HomeMy WebLinkAbout09.11.2012 MinutesBOARD OF COUNTY COMMISSIONERS OF WASHINGTON COUNTY Hagerstown, Maryland September 11, 2012 JOINT MEETING WITH WASHINGTON COUNTY BOARD OF EDUCATION The Board of County Commissioners met jointly with the Board of Education at its offices at 820 Commonwealth Avenue, Hagerstown. County Commissioner President Terry L. Baker called the meeting to order at 8:30 a.m. In attendance were Vice President John F. Bair and Commissioners Ruth Anne Callaham, Jeffrey A. Cline, and William B. McKinley. Board of Education members present were Wayne Ridenour, Paul Bailey, Karen Harshman, Justin Hartings, Donna Brightman, and Jacqueline Fischer. FOURTH QUARTER BUDGET ADJUSTMENTS — BOARD OF EDUCATION FY 2012 GENERAL FUND BUDGET Chris South, Chief Financial Officer for Washington County Public Schools, requested adjustments to the Fourth Quarter FY 2012 General Fund Budget by decreasing the following categories: Revenue - $64,594.00, Administration - $60,472.00, Instructional Salaries - $622,468.00, Instructional Textbooks and Supply - $14,747.00, Special Education - $259,135.00, Student Health Services - $23,258.00, Operation of Plant - $362,455.00, Capital Outlay - $5,628.00, and Food Service - $51.00; and by increasing the following categories: Mid -Level Administration - $208,764.00, Other Instructional Costs - $19,112.00, Student Personnel Services - $7,480.00, Student Transportation Services - $46,800.00, Maintenance of Plant - $276,268.00, and Fixed Charges - $102,770.00, for a net change in fund balance of $622,426.00. The proposed changes are necessary to properly categorize the Board's FY 2012 budget and effect the closeout of FY 2012. Commissioner Barr, seconded by McKinley, moved to approve the requested Fourth Quarter adjustments to the Board of Education's FY 2012 General Fund. The motior passed unanimously. LOCAL EARLY CHILDHOOD ADVISORY COUNCIL Steve Wernick, Director for Elementary Education, provided information on a recommendation by the Maryland State Department of Education to establish a Local Early Childhood Advisory Council. Mr. Wernick discussed the goals, responsibilities, and strategies for such a Council. Both boards agreed to work together toward forming a local Council, with the Board of Education taking a leadership role and Mr. Wernick serving as coordinator. WASHINGTON COUNTY PUBLIC SCHOOLS FISCAL YEAR 2014 STATE CAPITAL IMPROVEMENT PROGRAM PLAN REQUEST Boyd Michael, Deputy Superintendent, and Rob Rollins, Director of Facilities, Washington County Public Schools, presented the Fiscal Year 2014 (FY 2014) State Capital Improvement Program (CIP) Plan request to the County Comrnissioners. Mr. Michael stated that the request regards specific planning needs to fund construction, September 11, 2012 Page 2 renovation, addition, and systemic projects that qualify for State funding in FY 2014. He discussed school funding traditionally provided by the State of Maryland, which averages between $7 million and $9 million. Mr. Michael informed the Commissioners of various systemic maintenance projects for public schools and the recent contract rebidding for Bester Elementary School. There is an approximate $3 million difference between needed funding for Bester•, depending on the use of prevailing or non -prevailing wages. The Conmrissioners discussed the issue. Commissioner McKinley, seconded by Barr, moved to transfer $2.1 million to the Board of Education to be used for systemic projects as decided upon by the Board of Education. The boards discussed the motion verbiage for clarification. Mr. McKinley restated his motion to move to transfer $2.1 trillion to the Board of Education to be used for capital projects as decided upon by the Board of Education. Commissioner Barr seconded the restated motion. The motion passed unanimously. RECESS The Commissioners recessed at 9:09 a.m. CALL TO ORDER President Terry L. Baker called the regular meeting of the Board of County Commissioners of Washington County, Maryland to order at 10:07 a.m. in the County Administration Building located at 100 West Washington Street, Room 227, Hagerstown, with the following members present: Vice President John F. Barr and Commissioners Ruth Arne Callaham, Jeffi•ey A. Cline, and William B. McKinley. INVOCATION AND PLEDGE OF ALLEGIANCE Commissioner Barr offered the Invocation followed by the Pledge of Allegiance