The regular meeting of the Washington County Planning and Zoning
Commission was held Monday,January 4,1971 at 7:30 P.M.in
the Conference Room of the Court House Annex.
Present were:Chairman Donald R.Frush,John C.Herbst,John
F.Tritle,William E.Dorsey,Ex-Officio Rome F.Schwagel,
Planning Director W.D.Jones,Stanley Bond of the Department
of Health,Richard A.Schaub of the State Planning Department
and Harold Boyer County Commissioner.Not present:Vice-
Chairman Richard J.Walla and Richard W.Gross.
The meeting was called to order at 7:35 P.M.
The Minutes of the meeting of December 21,1970 were approved
as presented.Motion by Mr.Schwagel,seconded by Mr.Dorsey.
Motion carried.
BILLS AND COMMUNI CA'rI ONS :
Historical Advisory Committee:
A letter from John C.Frye as Chairman of the Historical Ad-
visory Committee was read in which the voluntary services of
a member of that Committee were offered in identifying the
many historical structures on the Land Use Maps of Washington
County.
The Chairman exposed and recommended the use of the Maryland
Historic Preservation Plan,Goals and Criteria,Technical Report
No.1 in coding the various historical sites in Washington County.
Mr.Schwagel moved to advise the Historical Advisory Committee
that it is the wish of the Planning Commission that the historical
sites in the County be coded in accordance with the Maryland His-
toric Preservation Plan-Technical Report No.1 and when completed,
be put on the Land Use Maps by members of the Historical Advisory
Committee.Seconded by Mr.Herbst.Motion carried.

Urban Land Institute Dues:
The Chairman requested the EX-Officio member to ask the
Commissioners to supply the Planning Commission with the
fOr the regular membership in the Urban Land Institute.

Copies of the final draft of the Zoning Text were received from
the consultant and made available to the members of the Commis-
sion.
Traffic Advisory Committee:
The Chairman reported that Mr.Bowser,Mr.Sisler and Mr.Charlton
Chairman of the Traffic Advisory Committee had met and that their
report would be forthcoming in the near future.
SUBDIVISION CONTROL REGULATIONS:
PRELIMINARY PLATS:
Arboranda Estates:Continuation recommended.
Mr.Schwagel moved to continue this application for Preliminary
Approval for additional information.Seconded by Mr.Dorsey.
Motion carried.

Manor for additional information.Seconded by Mr.Tritle.Motion

Mr.Schwagel moved to grant Final Approval to the County portion
of Potomac Manor,Section "C",based on the recommendation of
the acting County Engineer and that the City Engineer be notified

NEW BUSINESS:
Historical Zoning:
Motion was made by Mr.Herbst to have the Chairman of the Plan-
ning and Zoning Commission appear before the Board of Washington
County Commissioners and request that Washington County be pro-
vided the means to establish Historic Zoning as set forth in
Article 66B.Seconded by Mr.Tritle.Motion carried.

A special meeting of the Washington County Planning and Zoning
Commission was held Monday,January 11,1971 at 1:00 P.M.
Present were:Chairman Donald R.Frush,Vice-Chairman Richard
J.Walla,Ex-Officio Rome F.Schwagel,John C.Herbst,Richard
W.Gross,Planning Director W.D.Jones,James A.Rooney of
the Department of Health,James F.Strine,G.Russell Bowser,
J.Robert Sisler,Roger Charlton,and Mr.Leon Panitz and his
engineers,Mr.Kidd and Mr.Kees'of Baker-Wibberly.Not
present:Mr.Dorsey and Mr.Tritle.
The meeting was called to order at 1:05 P.M.
The purpose of the meeting was to consider communications from
the Traffic Advisory Committee,the Department of Health and
the Washington County Soil Conservation District regarding
Lakeside Mobile Home Park.
Letter from the Traffic Advisory Committee dated November 19,
1970 made a part of these Minutes by reference.
Mr.Panitz said that he would like to proceed with the devel-
opment of Section 1 of Lakeside Park and come to an under-
standing that an agreement be reached concerning the roads in
Section 2 when that part is submitted for approval.
It was unanimously agreed that when the second portion of
Lakeside Park is submitted to the Planning and Zoning Commis-
sion for final approval that a second access road be considered
to accomodate added ingress and egress.
Letter from the Chairman of the Soil Conservation District,Mr.
Jacob Ankeney,dated December 19,1970 made a part of these
Minutes by reference.
Mr.Panitz stated that the request of the Soil Conservation
District had been satisfied.Letter dated December 21,1970
to the Soil Conservation District.
Letter from the Washington County Department of Health dated
November 2,1970,made a part of these Minutes by reference.
Mr.Kidd stated that approval had been received from the State
Department of Health.
The Chairman thanked all those who attended on behalf of the
Commission as a good means of communication.

