When more than one principal use occupies the same structure and there are minimum lot areas specified for each use in this section, the minimum lot area shall be the greater of the two minimums permitted plus 10%. b. Where residential and non residential uses occupy the same structure all other zoning requirements for the non residential use such as parking, setbacks, screening, etc., must be accommodated on the site. In addition to the lot area determined necessary for the non-residential use, one-half of the minimum lot area specified for the residential use shall also be provided. c. Parking shall be provided at the rate specified in Article 21, Division I for the non-residential use plus a minimum of two spaces for each residential unit. d. Signage shall be limited to one free standing sign structure, which may contain separate signs for each of the multiple uses on the site. One building mounted sign for each use, limited to 10 square feet is also permitted e. Outside material storage areas including refuse or recycling containers shall be screened. f. All building mounted and parking lot lighting shall be constructed so that light and glare are diffused toward the ground. 2. SETBACKS — Where more than one use occupies a parcel or structure the greater of the two required front, rear and side yard setbacks shall be provided. Where adjacent parcels contain residential uses, a solid screening buffer shall be provided according to the guidelines contained at Section 5D.3(b)3 above. Section 5D.4 Special Provisions When 50% or more of the existing parcels within the boundary of the Rural Village contain special amenities such as, but not necessarily limited to, sidewalks, fences, street lighting, etc., and the amenity exists on any one adjacent parcels, new development shall provide continuation of the amenity of a size, style and number consistent with the existing amenities. Section 5D.5 Architectural Review It is the intention of the Rural Village designation to promote new developmentthat is consistent in type, scale and appearance with existing development in the village. (a) In Rural Villages that are identified in Washington County's Historic Sites Inventory, individual parcels identified in the same inventory when the village is not identified, properties listed in Maryland's Inventory of Historic Places 43 or properties listed in the National Register of Historic Places, the exterior appearance of new construction that requires a building permit, except buildings of 100 square feet or less, shall be subject to review and approval or disapproval by the Washington County Historic District Commission. The Historic District Commission shall use the adopted review guidelines as provided in Article 20 of the Zoning Ordinance. 1. In addition to the adopted guidelines the Historic District Commission shall give consideration to the following in its determination of appropriate exterior appearance of new construction in the Rural Village district. a. the exterior appearance of existing structures in the Rural Village including materials, style, arrangement of doors and windows, mass, height and number of stories, roof style and pitch, proportion. b. Building size and orientation c. landscaping d. signage e. lighting f. setbacks g. accessory structures (b) All applications for new construction, except buildings of 100 square feet or less, shall provide accurately scaled and detailed elevation drawings of all sides of the structure for review as part of the building permit or site plan review, whichever is first applicable. (c) As other Rural Villages or individual properties within the Rural Village district are evaluated to determine their historic significance according to Maryland Historical Trust guidelines and are added to the Maryland Inventory of Historic Properties, Washington County's Inventory of Historic Properties or the National Register of Historic Places, the exterior appearance of those structures shall also become subject to the review and approval or disapproval of the Historic District Commission. The requirement for Historic District Commission review of exterior appearance in Rural Villages added after original adoption of this Ordinance shall apply only after a public hearing during which the affected property owners have had the opportunity to provide input. Section 5D.6 Cluster Provisions and the Rural Village New development utilizing cluster design guidelines outside of the Rural Village district but within 1,000 feet of the district boundary shall be subject to Planning Commission review. The Planning Commission may require placement of clustered lots adjacent to the boundary of the Rural Village district. 44 0MB Approval No. 10240010 NPS farm 10-900-a (8-06) United States Department of the Interior National Park Service K ':tonal Register of Historic Places Continuation Sheet Section Number Fairplay Historic District Washington County, MD The Fairplay (also spelled "Fair Play" in some sources) Historic District is a physically small, rural, and nearly exclusively residential historic district of fifteen acres, containing the entirety of the unincorporated village of Fairplay, Maryland, which is located in Washington County, between the county seat of Hagerstown and Sharpsburg. The district lies in the Tilghmanton Election District (District 12), at the intersection of Spielman Road, Fairplay Road, and Tilghmanton Road, and consists of residential properties their related dependencies, and one former church which has been converted to commercial use. The Fairplay Historic District retains architectural integrity; among its total of twenty-six buildings, twenty-two (84%) contribute to the character of the district and four (16%) are non-contributing. Contributing buildings date