to the Flag by the full assemblage. APPROVAL OF MINUTES — AUGUST 28, 2012_ Commissioner McKinley, seconded by Barr, moved to approve the minutes of August 28, 2012. The motion passed unanimously. UPDATE -150th ANNIVERSARY OF THE MARYLAND CAMPAIGN OF 1862 Dennis Frye, Chief Historian, Harpers Ferry National Historic Park, and Tom Riford, President and CEO of the Hagerstown/Washington County Convention and Visitors Bureau, provided information on activities planned to commemorate the 150th Anniversary of the Civil War and the Battle of Antietam on September 17, 1862. Mr. Frye and Mr. Riford discussed Civil War conflicts that occurred in Hagerstown and surrounding areas, 1W. Frye presented the Commissioners copies of his books, Se tember Suspense and Harpers Ferry Under Fire. The Commissioners thanked the individuals for their work to commemorate the Civil War and preserve the County's rich heritage. September 11, 2012 Page 3 PROCLAMATION - ANTIETAM CAMPAIGN MONTH The Board of County Commissioners presented a proclamation to Dr. Susan Trail, Superintendent of Antietam National Battlefield, and Dan Spedden, Park Manager for the South Mountain Recreation Area, in recognition of Antietam Campaign Month during September 2012 to commemorate the sesquicentennial of the campaign. The individuals thanked the Commissioners for the proclamation and invited all to the events planned for the commemoration. CITIZENS PARTICIPATION Penny Nigh, 634 North Mulberry Street, Hagerstown, presented signed petitions and letters of concern to the Commissioners in opposition to the planned Multi -Use Stadium in downtown Hagerstown. Barbara Hovermill, 16286 Spielman Road, Williamsport, commented on the Stadium issue. Jim Laird, 1903 Maplewood Drive, Hagerstown, commented on the Stadium issue. OTHER BUSINESS Countv Attornev County Attorney John Martirano requested approval to convey 6,572 square feet or 0.159 acres, more or less, to the City of Hagerstown to finalize the recent alley improvement project behind the County Administration Building. Commissioner Barr, seconded by McKinley, moved to approve conveyance of the described property as presented. The motion passed unanimously. Countv Administrator County Administrator Gregory Murray noted that the Remembrance in the Park event to commemorate local heroes, coordinated by Kevin Lewis, Director of Emergency Services, would be held this evening in Hagerstown City Park. Reports from Countv Staff Plan Review and Permitting Jennifer Smith, Director of the Department of Plan Review and Permitting, provided a summary of "Customer Appreciation Week" held by the Department during August 13-17, which produced a 32% increase in permit activity over the same period as last year. The Commissioners congratulated Ms. Smith and staff on the successful event. Public Works Joe Kroboth, III, Public Works Director, stated that the Maryland Department of Transportation's Annual Tour meeting would be held on October 11, 2012 in Washington County, and the Pre -Tour discussion of transportation priorities next week. The Commissioners identified their transportation priorities in the following order: September 11, 2012 Page 4 1) Eastern Boulevard Corridor Improvements (Eastern Boulevard, Professional Court Extended, Marsh Pike, Longmeadow Road to I-81), 2) I-70 at Maryland 65, and 3) Hagerstown Regional Airport Traffic Control Tower. Mr. Kroboth advised the Commissioners that Washington County is the recipient of a $10,000.00 pass-through grant to create bike connectivity to the downtown core of Williamsport. The project involves repainting road lines and creating a loop back to the C & 0 Canal. The County will be performing engineering plans for the town. Aericultural Marketine Leslie Hart, Agricultural Marketing Specialist, informed the Commissioners of the "Start - Up Maryland" initiative to be held on September 27, 2012 in downtown Hagerstown. Washington County's rally involves ten business partners that will advise entrepreneurs and help identify funding sources, among other services offered. RESOLUTION IN SUPPORT OF NAMING THE ARENA OF THE ATHLETIC, RECREATION AND COMMUNITY CENTER AT HAGERSTOWN COMMUNITY COLLEGE County Attorney John Martirano introduced a Resolution in support of naming the Arena of the Athletic, Recreation, and Community Center at Hagerstown Community College after local coach James "Jim" Brown. The Commissioners previously expressed support of the naming request. Commissioner McKinley, seconded by Callaham, moved to approve a resolution in support of naming the Arena of the Athletic, Recreation, and Community Center at Hagerstown Community College after Jim Brown. The motion passed unanimously. (Resolution No. RS -2012-13 is located in the County Commissioners' Office.) FREE RECHARGEABLE BATTERY RECYCLING PROGRAM Bernadette Wagner, Co -Director of Volunteer Washington County, and Tony Drury, Washington County Recycling Coordinator, informed the Commissioners of efforts to promote free rechargeable battery recycling offered at various locations in the County. The Commissioners thanked Ms. Wagner and Mr. Drury for their efforts. Commissioner Callaham also congratulated Ms. Wagner on being named Businesswoman of the Year by the Hagerstown Business and Professional Women's Club. PUBLIC HEARING — ACOUISITION OF REAL PROPERTY — BLOCK B, PARCEL F, FINAL SUBDIVISION OF HAGERS CROSSING, PLAT 8728, HAGERSTOWN President Baker converged a public hearing at 11:32 a.m. to obtain public comment regarding the proposed acquisition of real property located at Block B, Parcel F, Final Subdivision of Hagers Crossing, Plat 8728, Hagerstown, for a "West City" Elementary School. Joe Kroboth, III, Public Works Director, reviewed details of the property. John Martirano, County Attorney, discussed the legal process to acquire real property for September 11, 2012 Page 5 future school sites, which includes several public hearings held by the Board of Education and Board of County Commissioners. Mr. Kroboth advised that the Commissioners approved a contract of sale for the purchase during its May 22, 2012 meeting and a purchase agreement was subsequently signed on May 25, 2012. The hearing was opened for public comment. Three individuals offered comment: Sally Hatch, 1201 Jefferson Boulevard, Hagerstown. Penny Nigh, 634 North Mulberry Street, Hagerstown. Sonja Pereschuk 15709 Jones Chapel Lane, Hagerstown. The public hearing was closed at 11:46 a.m. The issue will be discussed further at the next scheduled County Commissioners' meeting. WASHINGTON COUNTY VOLUNTEER FIRE AND RESCUE ASSOCIATION RETENTION OF VOLUNTEERS/REOUIRED PHYSICALS Dale Hill, President, and Rick Hemphill, Assistant Treasurer, Washington County Volunteer Fire and Rescue Association (WCVFRA), presented information on the cost of volunteer fire and rescue personnel physicals and a program developed to retain those volunteers. The County Commissioners had previously requested the plan as a prerequisite for the release of funding for those physicals. Mr. Hill described future projections and plans to expand its recruitment and retention committee. Mr. Hemphill presented a new recruit retention booklet for volunteers. The Commissioners discussed the issue, including funding for physicals and how bills are submitted and paid. Commissioner Cline moved that the County hold the funds to pay for volunteer fire and rescue physicals and pay for those physicals as supplied by purchase orders, billed by Health@Work, through the County's procurement process. The motion's verbiage was clarified by staff. Commissioner Cline restated his motion to move that the County hold the funds to pay for physicals as billed by Health@Work to the Washington County Volunteer Fire and Rescue Association, Commissioner McKinley seconded the restated motion. The motion passed unanimously. Commissioner McKinley requested a discussion during next week's meeting of how to continue to provide oversight of fire and rescue services. Kevin Lewis, Director of Emergency Services, was directed to provide information on a plan to combine and redefine the missions of the County's Emergency Services Advisory Council and the Fire and Rescue Communications Advisory Board. Baker called the afternoon session to order at 1:48 p.m. with the following members present: Vice President John F. Barr and Commissioners Ruth Anne Callaham, Jeffrey A. Cline, and William B. McKinley. PUBLIC HEARING — RE' OUESTS BY ORGANIZATIONS TO BE ADDED TO THE SECTION 1-108 LIST President Baker convened a public hearing at 1:48 p.m. to obtain public comment regarding requests received from Washington County nonprofit organizations to be added to the list of organizations to which the Board of County Commissioners may contribute