HomeMy WebLinkAbout04.01.1986April 1, 1986 Hagerstown, Maryland 21740 The Regular Meeting of the Board of County Commissioners of Washington County was called to order at 8:30 a.m. by the President, Ronald L. Bowers, with the following members present: Vice President Richard E. Roulette and Commissioners R. Lee Downey, John R. Salvatore and Martin L. Snook. CONVENE IN EXECUTIVE SESSION Motion made by Commissioner Salvatore, seconded by Downey to convene in Executive Session at 8:30 a.m. in regard to legal matters, pursuant to the authority contained in Article 76(A), Section 11(a)(6 & 7) of the Annotated Code of Maryland. Unanimously approved. RECONVENE IN REGULAR SESSION Motion made by Commissioner Roulette, seconded by Snook to reconvene in Regular Session at 9:00 a.m. Unanimously approved. INVOCATION AND PLEDGE OF ALLEGIANCE The Invocation was delivered by Rev. John Schildt, Chewsville United Methodist Church, followed by the Pledge of Allegiance to the Flag by the full Assemblage. PROCLAMATION - FAIR HOUSING MONTH Motion made by Commissioner Downey, seconded by Salvatore to Proclaim the month of April 1986 as Fair Housing Month in Washington County, and encourage all citizens to participate in activities promoting fair housing and equal opportunity and to work toward maintaining equal opportunity in housing for all. Unanimously approved. Commissioner Bowers read the Proclamation and presented a copy to Neil Curran, Director of the Department of Housing and Community Development. RECOGNITION OF YEARS OF SERVICE - WILLIAM E. WOLFORD, JR. Commissioner Bowers read the inscription and presented a plaque to William E. Wolford, Jr. in recognition of his years of service from 1972 to 1986 as a member of the Planning Advisory Board and the Planning Commission. SAVE HISTORIC ANTIETAM FOUNDATION John Urner, Attorney, speaking on behalf of his clients, Mr. and Mrs. Ernest H. Schuley, and as a representative of the Save Historic Antietam Foundation, appeared before the Commissioners to inform them that he felt they had erred in the rezoning of 12 acres of the property owned by Agnes Elliott to BG (Business General), Rezoning Case RZ-318, and to request that they repeal this decision. He stated that the rezoning was inaccurate because it was done without findings of fact involved and that BG zoning requires the presence of public sewer to be amenable to business uses. Tom Clemens said that the Save Historic Antietam Foundation is attempting to purchase the Grove Farm which is a very historically significant and valuable site and which lies contiguous to the rezoned Elliott property, and put scenic easements on it through the Maryland Historic Trust. Jane Hershey presented a petition with 5,000 signatures in opposition to the subject rezoning. Mary Ann Jenneke, League of Women Voters, said she was sorry the Commissioners had not taken the recommendation of the Planning Commission in the rezoning of the Elliott property, and hoped they would reconsider the vote or at least limit any building on the property to conform with the present architecture. The Commissioners took the matter under advisement at this time. APPOINTMENT TO CHILDRENS COUNCIL Motion made by Commissioner Salvatore, seconded by Downey to appoint Mrs. Carol Shearer to serve as a member of the Washington County Children's Council. Unanimously approved. GYPSY MOTH PROGRAM Motion made by Commissioner Salvatore, seconded by Snook to allocate the local share in the amount of $1,337 as an indication of participating in the Maryland Department of Agriculture's Gypsy Moth Program for treatment of 620 acres in Washington County. Unanimously approved. LINE ITEM TRANSFER - PLANNING DEPARTMENT Motion made by Commissioner Roulette, seconded by Salvatore to approve of the transfer of $1,000 in the Planning Department Budget from Printing (28-422-000) to Capital Outlay (28-427-000) for the purchase of a typewriter. Unanimously approved. APRIL 1, 1986 MINUTES, CONT'D. TABLE REQUEST TO IMPROVE AND USE COUNTY LOT FOR PARKING Motion made by Commissioner Salvatore, seconded by Roulette to table a decision on the request from Christ Assembly of God Fellowship to improve and use a county owned lot for overflow parking until an inspection of the property can be made. Unanimously approved. (Decision rendered later during Morning Session.) LINE ITEM TRANSFER - ELECTION BOARD Motion made by Commissioner Salvatore, seconded by Snook to approve of the transfer of $500 in the Election Board Budget from Office Supplies (15-413-000) to Capital Outlay (14-487-000) for the purchase of computer tables. Unanimously approved. PETITION FOR CREATION OF ELECTRIC LIGHTING DISTRICT In response to the petition for the creation of an Electric Lighting District in the area surrounding the intersection of Gay Street and Coffman Avenue, Halfway, Washington County, the Commissioners agreed to advertise a Public Hearing for consideration of the request. PROVIDE LOCAL MATCHING FUNDS FOR AGRICULTURAL PRESERVATION PROGRAM Motion made by Commissioner Salvatore, seconded by Snook to commit the county's share of the Agriculture Transfer Tax for Fiscal Year 1987 as local matching funds for the purchase of easements under the Maryland Agricultural Land Preservation Program. Unanimously approved. AWARD BID - MEMORIAL RECREATION CENTER ROOF Motion made by Commissioner Downey, seconded by Roulette to award the bid for the Memorial Recreation Center Roofing Project to Kline Associated Roofing Contractors who submitted the low bid of $17,950. Unanimously