The Regular Meeting of the Board of County Commissioners of Washington County was called to
order at 9:00 a.m. by the President, Richard E. Roulette, with the following members present: Vice
President Ronald L. Bowers, Linda C. Irvin-Craig, John S. Shank, and Gregory I. Snook.
INVOCATION AND PLEDGE OF ALLEGIANCE
The Invocation was delivered by Gary Rohrer, Chief, Division of Planning & Codes Administration,
followed by the Pledge of Allegiance to the Flag by the full assemblage.
PRESENTATION OF SERVICE PINS
Alan Davis, Director of Personnel & Insurance, presented service pins to those employees who
became eligible for service pins for five years or more of County employment between July l and
September 30, l99l. The following employees were presented with service pins: 20 years - Verna
Brown; l0 years - Jeff Smith, Constance Fierro and Diane Mongan; 5 years - Elena Hartman, Bob
Leatherman, Darell Sanders, Mary Showe, Wallace Malkowitz, Scott Canfield, Sue Schlossnagle,
Dee Hawbaker, Kevin Knight, Michael Sprecher, Donna Anders, Sondra Teeter and Sharon Disque.
The Commissioners thanked the employees for their dedication and performance.
STORM DAMAGE ASSESSMENT At the request of the County Administrator, various department
heads met with the Commissioners to provide an assessment of the damages incurred from the
storm which hit Hagerstown last week. Ted Wolford, Roads Department Superintendent, estimated
that damages for his department would cost approximately $3,000 for removal of trees,
clean-up, and repair to the damage done to the console of the new fuel dispensing system by
lightning. Terry McGee, County Engineer, reported that between 5 l/2" to 6" of rain fell in the
northern section of Hagerstown during a 9 hour period which will probably be categorized as a l00
year storm. He noted problems with downstream flooding at the Arborgate subdivision area
and Park View Meadows, where there are known problems with stormwater management. He
also stated that the majority of structures functioned as intended. Robert Graff, Facilities
Administrator, reported no electrical or mechanical structures were damaged with the exception
of the County Office Building which received the brunt of the storm damage with 2" of water in the
basement. He estimated approximately $3,500 of repairs excluding the damage incurred at the
9ll/Fire & Rescue Communications area. Peter Loewenheim, Supervisor
of Communications Maintenance, stated that the 9ll center took a direct hit from lightning which
knocked out the console and forced dispatchers to move to the Hagerstown Fire Department
office for back-up. With damages to the consoles at the Sheriff's Department, Fairview Mountain,
and the 9ll center, repairs will cost between $l0,000 - $l5,000. Commissioner Roulette
commended those involved for the manner in which they performed their duties during the storm
under difficult circumstances and thanked them for their efforts.
PUBLIC HEARING - BUILDING CODES Commissioner Roulette convened the Public Hearing to
review the proposed repeal of the l986 CABO One and Two Family Dwelling Code and the
enactment of the l989 CABO One and Two Family Dwelling Code, the proposed repeal of the
l987 BOCA National Building Code and the enactment of the l990 BOCA National Building Code
with changes and the proposed repeal of the l987 BOCA National Mechanical Code and the
enactment of the l990 BOCA National Mechanical Code, the enactment of the l990 BOCA National
Fire Prevention Code, and the enactment of the l988 NFPA l0l Life Safety Code, and to repeal the
l987 BOCA National Plumbing Code adopted by the Washington County Commissioners as the
Washington County Plumbing Ordinance On December 20, l988, and the enactment of the l990
BOCA National Plumbing Code, and to hear public testimony regarding the proposed enactments,
repeals, and changes. Gary Rohrer, Chief, Division of Planning and Codes Administration,
testified regarding the proposed repeals and enactments and discussed six possible revisions
requested by the Plumbing Board to the Plumbing Code. Susan Funk spoke in opposition to one
of the terms submitted by the Plumbing Board. The Commissioners decided to wait until the
revisions suggested by the Plumbing Board were distributed before taking action on the Plumbing
Code amendments.
Motion made by Commissioner Snook, seconded by Bowers, to repeal the l986 CABO One and
Two Family Dwelling Code, the l987 BOCA National Building Code, and the l987 BOCA National
Mechanical Code, and to adopt the l990 BOCA National Mechanical Code, the l990 BOCA
National Fire Prevention Code, the l988 NFPA l0l Life Safety Code, the l990 BOCA National
Building Code, and the l989 CABO One and Two Family Dwelling Code, to become effective
November l, l99l, and any application submitted prior to that time would come under the
jurisdiction of the Code in effect at that time. Unanimously approved.