from within the district's Period of Signifi- cance (c. 1830-1900) and possess an integrity of design which, within the context of the district as a whole, has not been irreversibly compromised by insensitive alteration. Non-contributing buildings date from outside the Period of Significance and/or possess architectural character which has been seriously impaired by insensitive alteration or the removal of character -defining features. Typical bng the alterations to buildings within the district are the application of synthetic siding material, the replacement of historic window sash, etc. The buildings within the Fairplay Historic District are constructed both of wood and brick, with wood predominating. Some buildings are of log construction with exterior cladding of weatkter- board. The district's buildings are modest in scale and are generally two stories in height. The majority of the buildings are gable -roofed, with roofing material varying among slate asphalt shingle, and standing -seam metal. Punctuating the rooflines of many buildings are chimneys of brick, some built within t e w sand others set on the outside. Some properties exhibit new exterior chimneys of concrete oc , a e m connection wrt the installation of modern heating systems. Scattered throughout the district is a series of detached dependencies, including smoke houses animal pens, utility sheds, automobile garages, and other similar small-scale buildings of indeterminate age and function. In most cases these outbuildings are treated as landscape features and are not included within the district's Resource Inventory. The Fairplay District is irregularly divided into random -sized building lots, with varying side and rear yard setbacks. Most buildings are oriented in close proximity to the three public roadways which traverse the district. Fairplay Road enters the district from the south and exits toward the northeast. Spielman Road enters the district from the west and ends at its intersection with Fairplay Road, and Tilghmanton Road leads southeasterly from Fairplay Road to the Sharpsburg Pike at the village of Tilghmanton, a distance of approximately one-half mile. Within the district, all three idways are paved with macadam. There are no alleys or sidewalks in the district and no coordi- nated landscape plan for the public rights -of -way. Some buildings follow traditional folk architectural genets such as log construction. Only a small number of the buildings suggest formal stylistic derivation. Among these are athree-bay brick Federal -style hall -and -parlor residence at 7852 Fairplay Road (No. 2), the Gothic c Revival style board -and -batten building at 7853 Fairplay Road (No. 16, now interconnected with the house immediately to the north and counted as a single resource), and the Italianate residences at 7872 Fairplay Road (No. 10) and 17903 Speilman Road (No. 24). The J. J. Middlekauff House (17838 Spielman Road, No. 23) is constructed of brick and features an Italianate-style wood portico incorporating chamfered posts, brackets, and pendants. The district's sole institutional building, the 1874 Union Chapel (17842 Spielman Road, No. 23), is of a vernacular Greek Revival design, with a temple -form facade and paired solid -paneled entry doors; it was previously converted for use as a fire hall and presently serves a commercial use. Built in 1882, the Miller House, is a two-story, three -bay, brick dwelling featuring an elaborate Victorian bay window. A Colonial Revival front porch was added in 1912. Located on the west side of Main Street in the Village of Rohrersville, the property also contains an unaltered front gable board -and -batten outbuilding southwest of the house. Although altered by a two-story rear addition, the dwelling retains its original ornamental massing and form. Both buildings are considered to be contributing. Located within a concentration of mid- to late 19th century dwellings, the Miller House sits along the sidewalk on a tree -shaded lot a few feet above the plane of the roadway. A dirt driveway is on the south side of the property. The dwelling is covered by a side gable roof sheathed with standing seam metal. The walls are laid in a common bond brick pattern and are painted red. Originally massed as an L -shape, the building's footprint has been squared -off by a frame addition on the southwest corner. New concrete block paired exterior brick chimneys interrupt the ridge line in the gable ends. The overhanging eave is finished with a plain frieze. The three -bay facade features 2/2 double -hung sash windows, a central entry, a bay window, and a full - width front porch. Added in 1912, the porch rests on cement blocks and cement steps leading to the south end of the porch. Round porch columns extend from the wooden porch floor to an entablature containing dentils in the architrave. The balustrade has turned spindle posts. The central doorway has a curved transom and is flanked by a 2/2 window to its south and a Victorian Gothic projecting bay window to its west. The bay window contains lancet windows with a double arched pane pattern. The segmentally arched windows of the facade feature flat wood sills and louvered shutters. The second floor contains three evenly -spaced windows. The identical north and south sides of the main block contain two windows on the first and second floors flanking the chimney. These windows are identical to those found in the facade. Two small square windows flank the chimneys in the gable ends. A stone foundation is visible on the north side and contains two small flat arched windows. The ell extension on the south side has two evenly -spaced windows on each floor. The rear (west) elevation has a centrally located new 1/1 (horizontal) window on the 1st floor of the