Baker called the regular meeting of the Board of County Commissioners of Washington County, Maryland to order at 1:32 p.m. at 100 West Washington Street, Room 227, with the following members present: Vice President John F. Barr and Commissioners Ruth Anne Callaham, Jeffrey A. Cline, and William B. McKinley. CONTRACT AWARD — SMITHSBURG WASTEWATER TREATMENT PLANT NITRIFICATION ENHANCEMENTS Rick Curry, Buyer, Purchasing Department, and Mark Bradshaw, Environmental Engineer, Division of Environmental Management, recommended award of the contract for the Smithsburg Wastewater Treatment Plant Nitrification Project for the Solid Waste Department (PUR-1212) to the lowest responsive, responsible bidder, Callas Contractors, Inc. of Hagerstown, Maryland, which submitted a Base Bid of $760,000 and a Contingent Bid (Items C-1 through C-11) at the cost of $25,500, for the lowest Total Sum of $785,500. Mr. Curry informed the Commissioners that the work to be performed under the contract includes the placement and installation of BioMag equipment. This project also involves the Chesapeake Bay Initiatives in accordance with Maryland Department of the Environment (MDE). Funding of $2,654,075 is available in the Department's Capital Improvement Plan. Commissioner Callaham, seconded by McKinley, moved to award the contract for the Smithsburg Wastewater Treatment Plant Nitrification Project for the Solid Waste Department to the lowest responsive, responsible bidder, Callas Contractors, Inc. of Hagerstown, Maryland, as presented. The motion passed unanimously. CONTRACT AWARD — SMITHSBURG WASTEWATER TREATMENT PLANT AERATION EQUIPMENT Karen Luther, Purchasing Director, and Mark Bradshaw recommended award of the contract for the Smithsburg Wastewater Treatment Plant Aeration Equipment to the responsible, responsive sole bidder, Aqua -Aerobic Systems, Inc. of Loves Park, Illinois, which submitted a Total Bid of $199,819. Ms. Luther indicated that Aqua -Aerobic would supply the necessary equipment to complete the Smithsburg Wastewater Nitrification Enhancements Project (PUR-1227). The project involves an enhanced biological treatment process that is part of the Chesapeake Bay Initiatives in accordance with the MDE strategy for Enhanced Nutrient Removal. Funding of $2,654,075 is included in the Department's Capital Improvement Plan. The Commissioners discussed the matter. Commissioner McKinley, seconded by Barr, moved to award the contract for the Smithsburg Wastewater Treatment Plant Aeration Equipment to the responsible, responsive sole bidder, Aqua -Aerobic Systems, Inc. of Loves Park, Illinois, as presented. The motion passed unanimously. August 20, 2013 Page 2 PROCLAMATION - NATIONAL HEALTH CENTER WEEK The Commissioners presented a proclamation to Kim Murdaugh, Executive Director of the Walnut Street Community Health Center, in recognition of National Health Week on August 11-17. Ms. Murdaugh discussed the services provided by the non-profit Walnut Street Community Health Center and the Tri-State Community Health Center. The Commissioners thanked Ms. Murdaugh for the assistance provided to Washington County citizens. BID AWARD — CATHOLIC CHURCH ROAD AND CHARLES MILL ROAD STRUCTURE REPAIRS AND REPLACEMENT Rob Slocum, Deputy Director of Public Works, recommended award of the contract for the Catholic Church Road and Charles Mill Road Structure Repairs and Replacement to the lowest, responsive, responsible bidder, Lone Star Builders, Inc. of Hagerstown, Maryland, for $199,034. Mr. Slocum described the project that involves a bridge superstructure replacement on Catholic Church Road and a culvert replacement on Charles Mill Road. The Commissioners discussed the project with Mr. Slocum. Commissioner Barr seconded by McKinley, moved to approve the award of the contract for the Catholic Church Road and Charles Mill Road Structure Repairs and Replacement to the lowest, responsive, responsible bidder, Lone Star Builders, Inc. of Hagerstown, as presented. The motion passed unanimously. BID AWARD — MARBLE QUARRY ROAD BRIDGE REPLACEMENT Rob Slocum recommended conditional award of the contract for the Marble Quarry Road Bridge Replacement to the lowest responsive, responsible bidder, C. William Hetzer, Inc. of Hagerstown, Maryland, for $1,502,272.40. Mr. Slocum indicated that the award is contingent upon concurrence from the State Highway Administration. The project includes the replacement of an existing 47 -foot span with a two-lane span of the bridge over the Little Antietam Creek on Marble Quarry Road, among other improvements. Commissioner Barr, seconded by Callaham, moved to conditionally (upon concurrence from the State Highway Administration) approve the award of the Marble Quarry Road Bridge Replacement contract to the lowest responsive, responsible bidder, C. William Hetzer, Inc. of Hagerstown, Maryland as presented. The motion passed unanimously. SECURITY ENHANCEMENT FUNDING TRANSFER Rob Slocum and Eunice Plank, Circuit Court Administrator, requested approval of security enhancement funding of $157,500 to cover the costs of a generator, fencing at an existing transformer, and a public address system in the Circuit Courthouse. The enhancements will be funded under a Memorandum of