Baker called the regular meeting of the Board of County Commissioners of Washington County, Maryland, to order at 12:13 p.m. at 14548 Pennsylvania Avenue, Hagerstown, with the following members present: Vice President Jeffrey A. Cline and Commissioners John F. Barr, LeRoy E. Myers, Jr. and Vincent G. Spong. CONVENE IN CLOSED SESSION Commissioner Barr, seconded by Myers, moved to convene in closed session at 12:13 p.m. to consider a matter that concerns the proposal for a business or industrial organization to locate, expand, or remain in the State, in accordance with Section 3-305(b) (4) of the General Provisions Article of the Annotated Code of Maryland. The motion passed unanimously. In closed session, the Commissioners discussed the specifics of a new business entity's proposal/plan to locate its business operations in the County. During closed session, the Commissioners instructed staff to continue to work closely with the business entity relating to its proposal/plan to locate its business operations in the County. Present during closed session were Commissioners Terry L. Baker, Jeffrey A. Cline, John F. Barr, LeRoy E. Myers, Jr. and Vincent G. Spong. Also present were Gregory Murray, County Administrator; Sarah Sprecher, Assistant County Administrator; Vicki Lumm, County Clerk; John Martirano, County Attorney; Kassie Lewis, Director, Business Development; Rob Slocum, Director, Engineering and Construction; Aaron Stoner, Project Liaison, Public Relations; Jason Divelbiss, Attorney; and three individuals representing a potential new business entity. RECONVENE IN OPEN SESSION Commissioner Cline, seconded by Myers, moved to reconvene in open session at 1:27 p.m. The motion passed unanimously. RECESS The Commissioners recessed at 1:27 p.m. and attended the grand opening of Hafer's Gunsmithing, Inc., 15411 National Pike, Hagerstown. INVOCATION AND PLEDGE OF ALLEGIANCE Commissioner Barr gave the Invocation followed by the Pledge of Allegiance to the Flag by the full assemblage. June 9, 2015 Page 2 CALL TO ORDER President Terry L. Cline and Commissioners John F. Barr, LeRoy E. Myers, Jr. and Vincent G. Spong. APPROVAL OF MINUTES — JUNE 2, 2015 Commissioner Barr, seconded by Myers, moved to approve the minutes of June 2, 2015. The motion passed unanimously. COMMISSIONERS REPORTS AND COMMENTS Commissioner Myers recognized Commissioner Baker on his upcoming retirement from Washington County Public Schools after teaching since 1979. The Commissioners thanked Mr. Baker for his service to local students. REPORTS FROM COUNTY STAFF Engine ring acid Construction Management — After Hours/Saturdav Commercial Inspections Rob Slocum, Director, Engineering and Construction Management, announced that the Plan Review and Permitting Department would be offering after hours and Saturday inspections to encourage productivity at jobsites. The service fees are $100 for Monday - Friday inspections between 4:00-8:00 p.m. and $175 for Saturday inspections. Scheduling for these services will begin Monday, June 15 and will require a 48-hour advance notice. Mr. Slocum advised of changes at the State Highway Administration (SHA) that will allow the local district engineer more authorization and should improve productivity in projects in which the SHA is involved. He noted that sections of Interstate -81 are scheduled for paving the next few weeks. Mr. Slocum indicated that the SHA is compiling accident data on that roadway and the County is preparing letters to support the need for its widening. MORGAN RURAL LEGACY PROGRAM EASEMENT Eric Seifarth, Rural Preservation Administrator, Planning and Zoning, recommended approval of the Bonnard J. and Peggy R. Morgan Rural Legacy Program (RLP) Easement Project of $115,341 for 33.37 easement acres and to adopt an ordinance approving the purchase. Mr. Seifarth indicated that for Fiscal Year 2015, Washington County was awarded $1,445 million in RLP grants to preserve farmland and open space containing significant agricultural, environmental and cultural or historic features surrounding the Antietam Battlefield. Commissioner Barr, seconded by Myers, moved to approve the Bonnard J. and Peggy R. Morgan Rural Legacy Program Easement Project of $115,341 as presented, adopt an ordinance approving the