OTHER BUSINESS:
The Chairman stated that the consultant has asked for final
approval of Phase I of the 701 Contract so that it can be
passed on~to the printers,and secondly,final approval of
the Zoning Ordinance so that it also can be passed to the
printers.
It was agreed that an extended meeting would be held following
the regular meeting on January 18 to consider these requests.
The meeting was adjourned at 2:30 P.M.

OTHER BUSINESS:
SanitarYiCommission:
On the recommendation of Mr.Schwagel,Mr.Carl Mann and Mr.
Harold Nunamaker of the Washington County Sanitary Commission
appeared before the Commission and participated in an informal
discussion regarding the projected expansion of sewerage treat-
ment facilities in the Halfway area.Other areas of the County
were also discussed relative to the completion of the Land Use
Plan and the present Water and Sewer Plan.
Mr.Schwagel thanked Mr.Mann and Mr.Nunamaker in behalf of
the Chairman and the Planning Commission.
Annual Report to the County Commissioners:
After minor changes,the Annual Report was approved fbr pre-
sentation by the Chairman to the Board of County Commissioners
on Tuesday,January 19,1971.Motion by Mr.Herbst,seconded
by Mr.Tritle.Motion carried.
H~storical Coding:
Mr.Schwagel moved to have the Historical Coding carried on the
agenda under Old Business until a method of procedure is accom-
plished.Seconded by Mr.Gross.Motion carried.
Maryland Association of County Planning Officials Meeting:
The Maryland Association of County Planning Officials meeting
in Baltimore on January 12 sas attended by the Chairman and
Mr.Gross.Mr.Gross brought back a full report to the Com-
mission which included discussion of transportation and impact
on development,status of Water and Sewer 10 Year Plan,Open
Space Program and election of officers.
Copies of these reports were made available to the members.
Municipal League Meeting:
The Municipal League Meeting will be held January 25,1971 at
6:30 P.M.in the Tortuga Restaurant.

Motion was made by Mr.Gross,seconded by Mr.Walla,that
Phase I of the Comprehensive Planning Program which is back-
ground studies,be passed on to the consultant for printing.

Zoning Text:
The Planning-and Zoning Commission is reviewing the final
~oning Text and will have recommendations for the necessary
changes.The Commission will not act on the final draft until
such time as the Land Use Map (Zoning)is delivered for Com-
mission review.Motion by Mr.Walla,seconded by Mr.Herbst.

FEBRUARY 1,1971
The regular meeting of the Washington County Planning and
Zoning Commission was held Monday,February 1,1971 at 7:30
P.M.in the Conference Room of the Court House Annex.
The meeting was called to order at 7:30 P.M.
Present were:Chairman Donald R.Frush,Vice-Chairman Richard
J.Walla,Ex-Officio Rome F.Schwagel,John C.Herbst,William

