CALL TO ORDER AND ROLL CALL Chairman Michael Gehr called the regular monthly meeting of the Historic District Commission to order on Wednesday, February 1 at 7:05 p.m. in Conference Room 1 of the Washington County Administrative Annex, 80 West Baltimore Street. Members present included: Michael Gehr, Jane Hershey, Merry Stinson, Sandra Izer, David Wiles and Carla Viar. Also present was County Commissioner Dori Nipps and Staff members Steve Goodrich and Debra Eckard. C. MINUTES Ms. Hershey made a motion to approve the December 7, 2005 minutes as presented. Seconded by Ms. Stinson. Unanimously approved. D. COMMUNICATIONS AND BILLS Maryland State Highwav Administration — 1-81 widenin Mr. Goodrich presented for review and comment the State Highway Administration's proposed widening project for Interstate 81 (Project No. WA128B11). The SHA is proposing an inside widening project between the West Virginia state line and the Pennsylvania state line and the construction of a two-lane Collector -Distributor Road that would extend from the 1-81/1-70 interchange through the 1-81/Halfway Boulevard interchange. The project also includes the widening of the 1-81 bridge over the Potomac River and revisions to the boundary of the Garden of Eden (MIHP WA -I-377). With the widening of the 1-81 bridge, the SHA has determined that the project would have an adverse effect on the C & O Canal. Ms. Stinson made a motion to agree with the State Highway Administration that there would be an adverse effect on the C & O Canal and the HDC would defer to the Maryland Historical Trust and the Park Service for future protection of the Canal. Seconded by Ms. Izer. Comment before the vote: Ms. Viar expressed her desire to have the HDC review the plans if any other changes would occur that would affect other historic properties. Ms. Stinson amended her motion to include the Commission's desire to review the plans if other changes occur that would affect other historic properties. Seconded by Ms. Izer. Unanimously approved. Maryland State Highway Administration —1-70 Beaver Creek Thermal Impact Reduction Mr. Goodrich presented for review the Maryland State Highway Administration's 1-70 Eisenhower Memorial Highway Beaver Creek Thermal Impact Reduction project. The SHA is proposing to replace approximately 1.9 miles of existing concrete swales along westbound 1-70 and 0.1 mile along northbound Maryland 66 with vegetated swales. This project will reduce thermal impacts to Beaver Creek and its tributary Black Rock. Creek, both of which suffer from increased water temperatures from highway runoff. No action required. E. UNFINISHED BUSINESS None. F. BUDGET None. G. NEW BUSINESS SP -05-066 Maugansville Elementary School Mr. Goodrich presented for review and comment the site plan for Maugansville Elementary School located along the south side of Maugans Avenue just east of its intersection with Maugansville Road. The original portion of the existing school dates back to the 1930's. The entire school building is proposed for demolition. Comments: Mr. Gehr stated that the original portion of the school has been modified several times over the years to modern standards. Commissioner Nipps stated that the proposed main access would go through the existing school and community athletic fields would be located in that area. The proposed school would be a two-story structure and would accommodate approximately 750 students. Ms. Stinson made a motion not to oppose demolition of the existing school because it is not a good example of an historic structure of its type due to the numerous alterations over time. Seconded by Ms. Izer. Unanimously approved. RZ-06-002 Hashempour Consulting & Management, LLC Mr. Goodrich presented for review and comments the Rezoning Case RZ-06-002 for Hashempour Consulting & Management. The property is located along the west side of Maryland Route 65, north of its intersection with Maryland Route 68 and consists of 198.8 acres currently zoned A — Agricultural (Rural). The applicant is applying for a zoning designation of RV — Rural Village. The property is located adjacent to Rockland that is listed on the Washington County Historic Sites Inventory as WA -l1-102 and has recently been restored and rehabilitated. Mr. Goodrich stated that the Rural Village zoning was designed to protect rural villages and boundaries were established to keep out large areas of vacant land. In villages where historic inventories have been completed, the HDC would have architectural review authority; however, this property is not included in an inventoried village. Ms. Izer noted that there is another historically significant property located just south of the site known as Widow's Mite that has been restored. She does not believe that a mistake was made in the original zoning of the property. Ms. Hershey noted that St. James School is also in close proximity to the site and they are in the process of obtaining permanent agricultural easements. Ms. Izer made a motion to recommend denial of the rezoning application to the Board of County Commissioners because this property is bounded on two sides by two significantly historic properties and is also bounded by a property that is in the process of obtaining permanent agricultural easements and it is not adherently part of the Rural Village of Lappans. Seconded by Ms. Hershey. Comments: Mr. Joe Michael and Marcie Michael, owners of Widow's Mite Farm, and Michael Moreland, owner of Rockland, were present at the meeting and offered the following comments. Mr. Michael stated that the property, until recently, was in agricultural preservation. He does not believe the current owner has an interest in historic preservation in Washington County. RZ-06-005 Ritchey's Totlot Mr. Goodrich presented for review Rezoning Case RZ-06-005 Ritchey's Totlot located at 13514 Little Antietam Road. The applicant is applying for a change in zoning classification from RV — Rural Village to