All work will occur in the median and installation of new guardrails consists of driving in new posts in the median. All work will occur within the existing SHA right-of-way. Roadway spans Clear Spring, Mason Dixon, Williamsport and Funkstown quads. County: Washington 7.5' Topographic Map Name: Funkstown Project Type: 12 Actions Taken: SHA Architectural Historian Fred Shoken consulted the SHA-GIS Cultural Resources Database video footage and aerial photographs The Area of Potential Effects (APE) is confined to the limits of construction disturbance for upgrading and installing new traffic barriers within the existing SHA right-of-way along 1-70 from mile post 20 (near St. Paul Road) to the bridge over Black Rock Road (milepost 35.5). There are no standing historic structures located within the APE along this stretch of I-70. As part of the Interstate Highway System, I-70 is included in the Exemption Regarding Historic Preservation Review Process for Effects to the Interstate Highway System [Federal Register Page 11928-119311. No additional architectural investigations are recommended. SHA Archeologist Carol A. Ebright assessed the archeological potential of the project area through consultation of the SHA-GIS Cultural Resources Database, aerial photographs and prior survey reports, site forms, and MIHP forms. Portions of the project area have been previously survey Wesler et al. (1981), Fehr et al. (1996, 1997) and Millis (2003). Recorded archeological sites in the project corridor include 18WA462, 18WA463, 18WA500, and 18WA501, all of which have been determined not eligible for NRHP listing, Based on data from the MIHP form for WA -V-040, the Conococheague Church, the original 1740s church site was likely within SHA's right-of-way, and the original road trace was observed in the I-70 median west of Ridge Road (Stoner 1978). Consequently the section of EB and WB I-70 from Ridge Road west to the crossing of NB 1-70 by Meadow Brook Creek is excluded from this project. The proposed work will occur in previously surveyed or disturbed right-of-way, and is unlikely to impact any intact, significant archeological resources. No further archeological work is warranted. The southern project terminus stops prior to the C&O Canal NHP and the Potomac River, which is technically owned by Maryland. The I-81 corridor in the project area contains four previously recorded archeological sites (18WA472 473, 500 and 500), all of which were determined not eligible for NRHP listing. Undisturbed portions of the project area were previously surveyed by Balicki (1998) and Millis (2003, 2004). The proposed work will occur in previouslv_surveyed or disturbed right-of-way, and is unlikely to impact any intact, significant archeological resources. No further archeological work is warranted. The Area of Potential Effects (APE) is confined to the limits of construction disturbance for upgrading and installing new traffic barriers within the existing SHA right-of-way along US 340 (Jefferson Pike) from the West Virginia State Line to MD 67. The southern terminus of the project is adjacent to the Chesapeake and Ohio Canal National Park (MHIP No WA -VI -048), which is listed in the National Register of Historic Places (NRHP), but there are no standing historic structures within the APE The upgrading of existing traffic barriers and installation of new traffic barriers within the SHA right-of-way is a minor alteration to the road. It will not be visually intrusive, impact the level of noise, nor alter atmospheric conditions to adjacent historic properties. No additional architectural investigations are recommended. The project area contains no recorded archeological sites, although the Potomac River bed at Harpers Ferry is the reported location of stone fish traps (HF quad File 6). One 0.5 mile long transect along US 340 was previously surveyed by Wesler et al. (1981) and the C&O Canal NHP underneath US 340 was previously surveyed by Larrabee (1962). The proposed work will occur in previously disturbed right-of-way, and is unlikely to impact any intact, significant archeological resources. No further archeological work is warranted. The farmhouse and outbuildings are located east of US Route 11 outside the airport's security fence. The Farmstead includes a brick farmhouse, family cemetery, barn and approximately seven other outbuildings; and WHEREAS, the FAA has defined in consultation with the Maryland State Historic Preservation Officer (MD SHPO) the area of potential effect (APE) for the extension of Runway 27, as defined in 36 CFR Part 800.16(d), to include all the buildings on the Farmstead as shown in Attachment A; and WHEREAS, a Phase I survey entitled Terrestrial Archeological Survey and Historic Architectural Resource Survey for Runway 9-27 Extension and Relocation of US Route 11, in 2001, was completed and Architectural Site WA -1-480 (Brumbaugh Kendle'-Grove Farmstead) was identified based on criteria in 36 CFR 800.5(a)(2)(iv) and (v). The Farmstead was found to be eligible for listing on the National Register of Historic Places under Criterion A and C; and WHEREAS, the FAA has determined in consultation with MD SHPO pursuant to 36 CFR 800.5 that concluding the Section 106 process will have an adverse affect on the Farmstead; and WHEREAS, the FAA has consulted with Washington