September 23, 2014
President Terry L. Baker called the regular meeting of the Board of County
Commissioners of Washington County, Maryland to order at 1:07 p.m. in the County
Administration Building located at 100 West Washington Street, Room 227, Hagerstown,
with the following members present: Vice President John F. Barr and Commissioners Ruth
Anne Callaham, Jeffrey A. Cline, and William B. McKinley.
PROCLAMATION
The Commissioners presented a proclamation to Jennifer Bentlejewski, Area Extension
Director, in recognition of the 100th anniversary of the Cooperative Extension educational
system. Ms. Bentlejewski described the University of Maryland Extension programs in the
community that provide practical, community-based learning opportunities in the areas of
agriculture, horticulture, natural resources, health and nutrition. She invited all to the 100th
Anniversary celebration on October 23 at the Agricultural Education Center, Boonsboro.
CONTRACT AWARD — WINEBRENNER WATER TREATMENT PLANT
UPGRADE
Rick Curry, Buyer, Purchasing, and Mark Bradshaw, Deputy Director, Environmental
Management, presented the proposal to award the contract for the C. William Winebrenner
Water Treatment ENR Plant Upgrade Project (PUR-1209) to HRI Bridge Co. of State
College, Pennsylvania, which submitted the lowest total sum bid of $12,198,000 (for Item
Nos. 1 and 2 plus contingent items C 1 through C5), contingent upon approval of the
Maryland Department of the Environment (MDE) and the County Attorney. Mr. Curry
discussed the bids received and Mr. Bradshaw described the work to be performed under
the contract. The Commissioners discussed the project.
Commissioner Barr, seconded by McKinley, moved to award the contract for the C.
William Winebrenner Water Treatment ENR Plant Upgrade Project to the responsible,
responsive bidder, HRI Bridge Co. of State College, Pennsylvania, which submitted the
lowest total sum bid of $12,198,000 (for Item Nos. 1 and 2 plus contingent items C 1
through C5), contingent upon formal approval by MDE and the County Attorney. The
motion passed unanimously.
CHANGE ORDER — SHARPSBURG WATER TREATMENT PLANT TRANSITE
PIPE REPLACEMENT
Mark Bradshaw requested approval of Change Order #1 to Underground Contractors, Inc.
for $87,062.78 for the Sharpsburg Water Treatment Plant Transite Pipe Replacement
Project. He indicated that during construction, it was discovered that the plant's discharge
would interfere with construction activities. The cost of piping the discharge around the
construction is $49,486. Prior to beginning construction, it was found that the original
design would not allow for the removal of sludge from the facility as required. The
redesign alternative cost associated with this change is $87,095.28. Mr. Bradshaw also
advised that the contractor has provided two value engineering change proposals that

would reduce costs of the work to be performed by $5,098 and $4,420.50. Mr. Bradshaw
indicated that the original contract called for modifications/upgrades to the wastewater
lagoons. Due to regulatory changes, it was determined that removing this from the current
contract and addressing it in a separate upgrade would be a more efficient method of
accomplishing these modifications. This would result in a deduction of $40,000. He
indicated that additional funds would need to be transferred between accounts to cover the
additional expenses. The Commissioners discussed the matter.
Commissioner McKinley, seconded by Callaham, moved to approve Change Order #1 to
Underground Contractors, Inc. for $87,062.78 for the Sharpsburg Water Treatment Plant
Transite Pipe Replacement Project as presented, including an $88,000 budget transfer to
cover additional expenses. The motion passed unanimously.
MARYLAND THEATRE SEATING PROJECT
Jessica Green, Operations Manager, and Sam Young, Facilities Chair, The Maryland
Theatre Association, Inc., (Theatre) appeared before the Commissioners to discuss the
Capital Improvement Overview plan for restoration of the Theatre. Mr. Young described
the projects planned to restore the Theatre for its I 001 anniversary celebration in 2015.
Ms. Green discussed the Theatre's seating project and the preliminary funding of $200,000
discussed by the Commissioners during their July 15, 2014 meeting. She advised that the
Board is requesting an additional $50,000 contribution each from the County and City of
Hagerstown due to a $100,000 funding gap in the seating project. If additional
sponsorships and grants are awarded by that time, the $50,000 will not be needed. The
Commissioners discussed the information presented and whether they had enough details
before them to justify the request. Commissioners McKinley and Cline indicated support
of only a $200,000 contribution at this time.
Commissioner McKinley, seconded by Barr, moved to approve $200,000 for the Capital
Improvement Seating Project at the Maryland Theatre, to be taken from the County's share
of Hotel Rental Tax funds. The motion passed unanimously.
FFY 2015 HAZARDOUS MATERIALS EMERGENCY PREPAREDNESS GRANT
Kevin Lewis, Director, Division of Emergency Services, requested authorization to enter
into a Memorandum of Agreement with the Maryland Emergency Management Agency
(MEMA) to accept a Federal Fiscal Year 2015 grant award of $41,395.03 ($28,800 toward
Planning and $12,595.03 toward Training.) Mr. Lewis indicated that the funding is
distributed by MEMA on an annual basis to increase State and local effectiveness in safely
and efficiently handling hazardous materials accidents and incidents. The grant requires a
20% recipient match of $10,348.76. The Commissioners discussed the request.
Commissioner Cline, seconded by McKinley, moved to accept the $41,395.03 Hazardous
Materials Emergency Preparedness grant as presented and to authorize the Director of
Emergency Services to execute a Memorandum of Agreement with the Maryland
Emergency Management Agency for that purpose. The motion passed unanimously.