RB — Rural Business to establish a proposed day care center. There was a brief discussion regarding properties surrounding the site. It was determined that no significantly historic structures are in close proximity to the site. The Commission also discussed uses allowed within a Rural Village and Rural Business zoning classification. Ms. Stinson made a motion that the Commission should not object to the rezoning of the property because there is not a negative effect on the historic aspects of the Rural Village of Leitersburg. Seconded by Ms. Izer. Unanimously approved. NEW BUSINESS 1) , PC -05-019 — Williamsport Ventures, LLC Mr. Goodrich presented for review and comment a concept plan for Williamsport Ventures, LLC (Britner and Ebersole properties). The property Is located along the south side of Sterling Road, east side of Doub Road and the north side.of Kendle Road. The developer is proposing 1267. residential units on 328 acres and is proposing to submit an application for a PUD (Planned Unit Development) zoning for this property. A PUD zoning allows a mixture of different types of uses. In this case, the developer is proposing a variety of residential uses such as single-family residences, townhomes and condominiums. A farm complex listed in the Washington County's Historic Sites Inventory (WA -1-017) is located on the site. - During the preliminary consultation, the developer stated that they do not plan to save any historic structures on the site. Mr. Wiles made a motion to recommend to the developer that the house be retained and rehabilitated because of the rapid disappearance of log structures in Washington County and because the house is an intact example of the building styles of the early 19th century . and an example of modifications and improvements typical to farm buildings over time. Mr. Wiles intended his motion to Include the entire farm complex because the other buildings will show the progression in the development of agricultural uses. Seconded by Ms. Stinson. Unanimously approved. 2) Draft — Land Preservation, Parks and Preservation Plan Mr. Goodrich presented for review and comment the Land Preservation, Parks and Recreation Plan. This document is required by the State to obtain Park Open Space funds and contains the proposals and goals for park land acquisition and development for the next three years. Ms. Stinson made a motion to recommend that the Plan should. contain a specific statement that any historic resources located on properties purchased in th.e future for park land, the historic resources should be preserved and maintained. Seconded by Ms. Hershey. Unanimously approved. H. The windows contain modern single pane sashes. The original framing has been replaced. The original two story brick masonry house is a simple rectangle approximately 20ft x 40ft with a stone basement. The two bay structure is a late 19`h century vernacular building with exposed log floor framing in the basement. Thick brick masonry walls have been modified to incorporate new doors and windows. This style of Architecture is based on early ninetieth century federal forms and is characterized by a smooth regular fa�ade, vertical placement of the windows, a low pitched roof and simple trim. This house uses local stone for basement walls. The original 12" thick brick masonry walls have been modified to. incorporate new door and window openings. The original openings, which have been enclosed with brick, can be identified by the original brick rowlock headers remaining in the wall. The new door entry and Robert B. Ebersole Property September 19, 2005 Page 2 window compromised the original vertical alignment of first and second floor fenestration symmetry. An additional basement entry was added with the new installation of Bilco type exterior entrance. The sloping horizontal doors are framed by concrete retaining walls. The installation of this door assembly required the removal of a section of the original stone foundation wall resulting in the weakening of the brick end wall. A major failure in the masonry is visually apparent and a large bulge has developed above the first floor window. Plywood has been installed along the end wall corner to prevent the brick from separating. Additions to the original structure includes a two story wood frame structure with wood siding, a single story utility room addition, and a wood framed porch on a concrete slab. The additions disguise the original appearance and further compromise the structure with additional penetrations to- the original walls. A chimney added 'at sometime has been separated from the end wall with a large noticeable gap under the roof eaves. A walk thru of the interior revealed the first and second floors slope towards the end wall. The modifications to the exterior walls described above have compromised the structural integrity of the end wall and settlement has occurred. Major repairs are needed to stabilize the current condition. In consideration of the items identified during our initial walk thru, a closer examination will most likely identify more potential problems and deficiencies. Thompson, Director of Planning Michael Renn, Davis, Renn & Associates Williamsport Ventures LLC Preliminary Consultation PC -06-001 — Williamsport Ventures LLC Wednesday, January 18, 2006 A second preliminary consultation was held for Williamsport Ventures, LLC on Wednesday, January 18, 2006 at the offices of the Washington County Planning Department at 80 West Baltimore Street. The purpose of the meeting was to review a revised PUD concept plan for the property located along the south side of Sterling Road, east side of Doub Road and the north side of Kendle Road. The developer is proposing 967 residential units on 328.16 acres, The property is currently zoned Agricultural. Present and participating were: Stephen T. Goodrich, Chief Planner, and Debra Eckard, Administrative Assistant, Washington County Planning