MINUTES OF THE HISTORIC DISTRICT COMMISSION FOR WASHINGTON COUNTY November 3, 2021
The Washington County Historic District Commission held its regular monthly meeting on Wednesday,
November 3, 2021 at 7:00 p.m. at the Washington County Administrative Complex, 100 W. Washington
Street, Room 2001, Hagerstown, Maryland.
CALL TO ORDER AND ROLL CALL
The Chairman called the meeting to order at 7:00 p.m.
Commission members present were: Greg Smith, Chairman, Lloyd Yavener, Vice Chairman, Ann Aldrich,
Vernell Doyle, Michael Lushbaugh, and Edie Wallace. Staff members present were: Washington County
Department of Planning & Zoning: Jill Baker, Director; Meghan Jenkins, GIS Coordinator and HDC Staff
member; and Debra Eckard, Administrative Assistant.
MINUTES
Motion and Vote: Mr. Yavener made a motion to approve the minutes of the October 6, 2021 meeting
as presented. The motion was second by Ms. Aldrich and unanimously approved.
NEW BUSINESS
Demolition Permit 2021-04260 – 16822 National Pike
Ms. Jenkins presented for review a demolition permit application for property located at 16822 National
Pike also known as the JR Fridinger/Dickinson Farm. The application is proposing the demolition of 2
dwellings, 2 barns, 2 garages, and 2 sheds. The property is currently zoned PI (Planned Industrial). Ms.
Jenkins noted that the property owner has acknowledged there have been some significant changes over
time to the original structure, such as: the roofline of the main house, an addition to the rear of the house,
and interior renovations; however, all buildings appear to be in good condition and sound. She noted that
the State Highway Administration will require an entrance permit if the site develops which will require a
Section 106 review of the property. MHT will be involved in the Section 106 review.
Mr. Mark Dickinson, property owner, Trevor Frederick from Frederick, Seibert & Associates, the
consultant, and Joe Franek and Brian Stahl from Northpoint Development were present at the meeting.
Mr. Dickinson stated that most of the interior was recreated in the 1980s with the exception of the stone
walls which were original to the house as referenced in the Maryland Inventory of Historical Places. He
noted that Northpoint Development has offered various aspects of the structures to individuals for
repurposing, such as the stone from the walls. Mr. Dickinson stated that some of the stone will be
repurposed on site by Northpoint at the entrance. The owners of Rockland Estates on Sharpsburg Pike
have expressed an interest in some of the stone to build a monument on their property recognizing the
Underground Railroad. They have also expressed an interest in 3 or 4 doors in the house and barn
materials to repair the bank barn on Rockland Estates. Northpoint Development has agreed to honor
these requests and to donate the materials to Rockland Estates. Mr. Dickinson stated that if other people
are interested in repurposing parts of the structures, he would be willing to coordinate those efforts.
Mr. Dickinson explained restrictions on the property which make it necessary to demolish the structures
in order to meet the needs of the proposed development. He noted that the property between the two
buildings is bisected by a high voltage power line subject to an easement of 100 feet in width on each
side. On the west side, there is a stream which borders the property. Northpoint Development will retain
28 acres of forest on the northwest side of the property to meet Forest Conservation mitigation
requirements. Therefore, this portion of the property will not be developed.
Mr. Dickinson noted that Northpoint Development has entered into a pre-annexation agreement with the
City of Hagerstown. Extension of water and sewer services would serve an additional 29 properties. He
believes the proposed development would create a great economic benefit for the County and its citizens
by creating jobs and a generous tax base of more than $1 million per year.
Mr. Brian Stahl and Mr. Trevor Frederick briefly discussed the current stage of construction. A grading
permit was applied for in August 2021. A mass grading plan has been submitted to the County and is
currently under review. The grading permit should be approved and issued in December. A site plan will
then be submitted to the County in the Spring of 2022. Building permits and SHA widening work should
start in the late spring of next year. A traffic impact study has been completed and has been approved by
both the State and the County. This study generated some off-site improvements which Northpoint is in
the process of completing as part of this project.
Mr. Frederick explained that Northpoint has applied for a permit through MDE for work within the
wetlands buffer and FEMA flood plain. Public notices have been sent to neighboring property owners.
Permits from MDE are expected by the end of November or December. A permit from SHA will be required
for the two proposed entrances.
Discussions: There was a brief discussion regarding the Section 106 review. Commission members
expressed concern that the buildings would be demolished and the project would be abandoned thereby
leaving the County without its historic resource. The applicant does not foresee any obstacles that would
cause them to abandon the project.
Commission members were also concerned that the MHT review would not happen before the structures
are demolished. The MHT review would provide a more thorough investigation of the property and its
history. There was a brief discussion between the applicants and the Commission members regarding a
pro-active approach of obtaining all information that would be necessary for the MHT review and moving
forward with the review process ahead of the SHA permit application process.
Motion and Vote: Mr. Yavener made a motion to support the demolition permit with the understanding
that the Section 106 review will occur prior to demolition of the structures, if possible. The motion was
seconded by Ms. Doyle and unanimously approved.
MD SHA Consultation, Bridge 2100200, Project No. 23878
Ms. Jenkins presented a request from MD SHA to review the proposed removal of graffiti from Bridge No.
2100200, MD 34 over the Potomac River and the C & O Canal National Historic Park (NR-12/MIHP No. WA-
VI-48). The State is seeking concurrence from the HDC that there will be no adverse effects on the historic
properties and an acknowledgement of MDOT SHA’s de minimis finding of concurrence.
Motion and Vote: Ms. Aldrich made a motion to support the removal of graffiti from Bridge No. 2100200
as presented. The motion was seconded by Ms. Wallace and unanimously approved.
OTHER BUSINESS
Staff Report
Ms. Jenkins gave a brief update on the following:
• The Board of County Commissioners will present a Certificate of Recognition to Mr. Tom Clemens
on Tuesday, November 16th. All Commission members are welcome to attend the meeting.
• Meghan and Wyatt continue to work on the Design Guidelines.
• Staff has contacted the GIS office to get an interactive cemeteries inventory map on the website.
This map will be linked to the SHA’s site.
• Staff will schedule the CLG HPC 102 Training for December 8th from 6 to 8 pm. December 7th will
be the alternate date.
• The By-laws will be updated by the County Clerk’s office in the near future. Staff has provided her
the list of proposed changes members discussed for inclusion.
• Staff is working on the pole building policy that was discussed during the previous meeting.
• Meghan will be making a presentation on November 18th at the Lunch & Learn for local real estate
agents. She will present information on the following topics: Duties of the Historic District
Commission, tax credits and demolition of historic properties.
• Meghan presented a list of historic resources on non-residentially zoned properties located within
the County and Town growth areas. Members have been asked to review this list to determine if
there are any properties we should actively seek out for the HP overlay and contact the property
owners.
Discussion: Members discussed the potential problems in the demolition permit process that were
encountered at this evening’s meeting. Members believe there should be a joint meeting with the HAC
to discuss these issues prior to having a workshop with the BOCC in order to present a united front.

