The Regular Meeting of the Board of County Commissioners of Washington County was
called to order at 9:00 a.m. by the President, Ronald L. Bowers, with the following
members present: Vice President Linda C. Irvin, and Commissioners R. Lee Downey,
Richard E. Roulette and John S. Shank.
INVOCATION AND PLEDGE OF ALLEGIANCE
The Invocation was delivered by Commissioner Bowers, followed by the Pledge of
Allegiance to the Flag by the full assemblage.
MAY YOUTH OF THE MONTH AWARD - DEBORAH KINGSBURY
Commissioner Irvin presented a Certificate of Merit to Deborah Kingsbury in
recognition for being selected as the May Youth of the Month. Commissioner Irvin
listed the many school, church and community activities which Deborah is involved
with and commended her for her participation. Deborah thanked the County
Commissioners for the Certificate and for noticing her efforts.
ACCEPT DEED AND PERFORMANCE BOND
Motion made by Commissioner Roulette, seconded by Irvin, to accept the deed for .45
acres of additional right-of-way needed on Mondell Road from Griffith and Mary
Garwood as described in Plat Folio 2651, Section B, and to accept a Letter of
Credit in the amount of $9,000 from R. Lee Downey, for Section 10 of VanLear Manor
for the first 700' of Hershey Drive and all of Cadwell Court. Motion carried with
Commissioners Bowers, Irvin, Roulette and Shank voting "AYE" and Commissioner
Downey "ABSTAINING".
APPROVAL OF MINUTES - MAY 16, 1989
Motion made by Commissioner Shank, seconded by Roulette, to approve the minutes of
May 16, 1989, as amended. Unanimously approved.
LINE ITEM TRANSFER - SHERIFF'S DEPARTMENT
Motion made by Commissioner Downey, seconded by Irvin, to approve the line item
transfer requested by the Sheriffs Department transferring $1,000 from Rentals -
Office Equipment (01-5-0201-523-010) to Contract Maintenance & Repair (01-5-1201-
554-000), $975 from Rentals - Office Equipment to Tires (01-5-1201-551-010), and
$360 from Training Materials (01-5-1201-527-010) to Operating Expenses - S.C.U.B.A.
(01-5-1201-520-030). Unanimously approved.
APPOINTMENT - CHILDREN'S COUNCIL
Motion made by Commissioner Irvin, seconded by Roulette, to appoint Jill Burkhart
to the Children's Council for a three year term. Unanimously approved.
REAPPOINTMENTS - WESTERN MARYLAND HEALTH PLANNING AGENCY
Motion made by Commissioner Irvin, seconded by Downey, to reappoint Peter Callas
and Jean Kaylor to the Governing Board of the Western Maryland Health Planning
Agency as Consumers for a three-year period from June I, 1989. Unanimously
approved.
BID AWARD - INSTALLATION OF HEATING SYSTEM - CO. 28
Motion made by Commissioner Irvin, seconded by Roulette, to award the bid for
installation of a heating system for Company 28 to J & W Mechanical who submitted
the low bid, meeting specifications, of $11,327 and to waive the performance bond
based on the recommendation of the General Purchasing Agent. Unanimously approved.
BID AWARD - INSTALLATION OF INSULATION - CO. 28
Motion made by Commissioner Downey, seconded by Shank, to award the bid for
installation of insulation at the Company 28 building to Ellsworth Electric, who
submitted the low bid of $16,500 and to waive the performance bond based on the
recommendation of the General Purchasing Agent. Unanimously approved.
REAPPOINTMENTS - GOVERNOR'S OFFICE
Barry Teach, County Administrator, informed the Commissioners that the County has
received copies of letters from the Governor's office reappointing Woodrow Rippeon
to the Board of License Commissioners to June 1995 and reappointing Richard Coss,
Geraldine Harmon, Ralph McCauley, Oscar Spigler and Walter Bell, Jr., to the Board
of Election Supervisors to June 1991.
PREPARATION OF SPECIFICATIONS - ASBESTOS REMOVAL
Motion made by Commissioner Roulette, seconded by Irvin, to accept the
recommendation of the Coordinating Committee and award the contract to prepare
specifications for removal of asbestos from the Washington County Administration
Building to Spotts, Stevens & McCoy for the low proposal of $7850 and $582 per day
for construction management and monitoring, with the conditions that a penalty of
$250 per day be assessed for each day over the 56 days specified for completion of
the contract and that Ellis Anderson be designated as Project Manager for the work
to be performed and any replacement must be approved by the County government.
Unanimously approved.