funds, pursuant to Section 1-108 of The Code of Public Local Laws of Washineton County. Maryland (1-108 List). County Attorney John Martirano reviewed the process and advised that addition to the list does not guarantee an organization will receive funding; that decision is made separately as part of the Community Organization Funding process and ultimately the County's budgetary process. Mr. Martirano indicated that the following organizations have requested addition to the 1-108 List: 1. Hagerstown Community College Foundation, Inc. 2. Hancock Historical Society Corporation 3. The public hearing was closed at 2:01 p.m. The Commissioners discussed the process by which organizations would be considered for funding with Jim Hovis, Director, Office of Community Grant Management. Commissioner Callaham, seconded by Barr, moved to approve a resolution adding all thirty-three organizations to the 1-108 List. The motion passed unanimously. CONVENE IN CLOSED SESSION Commissioner McKinley, seconded by Bair, moved to convene in closed session at 2:12 p.m. to consider the acquisition of real property for a public purpose and matters directly related thereto, to consult with staff, consultants, or other individuals about pending or potential litigation; to consult with counsel to obtain legal advice on a legal matter; and consider a matter that concerns the proposal for a business or industrial organization to locate, expand, or remain in the State, in accordance with Section 10- 508(a)(3), (4), (7), and (8) of the State Government Article of the Annotated Code of Maryland. The motion passed unanimously. In closed session, the Commissioners discussed the specific aspects of several potential purchases of real property and the legal issues related thereto with County staff. During closed session, the Commissioners provided staff with direction as to the ongoing negotiations with current property owners relating to the potential purchase of several parcels of real property. Present during closed session were Commissioners Terry L. Baker, John F. Barr, Jeffrey A. Cline, Ruth Anne Callaham, and William B. McKinley. Also present were Gregory Murray, County Administrator; Vicki Lumm, County Clerk; John M. Martirano, County September 11, 2012 Page 8 Attorney; Joe Kroboth, III, Public Works Director; and Joe Kuhna, Real Property Administrator. ANTIETAM CREEK WATERSHED RESTORATION PLAN Elmer Weibley, District Manager, Soil Conservation District, presented highlights of the Antietam Creek Watershed Restoration Plan (Plan), a cooperative effort of several County and State agencies. Mr. Weibley advised that the Clean Water Act requires states to perform water quality assessments to monitor and determine the status of water bodies. The Antietam Creek was placed on Maryland's 303(d) list in 1996. He summarized the Plan that establishes a fiamework for water quality improvement, completes a mandatory requirement from the U.S. Environmental Protection Agency to access funding, and meets the Total Maximum Daily Load (TMDL) requirements to have the watershed removed from the 303(d) listing. The Commissioners thanked Mr. Weibley for the information and agreed to send a letter of support endorsing the Plan. REAL PROPERTY ACQUISITION —16026 AND 16115 SPADE ROAD Joe Kuhna, Real Property Administrator, requested approval to close negotiations for the acquisition of rights of way at 16026 and 16115 Spade Road for necessary repairs to the Spade Road Bridge. Mr. Kuhna described the project to rehabilitate the bridge by replacing the deteriorated steel superstructure and thereby extend its life. He stated that $2,575.00 is available in the Capital Improvement Project Budget for the acquisitions. Commissioner Barr, seconded by Callaham, moved to approve an option agreement for partial real property acquisition close negotiations for acquisition of property for rights of way at 16026 and 16115 Spade Road for necessary repairs to the Spade Road Bridge, adopt an ordinance approving said purchase, and authorize the execution of the required documentation as presented. The motion passed unanimously. (Ordinance No. ORD -2012-27 is located in the County Commissioners' Office.) REAL PROPERTY ACQUISITION —11325 AND 11400 ROBINWOOD DRIVE AND MAP 50, PARCEL 76 Joe Kulma requested approval to enter into option agreements for partial real property acquisitions