purchase of the easement, and authorize the execution of all such documents as may be required to affect the purchase. The motion passed unanimously. (Ordinance No. ORD -2015-09 is located in the County Commissioners' Office.) ;k June 9, 2015 Page 3 MORGAN RURAL LEGACY PROGRAM EASEMENT Eric Seifarth recommended approval of the Bonnard J. Morgan, Jr., Teresa A. Morgan, and Frank B. Morgan Rural Legacy Program (RLP) Easement Project of $415,965 for 139.655 easement acres near the Antietam Battlefield in the Rural Legacy Area, and to adopt an ordinance approving the purchase. Mr. Seifarth indicated that easement applicants were previously ranked based on four main categories. RLP funds are State funds derived mainly from Department of Natural Resources Open Space funds. Commissioner Cline, seconded by Spong, moved to approve the Bonnard J. Morgan, Jr., Teresa A. Morgan, and Frank B. Morgan Rural Legacy Program (RLP) Easement Project of $415,965 as presented, adopt an ordinance approving the purchase of the easement, and authorize the execution of all such documents as may be required to affect the purchase. WASHINGTON COUNTY HISTORICAL ADVISORY COMMITTEE ANNUAL UPDATE Pat Schooley, Secretary, and George Anikis, Member, Washington County Historical Advisory Committee (HAC), discussed items of importance regarding the historical aspect of Washington County. Ms. Schooley stated that the HAC was created by the Board of County Commissioners on November 24, 1967. She described the group's latest mission to establish a Preservation Maryland Field Office in the County to serve the four western counties. This office would offer support services to citizens and local governments regarding the preservation of historic structures, rural land and historical open spaces. The Commissioners requested detailed information on the type of support the HAC would require. Mr. Anikis discussed non-compliance issues in the acquisitions of permits for historic structures and the lack of penalties for non-compliance. He requested that some "teeth" be applied to the process to establish a fine for tearing down an old building without a permit. Stephen Goodrich, Director, Planning and Zoning, described the system in his office that flags historic properties. Bill Knode, Committee member, distributed the latest list of historical manufacturing/industrial sites compiled by the Committee. The Commissioners thanked the individuals for their advocacy of historical preservation. HOTEL RENTAL TAX FUNDING REOUEST Susan Buchanan, Senior Grants Administrator, Community Grants Management, presented a request from the Maryland Symphony Orchestra (MSO) to fund $30,000 for direct expenses associated with the 30`h Annual Salute to Independence event at the Antietam National Battlefield to be held July 4, 2015. Michael Jonnes, Executive Director, and Vicki Willman, Director of Development, Maryland Symphony Orchestra, discussed the event and its positive impact on hotels and businesses in Washington County. Ms. Buchanan indicated that the total budget is $241,641; $102,182 has been received from private sources and $109,459 from in-kind contributions, community partners, and the Antietam National Battlefield. The Commissioners praised the event that is usually attended by over 25,000 persons. June 9, 2015 Page 4 Commissioner Spong, seconded by Barr, moved to provide $30,000 from the County's portion of the FY 2015 Hotel Rental Tax Funds to the Maryland Symphony Orchestra's Salute to Independence event. The motion passed unanimously. FY 2016 ANNUAL PROGRAM OPEN SPACE PROJECT FUNDING Jim Sterling, Director, Parks and Facilities, discussed the FY 2016 Program Open Space (POS) projects funding as recommended by the Washington County Recreation and Parks Advisory Board. He indicated that the anticipated POS allocation for FY 2016 is $456,518. Requests for consideration of POS funds were submitted from various municipalities, the Board of Education, Hagerstown Community College, City of Hagerstown, and Washington County. The recommendations are as follows: Boonsboro: Shaffer Park Development, Tot Lot Construction - $50,000; Hagerstown: Arts & Entertainment Walking Trail - $45,000, Fairgrounds Park Soccer Field Lighting - $36,000, and Fairgrounds Park