HomeMy WebLinkAbout07.17.2012 MinutesBOARD OF COUNTY COMMISSIONERS OF WASHINGTON COUNTY Hagerstown, Maryland July 17, 2012 JOINT MEETING WITH WASHINGTON COUNTY BOARD OF EDUCATION The Board of County Commissioners met with the Board of Education in Room 255 of the County Administration Building located at 100 West Washington Street, Maryland, County Commissioner President Terry L. Baker called the meeting to order at 8:03 a.m. In attendance were Vice President John F. Baty and Commissioners Ruth Anne Callaham, Jeffrey A. Cline, and William B. McKinley. Board of Education members present were Paul Bailey, Justin Hartings, Donna Brightman, Edward Forrest, and Karen Harshman. School Health Nurse Proaram Dr. Clayton M. Wilcox, Superintendent, Washington County Public Schools, provided an update on the School Health Nurse Program for Washington County Public Schools. Dr. Wilcox stated that upon approval of its Board, Washington County Public Schools would enter into final negotiations for a contract with Meritus Medical Center, Inc. (Meritus) to provide the nursing services. He indicated that Meritus would be following the standards of care issued by the American Nursing Association and the School Health Nurse Association. It plans to collaborate in hiring prior nursing staff members previously employed with the Washington County Health Department. Dr. Wilcox stated that procuring health services from Meritus would be a lesser amount than the previous expense with the Health Department through Washington County Government. Update on Bester Elementary School Proiect Boyd Michael, Deputy Superintendent, provided an update on the Bester Elementary School Project. Mr. Michael reported that Washington County Public Schools opened the bids for the new Bester Elementary School Project and the base bids received were over the budgeted amount. He stated that school officials would resend the bids by either breaking down the bid packaging or placing the bid out at both prevailing and non - prevailing wages. The Board of Education will inform the bodies of the results. The joint meeting concluded at 8:43 a.m. 14Y.11 N W0X0)71 ]D V President Terry L. Baker called the regular meeting of the Board of County Commissioners of Washington County, Maryland to order at 9:19 a.m, at 100 West Washington Street, Room 227, with the following members present: Vice President John F. Barr and Commissioners Ruth Anne Callaham, Jeffrey A. Cline, and William B. McKinley. INVOCATION AND PLEDGE OF ALLEGIANCE Commissioner Barr offered the Invocation followed by the Pledge of Allegiance to the Flag by the full assemblage. July 17, 2012 Page 2 APPROVAL OF MINUTES — JULY 10. 2012 Commissioner McKinley, seconded by Callaham, moved to approve the minutes of July 10, 2012 as amended. The motion passed unanimously. COMMISSIONERS REPORTS AND COMMENTS Commissioner Cline reported on the recent Animal Control Ordinance Public Hearing and thanked all who attended and provided comments. He attended the Washington County Building Code Advisory Committee meeting. Mr. Cline described the Civil War "Retreat through Williamsport" and congratulated the Williamsport Fire Company, Town of Williamsport and volunteers for the great event. Commissioner Cline attended the ribbon - cutting ceremony for the Faluney-Keedy Home and Village's Wastewater Treatment facility. Commissioner Callaham referred to a recent Herald -Mail newspaper article individualizing her comments on the proposed Civil War Rail Trail rather than the Commissioners as a collaborative group. She wrote a letter of response to the newspaper's Editor. Ms. Callaham stated that she recently drove on various roads in the southern part of the County and would like to hear from the citizens in those areas. Commissioner Barr reported that this weekend begins the Ag Expo and Fair at the Washington County Agricultural Education Center. He discussed several planned activities and encouraged all to attend. Commissioner McKinley stated that he would be collecting tickets at the Ag Expo gate on July 27. He reported on an informative and productive Economic Development Commission meeting. Mr. McKinley thanked all who attended the Animal Control Ordinance Public Hearing. He discussed a recent business visit to Flohr Pools. Commissioner Baker reported attending the Economic Development Commission meeting and thanked members and staff for their continued hard work. He thanked President Mark Thomas of the Review and Herald for hosting the recent business