AGRICULTURAL TRANSFER TAX CERTIFICATION Eric Seifarth, Associate Planner - Agriculture,
appeared before the Commissioners to present the final copy of the application for certification
which would allow Washington County to retain 75% of the Agricultural Transfer Tax for the
purchase of Agricultural Land Preservation Easements. Mr. Seifarth stated that both the
Planning Commission and Agricultural Land Preservation Advisory Board approved the
application. Motion made by Commissioner Bowers, seconded by Shank, to approve submission of
the application for certification of the Agricultural Land Preservation Program, which would allow
Washington County to retain 75% of the Agricultural Land Transfer Tax for purchase of
agricultural land easements. Unanimously approved. RESOLUTION - WORKMEN'S
COMPENSATION
Motion made by Commissioner Snook, seconded by Bowers, to approve a Resolution
pledging $75,000 of U. S. Treasury Bonds as a condition required by the State of
Maryland for the County's Workmen's Compensation self-insurance program.
Unanimously approved.
CITIZEN PARTICIPATION
No one was present who wished to participate.
CONVENE IN EXECUTIVE SESSION
Motion made by Commissioner Snook, seconded by Irvin-Craig, to convene in Executive
Session at 11:00 a.m. in regard to property matters in accordance with Section
l0.508 of the State Government Article of the Annotated Code of Maryland.
Unanimously approved.
RECONVENE IN REGULAR SESSION
Motion made by Commissioner Snook, seconded by Shank, to reconvene in Regular
Session at ll:l5 a.m. Unanimously approved.
RECESS - LUNCHEON AT HAGERSTOWN JUNIOR COLLEGE
The Commissioners recessed at ll:l6 a.m. in order to attend a luncheon at
Hagerstown Junior College with their Board of Trustees.
GROUNDBREAKING - SCHOOL HOUSE MANOR
The Commissioners attended the groundbreaking of School House Manor, the elderly
housing complex to be constructed in Boonsboro. The complex will be managed by the
County's Housing & Community Development office.
AFTERNOON SESSION
The Afternoon Session was convened at 2:30 p.m. by the President, Richard E.
Roulette, with the following members present: Vice President Ronald L. Bowers and
Commissioners Linda C. Irvin-Craig, John S. Shank, and Gregory I. Snook.
BOARD/COMMISSION REPORTS
Commissioner Irvin-Craig reported on the Transportation Commission meeting and
Commissioner Bowers spoke briefly about the stormwater drainage problems near the
Arborgate subdivision.
APPROVAL OF MINUTES - SEPTEMBER 10, 1991
Motion made by Commissioner Irvin-Craig, seconded by Bowers, to approve the minutes
of September l0, l99l, as corrected. Unanimously approved.
BID AWARD - ROOF INSPECTION MAINTENANCE SURVEY
Motion made by Commissioner Snook, seconded by Shank, to award the bid for roof
inspection on County buildings to Bonded Applicators, who submitted the low bid of
$3,620 and $50/hour for major repair/replacement design. Unanimously approved.
BID AWARD - FLEET VEHICLES
Motion made by Commissioner Snook, seconded by Bowers, to award the bid for fleet
vehicles to the following firms who submitted low bids: 2 l/2 ton pick-up trucks
(Permits) to Martin Truck Co. - $ll,074/truck; station wagon with front wheel drive
(Landfill) to Lanham Ford - $l4,395; full size l/2 ton pick-up truck with 4-wheel
drive (Roads) to Martin Truck Co. - $l6,652; and 3/4 ton pick-up with 4-wheel drive
(Housing) to Martin Truck Co. - $l8,055. Unanimously approved.

INDEPENDENT CEMENT COMPANY - CITIZENS GROUP
Barry Teach, Administrator, distributed copies of the newspaper ad for publication
by Independent Cement Company requesting interested parties to contact them if they
would like to serve on the citizens committee to study the proposed use of the
incinerator. Commissioner Bowers again stated his opposition to the committee
being controlled and formulated by ICC. Commissioner Roulette stated that he has
difficulty philosophically with appointing a County committee which would oversee l
company. The Commissioners discussed various aspects and the possibility of
appointing an air quality control committee or environmental matters committee to
deal with all environmental issues. The Commissioners requested that the Plant
Manager at ICC meet with them when he has the names they are proposing for the
citizens committee.