Understanding between the Circuit Court and the Administrative Office of the Courts, and require a budget amendment to the Capital Improvement Project budget. Ms. Plank indicated that the Administrative Office of the Courts has agreed to provide the County a grant to cover the costs once the items are installed. She described the importance of the security enhancements. August 20, 2013 Page 3 Commissioner Barr, seconded by McKinley, moved to approve a budget amendment of $157,500 to the Capital Improvement Project budget for security enhancement funding as presented. The motion passed unanimously. REVISIONS TO THE TIP JAR REGULATIONS OF THE OFFICE OF COMMUNITY GRANT MANAGEMENT Jim Hovis, Director, Office of Community Grant Management, presented several proposed revisions to the Tip Jar Regulations of the Office of Community Grant Management to clarify the requirements of licensure. Mr. Hovis stated that the proposed revisions clarify the definitions of a Charitable Organization, Volunteer Fire Company, and Volunteer Rescue Company. Other minor grammatical revisions are included in the proposal. The Commissioners discussed the revisions. Commissioner Callaham suggested adding supplemental verbiage under the definition of "Volunteer Fire Company" to clarify that volunteer fire companies have the obligation to provide first response medical assistance. Commissioner McKinley, seconded by Barr, moved to approve the proposed revisions (Revision 16) to the Tip Jar Regulations of the Office of Community Grant Management with the inclusion of Commissioner Callaham's verbiage as discussed. The motion passed unanimously. RECESS The Commissioners recessed at 2:35 p.m. to move to Room 255. HAGERSTOWN REGIONAL AIRPORT COMPREHENSIVE MARKETING PLAN PRESENTATION Airport Director Phil Ridenour introduced Bruce Tarletsky, Director of Airport Marketing for AvPORTS, an AFCO Company of Dulles, Virginia, whose team members presented the new Comprehensive Marketing Plan for the Hagerstown Regional Airport (HGR). The official start of the project was February 11, 2013. The four main objectives of the Plan include: • Existing airport business strengthening and growth strategies. • New aviation related commercial -industrial development. • Commercial air service development strategy and programming. • Evaluation of economic opportunities for freight movement and air/ground integration. The Commissioners discussed several aspects of the presentation with AvPORT team members and thanked them for the informative report. Mr. Ridenour described his vision for implementing the Marketing Plan that includes forming a team of individuals to devise a plan of action. He stated that the Plan would be posted on the Airport and County websites. CONVENE IN CLOSED SESSION Commissioner Barr, seconded by Callaham, moved to convene in closed session at 4:22 p.m. to discuss the appointment, employment, assignment, promotion, discipline, demotion, compensation, removal, resignation, and/or performance evaluation of August 20, 2013 Page 4 appointees, employees, or officials over whom this public body had jurisdiction; and to consider a matter that concerns the proposal for a business or industrial organization to locate, expand, or remain in the State; in accordance with Section 10-508 (1) (4) of the State Government Article of the Annotated Code of Maryland. The motion passed unanimously. In closed session, the Commissioners discussed the potential appointment of several individuals to a commission and two boards over which the Commissioners have appointment authority; and discussed proposals received from two entities relating to the potential purchase or lease of County -owned property, which would lead to the expansion of an existing business or the locating of a new business in the County. During closed session, the Commissioners instructed staff to bring forth the potential appointments of several individuals to two boards and a commission over which the Commissioners have appointment authority for further consideration and discussion during the evening open session meeting; and provided general direction to staff regarding the proposals received relating to the potential lease or conveyance of County -owned real property to be used in the expansion of a current business or the locating of a new business entity in the County. Present during closed session were Commissioners Terry L. Baker, John F. Barr, Ruth Anne Callaham, Jeffrey A. Cline, and William B. McKinley. Also present were Gregory Murray, County Administrator; Sarah Sprecher, Assistant County Administrator; Vicki Lumm, County Clerk; John M. Martirano, County Attorney; Kirk C. Downey, Deputy County Attorney; and at various times Ron Bowers and Stu Mullendore, EDC Board Members; John Kenney, Washington County Department of Social Services; Nikki Snider, Adult Public Guardianship Review Board; and Joe Kuhna, Real Property Administrator. RECONVENE IN OPEN SESSION Commissioner Barr, seconded by Cline, moved to reconvene in open session at 4:57 p.m. The motion passed unanimously. RECESS The Commissioners recessed at 4:57 p.m. EVENING MEETING — TOWN OF SHARPSBURG The evening session of the regular meeting of Board of County Commissioners of Washington