SUBJECT: RZ-16-004 APPLICATION FOR MAP AMENDMENT; ACH, LLC, Applicant

RECOMMENDED MOTION: N/A. Discussion Only. Reach consensus as to whether the
requested rezoning should be approved.
REPORT -IN -BRIEF: The applicant requests the rezoning of 21.436 acres of property
located on the south side of Western Maryland Parkway, north of West Washington Street.
DISCUSSION: The applicant requests reclassification of the property from Office,
Research and Technology (ORT) to Highway Interchange (HI). The Washington County
Planning Commission held a public rezoning meeting and the Board of County Commissioners
of Washington County, Maryland, held a public hearing on the application, where testimony was
received in support of and against the reclassification. The applicant claims that the ORT
classification was mistakenly applied to the property and that the HI zone is a better fit. The
Washington County Planning Commission recommended approval of the requested rezoning.
This matter is now on the agenda for discussion by the Board of County Commissioners to reach
a consensus on the issue of whether to approve or deny the rezoning request.
The Zoning Ordinance requires that any map amendment include consideration of the following
factors: (a) The report and recommendations of the Planning and Zoning Commission;
(b) Population change in the area of the proposed change; (c) Availability of public facilities in
the area; (d) Present and future transportation patterns in the area; (e) Compatibility with existing
and proposed development of the area including indication of neighboring sites identified by the
Washington County Historic Sites Survey and subsequent revisions or updates; (f) The
relationship of the proposed change to the Adopted Plan for the County, Development Analysis
Plan Map and Policies; (g) Whether there was a substantial change in the character of the
neighborhood where the property is located (not applicable, as the Applicant's case was
premised upon a mistake analysis); (h) Whether there was a mistake in the existing zoning
classification; (i) Whether there has been a convincing demonstration that the proposed rezoning
would be appropriate and logical for the subject property.

Public Hearing
SUBJECT: Agricultural Preservation District Applications — This is a public hearing
PRESENTATION DATE: May 23, 2017 at 10:30 a.m.

RECOMMENDED MOTION: Move to approve the 10 year Agricultural Land Preservation
Districts for the following five (5) property owners: Grove, Myer, Foltz, Seibert and Burns.
REPORT -IN -BRIEF: Each of these property owners owns title to agriculturally -assessed parcels in
Washington County. By applying for the County's Agricultural Land Preservation District program, each
landowner will commit their property to only agricultural land uses through a recorded district agreement
for a minimum period of ten years. After the ten year period ends, the landowners may elect to terminate
the district (in portion or in full) or remain in the district. Additionally, this program is a pre -requisite to
applying for a permanent easement through the Maryland Agricultural Land Preservation Program
(MALPP). Some basic information for each applicant can be found on the attached list.
DISCUSSION: On January 13, 2009 the BOC voted to continue with ten year District Agreements so as
to maintain the tax credit program, and as a means of landowners showing a commitment to agriculture
while waiting for funding for an easement sale. In order to qualify for the program, the district property
must be assessed Agriculture by the State of Maryland's Department of Assessments and Taxation, be at
least 50 acres (or 20 acres if it is contiguous to other preserved land), and have at least 50% of property
area consist of Class I, II and/or III soil capability. There are exceptions regarding intensity of use or
specialized use (dairy farms and orchards tend to qualify as high -intensity or specialized uses). If approved,
the enclosed applicants will be restricted to agricultural use only on their farms for a period of ten years. In
exchange the landowners will not pay County property tax on their agricultural land or buildings and they
will receive a credit of up to $711 on their farm house. The purpose of the public hearing is to take public
comment from interested parties.
FISCAL IMPACT: The cost of tax credits for these properties for the ten year period is approximately
$12/acre/year for a total of about $41,186 for the full 10 year period for 343.22 acres. This will be in the
form of property taxes not collected.
CONCURRENCES: The Agricultural Advisory Board approved the Districts because they meet
program criteria for size, soils and location outside growth areas. The applications are also consistent with
the Comprehensive Plan because they are all located in the rural area where no public water and sewer
facilities exist or are planned. The Myer, Seibert and Burns applications are also located in the Priority
Preservation Areas identified in the Comprehensive Plan.

