HomeMy WebLinkAbout170808 MinutesBOARD OF COUNTY COMMISSIONERS OF WASHINGTON COUNTY Hagerstown, Maryland August 8, 2017 INVOCATION AND PLEDGE OF ALLEGIANCE Commissioner Barr offered the Invocation followed by the Pledge of Allegiance to the Flag by the full assemblage. CALL TO ORDER President Terry L. Baker called the regular meeting of the Board of County Commissioners of Washington County, Maryland, to order at 10:13 a.m. at 100 West Washington Street, Room 1113, with the following members present: Commissioners John F. Barr, Wayne K. Keefer and LeRoy E. Myers, Jr. Vice President Jeffrey A. Cline was absent. APPROVAL OF MINUTES — AUGUST 1, 2017 Commissioner Keefer, seconded by Barr, moved to approve the minutes of August 1, 2017. The motion passed unanimously. (4-0, Commissioner Cline was absent.) COMMISSIONERS' REPORTS AND COMMENTS No reports or comments were made by the Commissioners. REPORTS FROM COUNTY STAFF County Administrator County Administrator Rob Slocum thanked Executive Office Assistant Krista Hart and Planning Department Administrative Assistant Debra Eckard for filling in during the County Clerk's absence in June and July. CITIZENS' PARTICIPATION No citizens were present that wished to comment. FORMAL ADOPTION OF REZONING DECISIONS Kirk C. Downey, Deputy County Attorney, brought forward two rezoning decisions for consideration by the Commissioners. He advised that a third case, RZ-16-007, had been withdrawn by the applicant and need not be considered. MAP AMENDMENT RZ-16-003 The Commissioners discussed Map Amendment application RZ-16-003, a request from VA AVE, LLC to change the zoning classification of property located on the south side of Virginia Avenue and adjacent to the east side of I-70 consisting of 32.783 acres from ORT (Office, Research and Technology) to IR (Industrial, Restricted). A public hearing was held April 11, 2017 regarding the request. Mr. Downey reviewed the comments received during the public hearing at the request of Commissioner Keefer. August 8, 2017 Page 2 Commissioner Barr, seconded by Keefer, moved to adopt the ordinance to approve the requested reclassification of the property that is the subject of RZ-16-003 and to adopt the Decision and Findings of Fact as prepared in support of the approval. The motion passed unanimously. (4-0, Commissioner Cline was absent.) MAP AMENDMENT RZ-16-004 Map Amendment application RZ-16-004 from Applicant ACH, LLC concerns the request to change the zoning classification of property on the south side of Western Maryland Parkway north of Md. 144 from Office, Research and Technology (ORT) to Highway Interchange (HI). The County Commissioners held a public hearing on March 21, 2017 to obtain comments regarding the application. Commissioner Baker requested that the matter be brought back in two weeks so he may have further questions answered. It was the consensus of the Commissioners to bring the matter back during their August 22 meeting. CONTRACT RENEWAL — LANDFILL INSPECTION SERVICES REQUIREMENTS CONTRACT Dave Mason, Deputy Director, Solid Waste, recommended renewal of the contract with Duffield Associates, Inc. (DAI) of Carlisle, Pennsylvania, for Landfill Inspection Services (PUR-1229) for a one-year period commencing October 17, 2017 under the same terms and conditions as the current contract with the exception of an approximate rate increase of 3% for construction inspection and engineering services based on DAI's letter of request dated July 26, 2017. The services provided under the contract consist of providing inspection services for landfill -related construction projects located throughout the County. This requirements contract is utilized on an as -needed basis with no guarantee of minimum or maximum number of hours. Commissioner Myers, seconded by Barr, moved to renew the contract with Duffield Associates, Inc. (DAI) of Carlisle, Pennsylvania for a one-year period commencing October 17, 2017 on the same terms and conditions as the current contract with the exception of a rate increase of 3% for construction inspection and engineering services based on DAI's letter of request dated July 26, 2017. Commissioner Baker requested the total amount spent last year under the current contract. Mr. Mason advised that it involved one project in the range of approximately $40,000-$50,000. The motion passed unanimously. (4-0, Commissioner Cline was absent.) COMMUNITY DEPUTY PROGRAM Sheriff Douglas Mullendore requested approval of the addition of a full-time Community Deputy to work ten hours per week in Sharpsburg, ten hours per week in Keedysville and twenty hours per week in Williamsport through a cost-sharing agreement between those municipalities and Washington County. The fiscal impact including salary and benefits, uniforms, equipment, a vehicle with equipment will be $125,441. The Sheriff's Office will soon be implementing a School Zone Speed Camera Program and the County will use some of the proceeds from this program as a cost sharing measure with the municipalities August 8, 2017 Page 