The Chairman requested that two letters be added to the agenda
under Bills and Communications.Mr.Schwagel moved to add
letters from the City of Hagerstown Water Department and the
Volunteer Fire Company of Halfway to the agenda.Seconded by
Mr.Dorsey.Unanimous.
BILLS AND COMMUNICATIONS:
The following bills were approved for payment on a motion by
Mr.Herbst,seconded by Mr.Schwagel.Hays for-office supplies,
$20.43,Gasoline -County Roads $3.14 and Hagerstown Book-
binding -printing of envelopes $28.00.Motion carried.
A letter was read from the City of Hagerstown Water Department
in which it was requested that consideration be given to the
zoning classification of the watershed area which serves as
a source of water supply to the Edgemont Reservoir.The
Chairman stated that he had forwarded a copy of this letter
to the Consultant for his consideration in drawing up the
Comprehensive Plan.
A letter from the Volunteer Fire Company of Halfway was brought
to the attention of the Commission in which they requested to
be included on the list of agencies mentioned in Section 308
of the Washington County Subdivision Ordinance.
The Chairman was authorized to answer this letter stating that
plans for subdivisions are now coordinated with the Fire
Marshal in relation to existing facilities.Motion by Mr.
Schwagel,seconded by Mr.Walla.Motion carried.

Flood Plain Studies:Mr.Schwagel stated that a letter had
been received from Senator Beall saying that he would be in
contact with the Corps of Engineers.

A copy of a letter from the Assistant County Engineer to Mr.
John Bushby District ENgineer of the State Roads Commission,
was read for information purposes in which it was stated that
the Board of County Commissioners had approved the State
Modified Plan for the Downsville Pike Grade Separation.
Letter to the Sanitary Commission:
The Chairman was directed to prepare a letter to Mr.Mann and
Mr.Nunamaker of the Washington County Sanitary Commission
to thank them for their presentation at the January 18 meeting
of the Planning Commission.Motion by Mr.Schwagel,seconded
by Mr.Herbst.Motion carried.
NEXT MEETING DATE:
The next regular meeting of the Planning and Zoning Commission
will be February 15,1971 at 7:30 P.M.in the Conference
Room of the Court House Annex.
REVIEW OF ZONING TEXT:
The comments and recommended changes made during the continuing
review of the Zoning Text are made a part of these Minutes by
reference.
Motion was made by Mr.Schwagel to arrange a joint workshop
meeting to include Mr.Strine and the Consultant to review
the remainder of the Zoning Text,such workshop meeting to
be arranged by the Chairman as soon as possible.Seconded by
Mr.Dorsey.Motion carried.

A letter from Senator Mathias was received in which it was
stated that he had requested a full report from the Corps
of Engineers regarding the flood plain studies.
Public Information Program:
Mr.Schwagel reported that the builders,banks and loan
associations have invited him to speak to them concerning
the Subdivision Ordinance and also the Zoning Text at their
March meeting.

A letter from the Consultant was read in which he thanked
the Commission for the detailed comments regarding the
Zoning Text.The Chia~man recommended that a letter be sent
to the Consultant requesting revised scheduling for com-
pletion of p-69 701 Contract.
Motion was made by Mr.Schwagel that the Chairman be directed
to write to the Consultant to request the exact updated
scheduling of the 701 Contract and also that a meeting with
the Consultant be scheduled as soon as possible to review
the remaining portion of the Zoning Text.Motion seconded
by Mr.Walla.Unanimous.
Motion was made by Mr.Dorsey to send to Mr.Schaub of the
State Planning Department,a carbon copy of Commission
correspondence with the Consultant.Seconded by Mr.Herbst.

