It is an L-shaped house with a steeply pitched gable at each end. Trimming the gables are cut gingerbread barge boards with turned finials at the eaves and at the gable peaks. Windows have two over two pane sashes with arched upper panes. Architraves have pointed top pieces. Section Frederick, Seibert & Associates Fred Frederick 128 South Potomac Street Attorney or Agent Address Justification Statement January 11, 2012 Maryland law states that in order to justify the rezoning of a property the applicant must prove that there has been a change in the character of the neighborhood or a mistake in the original zoning of the property. For this property we are charging that there has been a mistake in the original zoning of the property. As a part of the 2002 Comprehensive Plan and subsequent comprehensive map amendment, the RBE district was established as a Euclidian zoning district to satisfy property owners in the "old" Agriculture or Conservation districts with small businesses on them that may or may not have been considered non -conforming. A survey was mailed to suspected property owners with businesses on the property asking them to confirm or deny there was a business on the property and describe that business. The cover letter indicated that if the property is rezoned it could reduce the amount of paperwork and processing required if the business ever expanded. The mistake in this zoning is that there is not an underlying zoning district for the property to revert to should the business fail or want to move. Often these properties evolved over the years and are very specialized in what is performed on that property, many of which are family run businesses that no one has the desire to continue once the original proprietor is no longer able to work. The now commercial property is left as a white elephant normally surrounded by residential property. If the RBE district were a floating zone with an underlying Euclidian zone similar to surrounding properties that would appear to be more practical and allow the properties to revert to and be compatible with surrounding properties once the business has ceased. With the subject property the original owner of the business has closed the doors of the business, retired and moved on. We're now left with a commercial property surrounded by RV Residential zoning. To further restrict the property the zoning ordinance calls for a complex matrix of evaluation criteria to determine if the land use can change from its current use to something else. There are no provisions for special exceptions, not even to allow a single family home. A single family home is only permitted when in conjunction with a principal permitted non-residential use. This property was mistakenly rezoned to RBE during the 2005 comprehensive map amendment and the County was negligent in explaining zoning alternatives to the property owner during the comprehensive rezoning process. These individual blends of RBE on single parcels all around the County surrounded by some other zoning classification, in effect, create spot zoning. This letter is sent as part of the requirements for a Categorical Exclusion found in the "Environmental Documentation for Local Government Projects" prepared by the Maryland State Highway Administration. Douglas Drive - Maryland Route 65-A, and the on and off ramps associated with the I-70 interchange at this location in Washington County. The improvements will include resurfacing of existing pavement; inlet and storm adjustments; lane widening; utility relocation; grading; signal modification and installation of pavement markings and signage; and off -site right-of-way acquisition (along north bound Sharpsburg Pike from approximately station 76+00 to 82+50). This is in conjunction with the site development of several parcels to the south of Colonel H.K. Douglas Drive and to the west of Sharpsburg Pike, currently a Shopping Center, and the realignment of Rench Road. Findings Bohler Engineering has determined that although the road improvements along the Northbound lane of Sharpsburg Pike require additional right-of-way dedication to allow lane widening, the impact will be negligible with respect to the historical properties represented in the attachments accompanying this letter. Per the summary above, and the attached exhibits listed below, Bohler Engineering hereby requests a letter confirming your concurrence with our findings by I'ebruary 9, 2012. By carbon' copy, we invite the Washington County Historic Preservation Commission to provide comments and participate in the Section 106 process. It is grouped with a munber of houses on )4 to )4 acre lots in a short stretch along Rt. 65. These houses dating from the 1930s to the present time. The most notable feature of this house is its shape being a small house but distinguished by its asymmetrical gable roof. It sits on a level tract of land and has a high concrete block foundation covered with cement. The entranceway is marked by a small gable hood roof supported. by brackets which is the only ornamentation on the house. Six -over -six windows are in the other two bays on the front of the house and smaller six -over -six windows on the dormers on the roof. A small flue protrudes from a southern end of the ga- ble roof. The exterior is covered in aluminum siding. The roof is asphalt shingle.
