In addition to the routine review and approval of subdivisions and site plans, the Commission continued to implement the Comprehensive Plan that was adopted in 1981. The various elements of the Plan worked on by the Commission in Fiscal Year 1993 are described in this report along with the numerous other tasks undertaken during this fiscal year. As in the past, the new Work Program that has been formally adopted by the Planning Commission lists all those tasks the Commission plans to address. Many items which are outlined in greater detail in other sections of this report are directly related or reflect some aspect of the implementation of the policy and goals of the Comprehensive Plan. During FY 1993 the Planning Commission worked to implement the policies of the Comprehensive Plan through refinement of the Adequate Public Facilities Ordinance, adoption of the Forest Conservation Ordinance, securing certification of the Agricultural Preservation Program, progression on the Highway Interchange Study and the processing of both zoning ordinance map and text amendments. The Planning Commission's focus remains to facilitate development within the Urban and Town Growth Areas while preserving agricultural and historic areas within the County's rural landscape. Meetings with the City of Hagerstown and the Town of Boonsboro as well as the Agricultural Advisory Board and County Health Department emphasized this objective. With the approval of the Planning Act of 1992 by the Maryland General Assembly additional modifications to the Comprehensive Plan will become necessary. In accordance with the Planning Act the Planning Commission adopted a schedule for updating the Comprehensive Plan to incorporate the "Visions". This schedule also addresses development of a new plan element for the protection of sensitive areas as well as updating of the Transportation Element and regulations to implement the modifications to the 1 Comprehensive Plan. Revisions were also made to the Capital Improvement Program development process to reflect the requirement by the Planning Act to review each capital improvement project for consistency with the Comprehensive Plan. Since the Comprehensive Plan's adoption in 1981, the Planning Commission and Staff have worked continuously to implement its strategies for growth management and improvement of life in Washington County. The following is a list of the Comprehensive Plan policies and their current status since the start of the Plan implementation in 1981. The Program was established and is regulated by Agricultural Article, Section 2-501 through 2-515 of the Annotated Code of Maryland. It is administered through a Planning Commission staff member, by the Washington County Agricultural Land Preservation Advisory Board, the County Commissioners, and the Maryland Agricultural Land Preservation Foundation of the Maryland Department of Agriculture. The Program encourages landowners to voluntarily enter into an Agricultural Land Preservation District in which it is agreed that the land will not be developed for a period of at least five years. (To receive County tax credits, the landowner is required to commit his property to agricultural use only, for a period of ten years.) In return for that restriction, the landowner receives protection from nuisance complaints and becomes eligible to sell a Development Rights Easement. A landowner may exercise the option of selling a Development Rights Easement to the Agricultural Land Preservation Foundation provided that his offer to sell is recommended by the County's Advisory Board and the County Commissioners. At the local level, the Agricultural Advisory Board will review and rank easement applications, assigning point values to such items as farm size, soil quality and development pressure indicators on its easement checklist. Each farm's total point value will assist the Board in determining which farms to recommend for easement purchase and in what order of priority. The Board of County Commissioners makes the final local decision based on Advisory Board recommendations and data gathered at the required public hearing. If purchased by the State of Maryland, the easement will remain effective in perpetuity. During FY 1993, total acreage in the program increased to 20,586 acres with a total of 145 farms on file. In the Easement Purchase Program, contracts were issued during FY 93 for two more farms, bringing total easement properties in the program to 14, equalling 3,675 acres. The Agricultural Preservation Advisory Board is continuing to work with the Planning Commission to monitor the success of the easement program and to consider other options for the long term success of the Agricultural Preservation Program. in January 1993, Washington County was approved as a "certified" county, thereby allowing us to retain 75% of the agricultural transfer tax money. The additional money will be used to purchase easements through the State 60/40 match program, or through the County program. 7 The following tables illustrate the acreage of agriculturally significant land (land meeting the MALPP district criteria) that was converted to development during FY 1993 (by Planning Sector) and a summary of activity over the last 13 years. The studies were presented at Public Hearing during FY 1993 and were accepted by the Maryland Department of the Environment. The State's acceptance of the studies has cleared the way for grants and loan programs to fund portions of the studies found to be implementable. The UGA Water and Sewer Study also conducted by BCM Engineers was completed and adopted by the Mayor and Council of Hagerstown and the Board of County Commissioners in FY 1993. The study was adopted by Resolution to be used as a guide and basis for updating the County's Water and Sewerage Plan where applicable. The County and City Planning Departments, serving as staff for the County Commissioners Metropolitan Planning Organization, coordinated the efforts and reviewed the work performed by Travers Associates in the calibration of the travel forecasting model known as QRS -II. The project, which was 95% funded by Federal and State Highway Administration grants, is designed to assist in the assessment of long range transportation needs by modeling the effect of future land use development on present day road network. 