County Commissioners (COUNTY), as the Owner, pursuant to 36 CFR 800.2(c)(3) and has invited Washington County to be a signatory to this Memorandum of Agreements (MOA) pursuant to 36 CFR 800.6 (c)(2); and WHEREAS, the FAA has invited Hagerstown Aviation Museum to participate as a consulting party pursuant to 36 CFR 800.2(c)(5), and as a concurring party to this MOA pursuant to 36 CFR 800.6(c)(3), and Hagerstown Aviation Museum has (agreed/declined) to participate; and WHEREAS, the FAA has invited Hagerstown Preservation Design District to participate as a consulting party pursuant to 36 CFR 800.2(c)(5), and as a concurring party to this MOA pursuant to 36 CFR 800.6(c)(3), and Hagerstown Preservation Design District has (agreed/declined) to WHEREAS, the FAA has invited Washington County Planning Department to participate as a consulting party pursuant to 36 CFR 800.2(c)(5), and as a concurring party to this MOA pursuant Memorandum ofAgreement Treatment ofBrumbaugh-Kendle-Grove Farmstead Hagerstown Regional Airport, Maryland to 36 CFR 800.6(c)(3), and Washington County Planning Department has (agreed/declined) to participate; and WHEREAS, the FAA has invited Washington County Historical Trust to participate as a consulting party pursuant to 36 CFR 800.2(c)(5), and as a concurring party to this MOA to 36 CFR 800.6(c)(3), and Washington County Historical Trust has (agreed/declined) to participate; and WHEREAS, the FAA has invited Washington County Historical consulting party pursuant to 36 CFR 800.2(c)(5), and as a concur to 36 CFR 800.6(c)(3), and Washington County Historical Socie participate; and WHEREAS, the FAA has invited Heart of the Civil War Heritage Area to participate as a consulting party pursuant to 36 CFR 800.2(e)(5), and as a concurring party to this MOA F to 36 CFR 800.6(c)(3), and Heart of the Civil War Heritage Area has (agreed/declined) to participate; and WHEREAS, the FAA has notified the Advisory Council on Historic Preservation (ACHP) of its adverse effect determination pursuant to 36 CFR 800.6(a)(1) with specified documentation and the ACHP has chosen not to oarticinate: and NOW, THEREFORE, the FAA and MD SHPO agree that concluding the Section 106 process shall be implemented in accordance with the followine stinulatinnc The FAA shall I. A. Treatment: The evaluation effort conducted in Stipulation l.A. determined that Architectural Site WA -I-480 (Farmstead) is eligible for inclusion in the National Register of Historic Places. Consequently, the COUNTY will develop a plan to mitigate the adverse impacts to the site, in consultation with the FAA and MD SHPO. The Farmstead includes a brick farmhouse, brick washhouse, cemetery, stone smokehouse, barn, well, tool shed, chicken house, hog pen and silo. For all the alternatives the cemetery would be maintained by the COUNTY and remain in the current location. The well would be secured by the COUNTY and capped in accordance with local health department requirements. A history of the Farmstead and a list of alternatives are presented in Att L _La (erred mitigation action is to relocate the house, barn and other outbuildings )rt property by a third party. This alternative would require the third party to the entire structure(s) off airport property, The FAA and COUNTY will work with all parties to implement the preferred mitigation action. Should this alternative not be viable within four months from the date of signature of this MOA, the FAA, MD SHPO and COUNTY will move onto the second alternative. Memorandum ofAgreement Treatment ofBrumbaugh-Kendle-Grove Farmstead Hagerstown Regional Airport, Maryland 2. The second alternative is to dismantle and preserve architectural elements of the Farmstead for re -use. This alternative would require a third party to remove all or parts of a structure off airport property. The FAA and COUNTY will work with all parties to implement the preferred mitigation action. Should this alternative not be viable within four months from the resolution of Alternative 1, the FAA, MD SHPO and COUNTY will move, onto the third alternative. 3. The third alternative is to relocate the house and/or barn and/or; outbuildings on. airport property. This alternative requires the COUNTY and FAA to determine whether the identified location and type of airport land is not needed for airport purposes. Develop a plan for relocation that would be comply with local requirements and submit this proposal and other required information to the U.S.' Department of Homeland Security to determine if this location would be a security risk. If not a security risk, proceed with federal process to release the land from federal obligations. Advertise for third party to purchase land and relocate structures. The Farmstead included a brick farmhouse, family cemetery, barn and approximately seven other outbuildings. The Farmstead was found to be eligible for listing on the National Register of Historic Places (NRHP) under Criterion A and C. The cemetery will be maintained by the COUNTY and remain in the current location. The well will be secured by the COUNTY and remain on the property. The farmhouse and outbuildings are located outside the airport's security fence. The FAA and Transportation Security Administration have expressed concerns over the location of the farmhouse and security for the