3 to provide these services. A deputy will work the designated hours requested by the municipalities. The Commissioners discussed details of the deputy's assignments and the costs shared by the municipalities. Sharpsburg Mayor Hal Spielman commented in favor of the proposal. Commissioner Keefer, seconded by Barr, moved to approve the addition of a new full-time Community Deputy to work ten hours per week in Sharpsburg, ten hours per week in Keedysville and twenty hours per week in Williamsport through a cost -sharing agreement between the municipalities and Washington County as presented. The motion passed unanimously. (4-0, Commissioner Cline was absent.) PROPOSED RATE REDUCTION FOR RESIDENTIAL TRASH FOR LARGE HAULERS Julie Pippel, Director, Water Quality, and Dave Mason, Deputy Director, Solid Waste, proposed a discounted rate for large residential trash haulers (with a contract) bringing in more than 10,000 tons per year. The proposed rate is $40 per ton. Mr. Mason indicated that currently County haulers with a contract bringing in more than 1,000 tons per year pay a rate of $45 per ton. The proposed $40 per ton would only be applied to haulers with a contract that bring in more than 10,000 tons and only applies to residential trash. The regular rate for trash is $52 per ton. Currently, the landfill receives approximately 200 tons of material each day; the additional trash from a residential bulk hauler would increase this amount to 233 tons per day. Yearly totals could increase from approximately 60,000 tons to 70,000 tons. Mr. Mason advised that the Commissioners would first need to reach a consensus to schedule a public hearing on the proposal due to the proposed rate change. The Commissioners discussed the proposal involving the likelihood of receiving additional business from haulers that now use out of town or private landfill sites. Mr. Mason and Ms. Pippel affirmed that the change potentially could result in additional business and income for the County landfill. It was the consensus of the Commissioners to schedule a public hearing regarding the proposed rate change. PROCLAMATION - NATIONAL HEALTH CENTER WEEK The Commissioners presented a proclamation to Kim Murdaugh, Executive Director of Family Healthcare of Hagerstown, and Susan Walter, Executive Director of the Tri-State Community Health Center in Hancock. The proclamation recognizes National Health Center Week observed August 13-19, 2017. Family Healthcare of Hagerstown and the Tri- State Community Health Center are locally owned and operated community health centers serving Washington County residents. Ms. Murdaugh and Ms. Walter described the services provided by the centers and thanked the Commissioners for the recognition. CONVENE IN CLOSED SESSION Commissioner Barr, seconded by Keefer, moved to convene in closed session at 10:50 a.m. to discuss the appointment, employment, assignment, promotion, discipline, demotion, compensation, removal, resignation, or performance evaluation of appointees, employees, or officials over whom this public body has jurisdiction; or any other personnel matter that John M. Martirano, County Attorney August 8, 2017 Page 4 affects one or more specific individuals; in accordance with Section 3-305(b)(1) of the General Provisions Article of the Annotated Code of Maryland. The motion passed unanimously. (4-0, Commissioner Cline was absent). In closed session, the Commissioners discussed the potential reappointment/appointment of several specific individuals to a local review board over which the Commissioners have appointment authority; discussed the potential reappointment of a specific individual to a local advisory committee over which the Commissioners have appointment authority; considered several County employee position recommendations and related staffing issues with staff; and briefly discussed a proposal to establish a new advisory committee. During closed session, the Commissioners agreed to further discuss the individuals being considered for reappointment/appointment to a local review board at a future open session meeting; agreed to further discuss the individual being considered for reappointment to a local advisory committee at a future open session meeting; and provided direction to staff regarding several specific personnel/employment recommendations. Present during closed session were Commissioners Terry L. Baker, John F. Barr, LeRoy E. Myers, Jr. and Wayne K. Keefer. Also present were Robert J. Slocum, County Administrator; Vicki C. Lumm, County Clerk; John M. Martirano, County Attorney; and at various times Sarah Sprecher, Assistant County Administrator; Phil Ridenour, Director, Hagerstown Regional Airport; Stephanie Stone, Director, Health and Human Services; Nikki Snyder and Tiffany Rexrode, Department of Social Services. ADJOURNMENT The closed session adjourned at 11:19 a.m. The Commissioners attended a luncheon at the Fort Ritchie Community Center where they presented a $24,386 check from insurance proceeds for facility upgrades at the Center.
