The project involves remedial repairs to SHA Bridge No. 2104100, known as the Sandy Hook Bridge. This 1941 metal truss bridge was previously determined eligible for listing in the National Register of Historic Places (NRHP) on April 3, 2001. The proposed work includes plating all holes in the exterior sidewalk stringers, repairing loose or broken hanger rods for the diagonal sway bracing, arresting cracks in the floor beam, installing anchor bolts, extending PVC pipes down below the truss system, and plating the gusset plate on bearing 2 of pier 13 span 13. A project location map is included as Attachment 1. Funding Federal funds are anticipated for this project. Area of Potential Effects In determining the Area of Potential Effects (APE) for cultural resources for this project, SHA considered possible physical, visual, atmospheric, and audible impacts to historic properties. The repair of the bridge will not be visually intrusive to adjacent tax parcels nor impact the level of noise or atmospheric conditions. For archeology, the study area is defined as the limits of proposed construction, where ground disturbance would occur, and is thus coterminous with the APE. Identification Methods and Results Potentially significant architectural and archeological resources were both researched as part of the historic investigation instigated by the proposed intersection improvement project. Architecture: SHA Architectural Historian Fred Shoken consulted the SHA-GIS Cultural Resources Database, Maryland Inventory of Historic Places, and 2007 SHA Bridge Inventory. A site visit was not conducted due to the scope of the project. The APE for this project is restricted to the area of direct construction impacts to SHA Bridge No. 2104100 (MIHP # WA -III -168). This bridge is a 14 span, 2 -lane arched deck truss with steel beam approach spans and varying width sidewalks. In 1978, the concrete deck and interior curbing were removed and replaced, portions of the existing balustrades on the Maryland side and the existing balustrade Virginia side were removed and replaced with a solid concrete vertical wall scored to approximate the original features of the balustrade. The bridge was designed by Maryland State Roads Commission and is a significant as one of the few state designed structures of this type and magnitude (Attachment 3). The proposed work will not alter character defining elements of the bridge, and will preserve the integrity of the structure; therefore SHA recommends that this project will have no adverse impacts on the historic property. Archeology: SHA Archeologist Carol A. Ebright assessed the archeological potential of the project area through consultation of the SHA-GIS Cultural Resources Database, and aerial photographs. A site visit was not conducted due to the scope of the project. The project area contains no recorded archeological sites, although the C&O Canal running under the Maryland bridge abutments and piers may have associated archeological components. A reconnaissance level survey of the C&O Canal was undertaken by Larrabee in 1962. The proposed work requires no ground disturbance and the project has no potential to impact any intact, significant archeological resources. No further archeological work is warranted. Review Request Please examine the attached maps and Effects Table (Attachment 4). We request your concurrence by June 5, 2009 that there would be no adverse effects on historic properties by the rehabilitation of SHA Bridge No. 2104100, MD 340 over the Potomac Mr. J. The proposed resurfacing work, upgrading of existing traffic barriers, minor curb repairs, replacing pipes along the road and driveways and adding rip rap along ditches will primarily take place at or below grade. The improvements will not be visually intrusive, impact the level of noise, nor alter atmospheric conditions for properties adjacent to US 40. There are no historic standing structures within the APE. No additional architectural investigations are recommended. SHA Archeologist Carol A. Ebright assessed the archeological potential of the APE through consultation of the SHA-GIS Cultural Resources Database, aerial photographs, video footage and historic maps. The project area contains no recorded archeological sites. Three small sections have been previously surveyed, two 0.5 mile transects by Wesler et al. (1981), and a small section for a cell tower. This section of US 40 closely follows the original alignment of the National Pike, although widening and minor straightening has occurred. The proposed work will occur in previously disturbed right-of-way, and is unlikely to impact any intact, significant archeological resources. No further archeological work is warranted. This double box concrete culvert was built in 1959. This type of design is commonplace in Maryland and widely used throughout the Maryland road system in the mid to late twentieth century. The bridge is not associated with events that have made a significant contribution to the broad patterns of history, nor is it associated with the lives of persons significant in our past, and it lacks architectural or engineering significance. SHA