located at 11325 and 11400 Robinwood Drive and Map 50, Parcel 76, to allow for future road improvements and widening at Robinwood Drive. Mr. Kuhna stated that the properties were appraised and that $173,907.00 is available in the Capital Improvement Project Budget for the acquisitions. Commissioner Barr, seconded by McKinley, moved to approve option agreements for partial real property acquisitions at 11325 and 11400 Robinwood Drive, and Map 50, Parcel 76 for the purposes stated, adopt an ordinance approving said purchase, and authorize the execution of the required documentation as presented. September 11, 2012 Page 9 COMMISSIONERS REPORTS AND COMMENTS Commissioner Cline noted the eleventh anniversary today of the September 11, 2001 attacks. He attended Maugansville Pride Day and the Community Day open house at Wilson's Store. Mr. Cline attended the Vote for Vacation event to promote Allegiant Airlines' local passenger service. He was present for Food Lion's $25,000.00 donation to the western branch of the Washington County Food Bank and Haeerstown Maeazine's Hot List Bash at Leitersburg Cinemas. Commissioner Cline attended the Pooch Plunge at the Halfway Park pool to benefit the Humane Society. He congratulated the County's Recreation Department for sponsoring the popular Princess Party. Mr. Cline attended the Walk for Tori at Doub's Woods Park to support research and a cure for scleroderma. Commissioner Callaham attended the Hot List Bash and congratulated the County's Black Rock Golf Course for attaining the Milestone Award for best golf course the seventh year in a row. Ms. Callaham attended the Length of Service Award Program (LOSAP) coordinator meeting and a Historical Advisory Committee board meeting. Commissioner Barr attended the fall Board Retreat for the local Washington County Community Foundation. Mr. Barr reported on a Maryland Department of Housing and Community Development local conference attended by several Maryland counties. Commissioner McKinley attended the grand opening of the local Republican headquarters. He reported on a meeting attended by local and State government representatives at the Hagerstown Regional Airport to discuss the request for a new Airport traffic control tower. Mr. McKinley advised that the Planning Commission approved three site plans during a recent meeting. Commissioner Baker attended a picnic sponsored by Commissioner Cline at the Potomac Fish and Game Club. He reported on a business outreach visit to Customizers. Mr. Baker attended a Parks and Recreation Board meeting where positive reports were noted regarding its summer programs. Commissioner Baker attended the grand opening of the local Republican Club headquarters and Boonsborough Days. AMENDMENT NO. 1 TO EMPLOYEES' RETIREMENT PLAN OF WASHINGTON COUNTY Stephanie Stone, Director, Health and Human Services, presented recommendations to 1) Adopt Amendment No. 1 to the Employees' Retirement Plan of Washington County; 2) Adopt a Resolution which accompanies Amendment No. 1; and, 3) Adopt a Resolution approving the amended and restated 2012 update of the Employees' Retirement Plan of Washington County, which includes all changes that have been made to the plan since the last signed plan generally effective as of July 1, 1997 and as restated in May 30, 2002. Ms. Stone indicated that because the County's mortality tables have been revised and determined favorable by the Internal Revenue Service (IRS), it is necessary that the Cornmissioners approve and sign Amendment No. 1 to make certain changes required by September 11, 2012 Page 10 the IRS as a condition for issuing this favorable determination letter. In addition, staff recommends approval of the updated and restated Employees' Retirement Plan of Washington County, effective July 1, 2012, so that the County has one updated document to use moving forward. Commissioner Barr, seconded by McKinley, moved to adopt all three recommendations as stated and presented. The motion passed unanimously. (Resolution Nos. RS -2012-15 and RS -2012-16 are located in the County Commissioners' Office.) RESOLUTION FOR ENDORSEMENT OF MARYLAND ECONOMIC ASSISTANCE FUND LOAN AND LOCAL INCENTIVE TO PHOENIX COLOR CORP. Rob Ferree, Deputy Director, Economic Development Commission (EDC) requested approval of a resolution for the endorsement of the State of Maryland's $60,000.00 Maryland Economic