APPOINTMENT - FIRE & RESCUE COMMUNICATIONS ADVISORY BOARD
Motion made by Commissioner Bowers, seconded by Snook, to appoint Gail McDowell as
citizen-at-large representative to the Fire & Rescue Communications Advisory Board
for a three year term. Unanimously approved.
BID AWARD - AIRPORT GROOVING AND RUNWAY SIGNS
Motion made by Commissioner Bowers, seconded by Snook, to award the bid for runway
grooving and signs at the Regional Airport to Cardinal Industries, Inc., who
submitted the low bid, as clarified, of $229,530.64, pending Federal Aviation
Administration approval. Unanimously approved.
PERSONAL PROPERTY TAX PRO-RATION Motion made by Commissioner Irvin-Craig, seconded
by Shank, to approve pro-rating County personal property taxes for Ungers Auto Mart from $l7.68
to $ll.72, which provided certification from the State that the business closed in May l991.
Unanimously approved.
SCIENCE BUILDING ADDITION - HAGERSTOWN JUNIOR COLLEGE Barry Teach, Administrator,
informed the Commissioners that the Facility Design Review Committee has reviewed the
proposed addition to the Science building at Hagerstown Junior College and has approved the
design but felt the time specified in the contract was unreasonable and should be adjusted to
allow an additional 3 months. The Commissioners agreed with the recommendation to amend
the time specifications if HJC wishes to proceed with bidding at this time or if they would
prefer to wait and bid the project in the Spring.
GRANT AGREEMENT - AIRPORT RUNWAY GROOVING PROJECT Motion made by
Commissioner Shank, seconded by Snook, to approve the grant agreement with the Federal
Aviation Administration for the airport runway grooving project, subject to review by the County
Attorney. Unanimously approved.
SUBDISTRICT 18-1 - WATER SERVICE AGREEMENT Motion made by Commissioner Snook,
seconded by Shank, to approve the Water Service Agreement for Subdistrict l8-l (Water) by the
City of Hagerstown, the Board of County Commissioners and the Washington County Sanitary
Commission, as amended, with the condition agreed upon that at a future date, water service
may be extended to the area shown on the plat as a possible future addition to the subdistrict.
Unanimously approved.
CONSULTANT SERVICES - TOWN HISTORIC SURVEY Motion made by Commissioner Snook,
seconded by Bowers, to accept the recommendation of the Coordinating Committee and award the
contract for consultant services for the Town Historic Survey of Boonsboro and Clear Spring, to
Julianne Mueller, who submitted the low proposal of $l9,879. Unanimously approved.
CONVENE IN EXECUTIVE SESSION Motion made by Commissioner Snook, seconded by Shank,
to convene in Executive Session at 3:35 p.m. in regard to personnel and property matters and
to confer with the County Attorney in accordance with Section l0.508 of the State Government
Article of the Annotated Code of Maryland. Unanimously approved.
RECONVENE IN REGULAR SESSION Motion made by Commissioner Shank, seconded by Snook,
to reconvene in Regular Session at 4:58 p.m. Unanimously approved.
PROMOTION - ASSISTANT SUPERVISOR - EASTERN SECTION - ROADS DEPARTMENT
Motion made by Commissioner Bowers, seconded by Irvin-Craig, to promote James Green to
Assistant Supervisor in the Eastern Section of the Roads Department. Unanimously
approved.

EMPLOY - GRID TECHNICIAN Motion made by Commissioner Bowers, seconded by Snook, to
employ Carroll Strailman as Grid Technician in the Planning Department to fill an existing
vacancy.
Unanimously approved.
REJECT BIDS - CONSULTANT SELECTION - "E" POD - DETENTION CENTER Motion made by
Commissioner Bowers, seconded by Shank, to accept the recommendation of the Coordinating
Committee and reject all bids submitted for design of the E Pod at the Detention Center and rebid.
Unanimously approved.
HOMESTEAD PROPERTY TAX Motion made by Commissioner Snook, seconded by Bowers, to
approve the Homestead Property Tax Ordinance, pursuant to Tax-Property Article of the
Annotated Code of Maryland, which provides that the home state credit percentage for the
taxable year beginning July l, l992, shall not exceed ll0%, with said Ordinance to become
effective July l, l992. (Copy of Ordinance attached.)
