HomeMy WebLinkAbout890404April 4, 1989 Hagerstown, Maryland 21740 The Regular Meeting of the Board of County Commissioners of Washington County was called to order at 9:00 a.m. by the President Ronald L. Bowers, with the following members present: Vice President Linda C. Irvin, and Commissioners R. Lee Downey and Richard E. Roulette. INVOCATION AND PLEDGE OF ALLEGIANCE The Invocation was delivered by Commissioner Bowers, followed by the Pledge of Allegiance to the Flag by the full assemblage. JANUARY YOUTH OF THE MONTH AWARD - JEREMY BROWN Commissioner Irvin presented the January 1989 Youth of the Month Award to Jeremy Brown, as recommended by the Children's Council. Commissioner Irvin commended Jeremy for his participation with the Longmeadow Volunteer Fire Company, St. Mary's Church and Sunday School and the North High School Band. Jeremy thanked the Commissioners for the award. INTRODUCTION OF NEW EMPLOYEE Paul Prodonovich, Director of Permits & Inspections, introduced George "Jungle" Miller, the new Building Inspector in his department. BOARD/COMMISSION REPORTS Commissioner Roulette reported on the Planning Commission meeting and the Public Golf Corporation Meeting and stated that Black Rock Golf Course will open April 14; Commissioner Irvin gave a report on the Historic District Commission meeting and the Women's Fair; Commissioner Bowers reported that he met with the Restaurant Association and that there had been some confusion regarding the exemption of inspection fees from the Health Department for non-profit organizations since it only applies to those who do not hold a liquor license and requested that Mr. Teach contact the Health Department regarding this matter. Barry Teach, County Administrator, informed the Commissioners that settlement for the purchase of FSLIC property occurred yesterday. BOARD OF EDUCATION - CAPITAL BUDGET Motion made by Commissioner Downey, seconded by Roulette, to approve the revised Fiscal Year 1990 Capital Budget amount for the Board of Education in the amount up to $7,686,285, which will allow them to proceed with projects that must be started in the summer months. Unanimously approved. TOWN OF HANCOCK - SUPPORT FOR CDBG APPLICATION Motion made by Commissioner Roulette, seconded by Irvin, to support the Community Development Block Grant application submitted by the Town of Hancock for a downtown revitalization project and to contribute $2500 toward the matching funds needed. Unanimously approved. AGRICULTURAL EASEMENT PURCHASE PROGRAM Stephen Goodrich, Senior Planner, appeared before the Commissioners to explain the changes in the Agricultual Easement Purchase Program application procedure and the details of how the funding is divided between the counties. Mr. Goodrich explained that the County has $281,686 in the general allotment fund, $333,064 is the County's share of the Agricultural Transfer Tax, and after receiving the matching funds will have available $1,114,283.35 for agricultural purchases. Motion made by Commissioner Roulette, seconded by Irvin, to request approval of its local Agricultural Preservation Program and to participate in the State Development Rights Easement Purchase process, with the stipulation that Washington County's financial obligation in easement puchases be limited to that which can be covered by the local one-third share of the Agricultural Transfer Tax. Unanimously approved. BID AWARD - VIDEO SURVEILLANCE EQUIPMENT - NARCOTICS TASK FORCE Motion made by Commissioner Roulette, seconded by Irvin, to award the bid for video surveillance equipment needed by the Narcotics Task Force to Beryl Marketing who submitted the low bid of $4,083. Unanimously approved. PILOT RECYCLING PROPOSAL James Brittain, Director of the Planning Department, explained that pursuant to House Bill 714, recycling will take place in three phases. Phase I requires that the County submit a concept plan by August 31. In Phase 11, the completed recycling plan must be submitted by July I, 1990 and in Phase III, the waste stream must be reduced by 15% prior to January 1994. The proposed pilot program targets two neighborhoods, Tammany and St. James, for participation in a voluntary recycling APRIL 4, 1989 MINUTES, CONT'D. plan which should be operational by July I. The County will provide each household participating