CONTRACT AWARD — WASHINGTON COUNTY ADMINISTRATION
COMPLEX FIRST FLOOR RENOVATION
(Commissioner Barr recused himself from the discussion of this matter and left the
meeting room.)
Karen Luther, Purchasing Agent, and Rob Slocum, Director, Engineering and Construction
Management, recommended award of the contract for the Washington County
Administration Complex First Floor Renovation Project (PUR-1261) to the responsive,
responsible bidder, Building Systems, Inc. of Hagerstown, Maryland, which submitted the
lowest Total Base Bid of $2,921,600, with Alternate No. 1 of $297,300 for a total base bid
of $3,218,900. She requested approval of a $200,000 budget transfer to accommodate
systemic improvements associated with the project. Ms. Luther advised that one of
Building System's subcontractors, Carson Roofing, did not meet bid requirements.
Building Systems will be using Kline Roofing instead, which is certified. The total
available construction budget is $3,747,645. Mr. Slocum described the renovation project
at 100 and 120 West Washington Street that will combine both addresses into one and
provide expanded space for various County offices and an enlarged County Commissioner
meeting room on the first floor. He requested a budget transfer of $200,000 to provide the
total budget of $3,947,655. The Commissioners discussed the matter.
Commissioner McKinley, seconded by Cline, moved to award the contract for the
Washington County Administration Complex First Floor Renovation Project to the
responsive, responsible bidder, Building Systems, Inc. of Hagerstown, Maryland, which
submitted the lowest Total Base Bid of $2,921,600 with Alternate No. 1 of $297,300 for a
total base bid of $3,218,900, and to approve a $200,000 budget transfer as presented. The
motion passed unanimously (4-0, Commissioner Barr was absent.)

U.S. BICYCLE ROUTE I1
Rob Slocum, Director, Engineering and Construction, advised that the American
Association of State Highway and Transportation Officials (AASHTO) has designated an
east -west corridor paralleling the Potomac River in Maryland between Washington, DC
and western Pennsylvania to be developed as United States Bicycle Route 50 (USBR 50.)
He discussed a proposed route that traverses exclusively through Washington County,
providing benefits to residents and businesses. It is recommended to be designated USBR
11 so that it may be mapped and signed, thereby promoting bicycle tourism in the County.
Mr. Slocum indicated that the City of Hagerstown and affected municipalities are in
concurrence with the proposal.
Commissioner Barr, seconded by Cline, moved to give express approval and support for
the development of USBR 11 to be officially designated by AASHTO. The motion passed
unanimously.

MORGAN RURAL LEGACY PROGRAM EASEMENT
Eric Seifarth, Rural Preservation Administrator, and Chris Boggs, Land Preservation
Planner, Planning and Zoning, recommended approval of the Bonnard J. Morgan, Trustee,
Rural Legacy Program (RLP) Easement Project for $49,700. Mr. Seifarth indicated that
Rural Legacy Program (RLP) Easement funds are 100% State -funded and used to preserve
farmland and open space containing significant agricultural, environmental and cultural or
historic features surrounding the Antietam Battlefield. Mr. Boggs described the historic
20.25 total easement acres located on Chestnut Grove Road, Keedysville.
Commissioner Barr, seconded by McKinley, moved to approve the Bonnard J. Morgan,
Trustee, Rural Legacy Program Easement Project for $49,700 as presented, adopt an
ordinance approving the purchase of the easement, and authorize the execution of all such
documents as may be required to affect the purchase. The motion passed unanimously.
(Ordinance No. ORD -2014-16 is located in the County Commissioners' Office.)
HAGERSTOWN-WASHINGTON COUNTY FOREIGN TRADE ZONE
Robert Mandley, Business Development Specialist, Department of Business Development
(DBD), and Kendall McPeak, Assistant County Attorney, recommended rescission of the
2002 Resolution that established the Foreign Trade Zone Commission for Washington
County, Maryland (Commission); to confer the former Commission's advisory function to
the Economic Development Commission (EDC); and to appoint the County's DBD
employees holding the positions of Business Development Specialist and Business Support
Specialist as Zone Administrator and Co -Zone Administrator, respectively, for the
Hagerstown -Washington County Foreign Trade Zone #255. Mr. Mandley indicated that a
duly appointed Zone Administrator and Co -Zone Administrator could proceed with the
tasks of revising the Zone Schedule and acquiring the necessary property owner
agreements. The Commissioners discussed the current standing of the FTZ.
Commissioner Callaham, seconded by Barr, moved to rescind the January 15, 2002
Resolution that established the Foreign Trade Zone Commission for Washington County,
Maryland (Commission), to confer the former Commission's advisory function to the
Economic Development Commission (EDC), and to appoint the County's DBD employees
holding the positions of Business Development Specialist and Business Support Specialist
as Zone Administrator and Co -Zone Administrator, respectively, for the Hagerstown -