SITE SUITABILITY STUDY - LANDFILL SITES
Motion made by Commissioner Irvin, seconded by Roulette, to approve the Coordinat-
ing Committee's recommendation to award the contract for a Site Suitability Study
for a Sanitary Landfill and Land Reclamation site to Century Engineering to perform
the Phase I evaluation of the sanitary landfill site for the proposal submitted in
the amount of $82,500 and to perform the Phase 11 portion of the project for the
land reclamation site in the amount of $128,486. Unanimously approved.
AMEND UNIFIED PLANNING WORK PROGRAM - FY 1989
Motion made by Commissioner Irvin, seconded by Downey, to amend the Unified
Planning Work Program for Fiscal Year 1989 by correcting the error on Task B.3 and
adding Tasks B.4 - Micro -computer Transportation Network and Task B.5 - Journey to
Work Project and also to provide for the City of Hagerstown's Planning Department
to participate as part of the Metropolitan Planning Organization's staff on Special
Studies Tasks B.4 and B.S. Unanimously approved.
WATER/SEWER STUDY FOR HAGERSTOWN AREA - REQUEST FOR PROPOSALS
Barry Teach, County Administrator, presented the Commissioners with copies of the
Request for Proposals for the water/sewer study for the Hagerstown Metropolitan
area for their review and comment. Mr. Teach explained that the County has agreed
to cooperate on this study and fund 50% of the cost. Commissioner Roulette
commented that organizational/governmental responsibility for provision of
utilities also be added to the study.
REZONING CASES RZ-409-411 & SUBDIVISION ORDINANCE AMENDMENT S-5
James Brittain, Executive Director of the Planning Commission, and Stephen
Goodrich, Senior Planner, met with the Commissioners to review rezoning cases RZ-
409, 410 and 411 and Subdivision Ordinance Amendment S-5. Mr. Goodrich reviewed
the text of the overlay zones for the Antietam Battlefield area and stated that RZ-
409 was disapproved sometime ago; RZ-410 would add new text in the Zoning Ordinance
that describes the Antietam overlay itself; and RZ-411 is a map amendment that
applies the overlay to properties on the map. Mr. Goodrich stated that the purpose
of the overlay zones are to protect the quality of the viewshed and to assure that
any development is compatible with the historic and agricultural character of the
neighborhood. Mr. Goodrich also stated that the rezoning only provides an overlay
and does not change the land use permitted by the traditional zoning - it is in
addition to land use zoning categories.
The AO -I zone (battlefield buffer zone) encompasses the boundaries of the Antietam
National Battlefield Park and a few additional properties. Mr. Goodrich explained
if a building permit is required in this zone, the exterior appearance of all
additions or buildings, unless exempt, are subject to architectural review by the
Historic District Commission. Farm buildings are also subject to this review.
The AO -2 zone (approach zones) runs along the major highways leading to the
battlefield on 1000' on either side and requires architectural review for
commercial and non-residential buildings.
The AO -3 zone (Red Hill zone) does not require Historic District Commission review
but deals with trees and the viewshed of the battlefield. If tree cutting is to be
done without development, a Forestry Management Plan is required; however, if
development is to occur, trees may be removed to establish access, to build homes
or outbuildings, and an area 25' around the development can be cleared without a
Forestry Management Plan or additional restrictions.
At this time the Commissioners delayed further review of the subject rezoning cases
until scheduled bid openings were completed.
BID OPENING - BEAVER CREEK ROAD RECONSTRUCTION
The bids for the Beaver Creek Road reconstruction were publicly opened and read
aloud. Firms participating in the bidding and their proposals were as follows:
Poole & Sons Excavating - $139,920; Antietam Construction - $159,874; Building
Systems, Inc. - $137,265; Fayetteville Contractors, Inc. - $84,650; and P & W
Excavating - $97,646.50. The bids will be reviewed by appropriate officials prior
to a decision being rendered. (Decision rendered later in this Session.)
BID OPENING - HARPERS FERRY ROAD BRIDGE
The bids for the Harpers Ferry Road Bridge were publicly opened and read aloud.
Firms participating in the bidding and their proposals were as follows: Antietam
Construction - $199,680; Building Systems, Inc. - $181,237; and Fayetteville
Construction - $210,700. The bids will be reviewed by appropriate officials prior
to a decision being rendered. (Decision rendered later in this Session.)

BID OPENING - ROAD OVERLAY
The bids for road overlay were publicly opened and read aloud. Firms participating
in the bidding and their proposals were as follows: Richard F. Kline - $26.50
price per ton; Wolfe Brothers - $23.65 per ton; and P & W Excavating - $23.45 per
ton. The bids will be reviewed by appropriate officials prior to a decision being
rendered.