SUBJECT: HDC Policy No. 2021-01 :Review of Pole Buildings
Purpose
This memorandum will serve as a policy for the review of permit submittals involving pole buildings to
the Historic District Commission (HDC). This policy will apply to review of accessory structures
categorized as pole buildings in the permit application for areas of HDC review such as the Historic Rural
Villages, Historic Preservation Overlay, Antietam Overlay and any additional areas under HDC review.
The areas for review and review types for the HDC are outlined in the Washington County Zoning
Ordinance Section 20.6-Historic Preservation, Section 5D.4-Rural Village and Section 20A-Antietam
Overlay.
Definitions
For the purpose of this policy the following definition(s) shall apply:
Pole Building is an accessory structure that involves posts as a framing member buried in the ground to
support the weight of the walls and roof.
Review Guidelines
1. Construction of pole buildings in the Antietam Overlay or Rural Village zoning districts that are
designated as farm buildings are not subject to HDC or staff review per Article 20 of the zoning
ordinance.
2. Permit applications for construction of pole buildings that will require HDC review:
a. Construction of pole buildings in the Historic Preservation Overlay
b. Construction of a pole building, associated with a residential use, on a property or
portion of property which DOES contribute to Historic Rural Village.
c. Construction of pole buildings in any of the areas reviewed by the HDC that are
associated with a commercial use.
3. Permit applications for construction of pole buildings that may be designated to staff for review
on behalf of the HDC:
a. Construction of a pole building , associated with a residential use, on a property or
portion of property which does NOT contribute to the Historic Rural Village .
b. Construction of a pole building which is a direct replacement (size, location, materials)
on a property or portion of property which DOES contribute to the Historic Rural Village
4. If Staff: (1) is uncertain whether or not the application meets the criteria for staff review or (2)
does not support the approval of the permit application, or (3) determines that the application
does not meet the criteria for staff review, the application will be placed on the next available
Commission meeting agenda.
5. Any reviews completed by staff will be reported to the Commission at its monthly meeting.
Procedures
1. The applicant will file for the building permit with the Department of Permits and Inspections
which will then be routed for review to the HDC. All application requirements of the Department
of Permits and Inspections and those listed in the Zoning Ordinance under the respective zoning
category must be met for review to proceed.
2. If the application fits with the guidelines for staff review, staff will endeavor to review and act
within ten (10) business days from the date the application is deemed complete and routed for
review.
3. If the application meets the appropriate guidelines for staff review, staff will issue a letter of
support for the permit.
4. If the application does not meet the appropriate guidelines for staff review, staff will schedule
the application for the next available HDC agenda.

is included on the MIHP, we send a "no review-contact" letter to introduce the HDC and
the programs available, such as tax credits. Letters sent for review, especially demolition

The HDC met 11/2 to discuss this permit. A detailed letter is attached in the documents. The HDC voted
to support approval of the permit with the condition that the applicant will pursue MHT project review
before demolition of the structures and document the property using MHT-MIHP standards in good faith.