10 Town Planner Assistance Program The Assistance Program is nearing its second year of service and assistance to municipal governments in Washington County. The Town of Boonsboro continues to be active in the program and has found the program to be a viable option to employing a full --time staff person. The Town Planner organizes the monthly agenda, analyzes and coordinates the review of development proposals and assists in long term or comprehensive planning goals of the Town. In accordance with the Planning Act of 1992, the Boonsboro Planning Commission is in the process of updating their Comprehensive Plan and Zoning and Subdivision Ordinances. In FY 1993 the Commission approved the subdivision and site improvement plans for Phase I of the Crestview Subdivision. Phase I is the first 31 lots of the proposed 149 lot development and represents the first major subdivision to occur since the mid 19801s. The developer is being required to make major upgrades to the water distribution system including a new municipal well and wellhouse. The Town Planner developed a concept plan as requested by the Mayor and Council for addressing the downtown parking problem. The Town recently acquired a parcel adjacent to the Town's library for a future parking lot. The parcel will also provide handicap accessibility to the library and pedestrian traffic to Main Street. 11 Forest Conservation Program The Planning Department continued development of a local Forest Conservation Program through the end of 1992. In February, 1993 the Board of County Commissioners adopted the Washington County Forest Conservation ordinance meeting State requirements to retain local administration of the program. The ordinance is designed, in accordance with State law, to retain, and in some cases increase, forest coverage through monitoring and implementation during the land development plan review procedures. It requires delineation of existing forest cover and detailed plans for the removal and, in certain situations replacement of forest cover. There are also provisions for exemption under certain conditions. To date most activity has been in granting exemptions. Approximately ten delineations have been approved and minor conservation plans, consisting of protective measures on remaining existing forested lands occupy the majority of the effort in this program. The entire program has proved to be a challenge to the Department and continues to be refined. Currently under development is a program to plant new forest lands using the "payment in lieu of fees" that are allowed as a last alternative to. replanting cleared forest. 12 Water and Sewerage Plan No requests for individual amendments to the Water and Sewerage Plan were received or processed by the Planning Department in FY 1993. However, numerous requests were received for changes to be made part of the biennial update. These requests were reviewed by the staff and incorporated into the draft updated plan. In FY 1992 the State mandated biennial update of the Water and Sewerage Plan was initiated, work on the plan continued throughout FY 1993. Extensions to the due date of November 1, 1992 were requested by the Staff and granted by the State in order to allow time to include references to the Hagerstown Urban Growth Area Water and Sewer Study and to include new methodology for streamlining the review and approval process for new service areas within the adopted Growth areas. Changes are also proposed to include new policies dealing with designation of service areas located within the rural/agricultural area. The public hearing process and adoption of the updated plan is expected to be completed by the Fall of 1993. 13 Highway Interchange Study The Planning Staff continued progress of the Highway Interchange Zoning District Study along the I-70 and I-81 corridors during FY 1993. The Highway Interchange Study's primary purpose is to reclassify current HI districts into either HI -1 or HI -2 zones as well as to evaluate the limits of the current HI districts for possible changes. During the term of FY 1993, all 17 highway interchanges and surrounding Highway Interchange zoning districts along the 1-70 and I-81 corridors were analyzed in detail regarding all facets of development. Items such as current land use, environmental limitations, historic resources, utility identification and transportation patterns were mapped and evaluated to formulate recommendations for either the HI -1 or HI -2 designation or for a possible change in the current boundary of the Highway Interchange district. These 17 interchanges have been divided into 5 groups according to proximity and relationship with one another. Of the 5 groups, group 1 which incorporates I-70 at MD 66, I-70 at U.S. 40 and I-70 at MD 55 has been to a public information meeting and a public hearing, however a decision on the recommendations and testimony heard is not expected until early 1994. The remaining 4 groups will be scheduled to go to public information meetings and public hearings starting in early 1994 beginning with group 2 and working consecutively until all work is complete. 14 A grant was obtained from the Appalachian Regional Commission to help defray the costs of the study which was effective from April of 1992 to September 1993. 15 Adequate Public Facilities ordinance The Adequate Public Facilities Ordinance (APFO) which became effective on December 1, 1990, was assessed by the Planning Commission and recommended for continuance. During FY 1993, several amendments to the APFO were proposed by the Planning Commission. The amendments related to clarification of the definition of Agriculture, expanding the definition for new development, adding a definition for remaining lands along with wording that addresses the use of remaining lands to qualify for exemptions and the establishment of a baseline data point for use in determining the adequacy of schools. 