HomeMy WebLinkAbout901016 October l6, 1990 Hagerstown, Maryland 21740 The Regular Meeting of the Board of County Commissioners was called to order at 9:00 a.m. by the President, Ronald L. Bowers, with the following members present: Vice President, Linda C. Irvin, and Commissioners R. Lee Downey, Richard E. Roulette and John S. Shank. INVOCATION AND PLEDGE OF ALLEGIANCE The Invocation was delivered by Commissioner Bowers, followed by the Pledge of Allegiance to the Flag by the full assemblage. INTRODUCTION OF NEW ECONOMIC DEVELOPMENT COMMISSION MEMBERS Terry Randall introduced new Economic Development Commission members Robert Ginsberg, Jeannine Humphrey, Richard Meyer and Edmond Reushling. PRESENTATION - SMITHSBURG HISTORICAL SOCIETY Nicholas Shillinger and Charles Slick, representing the Smithsburg Historical Society, appeared before the Commissioners to announce that a book entitled The Poetic Works of Edgar Irving Brenner has been published and is now for sale at local bookstores. Mr. Shillinger explained that these manuscripts were discovered by Edgar Brenner's family, who resided in Smithsburg, after his death in l886 and were held by the family until recently when they were presented to the members of the newly formed Smithsburg Historical Society. He then presented the Commissioners with copies of a poem entited "In Maryland" by Edgar Irving Brenner which had been published in l886. COMMUNICATIONS MAINTENANCE - STATE AMBULANCE CONTRACT Kathleen Riley, Chief, Division of Citizens Services, and Pete Loewenheim, Supervisor of Communications Maintenance, appeared before the Commissioners regarding the State's request that the Washington County Communications Maintenance Department enter into an agreement to perform maintenance on the communications equipment for ambulance companies. Mr. Loewenheim explained that no bids were received by the State for this service and they are offering to pay the County a fixed amount per month to maintain existing equipment and installation of new equipment. He estimated that this would total $l8,000-$20,000 per year, but the County would have to hire a third technician to handle the additional work. The Commissioners agreed to the concept and asked Mr. Loewenheim to negotiate with the State regarding the monthly rate. AMENDMENT TO WATER & SEWER STUDY CONTRACT Motion made by Commissioner Roulette, seconded by Shank, to extend the contract with BCM Engineers, Inc., for additional work needed for the Water & Sewer Study for the Hagerstown Metropolitan Area, and to approve the County's share for this work of $4,445.50. Unanimously approved. ADOPTION OF ADEQUATE PUBLIC FACILITIES ORDINANCE Ralph France, County Attorney, reviewed the changes made to the Adequate Public Facilities Ordinance at the October 9, l990, meeting. Motion made by Commissioner Irvin, seconded by Roulette, to adopt the Adequate Public Facilities Ordinance as submitted with an effective date of December l, l990. Motion carried with Commissioners, Irvin, Roulette, Downey and Bowers voting "AYE" and Commissioner Shank voting "NO". (A copy of the adopted Ordinance is attached.) BOARD/COMMISSION REPORTS Commissioner Irvin reported on the Task Force on Homelessness meeting, the Volunteer Council for Alcohol & Drug Free Youth meeting, the Historical Advisory Council meeting, the Children's Council and the Washington County Historic Trust meeting, and Commissioner Downey reported on the Advisory Board of Health meeting. APPROVAL OF MINUTES - OCTOBER 2, 1990 Motion made by Commissioner Irvin, seconded by Downey, to approve the minutes of October 2, l990, as submitted. Unanimously approved. CONFIRMATION OF REAPPOINTMENT - COFFMAN HOME FOR THE AGING BOARD OF DIRECTORS Motion made by Commissioner Downey, seconded by Roulette, to confirm the reappointment of Howard Kaylor to the Board of Directors of the Coffman Home for the Aging. Unanimously approved. OCTOBER 16, 1990 MINUTES, CONT'D. TRANSFER OF FUNDS - CIVIL DEFENSE Motion made by Commissioner Downey, seconded by Roulette, to approve the transfer of $l,000 from Vehicle Maintenance (0l-5-l28l-554-000) to Machinery & Equipment (0l-5-l28l-542-000) to cover costs for repair of the generator at Fairview Mountain in the Civil Defense budget. Unanimously approved. STERLING ROAD - RAILROAD CROSSING RECONSTRUCTION Barry Teach, County Administrator, informed the Commissioners that a letter was received from Conrail agreeing to assume costs for work outside the crossing right-of-way which will reduce the County's cost by $42,000 for this reconstruction work. Motion made by Commissioner Shank, seconded by Irvin, to approve funding in the amount of $56,l00 as the County's share for the reconstruction of the Conrail railroad crossing at Sterling Road with funds to be taken from the Capital Contingency Fund. Unanimously approved. PUBLIC HEARING - AGRICULTURAL LAND PRESERVATION DISTRICT APPLICATIONS The Commissioners convened in public hearing at l0:00 a.m. in