Department; •Jim Bishop, Washington County Department of Water Quality; Gray Hebb, Washington County Engineering Department; David Bedard, Terrance Clingan, and Matt Snavely, Allegheny Power; Jeremy Rutter and Timothy Feaga, Heritage Land Development; Michael Renn, Davis, Renn & Associates, Inc.; and Robert Ebersole, Frank Ebersole, Kurt Britner, Joel Britner and John Britner, property owners. Opening Comments Mr. Goodrich noted changes to the first PUD concept following the rezoning hearing held in September 2005. The developer is proposing -.a school site.on the rezoning site rather than on an adjacent parcel, adding a 25,000 square foot commercial area, and changing the condominium units in the southwest corner of the development to duplex units. These changes create a reduction in the total number of units from 1,280 units to 967 units and a reduction in the proposed density from 3.89 to 2.93 dwelling units per acre. Mr. Feaga, Heritage Land Development, stated that there would be some senior housing designated in the development. The developer will request a density of three units per acre during the rezoning hearing. Washington County Engineering Department Mr. Gray Hebb was present at the consultation and presented the following comments. There are no changes to the comments as presented at the previous consultation that was held on July 6, 2005. A Traffic Impact Sttdy will be required for this project. Prior to issuing a scope of work, the Engineering Department will require the trip generation rates and the anticipated distribution be submitted for review and approval. All traffic counting must be done during the school year (after September 5th): It is recommended that the developer explore relocating the access at Kendle Road farther to the east to discourage cut -through traffic from adjacent developments. Traffic calming will not be required along the main Local Roadway; however, it will be required throughout the interior street sections. The County is not interested in maintaining the "Linear Park" along the main road. The right-of-way width should be reduced to exclude the park area and any needed open space provided somewhere else within the development. The developer will be required to work closely with Elmwood Farms regarding the improvements to Kendle Road. A new Highway Adequacy Policy and the traffic generated from this proposed development will now require that Kendle Road be widened to 20 feet. Pavement condition will also be considered when determining needed road improvements. Individual property access will not be allowed along the proposed Local Roadway. All residential lots must be accessed by the interior streets. Depending on phasing and phasing locations, the entire Local Roadway (between Kendle Road and Sterling Road) may be required to be constructed in its entirety up front. Stormwater management will be required and must be designed in accordance with the Maryland Design Manual. If this development is to be entirely owner occupied dwellings, the stormwater.management areas must be conveyed, in fee, to the County with a minimum road frontage of 25 feet. Preliminary Consultation PC -06-001 — Williamsport Ventures LLC Page 2 Stormwater management areas in the commercial portion of the development will require easements that permit County access for inspections. Engineering Department review fees will be required throughout the review of this development including the traffic impact studies. State Highway Administration A representative was not present at the consultation; however, John Wolford provided the following written comments. The additional traffic that could be generated from the proposed development is expected to cause operational issues at and between the US 11 intersections with Bower Avenue and Massey Boulevard. The following additional information will be needed before SHA can determine if the problems can be solved: analysis of the US 11 intersection at Massey Boulevard and its effects with the Bower Avenue hitersection; plans showing the full US 11 Improvements including utility relocation, application of AASHTO clear zone criteria, and bike and pedestrian compatibility; a signal warrant analysis for the Bower Avenue intersection at US 11; and a geometric study and auto -turn analysis for the Maryland 68 intersection at Kendle Road. The SHA will perform a combined review on the traffic information recently submitted by the developer and his consultant engineers in order to offer additional comments. SHA requests that a decision on the rezoning be withheld until it can determine if solutions to the concerns are feasible. Alleohenv Power Mr. David Bedard, Mr. Terrance Clingan and Mr. Matt Snavely were present at the consultation and presented the following comments. The substation located at the intersection of Downsville Pike and Sterling Road would serve the development. A study prepared several years ago determined that transmission service into the substation would be needed, The study indicated a proposed route across this property; however, the study would need to be updated to determine if this would be the best possible route; Other routes may exist. The AP representatives indicated, they would re-evaluate their needs and advise of any effects on the proposed development. Department of Water Quality Mr. Bishop was present at the consultation and offered the following comments. The Green Lawn pumping station must be reconstructed and the Infrastructure to get from the railroad track to the pumping station must be replaced and would be the responsibility of this development. There Is a $1,000 per unit Infrastructure management fee. The costs associated with the pumping station upgrade and installation of infrastructure would be deducted from the total Infrastructure management fee with the balance to be paid to the Department of Water Quality. A minimum of 50 units per year would be allocated for this development at