16 House Numbering The house numbering program begun in 1986 became fully implemented in FY 1993. This year saw the implementation of the "gray area" which is located around and adjacent to the City of Hagerstown. Except in a few instances, all houses in the gray area were numbered with an extension of the Hagerstown numbering system. Development of a system to keep the house numbering program updated as well as addressing any errors or modifications will continue in FY 1994. 17 Park Planning Park planning for FY 193 included a variety of projects and activities. The draft Land Preservation Plan was circulated to municipalities and a variety of service agencies and organizations. The plan was revised according to comments received at the public meetings. It was adopted by the Commissioners and sent on to the state in July. Several concept plans for the Pinesburg softball complex were prepared for the Parks and Recreation Board. A concept plan for a proposed Conococheague Creek Greenway was developed in conjunction with efforts to restore and preserve Prices Bridge. The final draft of a gifts acknowledgement policy for donations to the Parks Department was presented and adopted by the Parks and Recreation Board and cost estimates for gift acknowledgement plaques were provided to the Parks and Recreation Director. A revised concept plan for improvements to Byron Park was provided to the town of Williamsport. Other planning activities were research of development impact evaluation methods and techniques, review of a large PUD concept plan for adequate play lot provisions and development of fee in lieu of planting guidelines for the forest conservation program. Solid Waste Management Plan The required biennial update of the Solid Waste Management Plan for the County was completed during Fiscal Year 1992. The biennial update is prepared in accordance with the Code of Maryland Regulations and Title 9, Subtitle 5 of the Annotated Code of Maryland. The purposes of the Plan are to establish the County's solid waste management policies and to develop comprehensive goals that are economical and environmentally sound to meet the future needs of the citizens of Washington County. The Plan consists of an introduction and five chapters. The primary information required in the Plan's chapters include: County's goals and objectives regarding solid waste, County population, existing and projected waste generation entering County landfills, assessment of the County's existing solid waste disposal system, future plans for existing and proposed County landfills, and recommendations for accomplishing future solid waste goals. The updated Plan was presented to the Board of County Commissioners and adopted on June 22, 1993. The Washington County Recycling Plan was incorporated into the Solid Waste Management Plan as part of the update to provide a comprehensive planning document for management of the County's solid waste stream. 19 Historic District Commission The Commission completed .its first Certified Local Government project, updating photographic and owner/address information for the County's Historic Sites Survey, by the end of FY 92-93. It highlighted many other areas of the preservation issue that will need attention in the future. The Commission and its assigned staff have also been assisting in the transfer of ownership and preparation of a reuse feasibility study for the former Antietam Railroad Station near Sharpsburg. A consultant has been selected to perform the study. Following completion of the study, the Commission will likely assist in securing funds for the necessary rehabilitation. The Commission continues serious discussion about the need for a Comprehensive Historic Preservation Plan. It also continues to review construction permits in the HP and A© zones, demolition permits for sites listed in the Historic Sites survey, historic tax credit applications and rezoning requests for the Historic Preservation overlay zoning. 20 Development Activity Development proposals were reviewed by the Planning Commission in both conceptual and final form. The Commission reviewed and approved 125 residential, commercial, industrial or institutional subdivision plats involving 1,005 lots and representing 1,055 dwelling units on 793.5 acres. In addition the Commission approved 19 site plans, 44 simplified plats, and held 15 preliminary consultations concerning future development. Some of those conceptual forms have not resulted in a firm design while others have proceeded through final approval. Those subdivisions or developments of particular significance (final approval of twenty or more lots or units) are: Cross Creek, North Village Section 1, Northbrook Estates Section B, Rosewood Estates, Smithfield Estates, South Pointe PUD, Van Lear Manor Sections 13 & 14, and Woodbridge Section A & B. Site plans representing significant private investments within the County were approved for, Phoenix Color Corp., two Food Lion Stores, Teamsters Local Union No. 992, Potomac Valley Farm Supply, Trendline Inc., and USA Cartage Inc. Site plans were also approved for public projects including an addition to the Technical Innovation Center at HJC and the Conococheague Industrial Wastewater Pretreatment Facility. Page 25 through the first page of the appendix contains summary tables, individual listings, trend charts, (bar graphs) and mapping of subdivision activity during Fiscal year FY 1992-1993. 21 Rezoning Cases and Ordinance Amendments Between July 1, 1992 and June 30, 1993, the Planning Commission acted on 19 applications. Eleven of these were map amendments and eight were text amendments. Joint hearings with the Planning Commission and the Board of County Commissioners were held regularly on a quarterly cycle or special hearings were held as necessary to provide for efficiency in the hearing process.