visit. Commissioner Baker updated the Commissioners regarding the Unilever Hagerstown Plant closing. He advised that he would also be collecting gate tickets during the Ag Expo. OTHER BUSINESS Countv Administrator County Administrator Greg Murray congratulated Commissioner McKinley on receiving a Lifetime Achievement Award from the Hagerstown Conununity College Athletic Booster Club. REPORTS FROM COUNTY STAFF Division of Plan Review and Permitting Jennifer Smith, Director, Plan Review and Permitting, reported that the Division would be holding three training sessions for the public on the newly adopted 2012 Building Codes beginning the third week in August. She advised that the State Department of Housing and July 17, 2012 Page 3 Community Development recently released an interpretation of the requirements of the Residential Sprinkler Code for one and two-family dwellings and it discussed possible modifications for local jurisdictions. Ms. Smith stated that the Division would bring forth modifications for the Washington County Residential Sprinkler Codes to the Board for consideration by October 1 and then submit them to the State. She indicated that the Division is actively working on improving the plan review and permitting process for customers and has developed an on-going action plan. Health and Human Services Stephanie Stone, Director of Health and Human Services, introduced new county employees Benjamin E. Hoopengardner, 911 Call Taker; Dori M. Compton, 911 Call Taker; Todd Moore, Utility Worker II; and Darrell Shank, Utility Worker II. The Commissioners welcomed the new employees and wished them well in their positions. Ms. Stone requested permission to advertise and fill a Grade 13 Senior Planner position in the Division of Planning and Zoning due to a vacancy. Commissioner Callaham, seconded by Barr, moved to approve advertising to fill the Senior Planner position; and if an in-house candidate is selected, thus creating another opening, the Department has permission to fill the vacancy from within County Government without additional approval. The motion passed unanimously. Ms. Stone requested permission to advertise and fill a Grade 9 Legal Secretary position and a Grade 17 Assistant County Attorney position in the County Attorney's Office due to vacancies. Commissioner McKinley, seconded by Barr, moved to approve advertising to fill the Legal Secretary and Assistant County Attorney positions as presented. The motion passed unanimously. Ms. Stone reported that the Health and Human Services Department is introducing a new service to County employees and their families called "'Live Well" to help achieve health and wellness goals. Haeerstown Reeional Airport Phil Ridenour, Airport Director, reported that the Pittsburgh Institute of Aeronautics would be holding its first graduation on August 17 at the Hagerstown Regional Airport terminal. He also reported that the Airport and the Hagerstown Aviation Museum would be hosting the Wings and Wheels Expo 2012 on September 22. Mr. Ridenour stated that on October 19 and 20 the Airport will host a Smoketoberfest barbecue with proceeds going to the Make -A -Wish Foundation. CERTIFICATE OF APPRECIATION TO MARIA SPINNLER Upon reconnnendation by the Local Management Board, President Baker presented a Certificate of Appreciation to Maria Spinnler, Program Manager for Post Secondary July 17, 2012 Page 4 Education and Training Coordination Strategy at Ilagerstown Community College. The award recognizes Ms. Spinnler's excellent outreach and education services provided to teen parents in the community for almost twenty years. The Commissioners thanked Ms. Spirmler for her dedication to this endeavor. She thanked the Commissioners, and organizations and agencies that she works with, for their support. CONSTRUCTION BID AWARD — BROADFORDING ROAD, RESLEY ROAD, RICE ROAD. AND SPADE ROAM CULVERT AND BRIDGE SUPERSTRUCTURE. REPLACEMENTS Rob Slocum, Deputy Director of Public Works, and Scott I lobbs, Chief of Engineering Design, recommended award of the construction bid for Broadfording Road, Resley Road, Rice Road, and Spade Road Culvert and Bridge Superstructure Replacements (Contract BR -SR -194-14) to the lowest responsive, responsible bidder, Building Systems, Inc. for $584,897.00. Mr. Slocum stated that four bids were received for the project that involves the replacement of three drainage culverts at three separate sites and the replacement of a bridge superstructure at the fourth site. He said that this project includes