Pavilion - $27,000; Hancock: Kirkwood/Widmeyer Park Pedestrian Trail Planning Grant - $25,000; Smithsbura: Veterans Park Playground Upgrades - $24,000; Williamsport: Pool ADA Sidewalk Project, Miller Memorial Pool House - $3,206; Board of Education: Potomac Heights Playground Equipment - $67,500; and Washington County: Ag Center Land Acquisition - $91,800, Tennis Court Resurfacing, Cart Paths Resurfacing - $46,000, Regional Park Basketball Court Overlay - $14,012, and Doubs Woods Park Overlay and Patching - $27,000. Mr. Sterling discussed the Parks, Facilities, and Recreation survey found online and in printed versions to obtain public comment. Commissioner Myers, seconded by Barr, moved to approve the annual FY 2016 Program Open Space Program as presented and recommended by the Washington County Recreation and Parks Advisory Board. The motion passed unanimously. CONTRACT AWARD — WASHINGTON COUNTY MANUFACTURING SUPPLY CHAIN STUDY Karen Luther, Purchasing Director, and Kassie Lewis, Director, Business Development, recommended award of the contract for the Washington County Manufacturing Supply Chain Study (PUR-1285) based on the drawing of lots in public to either Supply Chain Visions of Stoneham, Massachusetts, or Towson University (Innovation and Applied Research) of Towson, Maryland, the responsive, responsible proposers with a tied Total Lump Sum Fee price proposal of $50,000, and as required, contingent upon the company/entity being in good standing and authorized and registered to do business in the State of Maryland with the Maryland Department of Assessments and Taxation and remaining so throughout the term of the contract. Ms. Lewis indicated that the contract proposal sought to have an analysis prepared detailing the Hagerstown -Martinsburg Metropolitan Statistical Area and surrounding counties manufacturing and fabrication companies by sector and identifying their current supply chain for materials, components, etc. When completed, the study will provide the Department of Business Development essential information to develop a targeted list of potential manufacturer suppliers/vendors and their interworking with companies within the study area focusing on Washington June 9, 2015 Page 5 County companies. The contract will be funded with $25,000 from the Appalachian Regional Commission and $25,000 from local matching funds. The Commissioners discussed the information to be gleaned from the service. Commissioner Spong, seconded by Myers, moved to award the contract for the Washington County Manufacturing Supply Chain Study based on a drawing of lots in public. The motion passed unanimously. Commissioner Spong drew the winning bid, which was Towson University (Innovation and Applied Research) of Towson, Maryland. Commissioner Cline, seconded by Spong, moved to award the contract for the Washington County Manufacturing Supply Chain Study based on a drawing of lots in public to Towson University (Innovation and Applied Research) of Towson, Maryland, the responsive, responsible proposer at $50,000. The motion passed unanimously. BID AWARD — GROUND MAINTENANCE CHEMICALS FOR VARIOUS COUNTY DEPARTMENTS Rick Curry and John Kain, Superintendent of the Black Rock Golf Course, recommended bid awards for Grounds Maintenance Chemicals for Various County Departments (PUR-1280) to the responsible companies with the lowest responsive bids that meet the specifications for each chemical item. The contract primarily provides needed chemicals for the Black Rock Golf Course, Highway Department, and Department of Water Quality. The City of Hagerstown may use the contract if desired. Mr. Curry advised that the contract term is for one year tentatively commencing July 1, 2015 and ending June 30, 2016. The Commissioners drew lots to award for tie bids for Nos. 5, 13 and 16, pursuant to Section 2.9 of the Washington County Purchasing Policy. June 9, 2015 Page 6 CONTRACT RENEWAL — JANITORIAL SERVICES FOR WASHINGTON COUNTY OFFICE BUILDING Rick Curry, Buyer, Purchasing Department, and Jim Sterling, Director, Parks and Facilities, requested permission to renew the contract for Janitorial Services for Washington County Office Buildings using Option No. 1 with Stockwell Maintenance Systems, Inc. of Williamsport, Maryland, based on its