NEW BUSINESS:
Updating of Tax Maps:
Motion was made by Mr.Walla to ask Mr.Schwagel to request
of the County Commissioners that the county tax maps be
updated on a monthly basis and also to have Mr.Strine take
up the matter of violations'of the Subdivision Ordinance.
Seconded by Mr.Dorsey.Motion carried.
A letter from Mrs.E.Frank Snyder regarding subdivision of
land was forwarded to the legal department.Motion by
Mr.Walla,seconded by Mr.Dorsey.Motion carried.
A letter from the State of Maryland Environmental Health
regarding the Clear Spring Sewerage Treatment Facility was
brought to ,the attention of the Commission.
Mr.Dorsey moved to ask the engineers designing this'par-
ticular facility to attend the next meeting and explain
certian aspects relative to planning.
A letter was read from Robert S.Norton,Maryland State
Surface Water Management,regarding flood plain infor-
mation.
Motion was made by Mr.Schwagel that copies of this letter
be sent to the Maryland Senators underlining portions
concerning Washington County and referring to letters from
the County Commissioners.Seconded by Mr.Tritle.Motion
carried.
A letter and plan from the Land Planning and Development
Company,Inc.,was brought to the attention of the Com-
mission regarding land development at the Intersection
of Md.Route 67 and 340.
Mr.Dorsey moved to notify the developer that he should
follow through by submitting a plan in compliance with
the Washington County Subdivision Ordinance.Seconded
by Mr.Walla.Motion carired.
County Car:
Mr.Herbst moved to convey the county car (Planning)to the
County Commissioners for their use until such time that
one is needed by the Planning Commission.Seconded by
Mr.Tritle.Motion carried.
A public information meeting of the Little Antietam Water-
shed Association was announced by the Chairman to be held
in the Conference Room on February 18,at 2:00 P.M.

The next regular meeting of the Planning Commission will be
held on Monday,March 1,1971 at 7:30 P.M.

As a result of a request of Mr.Stotler regarding a violation
of the Subdivision Ordinance,the matter has been taken up

Rescheduled for the

the request of the Commission to discuss certain aspects of
planning in relation to the proposed sewer facilities at
Clear Spring.
Mr.Cump explained that the land had been acquired for this
purpose,SRC approval obtained,and that application had
been made,subject to State Health Department approval,in
December.
The Chairman asked that Mr.Schwagel,in his capacity as
Ex-Officio member of the Commission,bring this matter to
the attention of the County Commissioners based on the var-
ious concerns expressed by the members of the Planning Com-
mission in relation to best utilization of land and aesthetic
values.

A letter from the Washington County Sediment Control Representa-
tive to the Board of County Commissioners was read in regard
to the Commissioners'accepting the $10.00 fee required for
filing application of Sediment Control plans,and also noted was
a copy of letter from Robert S.Norton,Department of Water
Resources,and opinion from Attorney General Burch,regarding
Statewide Storm Water Management for which an effective date
of July 1,1971,has been established.
A letter was read from John M.Colton regarding a transfer of
land for Beatrice B.Grove.

ask Mr.Strine to answer this request and to place this matter

*The Chairman announced a meeting in College Park,University of

The County Engineer was asked to prepare a letter to the Planning

The Chairman reported that the proposed amendments to the Sub-
division Ordinance are being reviewed by the legal department.
Health Department Request -Soil Maps:
Mr.Rooney inquired as to the status of the request from the

Zoning Commission for the coming year.
Mr.Herbst moved that the nominations for Chairman be closed.

bined.The Chairman reported that he and the County Planner had
met with Baker-Wibberly consultants and representatives of the
State Planning Department regarding the schedule for completion
of the "701"Contract.A letter was read from the Consultant
which reported status and completion as follows:
1.Volume I,Population,Housing and Economics and
Volume II,Community Facilities,has been approved
by the Commission and set in type for final printing.
2.Volume III,Land Use Development,Plan and Program is
in draft form,final portion to be delivered on June 10,
1971.Workshop to be held June 14,1971,&:00 P.M.,to
discuss the total draft of Vol.III and if no serious changes,
draft will be available for printing by June 21,1971.
Necessary graphics to be printed by Baker-Wibberly and de-
livered by July 15,1971.The plan is to combine Volumes
I,II and II~~nto one Volume.Therefore,the quantities
pprovided for in the contract for preliminary and final
reports will be combined and 625 copies of a final report
with graphics will be delivered to the Commission on July
15,1971.In addition,370 copies of the proposed zoning
Ordinance with 370 copies of a reduced,generalized zoning
map will be printed and delivered at the same time.
In addition,a series of mylar reproducible sheets of the
original land use atlas with zoning lines drawn in will
also be delivered.