in the program with a set of stackable plastic cartons in which to store recyclables such as cans, glass and newspapers, which will then be picked up once a week. Mr. Brittain explained that the sets have been priced at $17/set and the total expenditure would be approximately $20,000-$25,000 which also includes labor, equipment and printing brochures. Barry Teach recognized and thanked those on the committee who developed this proposal and commended them the thorough job they did in such a short period of time. RIGHT-OF-WAY REQUEST - POTOMAC EDISON Motion made by Commissioner Downey, seconded by Roulette, to approve the request for right-of-way made by the Potomac Edison Company for the Interstate Industrial Park along the County right-of-way into Caldwell Manufacturing. Unanimously approved. INSPECTION & MAINTENANCE AGREEMENT AND PERFORMANCE BOND Motion made by Commissioner Downey, seconded by Roulette, to accept the following agreements: Inspection & Maintenance Agreement for stormwater feasibility by Donald M. Bowman, Jr. for the area south of the intersection of Halfway Boulevard and Hopewell Road and to accept the Performance Bond from the Charles E. Brake Company for 1350' of roadway located in the Colonial Park East Subdivision - 700' of Standford Way, 300' of Sweetbriar Lane and 350' of North Colonial Drive with bond set at $25,000. Unanimously approved. APPOINTMENT - TOURISM ADVISORY COMMISSION Motion made by Commissioner Downey, seconded by Roulette, to appoint Frank Sagi to the Tourism Advisory Board for a two-year term extending to April 1991. Unanimously approved. BID OPENING - TAX BILL FORMS The bids for the tax bill forms were publicly opened and read aloud. The firms and their proposals were as follows: Antietam Paper Co. - $3,110.24; Moore Business Forms and Systems - $4,464.03; Standard Register - $4,965.19; and Trade Forms & Supply - $4,370.20. The bids will be reviewed by appropriate officials prior to a decision being rendered. (Decision rendered in the Afternoon Session.) BID OPENING - TRUCK TURNAROUND The bids for the construction of a truck turnaround at Rohr Industries were publicly opened and read aloud. The firms participating in the bidding and their proposals were as follows: D. L. George & Sons - $27,950; Fayetteville Contractors - $15,500; Henson and Son - $327720; P & W Excavating - $14,025; and C. L. Milburn & Son - $28,363. The bids will be reviewed by appropriate officials prior to a decision being rendered. (Decision rendered in Afternoon Session.) CONVENE IN EXECUTIVE SESSION Motion made by Commissioner Roulette, seconded by Irvin, to convene in Executive Session at 11:10 a.m. in regard to personnel and property matters and to confer with the County Attorney in accordance with Section 10.508 of the State Government Article of the Annotated Code of Maryland. Unanimously approved. RECONVENE IN REGULAR SESSION Motion made by Commissioner Downey, seconded by Irvin, to reconvene in Regular Session at 11:45 a.m. Unanimously approved. LUNCHEON - UNISYS The Commissioners recessed the meeting to attend a luncheon at Hagerstown Junior College sponsored by UNISYS. AFTERNOON SESSION The Afternoon Session was convened at 1:55 p.m. by the President Ronald L. Bowers with the following members present: Vice President, Linda C. Irvin, and Commissioners R. Lee Downey and Richard E. Roulette. BUDGET REVIEW Sheriffs Department- Sheriff Charles Mades presented the Fiscal Year 1990 budget requests for the Detention Center, Patrol Division and Judicial Divisions. The total Detention Center budget request is $1.3 million, the Patrol budget totals $804,000 and the Judicial Division, $256,000. Health Department - Dr. John Neill, Health Officer, and Gene Jenkins, Deputy Health Officer, presented the Health Department's budget requests for Fiscal Year 1990. The total request for County APRIL 4, 1989 MINUTES, CONT'D. funds is $1,8865,083. Also discussed was the possibility of funding the cholesterol screening portion of the CLUE 11 project over two fiscal years and the position of Drug & Alcohol Counselor. At this time Commissioner Bowers was excused from the Meeting, and Commissioner Irvin assumed the Chair. CONVENE IN EXECUTIVE SESSION Motion made by Commissioner Roulette, seconded by Downey, to convene in Executive Session at 