the Conococheague Wastewater Treatment plant. City of Hagerstown Water Department A representative was not present at the consultation; however, Ms. Kimberly Ridenour provided the following written comments. Water service is available upon extension of the mains. An application must be submitted and approved by the Annexation Review Committee before service would be available. Fire protection services for this development will be divided between the Volunteer Fire Company of Halfway and Williamsport Fire Company. The Volunteer Fire Company of Halfway and Williamsport Ambulance Service will provide emergency medical services. Future correspondence should be forwarded to each of these agencies. New and existing buildings shall have approved address numbers placed in a position to be plainly legible and visible from the street or road fronting the property (NFPA 1-10.13.1). Street names shall be reviewed and approved for use to prevent duplicated and sound alike street names. Fire department access boxes will be required on all buildings except l and 2 family dwellings and town homes. The box will be required to contain keys to the building, gates apd other areas as requested by the fire department (NFPA 1-10.12). Planned Building Groups shall comply with the requirements of NFPA 1141, Standard for Fire Protection in Planned Building Groups— Construction occurring on this site shall comply with NFPA 241, Standard for Safeguarding Construction, Alteration, and Demolition Operations, and Chapter 16 of NFPA 1, Uniformed Fire Code. Access to all areas of the site shall meet the requirements of Chapter 18 of NFPA 1, Uniformed Fire Code. Due to the size of the development -and accessibility needs of the fire and EMS departments serving this project, we request that the main road connecting Kendle Road and Sterling Road be included in phase 1 of the project. Washington County Planning Department Mr. Steve Goodrich was present at the consultation and presented the following comments. The development is in the Fountain Rock Elementary and Williamsport Elementary, Springfield Middle and Williamsport High school districts, Both elementary schools and the high school are currently over capacity; however, there Is capacity available at Springfield Middle School. He cautioned that school adequacy remarks from the Planning Department are based on guidance from the Adequate Public Facilities ordinance. The Board of Education may comment on adequacy as well but their comments Include other factors and concerns. Mr. Goodrich also said that comments from the previous consultation should be considered valid with the current proposal. Discussion: There was a brief discussion regarding the developer's plans to begin construction of the development. There are many factors including school capacity issues that will effect this development and the rezoning necessary to allow it to proceed, It is difficult to determine when construction may begin; Mr. Feaga estimated that construction on the senior housing could begin in the summer of 2007. Comment: Mr, Goodrich recommended that the issue regarding the historic complex should be addressed. He believes that the Historic District Commission will again recommend retention and rehabilitation of the historic structures on the property even though the developer has provided a preliminary analysis Indicating the structure has been changed significantly over time. Closing Comments There being no further discussion, the consultation concluded. All agencies will receive a written summary of the meeting. If there are any discrepancies In the report, the Planning Staff should be contacted. We would like the developer to explore relocating the access at Kendle Road farther to the east. This will help discourage cut -through traffic from adjacent developments. 4. Traffic calming will not be required along the main Local Roadway. However, it will be required through out the interior street sections. 5. The County is not interested in maintaining the "Linear Park". We would like to see the right-of-way width reduced and any needed -open space provided somewhere within the development. 6. We will require this developer work closely with the Elmwood farms concerning the improvements to Kendle Lane. Elmwood Farms is required to upgrade Kendle lane as part of their. development. However, the County as adopted a new Highway Adequacy Policy that will now require Kendle Road be widened to ?0' (Elmwood was only required to widen to 18') It would be beneficial for both parties to work together to make the required road improvements. 7. Another road condition that we now consider is pavement condition. We will wait until we see the trip distribution before we determine the effected road network. 8. Direct access will not be allowed along the proposed Local Roadway. 9. Depending on phasing and the phasing locations, we may require the entire Local Roadway (between Kendle and Sterling) be constructed in its entirety up. front. 10. Stormwater management will be required and must be design in accordance to the Maryland Design Manual. Additional information needs to be submitted in order to determine if a resolvable solution can be mitigated for the US 11 intersection at Bower Avenue and the close proximity to Massey Boulevard, The following information is needed to complete our review: • Analysis of the US 11 intersection at Massey Blvd. and its effects with the Bower Avenue Intersection. • Plans showing the full US 11 improvements including utility relocation, application of AASHTO clear zone criteria, and bike & pedestrian compatibility. • A signal warrant analysis for the Bower Avenue intersection at US 11. • A geometric study and Auto -turn analysis for the MD 68 intersection at Kendle Road. We will perform a combined review within the SHA on the traffic information recently submitted by the developer and his consultant engineers in order to offer additional comments.