The Chairman recommended that the consultant be asked to
prepare a brief,summary type brochure with the necessary
information for public review which could be prepared by him
with the necessary graphics at a cost of approximately
$2,500.00,printing to be done locally and paid for by the
Commission.
Motion was made by Mr.Herbst to pursue plans for the preparation of
a public information brochure and the price of such a document.

letter to the consultant acknowledging the dates established for

Proposed Shopping Center,W.C.Schroeder:
The legal opinion of Mr.Strine was read stating that the proposed
shopping center on U.S.Route 11 North would come within the re-
quirements of the Subdivision Ordinance.
Motion was made by Mr.Walla to inform the developer by letter making
Mr.Strine's legal opinion available to him.Seconded by Mr.Dorsey.

Beaverbrook,Point of Discharge,Sanitary Commission:
Recommendations of the Sanitary Commission were read regarding the
Beaverbrook Point of Discharge for sewer facilities relative to the
Washington County Master Water and Waste Water Plan.
The Chairman recommended that all recommendations regarding the
Water and Waste Water Plan be considered simutaneously and submitted
to the Washington County Commissioners for consideration.
The Chairman made the following recommendations to change the final
version of the Water and Waste Water Plan:
1.As a prerequisite for development,it is recommended
that the County Commissioners amend the definition
on page 2'16 of the Plan from "immediate future"to
"immediate priority"in order to use the W3 and S3
delineation in areas where soils are not acceptable
for septic fields as exposed by the Washington County
Soils Limitation Maps and Charts which show severe
limitations for septic fields.
2.It is recommended that the Soils Limitation Maps and
Chart be used as a guide for the revision of the Master
Water and Sewer Plan.
3.It is recommended that the annual revision of the
Comprehensive Water and.Waste Water Plan should contain
provisions for handling "local"treatment facilities
with an annual review basis or at the time such a project
is submitted for approval.
4.It is recommended that the area North of Sanitiilry
Sub-District 6 to the Pennsylvania line be considered
for immediate priority of water and waste water facilities
since none are considered by the year 2,000.

A special meeting of the Washington County Planning and Zoning
Commission was held Tuesday,June 15,1971,at 8:00 P.M.in the
Court House Annex Conference Room.
Present were:Mr.Donald R.Frush Chairman,Mr.Richard J.Walla

The purpose of the meeting was to discuss the status of the
Comprehensive Development Plan and to act on several letters of
correspondance from Mr.McDonnell.
The Commission discussed and voted in favor of the following
items:
1)Mr.McDonnell was authorized to proceed on the
printing of the final reports.
2)Mr.McDonnell was authorized to proceed on the
printing of the existing and proposed highway
plan.
3)Approval for payment was given to pay Baker-Wibberly
and Associates,$1,274.00 for work on the "701"
Contract,per Invoice for 5626.
4)Mr.McDonnell was authorized to prepare a promotional
piece for the County Plan at a cost of $2,000.00,
provided the material will be delivered to the Com-
mission no later than July 6,1971.
5)The revised subdivision forms,concerning preliminary
and final plat approval,was approved and signed by
the Commission members.
6)The Commission members are to be notified that due to
a holiday,the regularly scheduled meeting on July 5,
will be changed to July 12.
7)A letter of May 21,1971,from Mr.McDonnell regarding
compensation for a second Zoning Ordinance preparation
was presented to the Commission.
The Commission,after reviewing,stated that Mr.McDonnell
should present his case to the firm of Baker-Wibberly.
8)A workshop session on the Subdivision Amendments and pro-
posed revisions is scheduled for Monday,June 21,1971,
in the Court House Annex Conference Room.
9)Resumes for the posit~on of secretary and office adminis-
trator were reviewed and duscussed by the Commission.
Mr.Burtner will begin interviewing applicants for the
position of secretary and Mr.Frush will contact Mr.Lem

the following reasons:
1.It did not have approval from the Washington
County Department of Health and the Washington
County Soil Conservation District per Section
308,paragraph 2,of the 1970 Subdivision Ordinance.
2.It was in the area of the 1972-1976 Highway
'Improvement Program by the State Highway
Administration.