four budgeted Capital Improvement Program (CIP) improvements with an unencumbered balance of $817,706.44. The Commissioners praised staff for the project coming in below budget. Commissioner Barr, seconded by McKinley, moved to award the construction bid for Broadfording Road, Resley Road, Rice Road, and Spade Road Culvert and Bridge Superstructure Replacements to the lowest responsive, responsible bidder, Building Systems, Inc., for $584,897.00 as presented. The motion passed unanimously. CHANGE ORDER — COUNTY OFFICE BUILDING FOURTH FLOOR HVAC Joe Kroboth, 111, Director, and Scott Hobbs, Chief of Capital Projects, Division of Public Works, requested Change Order No. i for $117,950.00 to M.S. Jolmston Co., Inc, of Hagerstown, Maryland for repairs at tine County Office Building located at 33-35 West Washington Street. Mr. Kroboth stated that the Heating, Ventilation, and Air Conditioning (HVAC) project's base bid price only included replacement of a rooftop HVAC unit and alternate pricing for additional work (Contract BL -COB -154-28). Additional structural systems are necessary to support the unit. Mr. Kroboth indicated that supplementary funding was added to the budget as part of the new FY 2013 Capital Budget and sufficient funds are now available to complete both the original base bid and the alterroate scope of work. Connnissioner Barr, seconded by Cline, moved to approve Change Order No. I for $117,950.00 to M.S. Johnston Co., Inc. for repairs at the County Office Building located at 33-35 West Washington Street as presented. The motion passed unanimously. CHANGE ORDER — BUILDING DESIGN, WASHINGTON COUNTY SENIOR ACTIVITIES CENTER Mr. Kroboth requested Change Order No. 2 for $69,228.75 to BFM Architects of Hagerstown, Maryland for the Washington County Senior Center. He stated that on May 1, 2012, staff presented competitive bids received for the project and various options July 17, 2012 Page 5 available to proceed considering budget constraints. The Commissioners directed staff at that time to modify the building design to eliminate the second floor, reduce building square footage wherever possible, and redesign the building in preparation of rebidding the project. Mr. Kroboth indicated that the Change Order covers the redesign costs. The Commissioners discussed the matter. Commissioner Cline, seconded by McKinley, moved to approve Change Order No. 2 for $69,228.75 to BFM Architects of Hagerstown, Maryland for the Washington County Senior Center as presented. The motion passed with Commissioners Cline, McKinley, Callaham, and Baker voting "AYE" and Commissioner Barr "ABSTAIN." CITIZENS PARTICIPATION There was no one present who wished to participate. CONVENE IN CLOSED SESSION Commissioner Cline, seconded by Barr, moved to convene in closed session at 10:38 a.m. to discuss the appointment, employment, assignment, and/or performance evaluation of appointees, employees, or officials over whom the public body has jurisdiction; and discuss personnel matters that affect one or more specific individuals, in accordance with Section 10-508(a)(1) of the State Government Article of the Annotated Code of Maryland. The motion passed unanimously. In closed session, the Commissioners discussed the potential appointment of certain individuals to several County boards, the potential reappointment of individuals to a County board; the functions of a County appointed committee and the future operational effect on specific individuals; received a brief update from Staff on a company's proposal to remain in the County; and the recent job performance of an individual employee. During closed session, the Commissioners instructed Staff to place the potential appointments/reappointments for further discussion on a future open session agenda; authorized Staff to begin the planning process to create a new advisory/resource committee; and instructed the County Clerk to research the facts surrounding the current membership of an individual for a county appointed position on an outside committee. Present during closed session were Commissioners Terry L. Baker, John F. Barr, Ruth Anne Callaham, Jeffrey A. Cline, and William B. McKinley. Also present were Gregory Murray, County Administrator; Katie Yoder, Executive Office Associate; John Martirano, County Attorney; Jennifer Smith, Director, and Angela Smith, Deputy Director, Division of Plan Review and Permitting. ADJOURNMENT Commissioner Bair, seconded by McKinley, moved to adjourn at 11:42 a.m. The motion passed unanimously.