recommends that the bridge is not eligible for listing in the National Register of Historic Places (Attachment 3, Short DOE Form for Ineligible Properties). Since no historic structures exist within the APE, this project will have no impact on historic properties. Archeology: SHA Archeologist Carol A. The APE contains no recorded archeological sites, nor has it been previously surveyed. MD 67 was built on new location in 1959, bypassing Rohrersville, and crosses a waterway modified for use in milling industries going back to at least the very early 19th century (Varle 1808, Taggart 1859, Lake 1877, McGrain 2007). The modern road crossing lies between the Barkman Mill complex located at the north end of Rohrersville, and Rohrer's Mill located to the southeast, with the tail race of the former being utlitized as the head race of the latter. MD 67 crosses both the stream and former race, and based on aerial photographs, potentially a portion of a former pond. An earlier mill complex was possibly located between Barkman's and Rohrer's mills (Varle 1808). No remnants of earlier mill sites or hydraulic features were observed in the project area during a field visit on April 30, 2009, although the stream bed contained secondarily deposited slabs of concrete. The proposed work will occur in previously disturbed right- of-way, and is unlikely to impact any intact, significant archeological resources. No further archeological work is warranted. Mr. J. The bridge carries MD 67 running north -south between Gapland and Boonsboro over the Little Antietam Creek flowing from east to west. . Built in 1959, this double cell box culvert has no parapets, instead guard rails are built along the road above the box culvert. The date, 1959, is engraved on the head wall on the downstream side of the culvert. This type of concrete culvert is commonplace in Maryland and widely used throughout the MD State road system in the mid to late twentieth century. SHA Bridge No. 2107200 is not eligible for listing in the National Register of Historic Places (NRHP). The bridge is not associated with events that have made a significant contribution to the broad patterns of our history (Criterion A). The bridge is not associated with the lives of persons significant in our past (Criterion B). The bridge is not eligible for the NRHP under Criterion C due to a lack of architectural or engineering significance. The HDC approval authority for the sign design comes from the Antietam Overlay zone requirements of the Zoning Ordinance. The overlay zone is located on both sides of the Shepherdstown Pike, southwest of Sharpsburg. The HDC also reviewed and recommended approval of a setback variance for the same sign. The applicants were present during the HDC meeting and were most cooperative during the review and approval of the sign design. The design approved by the HDC is substantially different from the applicant's original proposal. Through a lengthy discussion and compromise by both parties the sign is now something that meets the Pharmacy's need for recognition and advertising and the HDC's desire to protect the Antietam Battlefield viewshed. The original sign proposal included a 4 feet x 6 feet internally illuminated sign box on a single 8' pole for a total height of 12'. Through extensive discussion the Commission and applicant agreed upon the same 4 feet by 6 feet sign placard that rests on two posts, one on each end of the sign box. If the posts are external to the sign box they will be designed with finial caps, but they may also be contained within the sign box. The sign will retain the originally proposed graphic design with blue and beige backgrounds, the Sharpsburg Pharmacy logo and an area for changeable letters. The sign's bottom edge is to be no more than 4 feet from the ground which will result in a total height of approximately 8 feet. The sign is to be externally lit. On a motion and unanimous vote, the HDC approved the revised design for the Sharpsburg Pharmacy sign as noted above. The applicant should provide a revised drawing of the sign prior to issuance of the permit. Deviations from the design described above may need additional HDC review. The "AO" District is an overlay zone meant to enhance, not substitute for the existing underlying zoning designation, which regulates land use. Section 20A.1 Regulations (a) Subdistricts Established and Areas Delineated The Antietam Overlay District is comprised of these subdistricts: The Battlefield Buffer (AO -1), the Approach Zones (AO -2), and the Red Hill Area (AO -3). Lands zoned AO -1 (Battlefield Buffer) and AO -3 (Red Hill Area) are situated within the Battlefield Foreground and Red Hill Middleground, respectively, of the Antietam Viewshed, as determined by the National Park Service and documented in its April 1988 technical study entitled Analysis of the Visible Landscape: Antietam. The boundaries of the AO -1 and AO -3 zones conform to property boundaries except where manmade or natural features provide suitable boundaries. 