Schwagel that a letter be forwared to the Consultant asking that
the maps be brought up to date,the subdivisions placed on the maps
and that a deadline be given for completion of the work without

Letter from County Attorney -Harvey Gladhill,Sunset Acres:
A letter was read from the County Attorney in which was rendered
a legal opinion regarding the issurance of a drivew~~permit for
a subdivider who may be in violation of the Washington County
Subdivision Ordinance.
It was the opinion of the County Attorney that the County Engineer
should not issue a driveway permit to any subdivider who is in
violation of any section of the Subdivision Ordinance.
Based upon the legal opinion of the County Attorney,motion was
made by Mr.Schwagel,seconded by Mr.Walla that the Planning
staff review this subdivision for a possible violation of the
Ordinance and that it be placed on the agenda for the next meeting.
It"was also recommended that Mr.Dull contact Mr.Hoover of the
State Highway Administration regarding continued cooperation
for entrance permits on to State ,roads.Motion carried.
Letter from County Attorney -Halfway Manor:
A letter was read from the County Attorney regarding a 25 foot
building set back line violation in the Halfway Manor development.
It was the legal opinion of the County Attorney that no legal action
be taken and that the violation be waived which would apply only to
this particular violation and understood that any future violation
would be dealt with in a different manner.The letter also stated
that all plats of this development should be promptly amended to show
new set back lines to conform to this opinion and submitted to the
Planning Commission for approval.
It was the recommendation of the County Engineer that the following
notation be placed on the plats:"The building set back line as
noted for building No.9 is in accordance with the variance as
granted by the Planning and Zoning Commission on August 16,1971",
be placed on the plat with the Chairman's signature.
Motion was made by Mr.Herbst,seconded by Mr.Schwagel,that a
new plat be submitted by the developer showing the new set back
line and subject to the Planning and Zoning notation being placed
the plat calling attention to the building number and brought back
to the Commission for their action.So ordered.

Chairman expressed regret in approving the plans but stated that
the Commission is guided by the existing laws regardless of per-
sonal viewpoints.
The Chairman brought to the attention of the developer ~he fact
that if Congress passes the bill to empower the National Parks
Service to acquire nore Battlefield land,homes built after
January 1.1971,could be demolished.
It was also recommended that re-consideration be given to the length
of the cul-de-sac and that the developer and the County Planner
prepare the protective covenant to absolve the County from
building or maintaining the roads in this subdivision now or in
the future before the final plat is submitted to the Commission for

A letter from Mr.Norman I.Broadwater concerning a transfer of
land by Mr.Hugh Middlekauff,was read to the Commission.Mr.
Broadwater appeared before the Commission to explain the
transfer of property to the Commission which consists of approximately
2.09 acres.The owner intends to restore the existing farm
house.
The Chairman requested that a copy of the plat be submitted
to the Planning Commission with the necessary information appli-
cable to this particular transfer of land.
On a motion by Mr.Dorsey,seconded by Mr.Schwagel,the Com-
mission voted to ask the County Planner to review this matter
and recommended that the requirements of the Ordinance must be

A letter was read from the County Planner,Leroy R.Burtner to
Mr.Donald R.Detwiler,President of the Urban Reaseach and
Development Corporation,regarding Washington County's partici-
pation in the preparation of the Comprehensive Outdoor Recreation
and Open Space Plan.A copy of the County Plan,Summary Brochure
on the plan and other detailed information was forwarded to Mr.
Detwiler so that Washington County could be included in the State
Plan.
A letter from the County Engineer was read regarding provisions
for adequate storm water facilities for the Hagerstown Trust
Branch office on Jefferson Boulevard.No prior Planning and
Zoning Commission or Engineering approvals were sought or
granted before construction was under way.