approved. AWARD BID - WEATHER TREATMENT COURT HOUSE ANNEX Motion made by Commissioner Salvatore, seconded by Downey to award the bid for the Weather Treatment Court House Annex Project to Gruber Building, Cleaning & Restoration who submitted the low bid of $18,591 and to appropriate funds in excess of budget for this project from excess FY 1987 C.I.P. funds budgeted for the Memorial Recreation Center Roof Project. Unanimously approved. RESOLUTION TO ISSUE $4,860,000 PUBLIC IMPROVEMENT BONDS Motion made by Commissioner Roulette, seconded by Snook and unanimously passed to adopt a Resolution authorizing and empowering the County Commissioners of Washington County to issue and sell at public sale, upon its full faith and credit, its general obligation serial maturity bonds in the aggregate principal amount of $4,860,000 to be known as "Washington County, Maryland, Public Facilities Bonds of 1986" pursuant to the provisions of Chapter 470 of the Laws of Maryland of 1985 to provide funds for a grant to Hagerstown Junior College to finance the construction of an athletic facility/civic center on its campus, and to provide funds to finance a public golf course and swimming pool in Washington County; prescribing the terms and conditions of said bonds and upon which said bonds shall be issued and sold and other incidental details with respect thereto; providing that, in the event that funds available to the county are insufficient to pay the principal of and interest on the bonds that the Board of County Commissioners of Washington County shall levy and collect ad valorem taxes upon all the legally assessable property within the County sufficient to provide for such payments when due; authorizing the preparation and distribution of an official statement in connection with the issuance and sale of said bonds; making certain findings concerning debt limitations of Washington County and generally providing for the issuance of such bonds. LOCAL CENSUS STATISTICAL AREA COMMITTEE Motion made by Commissioner Roulette, seconded by Salvatore to appoint the following persons to serve as members of the Local Census Statistical Area Committee: Gloria Urban, Richard L. Kautz, Charles Stroh, David Foltz, Timothy Griffith, James Lemmert, Dr. George Comstock, Pat Barbarowicz, Stephen Goodrich and Jack Hawbaker as Census Statistical Area Keyperson. Unanimously approved. UPDATE EXISTING EEO AFFIRMATIVE ACTION PLAN Motion made by Commissioner Downey, seconded by Salvatore to update and adopt the existing Affirmative Action Statement of the Board of County Commissioners of Washington County for Housing and Community Development and the Housing Authority of Washington County. Unanimously approved. APRIL 1, 1986 MINUTES, CONT'D. REMOVE FROM TABLE REQUEST TO IMPROVE AND USE COUNTY PROPERTY FOR PARKING Motion made by Commissioner Salvatore, seconded by Roulette to remove from the Table the request from Christ Assembly of God Fellowship to improve and use a county owned lot for overflow parking. Unanimously approved. DECISION ON REQUEST TO IMPROVE AND USE COUNTY PROPERTY FOR PARKING Motion made by Commissioner Snook, seconded by Salvatore to enter into an agreement with Christ Assembly of God Fellowship for making improvements to a small parcel of county property adjacent to Piper Lane Park, and use by the Fellowship for overflow parking, conditional upon there being no on -street parking on the opposite side of York Road. Unanimously approved. RECESS The Meeting was recessed at 11:45 a.m. for a luncheon meeting with the Board of Trustees at the Hagerstown Junior College. AFTERNOON SESSION The Afternoon Session was convened at 1:50 p.m. with President Bowers presiding and Vice President Roulette and Commissioners Downey, Salvatore and Snook present. BUDGET HEARINGS The following FY 1987 Budget requests were presented: PARKS & RECREATION - submitted by Edith Sweigert and Bob Coble in the amounts of $460,678 and for HALFWAY COUNTY PARK SWIMMING POOL in the amount of $39,000. The Commissioners advised the Parks officials to include first year management costs in the swimming pool budget; ROADS DEPARTMENT - submitted by Ted Wolford in the amount of $3,526,441. No decisions were made at this time. CONVENE IN EXECUTIVE SESSION Motion made by Commissioner Roulette, seconded by Snook to convene in Executive Session at 3:00 p.m. in regard to personnel matters, pursuant to the authority contained in Article 76(A), Section 11(a)(6 & 7) of the Annotated Code of Maryland. Unanimously approved. RECONVENE IN REGULAR SESSION Motion made by Commissioner Snook, seconded by Roulette to convene in Regular Session at 3:15 p.m. Unanimously approved. PROPOSALS FOR AUDITING SERVICES Proposals for County Auditing Services were publicly opened and read aloud. Firms submitting proposals were as follows: Donovan Bachtell - $27,500, Ronald Z. Sulchek - No proposal, Main Hurdman - $22,600, Smith Elliott - $20,600, Linton Shafer & Co. - $19,500. The proposals will be reviewed by appropriate officials prior to a decision being rendered. BUDGET HEARING - HAGERSTOWN JUNIOR COLLEGE The Hagerstown Junior College Budget request was submitted by Dr. Atlee Kepler, William Clowser and Arthur Barnhart in the amount of $1,859,948 which represented 32.80 of the total college budget of $5,664,228. No decisions were made at this time. Unanimously approved. RECONVENE IN REGULAR SESSION AND ADJOURN Motion made by Commissioner Snook, seconded by Salvatore to reconvene in Regular Session and adjourn at 5:00 p.m. Unanimously approved.