BID OPENING - TRAFFIC PAINT & BEADS
The bids for traffic paint and beads were publicly opened and read aloud. Firms
participating in the bidding and their proposals were as follows: Flex -O -Lite -
$8.2425/bag, Total - $8,654.63 (traffic beads); Ennis Paint Manufacturing - 4500
gal. yellow paint - $4.416/gallon or $19,872 total, 1500 gal. white paint - $4.60
/gallon or $6,900 total; Sherwin Williams - 4500 gal. yellow paint - $4.73/gallon
or $21,285 total, 1500 gal. white paint - $4.91/gallon or $7,365 total; Potters
Industries - $10.50/bag, Total - $11,675 (traffic beads); and Linear Dynamics -
4500 gal. yellow paint - $4.15/gal. or $18,675 total, 1500 gal. white paint -
$4.60/gal or $6.900 total. The bids will be reviewed by appropriate officials
prior to a decision being rendered.
REZONING CASES - ANTIETAM OVERLAY ZONES, CONT'D.
The Commissioners each commented regarding the proposed overlay zones and
disspelled misinformation which has been circulating regarding these rezoning
cases. In their discussions the Commissioners also agreed to exempt farm buildings
in the AO -2 zone from review by the Historic District Commission, to remove
the words "general appearance" in the AO -I zone for farm structures, and to change
the language to "clearcutting" on item 4) regarding the AO -3 zone.
Commissioner Shank requested that the vote on these cases be delayed one week to
allow him to formally review the applications and the tapes of the public hearing.
The Commissioners agreed to this request.
Commissioner Roulette also mentioned that the Historic District Commission is
preparing a proposal to allow property owners to receive tax credit for restoring
buildings on the Historic Site Survey. The proposal will be presented by the
Historic District Commisison when it is completed. The Commissioners then opened
the meeting for testimony and questions.
CONVENE IN EXECUTIVE SESSION
Motion made by Commissioner Roulette, seconded by Irvin, to convene in Executive
Session at 1:10 p.m. in regard to personnel, property, and potential litigation in
accordance with Section 10.508 of the State Government Article of the Annotated
Code of Maryland. Unanimously approved.
Commissioner Bowers was excused from the meeting at 3:10 p.m., and Commissioner
Irvin assumed the Chair.
RECONVENE IN REGULAR SESSION
Motion made by Commissioner Downey, seconded by Roulette, to reconvene in Regular
Session at 3:50 p.m.
EMPLOY CLERK -TYPIST I - HOUSING & COMMUNITY DEVELOPMENT
Motion made by Commissioner Roulette, seconded by Shank, to employ Laurie
Montgomery as a Clerk -Typist I in the Housing & Community Development office to
fill an existing vacancy. Unanimously approved.
PROMOTION - CHIEF PLUMBING INSPECTOR
Motion made by Commissioner Roulette, seconded by Downey, to promote Edward Parker
to Chief Plumbing Inspector to fill an existing vacancy. Unanimously approved.
TRANSFER - SCOTT DOYLE
Motion made by Commissioner Shank, seconded by Roulette, to transfer Scott Doyle
from the Transportation Commission to the Court House Maintenance Dept.
Unanimously approved.
BID AWARD - HARPERS FERRY ROAD BRIDGE
Motion made by Commissioner Downey, seconded by Roulette, to award the bid for the
Harpers Ferry Road Bridge to Building Systems, Inc., who submitted the low bid of
$181,237. Unanimously approved.
BID AWARD - BEAVER CREEK ROAD RECONSTRUCTION
Motion made by Commissioner Shank, seconded by Roulette, to award the bid for the

Motion made by Commissioner Downey, seconded by Shank, to approve the line item
transfer of $5,000 from Advertising (01-5-0201-521-000) to Other -Promotion (01-5-
0201-529-060). Unanimously approved.
BID AWARD - STORMWATER DETENTION POND - BUSINESS PARK
Motion made by Commissioner Downey, seconded by Roulette, to award the bid for
construction of a stormwater detention pond at the Washington County Business Park
to K. M. Faith Construction who submitted the low bid of $10,800. Unanimously
approved.
BID AWARD - PARK IMPROVEMENTS
Motion made by Commissioner Roulette, seconded by Shank to award the bid for
Regional Park improvements to Fayetteville Contractors who submitted the low bid of
$521,800. Unanimously approved.
LINE ITEM TRANSFER - HOUSING & COMMUNITY DEVELOPMENT
Motion made by Commissioner Roulette, seconded by Shank to approve the line item
transfer of $500 from Per Diem (01-5-0211-528-010) and $500 from Tuition Assistance
(01-5-0211-527-010) to Dues & Conventions (01-5-0211-526-000). Unanimously
approved.