CONVENE IN CLOSED SESSION
Commissioner Cline, seconded by Callaham, moved to convene in closed session at
2:53 p.m. to discuss the appointment, employment, assignment, promotion, discipline,
demotion, compensation, removal, resignation, or performance evaluation of appointees,
employees or officials over whom this public body has jurisdiction; or any other personnel

matters that affect one or more specific individuals, in accordance with Section 10-508(a)
(1) of the State Government Article of the Annotated Code of Maryland. The motion
passed unanimously.
In closed session, the Commissioners discussed the potential appointment of specific
individuals to several boards, commissions and an advisory committee over which the
Commissioners have appointment authority; and were briefed on a specific personnel
matter.
During closed session, the Commissioners instructed staff to bring forth the potential
appointments to several boards, commissions and an advisory committee over which the
Commissioners have appointment authority for further consideration and discussion during
the evening open session meeting.
Present during closed session were Commissioners Terry L. Baker, John F. Barr, Ruth
Anne Callaham, Jeffrey A. Cline, and William B. McKinley. Also present were Gregory
Murray, County Administrator; Sarah Sprecher, Assistant County Administrator; Vicki
Lumm, County Clerk; John M. Martirano, County Attorney, and at various times, Angela
Smith, Chief of Permitting, Plan Review and Permitting; Eric Seifarth, Rural Preservation
Administrator, Planning and Zoning; and Phil Ridenour, Airport Director.
RECONVENE IN OPEN SESSION
Commissioner Barr, seconded by McKinley, moved to reconvene in open session at
3:14 p.m. The motion passed unanimously.

The Commissioners recessed at 3:14 p.m.
EVENING MEETING — TOWN OF KEEDYSVILLE
The evening session of the regular meeting of Board of County Commissioners of
Washington County, Maryland was held at Keedysville Town Hall, 19 South Main Street,
Keedysville.
INVOCATION AND PLEDGE OF ALLEGIANCE
Commissioner Terry L. Baker offered the Invocation followed by the Pledge of Allegiance
to the Flag by the full assemblage.
CALL TO ORDER
President Baker called the meeting to order at 7:04 p.m. with the following members
present: Commissioners Ruth Anne Callaham and Jeffrey A. Cline. Commissioners John F
Barr and William B. McKinley were absent.
APPROVAL OF MINUTES — SEPTEMBER 9.2014
Commissioner Cline, seconded by Callaham, moved to approve the minutes of September
9, 2014. The motion passed unanimously.

COMMISSIONERS REPORTS AND COMMENTS
Commissioner Cline thanked the Mayor and Council for hosting the meeting. He
congratulated Hagerstown Community College (HCC) on the groundbreaking for its
expanded Student Center. Mr. Cline attended the commemoration of historic markers at St.
Mark's Church. He enjoyed the Future Farmers of America (FFA) Farm to Fork event at
the Barn at the View that featured locally grown food. Commissioner Cline attended the
Washington County Volunteer Fire and Rescue Association (WCVFRA) meeting and the
Chamber of Commerce mixer at HCC. He praised the Hancock Canal Apple Days event.
Mr. Cline attended the Bark for Life cancer fundraiser at the Hagerstown Fairgrounds. He
reported attending the Wings and Wheels Expo at the Hagerstown Regional Airport and
the Remembrance in the Park 9/11 Commemoration.
Commissioner Callaham reported on the Maryland Municipal League (MML) meeting
hosted by the Town of Keedysville. She attended the Wings and Wheels Expo and the
75 -year celebration of the North American Rod and Gun Club.
Commissioner Baker reported attending the MML meeting in Keedysville and a Board of
Social Services meeting. He attended the WCVFRA meeting where it was announced that
a retention coordinator has been hired for volunteer fire companies. Mr. Baker attended the
Student Center groundbreaking at HCC and the Remembrance in the Park event at
Hagerstown City Park.
MAYOR AND COUNCIL COMMENTS
Mayor Matt Hull welcomed the Commissioners to Keedysville and praised County
employees for their assistance given the Town. Town Administrator Richard Bishop
echoed the Mayor's comments. Council members Ken Lord and Victoria Gudeman
introduced themselves.
CITIZENS PARTICIPATION
No citizens were present who wished to participate.
OTHER BUSINESS
County Clerk — Appointments to Boards/Commissions
Washinzton County Plumbing and Mechanical Board
Commissioner Cline, seconded by Callaham, moved to reappoint William K. Vance the
member at large representative and Brian Tana the Master Plumber representative to serve
second, three-year terms retroactively from August 1, 2014 through July 31, 2017 on the
Washington County Plumbing and Mechanical Board. The motion passed unanimously.
(3-0, Commissioners Barr and McKinley were absent.)
Washington County Electrical Board of Examiners and Supervisors
Commissioner Cline, seconded by Callaham, moved to reappoint Charles Shindle, Sr. the
Washington County Volunteer Fire and Rescue Association representative and Steven
Ryan the electric public utility company representative to serve additional two-year terms