order to consider six applications for Agricultural Land Preservation Districts and to hear public comments regarding these applications. Eric Seifarth, Associate Planner - Agriculture, reviewed each of the applications and informed the Commissioners that all have been approved by the Agricultural Advisory Board and were considered compatible with the Comprehensive Plan by the Planning Commission. The hearing was then opened for public comments. No one was in attendance to speak regarding the applications. Motion made by Commissioner Roulette, seconded by Shank, to approve the following applications for Agricultural Land Preservation Districts: AD-90-27 submitted by William & Rachel Niemyer; AD-90-28 submitted by Carolyn Baker and Linda Hammond; AD-90-33 submitted by Elmer Stone; AD-90-34 submitted by Daniel Secrest; AD-90-39 submitted by Robert & Carrie Stockslager; and AD-90-4l submitted by Glenn & Doris Martin. Unanimously approved. APPOINTMENTS - CHILDREN'S COUNCIL Motion made by Commissioner Irvin, seconded by Shank, to appoint Carol Diehl and Karen Callen to the Children's Council for three-year terms. Unanimously approved. BID OPENING - IMPROVEMENTS TO INTERSECTION OF ROBINWOOD DRIVE & HAGERSTOWN JUNIOR COLLEGE One bid was publicly opened and read aloud for improvements to the intersection of Robinwood Drive and Hagerstown Junior College. The following firm and its proposal was as follows: C. William Hetzer - $l44,627, Alternate - $33,393.50, for a total bid of $l78,020.50. The bid will be reviewed by appropriate officials prior to a decision being rendered. DRAINAGE PROBLEMS Terry McGee, County Engineer, met with the Commissioners to discuss the drainage problems experienced in the County due to the heavy rainfall last week. Mr. McGee stated that he made site visits to l0 locations in the County and found 3 areas with significant problems. These areas are the Park View Meadows subdivision, the Arborgate subdivision and Maryland Paper located in the 70/81 Industrial Park. Mr. McGee explained that last week's storm was classified as a 5- or l0-year storm which means that a storm of this severity is only anticipated every 5 or l0 years. He informed the Commissioners that the major problems occurred because of the run- off from areas which were stripped during development. The lack of grass and vegetation in these areas accounted for approximately twice the amount of water run-off which would have occurred if the areas had been stabilized. Mr. McGee stated that the Engineering Department is gathering data at this time, but the Commissioners may need to approach the State to initiate changes to the Stormwater Management Ordinance. The Commissioners discussed the provisions in the Ordinance limiting the amount of land which can be disturbed at one time. Several property owners were in attendance from the Park View Meadows subdivision to comment regarding the problems they are experiencing in this area. The Commissioners requested that the County Administrator schedule a meeting with the property owners, to include the County Attorney and County Engineer, to discuss the situation. 1991 LEGISLATIVE PACKAGE Ralph France, County Attorney, and Barry Teach, County Administrator, reviewed the requests submitted by County departments for inclusion in the legislative package to the Washington County Delegation to the General Assembly. Mr. Teach informed OCTOBER 16, 1990 MINUTES, CONT'D. the Commissioners that a meeting with the Delegation has been scheduled for November 8 to discuss these requests in more detail. CONVENE IN EXECUTIVE SESSION Motion made by Commissioner Roulette, seconded by Irvin, to convene in Executive Session at ll:45 a.m. in regard to personnel, property and to confer with the County Attorney, in accordance with Section l0.508 of the State Government Article of the Annotated Code of Maryland. Unanimously approved. RECESS The Commissioners recessed at l2:00 noon in order to attend Head Start's Anniversary Reception, and then reconvened in Executive Session at l:00 p.m. RECONVENE IN REGULAR SESSION Motion made by Commissioner Irvin, seconded by Downey, to reconvene in Regular Session at 2:37 p.m. Unanimously approved. ADDITIONAL COMPENSATION FOR LEAD WORKERS - PARKS DEPARTMENT Motion made by Commissioner Shank, seconded by Roulette, to provide an additional $.50 per hour compensation to Lead Workers at the Parks Department for the supervisory duties which were added to their positions. Unanimously approved. BID AWARDS - SHOP EQUIPMENT - TRANSPORTATION DEPARTMENT Motion made by Commissioner Irvin, seconded by Roulette, to award the bid for shop equipment for the Washington County Transportation Department to the following low bidders: Auxillary support stands to Johnson & Towers - $2,600; Industrial fiberscope to Olympus Corporation - $l0,890; Portable electro-mechanical jacks to Johnson & Towers - $24,650; Refrigerant reclaimer and recycler to Old Orchard Auto Parts - $3,486.