Landfill Project.Mr.Frush stated that the Park Commission

hearing notice three times in the newspaper so that there
is wide spread distribution on this information.The
public hearing is scheduled for October 6,1971 at 7:00

Mr.Muritz was present at the last meeting of the Planning
and Zoning Commission and stated that he had not sold any
land and questioned whether or not he had to comply with the
Subdivision Ordinance.The next day,however,it was dis-
covered that a notarized letter from Mr.Carrol stated that
he purchased 18 acres of land from Mr.and Mrs.Muritz,on
July 10,1971.He said this land would be used for a home
i~l'~~~~land the rest of the land would be used for~~~purposes.The Chairman stated that according to
Mr.Robert Johnson,there is only a contract of sale with a
settlement date of December 28,1971,and that in fact,Mr.
Muritz has not subdivided his land.Mr.Johnson stated that

ember,that a plat will be prepared by Fox &Associates for
submission under the requirements of the Subdivision Ordinance.

Wednesday,September 22,at 7:00 P.M.,informational meeting at

elected officials.

all meetings.
The Chairman requested that Mr.Seymour be advised of the number
of persons from the Planning and Zoning Commission attending the
Municipal League information meeting.
A letter was read from the Consultant,Mr.William C.McDonnell,in
which he proposed a continuing consulting relationship with the
Planning Commission to assist in implementing the Plan and program.
The Commission requested that copies of this proposal be made
available for their consideration at a later date.
A letter was read from Joseph R.Murnane,Maryland Association of
Counties,Inc"regarding a request from the Fiscal Pro~am Analysis
Committee to participate in the Open Space Program,and how it
could be modified to expedite the acquisition of recreation areas
and to accelerate ~he development of needed recreation facilities.
The Chairman stated that Mr.Burtner and he had very recently the
opportunity to amend the State Open Space and Recreation Plan to
include the existing municipal and county recreation areas,etc.
These areas were not included in the SEate's final draft.

ment and City of Hagerstown approval had been obtained and requested that
consideration be given to approval of the plan.
The Chairman recommended that the Commission should consider the

A letter was read from Mr.Strine regarding the size of plats and

resolve any problems and to expedite the handling of one lot plats.

planned new towns,since his understanding of the planned towns
controlting development of Washington County is not dictated by the
Plan for the County,but merely a proposal.

Washington County on the Antietam Creek.This report was
prepared by the Baltimore District of the Army Corps of Engineers
at the request of the Planning Commission as an aid in the sol-
ution to local flood problems and the best utilzation of land which
is subject to overflow.

Michael E.Dawson:
Mr.Michael Dawson appeared before the Commission regarding
the mininum requirement of right-of-way width along an existing
county road as established by the County Engineer.
The County Engineer replied that the R/W requirement on existing
county roads was established by the Washington County Subdivision
Regulations.
Point of Discharge Application -Fortney"Mobile Home Park:
A letter from the Washington County Sanitary Commission was read
superseding and invalidating all previous correspondence pertaining
to the above referenced Point of Discharge.It further summarized
the position of the Sanitary Commission on the application.
Recommendations were also made by Mr.Burtner with reference
to this proposed facility.
1.The application should be re-submitted to the State
Department of Health.
2.Consideration should be given to expansion of Subdistrict
#6 to inrelude this area,thereby placing it in a higher
priority capacity.
3.The facility should be considered for installation only
on a temporary basis and should not be located in t~
path of the proposed Hagerstown Beltway.X~MXK~~M The
status of detailed studies on the Beltway location should
be determined first before final approval is given the lo-
cation of this facility.
The Commission voted,on a motion by Mr.Walla and seconded by

Noting that authorization to proceed with preparation of the
overlay for the Zoning Map was approved at one of the workshop
sessions,the Chairman asked for authorization to follow through