County, Maryland was held at Sharpsburg Town Hall, 106 Main Street, Sharpsburg. INVOCATION AND PLEDGE OF ALLEGIANCE Commissioner Barr offered the Invocation followed by the Pledge of Allegiance to the Flag by the full assemblage. August 20, 2013 Page 5 CALL TO ORDER President Terry L. Baker called the meeting to order at 7:05 p.m. with the following members present: Vice President John F. Barr and Commissioners Ruth Anne Callaham, Jeffrey A. Cline, and William B. McKinley. APPROVAL OF MINUTES — AUGUST 6, 2013 Commissioner Barr, seconded by Callaham, moved to approve the minutes of August 6, 2013. The motion passed unanimously. COMMISSIONERS REPORTS AND COMMENTS Commissioner Cline noted the passing of senior citizen advocate Ed Wurmb. Mr. Cline attended the National Night Out in Hancock and the Smithsburg Fireman's Carnival. He visited Krumpe's Donut Alley Rally 5K Run/Walk where profits benefitted the Wounded Warrior's Foundation. Commissioner Cline enjoyed the Sharpsburg Volunteer Fire Company's barbeque chicken fundraiser and the Potomac Valley Volunteer Fire Company's steak feed. He represented the Commissioners at the Michael Callas New Teacher Reception at North Hagerstown High School. Mr. Cline accompanied EDC staff and other officials on two potential business location meetings. He enjoyed the Fahrney- Keedy Summer Festival. Commissioner Cline noted that the American Prevention of Suicide Walk would be held on September 7 at Hagerstown City Park. Commissioner Callaham attended a meeting of the Antietam Battlefield Advisory Committee. She advised of safety concerns regarding access to the Antietam Stream at Keedysville/Mansfield Road. Ms. Callaham reported meeting with the Interim Director of the I-81 Corridor Coalition and indicated that the group is refocusing toward a more political view to gather strength in the legislature for more infrastructure funding. Commissioner Callaham reported on last week's Maryland Association of Counties (MACo) Summer Conference in Ocean City that focused on economic development. Commissioner McKinley reported attending the recent Chamber of Commerce Eggs and Issues breakfast where Hagerstown City Police Chief Mark Holtzman discussed crime statistics in Hagerstown. He attended the National Night Out in Williamsport. Mr. McKinley reported on meetings he attended during the MACo Convention. Commissioner Barr reported hearing the crime figures presentation by Chief Holtzman at the Antietam Exchange Club meeting. Mr. Barr discussed his activities during the MACo Conference while serving as MACo's Secretary, which included meeting with Governor Martin O'Malley. Commissioner Barr read thank you notes received from owners of the Grand Champion Turkey personally bought by the Commissioners and a steer purchased by Commissioner Barr during the Ag Expo and Fair. Commissioner Baker thanked the Mayor and Town officials for the warm welcome. He reported attending the MACo Summer Conference and thanked Commissioner Barr for his work done on behalf of MACo and Washington County. Mr. Baker attended the Smithsburg Fireman's Carnival. August 20, 2013 Page 6 MAYOR AND COUNCIL COMMENTS Mayor Hal Spielman welcomed the Commissioners to Sharpsburg. Council Member Russ Weaver discussed the high water and sewer rates in the Town of Sharpsburg due to its earlier agreement not to become a growth area. The Commissioners discussed growth issues in the County. President Baker introduced Assistant County Administrator Sarah Sprecher, who was representing County Administrator Greg Murray. OTHER BUSINESS Countv Clerk — Annointments to Countv Boards/Commissions Washington County Agricultural Reconciliation Board Commissioner Barr, seconded by Callaham, moved to appoint Ellen Matheny to serve as the Washington County Farm Bureau representative on the Washington County Agricultural Reconciliation Board, to fulfill a term through November 30, 2015. The motion passed unanimously. Economic Development Commission of Washinaton Countv Commissioner Callaham, seconded by McKinley, moved to appoint Ryan Daughtridge to serve as the City of Hagerstown representative and Hugh Breslin to serve as a Greater Hagerstown Committee representative on the Economic Development Commission, to first, three-year terms through June 30, 2016. The motion passed unanimously. Adult Public Guardianship Review Board Commissioner Cline, seconded by Barr, moved to appoint Susan Parks to serve as the Public Health Nurse representative on the Adult Public Guardianship Review Board to a first, three-year term through June 30, 2016. The motion passed unanimously. REPORTS FROM COUNTY STAFF Assistant Countv Administrator/Public Relations and Communitv Affairs Sarah Sprecher, Assistant County Administrator, discussed the County's new Public Relations and Community Affairs Department. She displayed various marketing materials for the Mayor and Town Council and advised them to contact the County's Public Relations Office for assistance in promoting local events. CITIZENS PARTICIPATION Ken Myers, of the Halfway area, requested that the County Commissioners' meetings be broadcast on local television. He also requested a question and answer program hosted by the County Sheriff and City Police Chief.
