Baker called the regular meeting of the Board of County Commissioners of Washington County, Maryland to order at 10:05 a.m. at 100 West Washington Street, Room 227, with the following members: Commissioners John F. Barr, Ruth Anne Callaham, and William B. McKinley. (Commissioner Jeffrey A. Cline was absent from the morning session.) INVOCATION AND PLEDGE OF ALLEGIANCE Commissioner Barr provided the Invocation followed by the Pledge of Allegiance to the Flag by the full assemblage. APPROVAL OF MINUTES — OCTOBER 23.2012 Commissioner McKinley, seconded by Barr, moved to approve the minutes of October 23, 2012. The motion passed unanimously. (Commissioner Cline was absent from the vote.) 1 : `7:�`►IIZ�ZI t7Ni IM`►m, Commissioner Callaham commented on the excellent work performed by first responders during Hurricane Sandy. She reported presenting a County flag and certificate of recognition to Randy Lohman, a Boonsboro High School student who attained the rank of Eagle Scout. Commissioner Callaham noted that she would be commenting this evening on today's election results on The Herald -Mail's Channel 6 television. Commissioner Barr recognized emergency service workers and volunteers who came to the aid of fellow citizens affected by the hurricane. He attended a small business visit to Hendershot's Sporting Goods and the annual meeting of the Greater Hagerstown Committee. Mr. Barr attended a Maryland Association of Counties (MACo) Executive Committee meeting in Annapolis to review legislative issues. He enjoyed the Maugansville Ruritan Club breakfast. Commissioner Barr noted that he spoke on government issues in Dave Yohman's Government class at Hagerstown Community College. He congratulated Joan Warner, Associated Builders and Contractors -Cumberland Valley Chapter, during her recent retirement banquet. Commissioner Barr attended a dedication service for the Woodlands facility at Homewood Assisted Living that has been refurbished into a transitional living area. Commissioner McKinley commended the Divisions of Public Works and Emergency Services for their excellent response to County citizens during the Hurricane Sandy event. He reported meeting with Volvo Powertrain officials and State Department of Business and Economic Development representatives to discuss local business efforts. Mr. McKinley attended a Hagerstown Regional Airport Advisory Commission meeting. He indicated that Sun Air is the new local commercial carrier at the Airport, providing service to Dulles International Airport. Commissioner McKinley participated in the Alsatia Mummers Parade with his fellow Commissioners. November 6, 2012 Page 2 Commissioner Baker discussed a successful open house held at the Technical High School. He attended a Washington County Museum of Fine Arts Board meeting. Ivh.. Baker participated in the Hendershot's Sporting Goods business visit and the Alsatia Mummers Parade, He thanked Highway Department employees who volunteered their time to prepare the parade vehicle. Commissioner Baker attended the Maugansville I2uritan Club breakfast. He reported on two conference calls with Governor O'Malley during Hurricane Sandy and thanked staff for the outstanding services performed during the incident. Mr. Baker attended a Recreation and Parks Advisory Board meeting and advised of this weekend's Rural Heritage Museum breakfast frmdraiser. CITIZENS PARTICIPATION Patricia Cross, I Iagerstown, commented on the proposed Senior Center site at Hagerstown Community College. Wanda Barber, Hagerstown, commented on the need for a Senior Center facility. OTHER BUSINESS Countv Clerk - Annointments to Countv Boards and Commissions, Aericultural Reconciliation Board Commissioner Barr, seconded by Callaham, moved to appoint the following individuals to the Agricultural Reconciliation Board to first, three-year terms through November 30, 2015, representing the following required categories: Donald Harding (Farm Bureau), Jeff Semler (Maryland Cooperative Extension Office), Charles Fewster (citizen at -large), Aaron Anderson (citizen at -large), and Marcia Watters (attorney member.) The motion passed unanimously. (Commissioner Cline was absent from the vote.) Countv Administrator Comments County Administrator Greg Murray reiterated statements made by the Commissioners regarding the excellent emergency and public works services provided by County employees during the hurricane event. He advised that numerous local emergency responders are in New York and New Jersey giving support to the ongoing recovery efforts. Countv Staff Health and Human Services Stephanie Stone, Director, Health and Human Services, introduced new County employees Kendall Desaulniers, Assistant County Attorney, County Attorney's Office; Christina Zaeir, Officer First Class, Detention Center; Michael Dick, Equipment Operator h, Highways; and Joseph Witmer, Officer First Class, Detention Center. The Commissioners wished the employees well in their new positions. Ms. Stone requested permission to advertise and fill a full-time, Grade 6, Utility Worker I1 position at the Department of Water Quality due to an employee transfer. November 6, 2012 Page 3 