Assistance Fund (MEDAF) loan and approval of a $30,000.00 conditional loan from the County. Mr. Ferree stated that the Maryland Department of Business and Economic Development, under the Maryland Economic Development Assistance Authority, has agreed to conditionally loan Phoenix Color Corp. up to $60,000.00 from the MEDAF. The loan proceeds will be used by Lehigh Phoenix to relocate its Rockaway, New Jersey bindery operations. The project will retain 370 jobs and create 20 additional full-time jobs in Hagerstown with an average wage of $36,000.00. Commissioner Barr, seconded by McKinley, moved to approve a resolution for the endorsement of the State of Maryland's $60,000.00 Maryland Economic Assistance Fund loan to Phoenix Color Corp., and the approval of a $30,000.00 conditional loan from the County. The motion passed unanimously. SUSTAINABLE GROWTH AND AGRICULTURAL PRESERVATION ACT OF 2012 — "SEPTIC BILL" Stephen Goodrich, Director, Department of Planning and Zoning, advised that during their August 28, 2012 meeting, the County Commissioners directed staff to prepare a motion to provide the needed direction to proceed with the Sustainable Growth and Agricultural Preservation Act of 2012 ("Septic Bill"). Mr. Goodrich stated that staff had developed a motion using the word "implement" rather than accept. He advised the Commissioners of recent conversations with the Maryland Department of Planning regarding tier mapping. The Commissioners discussed the issue and the fact that not approving the Septic Bill would limit the number of lots subdivided per parcel in the rural areas. Commissioner McKinley, seconded by Callaham, moved to direct Planning and Zoning Department staff to proceed with the preparations needed to implement the requirements of the Sustainable Growth and Agricultural Preservation Act of 2012 ("Septic Bill") and direct staff to prepare correspondence for the County Commissioners' signature that September 11, 2012 Page 11 expresses the Board's strong concerns, distress, and objections to the disproportionate negative burdens resulting from this law, which are placed on rural property owners in Washington County and other rural counties. The correspondence should also express the Commissioners' disappointment and frustration that jurisdictions were not afforded the opportunity to adopt locally developed strategies to accomplish water quality improvements that are fair and equitable. The motion passed unanimously. CONTRACT AWARD — CITY/COUNTY LANDFILL ACCESS ROAD CONSTRUCTION Rick Curry, Buyer, Purchasing Department, and Dave Mason, Environmental Engineer, Department of Water Quality, recommended award of the contract for the City/County Landfill Access Road Construction Project (PUR-1187) to the responsive, responsible bidder, David H. Martin Excavating, Inc. of Chambersburg, Pennsylvania, which submitted a Base Bid of $67,780.00 and a Contingent Bid cost of $5,488.50 for the lowest Total Sum Bid of $73,268.50. Mr. Mason described the need for the project and the bids received. Commissioner Barr, seconded by McKinley, moved to award the contract for the City/County Landfill Access Road Construction Project for the Solid Waste Department to the responsive, responsible bidder, David H. Martin Excavating, Inc. of Chambersburg, Pennsylvania, which submitted a Base Bid of $67,780.00 and a Contingent Bid cost of $5,488.50 for the lowest Total Sum Bid of $73,268.50 as presented. The motion passed unanimously. CONVENE IN CLOSED SESSION Commissioner Barr, seconded by Callaham, moved to convene in closed session at 4:29 p.m. to consider a matter that concerns the proposal for a business or industrial organization to locate, expand, or remain in the State, in accordance with Section 10-508(a)(4) of the State Government Article of the Annotated Code of Maryland. The motion passed unanimously. In closed session, the Commissioners discussed a proposed economic incentive package relating to a company's proposal to locate in the County/State. During closed session, the Commissioners provided direction to staff regarding the County's continuing discussions with a local company relating to potential economic incentives and the company's proposal to locate in the County/State. Present during closed session were Commissioners John F. Barr, Terry L. Baker, Ruth Anne Callaham, Jeffrey A. Cline, and William B. McKinley.