retroactively from July 1, 2014 through June 30, 2016; and appoint Robert Kochera as a
Master Electrician representative to a first, two-year term through September 30, 2016, to
the Electrical Board of Examiners and Supervisors. The motion passed unanimously. (3-0,
Commissioners Barr and McKinley were absent.)
Hagerstown Regional Airport Advisory Commission
Commissioner Cline, seconded by Callaham, moved to reappoint Michael Hough to serve
a second, three-year term through September 30, 2017 on the Hagerstown Regional
Airport Advisory Commission. The motion passed unanimously. (3-0, Commissioners
Barr and McKinley were absent.)
Washington County Avricultural Land Preservation Advisory Board
Commissioner Callaham, seconded by Cline, moved to reappoint Jeremiah Weddle to
serve a second, five-year term through October 31, 2019, and Dean Boggs to serve a first,
five-year term through September 30, 2019 on the Washington County Agricultural Land
Preservation Advisory Board. The motion passed unanimously. (3-0, Commissioners Barr
and McKinley were absent.)
Washington County Gaminiz Commission
Commissioner Cline, seconded by Callaham, moved to appoint Connie Mozingo to serve a
first, two-year term from October 1, 2014 through September 30, 2016 on the Washington
County Gaming Commission. The motion passed unanimously. (3-0, Commissioners Barr
and McKinley were absent.)
Local Management Board
Commissioner Cline, seconded by Callaham, moved to reappoint Carolyn Brooks as a
community representative on the Local Management Board to serve a second, three-year
term from October 1, 2014 through September 30, 2017. The motion passed unanimously.
(3-0, Commissioners Barr and McKinley were absent.)
Washington County Mental Health Authority, Inc.
Commissioner Callaham, seconded by Cline, moved to reappoint Jennifer Lowery the
child advocate representative and Rev. Stan Steele the clergy representative to the
Washington County Mental Health Authority, Inc. to serve second, three-year terms from
October 1, 2014 through September 30, 2017. The motion passed unanimously. (3-0,
Commissioners Barr and McKinley were absent.)
Countv Clerk — Correction to August 5, 2014 Minutes
County Clerk Vicki Lumm requested a correction to the minutes of August 5, 2014,
concerning information contained in a vote that approved a revised succession plan for the
Office of Budget and Finance. She advised that the motion should have stated that Sarah
Greaves would be moved to the position of Deputy Director of Budget and Finance (not
Assistant Deputy Director) and Kim Edlund to the position of Director of Budget and
Finance (not Deputy Director.)

Commissioner Cline, seconded by Callaham, moved to amend the previously adopted
minutes of August 5, 2014 as discussed, to direct the County Clerk to make a notation of
the correction to those minutes, and to approve those minutes as corrected. The motion
passed unanimously. (3-0, Commissioners Barr and McKinley were absent.)
County Administrator — Proiect Liaison Position
County Administrator Greg Murray thanked the Town for the warm welcome. He
discussed the County's vacant Project Liaison position. Assistant County Administrator
Sarah Sprecher presented the recommendation to hire an in-house candidate, Aaron Stoner,
at the Grade 14, Step 1 salary of $47,658, which is $9,000 less than the salary of the
previous person in that position.
Commissioner Cline, seconded by Callaham, moved to approve hiring Aaron Stoner as the
Project Liaison at Grade 14, Step 1 entry level salary of $47,658. The motion passed
unanimously. (3-0, Commissioners Barr and McKinley were absent.)
ADJOURNMENT
Commissioner Callaham, seconded by Cline, moved to adjourn at 7:37 p.m. The motion
passed unanimously.