3:00 p.m. in regard to personnel matters in accordance with Section 10.508 of the State Government Article of the Annotated Code of Maryland. Unanimously approved. RECONVENE IN REGULAR SESSION Motion made by Commissioner by Roulette, seconded by Downey, to reconvene in Regular Session at 3:35 p.m. Unanimously approved. BUDGET REVIEW - FIRE & RESCUE ASSOCIATION Wayne Williams, President of the Fire & Rescue Association, presented the budget request for the Volunteer Fire & Rescue Association for Fiscal Year 1990, Don Koons presented the budget request for the Emergency Air Unit and Greg Socks presented the budget request for the Hazardous Incident Response Team. Budget requests for these agencies are as follows: Contributions to Volunteer Fire Companies - request total $580,000; Fire Police - $4,928.74; Fire & Rescue Association - $136,913; Ladies Auxiliary - $8,362.50; Emergency Air Unit - $11,500; and the HIRT Team - $37,333. EMPLOY WEIGH CLERKS Motion made by Commissioner Roulette, seconded by Downey, to employ Kimberly Thomas and Dennis L. Brown as Weigh Clerks at the Washington County Landfill. Unanimously approved. EMPLOY - HOUSING MAINTENANCE TECHNICIAN Motion made by Commissioner Downey, seconded by Roulette, to employ John A. Kelly, Sr. as Housing Maintenance Technician in order to fill an existing vacancy. Unanimously approved. EMPLOY SECRETARY I - PERMITS & INSPECTIONS Motion made by Commissioner Roulette, seconded by Downey, to employ Linda Sokol as Secretary I, Temporary-Fulltime, in the Permits & Inspections Office. Unanimously approved. BID AWARD - TAX BILL FORMS Motion made by Commissioner Downey, seconded by Roulette, to award the bid for tax bill forms to Antietam Paper Company who submitted the low bid of $3,110.24. Unanimously approved. BID AWARD - TRUCK TURNAROUND Motion made by Commissioner Roulette, seconded by Downey, to award the bid for construction of a truck turnaround at Rohr Industries to P & W Excavating who submitted the low bid of $14,025. Unanimously approved. RECESS The Meeting was recessed at 4:40 p.m. EVENING SESSION The Evening Session was convened at 7:00 p.m. in Court Room No. I by the President, Ronald L. Bowers, with the following members present: Vice President Linda C. Irvin and Commissioner R. Lee Downey. (Commissioner Roulette was absent from the hearing due to a speaking engagement at the Wilson Ruritan regarding landfill fees.) PUBLIC HEARING - LANDFILL USER FEES Barry Teach, County Administrator, introduced Richard Parks, Director of Planning & Review, wh gave an explanation of the landfill user fees and the reasons for the fees. Mr. Parks explained that the State has enacted regulations, through the Department of the Environment, which requie that new landfill space comply by installing synthetic liners and a leachate collection system. The annual operating cost to the County will be approximately $950,000, personnel and equipment - $600,00, site improvement and large equipment costs - $300,000 and the liner system - $4 million. APRIL 4, 1989 MINUTES, CONT'D. Robert Davenport, Director of Landfills, explained that weigh clerks will develop a history on each truck and will come to agreement on the light weight. Mr. Davenport also explained the stickers program and the prices for those issued- $5/yr. - automobile and $10/yr. - truck without sideboards for residential, non- business use. Other prices for landfill use are as follows: $25/ton commercial fee; $75/ton unsliced tires; $60/ton - industrial sludge; $1.50/bag - asbestos; and $7.50/asbestos drum. Jim Krawczyk, Assistant Vice President of Century Engineering, the County's landfill consultant, presented a slide show of Carroll County's landfill and the changes made to meet the new regulations. James Brittain, Director of the Planning Commission, explained the pilot recycling program and the three phases needed for compliance to the State Ordinance. Commissioner Bowers then opened the meeting for public comments regarding the proposed landfill fees. Seven individuals testified in this regard along with representatives of the Towns of Hancock and the City of Hagerstown. The Town of Boonsboro submitted a letter for consideration. Commissioner Bowers announced that the record will remain open for ten (10) days in order to receive written testimony.