SUBJECT: School Based Health Center Grant — Approval to Submit Application

RECOMMENDED MOTION: Move to approve the submission of the grant application for
the School Based Health Center Grant Program to the Maryland State Department of Education in
the amount of $200,384 and accept awarded funding.
REPORT -IN -BRIEF: The Washington County Office of Community Grant Management,
on behalf of and at the direction of the Local Management Board is seeking approval to submit a
an application to the Maryland State Department of Education requesting funding for School Based
Health Centers in Washington County.
DISCUSSION: Currently there are two School Based Health Centers in Washington County
which are located at South Hagerstown High School and Western Heights Middle School. The
Centers provide exams, prescriptions, immunizations, nutritional assessments, orders lab work and
assists in the management of chronic conditions such as asthma and diabetes, etc. Meritus Medical
Center is the vendor contracted to provide these services. They will be entering the 3rd year of a 4
year contract. Funding in the amount of $10,019 is included in the award for County administrative
support.
FISCAL IMPACT: Provides $10,019 for County administrative expenses.
CONCURRENCES: The Local Management Board approves the submission of the
proposal and recommends the acceptance of this award.

SUBJECT: Healthy Families Home Visiting Grant — Approval to Submit Application
and Sole Source Award
PRESENTATION DATE: May 23, 2017

RECOMMENDED MOTION: Move to approve the submission of the grant application for
the Healthy Families Home Visiting Grant to the Maryland State Department of Education in the
amount of $277,993, to accept the awarded funding, and to award a Sole Source contract to the
Washington County Health Department with the Sole Source contract being contingent upon
approval of the application for funding.
REPORT -IN -BRIEF: The Washington County Office of Community Grant Management,
on behalf of and at the direction of the Local Management Board is seeking approval to submit a
Fiscal Year 2018 Healthy Families Home Visiting grant application to the Maryland State
Department of Education.
The Healthy Families Home Visiting Program is a comprehensive program modeled after a
nationally renowned initiative. The goals of the program are to prevent child maltreatment through
early intervention, promote healthy growth, development and strengthening the parent -child
relationship. The Washington County Health Department is the vendor contracted to provide this
service.
DISCUSSION: In order to be a vendor for the Healthy Families program the vendor must
be certified as qualified by "Healthy Families America." This is a credentialing process and the
Washington County Health Department is the sole certified applicant in Washington County. The
record shows that the Washington County Health Department has been the only respondent to the
RFP that has been issued for this program since 2007. The Health Department has been the only
contracted vendor for this program since before the year 2000.
The OCGM wishes to apply Section 1-106.2(a)(1) of the Code of Local Public Laws of
Washington County, Maryland, to the procurement requested. This section states that sole source
procurements are authorized and permissible when: (1) only one source exists that meets the
County's requirements.
This request requires the approval of four (4) out of five (5) Commissioners in order to proceed
with sole source procurement. If approved, the following remaining steps of the process will occur
as outlined by the law. 1) Not more than ten (10) days after the execution and approval of a contract
under this section, the procurement agency shall publish a notice of the award in the newspaper of
general circulation in the County, and 2) An appropriate record of the sole source procurement
shall be maintained as required.
FISCAL IMPACT: The Office of Community Grant Management receives $6,950 for
administrative expenses. The total funding allocated to the Washington County Health Department
is $271,043. No County funds are involved in this award.
CONCURRENCES: The Local Management Board approves the submission of the
proposal and recommends the acceptance of the award. Karen Luther, Director of Purchasing
concurs as to the Sole Source procurement request.

SUBJECT: Contract Award (PUR-1348) — Stop Loss Insurance Coverage

Benefits & Insurance Services, Inc.
RECOMMENDED MOTION: Motion to award a contract for Stop Loss Insurance to the
responsive, responsible proposer, Sun Life Financial of Wellesley Hills, MA who submitted the
lowest price with no special terms for high claimants for a total annual premium of $573,663.00 with
specific stop loss @ $175,000 per claimant.
REPORT -IN -BRIEF: The Request for Quote (RFQ) was advertised on the State's
"eMaryland Marketplace" web site, on the County's web site, and in the local newspaper. Direct
notice of the solicitation was e -mailed to nine (9) potential providers of the insurance.
Quotations were received before the deadline on May 5, 2017 from four (4) companies that are
providers of Stop Loss Insurance. Two (2) were received after the deadline and were not considered.
The pricing in the quote from Sun Life Financial is only firm until May 26, 2017.
DISCUSSION: N/A
FISCAL IMPACT: The amount budgeted for health insurances and stop loss insurance
coverage in FY 2018 is $15,146,250 based on a 1.74% increase to the FY 2017 Approved Budget
amount of $14,887,760.
CONCURRENCES: As recommended with the concurrence of the Director of Health and
Human Services, County Benefits Coordinator