Commissioner Barr, seconded by McKinley, moved to approve the request as presented. The motion passed unanimously. (Commissioner Cline was absent from the vote.) Public Works Joe Kroboth, III, Public Works Director, reported that a new traffic signal on Maugans Avenue is now fully functional. He reported on an informational meeting held with residents of the Colonial Park subdivision to discuss cut -through traffic issues. Mr. Kroboth stated that the BayRunner Shuttle, a State and federally supported transportation service to BWI Airport, would now be using the County's Transit Transfer Station behind the County Administration Building. Environmental Management Anthony Drury, Recycling Program Coordinator, Environmental Management and Bernadette Wagner, Co -Chair, Volunteer Washington County, reported on the success of the battery recycling drop box event this year. Mr. Drury stated that over four hundred pounds of batteries were recycled and twelve usable cell phones were given to local charities. Ms. Wagner noted that ten public schools participated in the program. She advised of repairs made to the Memorial Recreation Center by volunteers during the recent United Way Day of Caring. The Commissioners congratulated Mr. Drury and Ms. Wagner on their successful efforts. PROCLAMATION - AMERICA RECYCLES DAY Anthony Drury presented information on America Recycles Day, recognized annually on November 15. He discussed events planned by the Washington County Division of Environmental Management, Solid Waste Department, local businesses and organizations to raise awareness and celebrate the successes of recycling. Mr. Drury announced that residential electrical wiring, cell phone chargers, and unwanted Christmas lights would be accepted for recycling at the Washington County Landfill as of November 13. In addition, the Landfill will be partnering with Horizon Goodwill Industries to accept electronics without charging a recycling fee. The Commissioners presented Mr. Drury a Proclamation proclaiming November 10-17, 2012 "Recycling Awareness Week" in Washington County and thanked him for his efforts to promote recycling in the community. MODIFICATION TO THE PAD -READY SITES COMMERCIAL PROPERTY STIMULUS PROGRAM Robert Mandley, Economic Development Commission (EDC) Project Coordinator, requested approval of the Commercial Property Stimulus Program resolution, which repeals Resolution No. RS -2011-18 and renames and modifies the existing Pad -Ready Site Commercial Stimulus Program. Mr. Mandley stated that the County Commissioners previously adopted a three-year Pad Ready Site Commercial Stimulus Program that included undeveloped parcels and properties that have an existing structure that is to be demolished, renovated, or expanded. During a recent review, EDC staff found various inconsistencies in the current language. The proposed resolution clarifies the location of November 6, 2012 Page 4 properties and the types of projects that are eligible to participate in the program, provides a description of deferred County fees, and delineates the nature of the real property tax credit. The Commissioners discussed the revisions. It was their consensus that the Resolution be effective today through November 6, 2015. Commissioner McKinley, seconded by Barr, moved to approve the Site and Commercial Property Stimulus Program Resolution, which repeals Resolution No. RS -2011-18 and renames and modifies the existing Pad -Ready Site Stimulus Program. The motion passed unanimously. (Resolution No. RS -2012-19 is located in the County Commissioners' Office.) (Commissioner Cline was absent from the vote.) SMITHSBURG WASTEWATER TREATMENT PLANT UPGRADE Julie Pippel, Director, Division of Environmental Management, and Mark Bradshaw, Deputy Director, Engineering Services, requested approval of Change Order #6 to Buchart-Horn, Inc. of $212,979.00 for the Smithsburg Wastewater Treatment Plant (WwTP) interim upgrade design and engineering construction services. Ms. Pippel stated that to maintain compliance at the Smithsburg WwTP, an interim design and construction project must be completed, referenced as Phase I, to the long-term enhanced nutrient removal (ENR) and capacity upgrade for this facility. The proposed Phase I project has been planned in a manner that will allow the new equipment and modifications to be utilized as part of ENR and capacity upgrades when completed. Ms. Pippel advised that in the long-term, these monies have been programmed for the upgrade to the Smithsburg WwTP and only require temporary transfer of funding. Therefore, there is no overall change to the Capital Improvement Program project budget. Commissioner Barr, seconded by McKinley, moved to approve Change Order #6 to Buchart-Horn, Inc. of $212,979.00 for the Smithsburg Wastewater Treatment Plant interim upgrade design and engineering construction services; a budget transfer of $1,700,000.00; and sole source procurement of the BioMag equipment and interim rental of $1,452,400.00. The motion passed unanimously. (Commissioner Cline was absent from the vote.) RECESS The Commissioners recessed at 11:21 a.m. AFTERNOON SESSION President Terry