airport. The rehabilitation of the farmhouse for non-residential use is not feasible since it is located approximately one mile from the terminal building, outside the perimeter fence and would require extensive rehabilitation and upkeep costs. Securing and mothballing the farmhouse would not alleviate the security concerns since it is located outside the perimeter fence. The Airport does not have a security or law enforcement staff that could monitor or protect the property from vandals. In addition, the farmhouse was not habitable when Washington County purchased the property. It did not have any sort of heating plant and as documented was mold laden. The purpose of •this section is to establish regulations to facilitate the installation and construction of small wind energy systems in Washington County for private landowners, subject to reasonable restrictions, which will preserve the public health and safety. (a) The following standards shall apply to the development of Small Wind Energy Systems. Setbacks. A wind tower for a Small Wind Energy System shall be set back a distance equal to its total height plus an additional 20 feet from: a. any State or County right-of-way or the nearest edge of a State or County roadway, whichever is closer; b. any right of ingress or egress on the owner's property; c. any overhead utility lines; d. all property lines; and e. any existing guy wire, anchor or small wind energy tower on the property. 2. Access. a. All ground mounted electrical and control equipment shall be labeled and secured to prevent unauthorized access. b. The tower shall be designed and installed so as to not provide step bolts or a ladder readily accessible to the public for a minimum height of 15 feet above the ground. 3. Electrical Wires. All electrical wires associated with a Small Wind Energy System, other than wires necessary to connect the wind generator to the wind tower wiring, the wind tower wiring to the disconnect junction box, and the grounding wires shall be located underground. 4. Clearance. The blade tip or vane of any Small Wind Energy System shall have a minimum ground clearance of fifteen (15) feet as measured at the lowest point of the arc of the blades. 5. Lighting. A wind tower and generator shall not be artificially lighted unless such lighting is required by the Federal Aviation Administration (FAA). Lighting of other parts of the Small Wind Energy Systems, such as appurtenant structures, shall be limited to that required for safety purposes, and shall be reasonably shielded from abutting properties. 6. Appearance, Color and Finish. The wind generator and wind tower shall remain painted or finished the color of finish that was originally applied by the manufacturer. 7. Signs. All signs, other than the manufacturer's or installer's identification, appropriate warning signs, or owner identification on a wind generator, wind tower, building, or other structure associated with a Small Wind Energy System visible from any public road shall be prohibited. 8. Code Compliance. A Small Wind Energy System including wind tower shall comply with all applicable construction and electrical codes. 9. Utility notification and interconnection. Small Wind Energy Systems that connect to the electric utility shall comply with the Public Service Commission regulations. 10. Small Wind Energy Systems attached to any building shall not exceed the permitted height for principle structures within the zoning district. 11. Met towers shall be permitted under the same standards, permit requirements, restoration requirements, and permit procedures as a Small Wind Energy System. 12. Each property is eligible for two Small Wind Energy Systems only. (b) Abandonment A Small Wind Energy System that is out -of -service for a continuous 6- month period will be deemed to have been abandoned. The Zoning Administrator may issue a Notice of Abandonment to the owner of a Small Wind Energy System that is deemed to have abandoned. The Owner shall have the right to respond in writing to the Notice of Abandonment setting forth the reasons for operational difficulty and providing a reasonable timetable for corrective action, within 30 days from the date of the Notice. The Administrator shall withdraw the Notice of Abandonment and notify the owner that the Notice has been withdrawn if the owner provides information that demonstrates the wind energy system has not been abandoned. 2. If the Small Wind Energy System is determined to be abandoned, the owner of a Small Wind Energy System shall remove the wind generator from the wind tower at the Owner's sole expense within 3 months of the date of Notice of Abandonment. If the owner fails to remove the wind generator from the wind tower, the Administrator may pursue a legal action to have the wind generator removed at the Owner's expense. (c) Public Service Commission In accordance with the Maryland Annotated Code, Public Utilities Companies, Section 7-207.1, any property owner seeking to construct a Small Wind Energy System and connect such system to the main power grid with the capability of transporting energy back to their main power company shall apply to the Public Service Commission (PSC) for approval and provide documentation of such approval to the County prior to construction and being issued a building permit.