original section. The original facade portico has been moved to the rear of the house within the ell, filled in with vinyl siding, and contains paired windows. The portico features elaborate Victorian brackets similar to the existing front porch, which were indicative of the time period in which the house was built. The upper story was closed in with vinyl after 1969 by the current owners. The south elevation of the addition has a door and paired 1/1 windows on the first floor. A portion of the original second floor contains a bricked -in small square window and a new window to the east. The enclosed second story contains an aluminum window. The front gable board and batten summer kitchen or workshop rests on a stone foundation and is covered with a metal roof. Small lengthwise rectangular openings are in the gables. Aluminum 1/1 windows are located on the side elevations. Off -center doors are located in both the gable ends. The interior was not accessible. Changes to the house include the removal of the original portico entrance to the rear of the house, and the addition of a full -width porch on the facade in 1912. The infilled portico hides the original exterior and is unusual in appearance, however does not detract greatly to the overall character of the dwelling since it is on the rear elevation. The addition of the full -width porch slightly alters the scale of the facade from its original appearance, however a full width front porch is not unusual for this time period. Built in 1882, the Miller House is part of the village of Rohrersville, a rural farm trading center. The house is a two-story, three -bay building with a two-story shed roofed extension and represents a traditional building style popular in Washington County in the late 19th century. The building is significant because of its high level of integrity from its period of construction as well being the only traditional style house that also features a distinctive front projecting window bay in Rohrersville. Site History The Miller House was built in 1882 by Ezra D. Miller in the same year that he acquired the property. A datestone in the south corner of the facade reads, "Built by E. D. Miller 1882". The 1900 census lists Miller as being 76 years old with an occupation related to farming.' The home was most likely a retirement home for Miller who had bought the property from a trustee after it became embroiled in an equity case. The land this house is located on was traced back to 1842 under the ownership of a family named Grim and was part of a larger property described in the deed as having 73.5 perches and all houses, building... ways, waters, water courses, etc. The equity case noted one acre of land, a dwelling house and a house used as a store house. These buildings are most likely associated with the Grim property that appears on the 1877 Washington County Atlas and which Ezra Miller sold while keeping the land to build this house2. Miller built the house at a prosperous time in the rural trading village of Rohrersville which began developing in the early 19th century around a grist mill that formed the northern terminus of the village. Located in a fertile area known as Pleasant Valley between South Mountain and Elk Ridge, Rohrersville was the largest village in the valley that was part of an area in Washington County known for its grain production. The county's rich grain resources were, in part, the impetus for construction of the Baltimore & Ohio Railroad, one of the nation's earliest railroads that extended west from Baltimore. In 1867, the railroad began traveling through four stations in Pleasant Valley, with one in Trego, just west of the village. As the railroad expanded the farm market, it brought new growth and opportunities to the village and the area. Rohrersville's status as a farm trading center continued into the early 20th century as the Miller House went out of Ezra Miller's possession In 1911, when it was involved in a second equity case and was sold by the trustees to Jacob and Alverta Long. The next citation was in 1915, when John & Bessie Clopper acquired the property from the Longs. The Cloppers kept the property for close to 25 years and then sold it to John & Nellie Keedy in 1941, who kept it for 28 years and sold it to the current owners in 1969. Maryland Historical Trust SurveyNo. WA -III -149 State Historic Sites Inventory Form Magi No. DOE yes no Section Number 8 Page Theme Late 19th century architecture in Rohrersville, Maryland: As a result of the success of the surrounding agricultural area and the construction of the Baltimore and Ohio Railroad in Pleasant Valley, Rohrersville experienced a second phase of building in the late 19th century. Styles popular in the village at this time included those from the Victorian period of 1860-1900, as well as the traditional, or vernacular, style of building of the early- to mid -1 9th century of Washington County. This traditional style was represented by two-story, side gabled, brick or frame buildings that were three or four bays wide. Just about half of Rohrersville's thirty-six dwellings were constructed in this traditional style. Fashionable elements of the Victorian time period were often added to traditional houses of Washington County and reflected the prosperity of its owner. Some of the dwellings in the community had small support structures consisting of frame barns or garages. The Miller House represents a fairly substantial traditional home that was built in Rohrersville with its accompanying summer kitchen or workshop. Of the 36 dwellings existing in Rohrersville today, bay windows exist on three other dwellings that are Gothic Revivals from the Victorian Period, making the Miller House the only traditional house with a bay window in the village.