L. Baker called the afternoon session to order at 1:39 p.m. with the following members present: Vice President John F. Barr and Commissioners Ruth Anne Callaham, Jeffrey A. Cline, and William B. McKinley. FISCAL YEAR 2013 RURAL LEGACY PROGRAM GRANT Eric Seifarth, Rural Preservation Administrator, and Christopher Boggs, Land Preservation Planner, Planning and Zoning, requested approval of a 2013 Rural Legacy Grant Agreement of $1,260,000.00. Mr. Seifarth indicated that Rural Legacy Program funds are November 6, 2012 Page 5 100% state -paid, mainly from the Department of Natural Resources Open Space funds, used to preserve farmland and open space containing significant agricultural, environmental and cultural or historical features surrounding the Antietam Battlefield. With the addition of the FY 2013 award, Washington County's total Rural Legacy Program of preserved land will be 4,721 acres on 39 farms through grant awards exceeding $14 million. Rural Legacy Program funds also help to buffer sensitive areas which eventually drain into the Chesapeake Bay watershed. Commissioner McKinley, seconded by Cline, moved to approve the 2013 Rural Legacy Grant Agreement of $1,260,000.00 and authorize the execution of such documents as may be required. The motion passed unanimously. SOLE SOURCE PROCUREMENT — KEYSTONE ONLINE SAFETY FIRE MOBILE SOFTWARE FOR THE DIVISION OF EMERGENCY SERVICES Rick Curry, Buyer, Purchasing Department, and Kevin Lewis, Director of Emergency Services, requested authorization of a Sole Source Procurement of KOPS Fire Mobile software for use by the Department of Emergency Services (DES) of $66,128.00 fi•om Keystone Public Safety, Inc. (Keystone) of St. Louis, Missouri, based on its proposal dated May 25, 2012. Mr. Curry indicated that DES wishes to apply Sections 1-106.2(a) (1) and (2) of the Code of the Public Local Laws of Washinaton County. Marvland to the procurement requested and that pursuant to those sections, the approval of four County Commissioners is required. Kevin Lewis stated that the Fire Mobile software would be purchased from the Department's current computer aided dispatch vendor, Keystone. The agreement with Keystone authorizes the County to execute said agreement and renew the maintenance agreement contract at the County's discretion. Funding in the amount of $484,593.00 is available in grant account GRT072 for the purchase of the software. Commissioner Callaham, seconded by Barr, moved to approve the request as presented. The motion passed unanimously. (Commissioner Barr left the meeting during discussions of the next agenda item due to business reasons.) 1L'/�.9:11►(!!11[I7►[K111J�Y 11Y. 1►[[913y-MilNl Joe Kroboth, III, Public Works Director, and Karen Luther, Purchasing Agent, presented available options regarding the proposal to award the contract for a Washington County Senior Center at Hagerstown Community College to the responsive, responsible, bidder, Roy C. Kline Contractors, LLC of Smithsburg, Maryland. Mr Kroboth stated that three available options were: 1) to award the contract as presented; 2) reject all bids and pursue other opportunities; or 3) again delay the decision. He indicated that bids are valid through January 17, 2013. Ms. Luther commented that bidders have contacted her office regarding the status of the bid award due to their need to plan ahead for the next building season. Commissioner McKinley, seconded by Callaham, moved to reject all current bids and pursue other options for the Senior Center. Commissioner Callaham acknowledged a November 6, 2012 Page 6 resolution received by the County Commissioners from the Commission on Aging Board and thanked members for their leadership, patience, and understanding during this difficult process. The motion passed unanimously. (Commissioner Barr was absent from the vote.) CONVENE IN CLOSED SESSION Commissioner Cline, seconded by McKinley moved to convene in closed session at 1:45 p.m. to discuss the appointment, employment, assignment, and/or performance evaluation of appointees, employees, or officials over whom this public body had jurisdiction; and other personnel matters that affect one or more specific individuals in accordance with Section 10-508(a) (1) of the State Government Article of the Annotated Code of Maryland. The motion passed unanimously. In closed session, the Commissioners discussed the potential appointment of individuals to a County authority, board or commission, and the recent job performance of several individual County employees and related County staffing issues. During closed session, the Commissioners instructed staff to place the potential appointments on a future open session agenda for further consideration and discussion; and provided staff with direction as to the personnel issues/job performance issues presented. Present during closed session were Commissioners Terry L. Baker, John F. Barr, Ruth Anne Callaham, Jeffrey A. Cline, and William B. McKinley. Also present were Gregory Murray, County Administrator; Vicki Lumm, County Clerk; John M. Martirano, County Attorney; and at various times, Richard Willson, Director, Washington County Housing Authority.