letter dated March 27, 2015 requesting a thirteen percent (13%) increase for Fiscal Year 2016 for an annual total price of $174,936.60 ($172,608.20 for annual cleaning cost and $2,328 for annual cost of stripping/waxing and buffing floors, and window cleaning). The original contract was awarded June 18, 2013. Mr. Curry indicated that the contract covers the County Administration Buildings One and Two, County Courthouse and Annex, County Extension Services Office Building, and County Office Building. He added that the requested increase represents employee wage costs expected to rise due to minimum wage increases in Fiscal Year 2016. The Commissioners discussed the County's various contracts and the rebidding process. Commissioner Barr, seconded by Myers, moved to renew the contract for Janitorial Services with Stockwell Maintenance Systems, Inc. of Williamsport, Maryland, using Option No. 1 based on its letter dated March 27, 2015 requesting a thirteen percent (13%) increase for Fiscal Year 2016 for an annual total price of $174,936.60 as presented. The motion passed unanimously. (President Baker left the meeting at 4:16 p.m. due to his involvement with the Washington County Student Trades Foundation. Vice President Cline assumed the Chair.) REOUEST TO DECLARE REAL PROPERTY' AS SURPLUS PROPERTY AND CONVEY —19327 LONGMEADOW ROAD Susan Small, Real Property Administrator, requested permission to declare certain real property located at 19327 Longmeadow Road, Hagerstown, surplus property, approve an option agreement for its conveyance, and authorize advertising the County's intent to convey. Ms. Small indicated that the County purchased the property and razed the house to accommodate road construction and improvements to Longmeadow Road. The Washington County Student Trades Foundation has requested to purchase the property to construct a house. The recommended consideration is 40% of the assessed value or $32,000. Commissioner Spong discussed the long thin property and suggested that it be divided and offered to adjacent property owners. The Commissioners directed Ms. Small to discuss that possibility with the adjacent property owners. (President Baker returned to the meeting at 4:23 p.m. and resumed the Chair.) June 9, 2015 Page 7 CONVENE IN CLOSED SESSION Commissioner Myers, seconded by Barr, moved to convene in closed session at 4:25 p.m. to discuss the appointment, employment, assignment, promotion, discipline, demotion, compensation, removal, resignation, and/or performance evaluation of appointees, employees, or officials over whom this public body has jurisdiction; and to discuss other personnel matters that affect one or more specific individuals, in accordance with Section 3-305(b) (1) of the General Provisions Article of the Annotated Code of Maryland. The motion passed unanimously. In closed session, the Commissioners discussed the potential reappointment of a specific individual to an advisory board over which the Commissioners have appointment authority; discussed the potential appointment of a specific individual to an authority over which the Commissioners have appointment authority; discussed the potential appointment/reappointment of several specific individuals to a management board over which the Commissioners have appointment authority; and discussed several specific County personnel recommendations/employee matters with County staff. During closed session, the Commissioners instructed staff to bring forth the potential reappointment to an advisory board over which the Commissioners have appointment authority for further consideration and discussion and a possible vote during a future open session meeting; instructed staff to bring forth the potential appointment to an authority over which the Commissioners have appointment authority for further consideration and discussion and a possible vote during a future open session meeting; instructed staff to bring forth the potential appointment/reappointment to a management board over which the Commissioners have appointment authority for further consideration and discussion and a possible vote during a future open session meeting; and provided specific direction to staff regarding the several specific County employee matters/recommendations.