3. Lands zoned AO -2 (Approach Zones) are situated within 1000 feet of the centerline of certain road segments, and do not necessarily conform to property boundaries. The length of the AO -2 (Approach Zones) are as shown on the zoning maps. Section 20A.2 AO -1 Battlefield Buffer Regulation (a) The regulations and criteria in this subsection are in addition to the conventional underlying zoning which regulates land use. A declaration of intent shall be filed with the Planning Department for tree harvesting activities in accordance with the Washington County Forest Conservation Ordinance. Unless exempt, all tree cutting relating to development of a property within the Antietam Overlay District shall be in accordance with an approved Forest Conservation Plan. 1. Tree removal, which is inconsistent with the Forestry Management Plan, is subject to the enforcement provisions included in Article 26 of the Ordinance with the exception that the offense shall not continue beyond the original cutting of each tree. 2. The property owner will be required to replace any trees cut inconsistently with the Forestry Management Plan with a similar or compatible variety. (c) The Zoning Administrator shall review applications for building permits, site plans and zoning certifications with respect to the cutting of trees, and may impose limitations on the number, location, .and distribution of trees proposed for removal in order to minimize negative impact on viewshed quality. The Zoning Administrator shall use the guidelines in Section 20A.4(f) in deciding the disposition of the requested building permit, site plan or zoning certification. 142 (g) Applications submitted for subdivisions, site plans, special exceptions, expansion of non -conforming use building permits, zoning certifications or variances on land zoned AO -3 shall be accompanied by scale drawings which indicate the locations of structures and the areas where trees are proposed for removal. Any other material, which would assist in determining the existing and proposed conditions of the subject site, may be submitted. (h) Tree removal, which is inconsistent with the standards specified above including the Forestry Management Plan, is subject to the enforcement provisions included in Article 26 of this Ordinance with the exception that the offense shall not continue beyond the original cutting of each tree. (i) The property owner will be required to replace any trees cut inconsistently with the Forestry Management Plan with a similar or compatible variety. ..•� �i" Section 20A,5 Establishment of "AO" Zone An area may be zoned "AO" by request of the property owner or by comprehensive zoning, and only upon findings of fact by the County Commissioners that: (a) The area falls within the viewshed of Antietam Battlefield and that the exterior appearance of development in the area has significant potential to diminish the `j existing quality of the viewshed; or (b) The area falls within 1000 feet of the centerline of the segment of a major road which provides public access to Antietam Battlefield, and that the exterior appearance of development in the area has significant potential to detrimentally affect the public's use, enjoyment, and appreciation of the Antietam Battlefield, or may otherwise impair the integrity of the Battlefield. Section 20A.6 Appeals Decisions rendered under Article 20A may be appealed according to the guidelines of Article 25 - Board of Appeals. 144 3. The historic resource should be identified with a person or a group of persons who influenced society; or 4. The historic resource exemplifies the cultural, economic, social, political, or historic heritage of the County and its communities. (c) Architectural and Design Significance 1. The historic resource embodies the distinctive characteristics of a type, period, or method of construction or architecture; 2. The historic resource represents the work of a master artisan, architect or builder; 3. The historic resource possesses high artistic value; 4. The historic resource represents a significant and distinguishable entity whose components may lack individual distinction; 5. The historic resource represents an established and familiar visual feature of the neighborhood, community, or County, due to its singular physical characteristics, landscape or historical event. 6. The historic resource is the only example ever existing or remaining of a particular period, style, and material or construction technique. Section 20.6 Activity Within an "HP" Zone In the "HP" District, any activity which requires the issuance of a building permit according to the currently adopted Washington County Building Code and subsequent amendments as adopted for use in Washington County and the procedures of the Department of Permits and Inspections shall be subject to review, approval or disapproval by the Historic District Commission of Washington County. Such activity can include but is not limited to construction, reconstruction, relocation, restoration, rehabilitation, modification, enlargement, conversion or demolition of all or any portion of the exterior features of the subject site, structure or district. The purpose and intent of this Section is to provide an additional mechanism for the review of the appropriateness of proposed activity, not