Letter -William C.McDonnell:
A letter was read from the Consultant,Mr.William C.McDonnell
in which he enclosed a statement on time spent to date against
the $2,000.00 retainer fee received on November 1,1971 for Zoning
matters requesting that the Commission advance $1,500.00 against the
$2,238.50 projected requirement to complete the project.
The Commission voted,on a motion by Mr.Gross,seconded by Mr.
Dorsey,to pay the requested $1,500.00 retainer fee.So ordered.
Historic District Commission:
The Washington County Historical Advisory Committee advised the
W County Commissioners at their meeting on November 23,1971,tp
appoint an Historic District Commission,which would qualify
under Maryland law to regulate exterior changes in historic
buildings in districts which would be ~zoned historic by the
County.This was referred K~KXMliXK~XK~M to the Planning a~d
Zoning Commission for their recommendations.
The Commission voted,on a motion by Mr.Gross,seconded by Mr.
Walla,to have Mr.Frush review all the facts in the interest
of the County to see what is acceptable and report back to the

A letter from the State Department of Health was read regarding
a Point of Discharge application for Antietam Mobile Home Estates.
A ~~~~~copy of a letter from the Sanitary commission was read and
also a memo from the County Planner which referred the Commission to
the following statement from the utilities Policies Section of the
Plan for the County.(U-ll).
u-II:Since the Antietam Creek is proposed primarily for preser-
vation as is the Little Beaver Creek area,long-range projections
for the Sewering of these two watercourses should be eliminated.
The Commission voted,on a motion by Mr.Schwagel,seconded by

transmitting the letter from the Sanitary CommissDon and also
the information that Mr.Burtner has prepared in form of a memorandum,

Present were:Chairman Donald R.Frush,Ex-Officio Rome

The Minutes of the meeting of December 6,1971,were approved
as written on a motion by Mr.Gross,seconded by Mr.Tritle.

OLD AND UNFINISHED BUSINESS:
Flood Plain Studies and Flood Plain Ordinance:
On December 20,1971,a meeting was held between Mr.Burtner,
Mr.Dull and Mr.Thompson concerning the draft Flood Plain
Ordinance by the Little Antietam Watershed Association and
its relationship to existing and future County Ordinances.
All parties agreed to the following recommendations:
1.All present County Ordinances would,and do
apply to the entire Watershed area,including
all flood plains.
2.All future County Ordinances would apply
within the entire Watershed with the
exception of any County Flood Plain
Ordinance that would lessen the extent
~X of Flood protection in the Little Antie-
«~tam Watershed.
3.DIVISION IV,THE USE OF FLOOD AREAS,in
the proposed Zoning Ordinance should be
amended to conform with State and Federal
guide lines for flood control.

a letter,dated December 21,1971,be prepared to the Board
of County Commissioners giving favorable recommendations to

voted"Yes"with Mr.Dorsey abstaining until clarification is made
by the County Engineer as to where the drainage is going.So ordered

The Commission voted,on a motion by Mr.Tritle,seconded by
Mr.Dorsey to grant Final Approval to the plat file.So ordered.
OTHER BUSINESS:
Chair.man ,.,, hThe~stated that s~nce the Plann~ng Comrru6s~on ad made
some recommended changes XK to the Master Water and Waste Water
Plan,that he would like the commission to consider these
recommendations again to see if they were presented to the County
Commissioners.Mr.Schwagel said that when any recommendations
for changes are presentedKM to the County Commissioners,they will
be presented to the Planning and Zoning Commission for their
review.Mr.Schwagel will look into the matter and when revisions
are received,they will be given to the Commission for review
and their comments and recommendations will be noted prior to
Public Hearing.
IDTHER BUSINESS CONTD:
The Chairman alsb noted that the projected 1973-1977 Highway
Needs Study was presented to the elected officials and others
and there was some discussion regarding the Master Plan comments
~it pertains to the proposed Hagerstown Parkway,the proposed
Sharpsburg By-Pass and the East-West Expressway.
The Commission voted,on a motion by Mr.Schwagel and seconded
by Mr.Gross,to ask Mr.Burtner to look into the matter and
bring comments and recommendations back to the Commission for
their further consideration.So ordered.

January 3,1972 at 7:30 P.M.in the Conference Room of the
Court House Annex.
