in a small rural
community listed in the survey as "Flickersville". This property
is not listed individually.
It was Mr. Ecton's opinion that although this structure may be
from the same time period, it is not located in what he knows to be
Flickersville. That community is further down the road and all but
one of the houses that were there, and similar to the one in
question, have been torn down.
According to Mr. Ecton and Ms. Giffin's description the
structure is in very bad shape. It is only 12' wide. Ms.Giffin
has occupied the house for twelve years and has seen major
settlement over that time. The logs are deteriorating and the
building is 14" out of level in the living room. There are only
two electric outlets in the house. The plans are to replace the
house with a mobile home which is already located on the site.
The applicants were asked what they had planned to do with the
material after the building was dismantled. They said the logs are
rotting and would be of no use. Steve Goodrich noted a list of
contractors who do preservation type work and have expressed
interest in salvage material that the Commission has handed out in
the past.
Gerry Ditto made a motion to recommend no opposition to the
demolition of this property and to supply the applicant the list of
parties interested in the salvage. Henry Bonebrake seconded the
motion. The motion was unanimously approved.
7. Demolition Permit #95-4476 - 13811 National Pike
Property owner David Witmer was present to answer questions
the Commission may have on his demolition permit. This is a
similar situation to the previous application in Flickersville.
The house is located in another one of the small rural communities,
this one known as Shady Bower. The house is right along Route #40.
Mr. Witmer stated he has started to remove the boards to see what
was under them.

Gerry Ditto excused himself from the discussion and left the
meeting at this time to eliminate any appearance of a conflict of
interest since he is related to Mr. Witmer. Frank Artz stated he
didn't think there was a difference between the two demolition
applications, and made a motion to present no opposition. Charles
Highbarger seconded the motion. The motion was unanimously
approved.
Mr. Witmer noted that the Historic Society of Clear Spring was
interested in some of the logs.

Maryland Historical Trust which administers the National Register program as the State Historic
Preservation Officer for Maryland. If both the Historic District Commission and the County
Commissioners oppose the nomination, the process will stop unless an appeal is filed with the keeper of
the National Register, National Park Service. If either of these recommends nomination, the nomination
process will continue.

The nomination is recommended due to the significance and pristine condition
of the stone house which displays the distinctive characteristics of this type
and method of construction in Washington County and the Cumberland Valley. It is
also a rare example of this type of structure dating from the end of the period
when stone construction was prominent. The remains of the mill structure are
also significant and contribute to the importance of the district. The other
structures on the site are of more modern construction or have been substantially
altered to the degree that they are considered to be non-contributing to the
district.

The nomination is recommended because, as the application clearly explains, it
is consistent with National Register Criteria A and is associated with a pattern of
events that made a significant contribution to the development of Washington County,
the State of Maryland and the Nation. More specifically, the Rufus Wilson Complex
was established, existed and prospered at this location due to its relationship with
the National Road. The National Road, which bisects Washington County and is
intimately connected to its history, was a major encouragement to westward expansion
and settlement.