to change the building permit application procedure. Nothing in this Section shall be construed to exempt any activity from the requirement of a building permit or require a permit where one would not normally be needed, if the structure were not in an "HP" zone. The Commission shall develop and make available to all interested parties guidelines for activities constituting ordinary maintenance, and shall provide these guidelines to each applicant for an "HP" overlay zone. 137 The Commission shall consider only exterior features of a structure which would affect the historic, archeological, or architectural significance of the site or structure, any portion of which is visible or intended to be visible from a public way, and shall not consider any interior arrangements, although interior changes may still be subject to building permit procedures. All permits as required above shall be transmitted to the Commission by the Department of Permits and Inspections. The Commission shall render a decision on a completed application within 45 days of receipt of the completed application. Failure to act within the specified time period shall be considered an approval of the application by the Commission. The 45 -day review period may be extended upon agreement by the Commission and the applicant. (a) The tethe on shall be approved by the Commission if it is consistent with following criteria: 1. The proposal does not substantially alter the exterior features of the structure. 2. The proposal is compatible in character and nature with the historical, archeological, architectural or cultural features of the site, structure or district and would not be detrimental to achievement of the purposes of this Article. 3. The proposal would enhance or aid in the protection, preservation and public or private utilization of the site or structure, in a manner compatible with its historical, archeological, architectural or cultural value. 4. The proposal is necessary in order that unsafe conditions or health hazards be remedied. 5. The "Secretary of the Interior's Standards for Rehabilitation and Guidelines for Rehabilitating Historic Buildings" and subsequent revisions are to be used as guidance only and are not to be considered mandatory. (b) In reviewing the plans for any such construction or change, the Commission shall give consideration to and not disapprove an application except with respect to the factors specified below. The historic or architectural value and significance of the site or structure and its relationship to the historic or architectural value and significance of the surrounding area. 2. The relationship of the exterior architectural features of the structure to the remainder of the structure and to the surrounding area. 138 3. The general compatibility of exterior design, scale, proportion, arrangement, texture, and materials proposed to be used. 4. Any other factors including aesthetic factors, which the Commission deems to be pertinent. (c) The Commission shall be strict in its judgment of plans for those structures, sites or districts deemed to be valuable according to studies performed for districts of historic or architectural value. The Commission shall be lenient in its judgment of plans involving new construction, unless such plans would seriously impair the historic or architectural value of surrounding structures or the surrounding area. (d) The Commission shall deny a permit if it finds, based on evidence and information presented to or before the Commission, that the alteration forwhich the permit is sought would be inappropriate or inconsistent with, (a), (b) or (c) above, or detrimental to the preservation, enhancement, or ultimate protection of the historic structure site or district or the purpose of this Article as stated in Section 20.0. The use of the Secretary of the Interior's "Standards" noted in §20.6(a)(5) above is advisory only and not mandatory. 1. If the Commission determines that the permit should be denied, it shall provide a written statement of the basis for denial with specific references to the goals of this Article. The Commission may also, at its discretion, provide the applicant with suggestions or recommendations for revisions to the proposal. 2. A building permit shall not be issued if the Commission has disapproved the application. 3. Nothing shall prevent the applicant from modifying the permit application to address suggestions made by the Commission to meet the purpose of this Article. (e) It is not the intent of this Section, nor is the Commission required, to limit new construction, alteration or repairs to any one period of architectural style. Section 20.7 Definitions (a) For the purpose of this article, the term "structure" shall mean a combination of materials to form a construction that is stable, the use of which requires fixed location on the ground including among other things, buildings, tanks and towers, trestles, piers, bridges, paving, bulkheads loading docks, smokestacks, cranes, booms, sheds, coal bins, shelters, fences, walls and display signs; the term "structure" shall be construed as if followed by the words "or part thereof."
