President Terry L. Baker called the regular meeting of the Board of County
Commissioners of Washington County, Maryland to order at 9:12 a.m. at 100 West
Washington Sheet, Room 227, Hagerstown, with the following members present:
Commissioners Ruth Anne Callaham, Jeffrey A. Cline, and William B. McKinley.
Commissioner John F. Barr was absent from the meeting.
INVOCATION AND PLEDGE OF ALLEGIANCE
Commissioner Callaham provided the Invocation followed by the Pledge of Allegiance to
the Flag by the full assemblage.
APPROVAL OF MINUTES — JUNE 12, 2012
Commissioner McKinley, seconded by Callaham, moved to approve the minutes of
June 12, 2012. The motion passed with Commissioners McKinley, Callaham, and Baker
voting "AYE", and Cline "ABSTAIN." (Commissioner Barr was absent from the
meeting.)
THIRD OUARTER BUDGET ADJUSTMENTS — BOARD OF EDUCATION
FY 2012 GENERAL FUND BUDGET
Chris South, Chief Financial Officer for Washington County Public Schools, requested
adjustments to the Third Quarter FY 2012 General Fund Budget by decreasing the
following categories:, Administration - $72,794.00, Instructional Salaries - $672,142.00,
Other Instructional Costs - $184,392.00; Special Education - $82,745.00, Operation of
Plant - $458,429.00, Capital Outlay - $16,865.00 and Fixed Charges - $476,265.00;
and by increasing the following categories: Revenue - $103,595.00; Mid -Level
Administration - $300,000.00; Instructional Textbooks and Supply - $751,390.00, Student
Transportation Services - $290,837.00; and Maintenance of Plant - $725,000.00, for a net
change in fund balance of $0. The Commissioners discussed several budget categories with
Mr. South.
Commissioner McKinley, seconded by Cline, moved to approve the requested Third
Quarter adjustments to the Board of Education's FY 2012 General Fund Budget for a net
change in the fund balance of $0. The motion passed unanimously. (Commissioner Barr
was absent from the meeting.)
SUSTAINABLE GROWTH AND AGRICULTURAL PRESERVATION ACT OF
2012
Jill Baker, Chief Planner, and Stephen Goodrich, Director, Planning and Zoning; and
Jennifer Smith, Director, Plan Review and Permitting, presented an overview of the
Sustainable Growth and Agricultural Preservation Act of 2012 (known colloquially as the
"Septic Bill") passed by the Maryland General Assembly, signed into law on May 2, 2012,
and effective as of July 1, 2012. The bill requires counties and municipalities to designate
areas or "tiers" in their Comprehensive Plans, which are then linked to restrictions on the

number of lots and type of sewage disposal system that may be used. The new rules apply
only to residential subdivisions, defined by Washington County as five lots or less. Mr.
Goodrich discussed the composition of the tiers and the effect on septic systems and
subdivisions in Washington County. He advised that the tiers must be adopted into the
Comprehensive Plan by December 31, 2012, which process includes a public hearing. The
Commissioners discussed the new requirements and whether the County should request an
extension while working on its program. Mr. Goodrich advised that his office would
proceed as if the County is complying unless otherwise directed by the Commissioners.
Jennifer Smith stated that her office would notify the development cormnunity of the
proposals being considered as soon as possible due to major subdivision planning.
Commissioner Callahan stated that she would prefer to address the issue after discussing it
at the August 15, 2012 Maryland Association of Counties' Summer Conference, and the
Commissioners agreed.
PUBLIC HEARING — AGRICULTURAL PRESERVATION EASEMENT
RANKINGS FOR IiISCAL YEAR 2013
President Baker convened a Public Hearing at 10:00 a.m. to obtain public continent on the
proposed Agricultural Preservation Easement Rankings for Fiscal Year 2013. Eric Seifarth,
Rural Preservation Administrator, and Chris Boggs, Land Preservation Planner, Planning
and Zoning, provided information on the purchased easement program. He advised that the
Board of County Commissioners approves the priority ranking order from a list
recommended by the Advisory Board and then forwards the top ten farms on the ranking
list to Annapolis. He indicated that $9 million in funding is available fionn the State. The
County will have the opportunity to contribute funds later in fall 2012 using a 60/40
mechanism. The 40% County funds are derived from local agriculture transfer taxes.
The hearing was opened for public comment.
Per Olaf Bachman, 19121 Manor Church Road, Hagerstown, commented that he owns
property in a wildlife conservation arca that is not crop producing but leads to the Potomac
River. He spoke in favor of conserving all types of land.
Joe Lane, 12030 Hippan Hill Road, Smithsburg, spoke in support of the Agricultural
Preservation Easement Program and for additional programs to be developed to preserve
agriculture in the community.
The Commissioners had no continents. The Public Hearing was closed at 10:09 a.m.
Commissioner Callalnam, seconded by Cline, moved to accept the recommendations for
priority rankings as recommended by the Agricultural Advisory Board. The motion passed
unanimously. (Comnnissioner Barr was absent from the meeting.)
SCHOOL MITIGATION PROPOSAL — SOUTH POINTE CONDOMINIUMS,
Stephen Goodrich discussed a School Mitigation proposal for South Pointe Condominiums
that involves 102 planned units on Oak Ridge Drive East. Attorney Jason Divelbiss, who

submitted the proposal on behalf of developer Paul Crampton, Jr., advised that Pupil
Generation Rates provided by Washington County Public Schools and the Planning and
Zoning Department show that for this proposed development, only South Hagerstown
High School has enrollment that now exceeds its capacity. The proposed mitigation plan
limits construction to a certain number of units per year through 2016 to allow the
projected students at South Hagerstown High School to be absorbed at manageable rate.
The Commissioners discussed the plan and the anticipated total excise tax revenue
($564,000.00) that would be generated from a total build out as proposed by the developer.
The Commissioners further discussed the proposal.
Commissioner Callaham, seconded by McKinley, moved to accept the mitigation proposal
as presented. The motion passed unanimously. (Commissioner Barr was absent from the
meeting.)
CITIZENS PARTICIPATION
Joe Lane, 12030 Hippan Hill Road, Smithsburg, commented on the school mitigation
process, the County's budget, and funding for the Board of Education.
RECOGNITION OF WASHINGTON COUNTY JUNIORS VOLLEYBALL
LEAGUE "TWISTERS" TEAM
The Commissioners presented a certificate of recognition and Washington County pins to
the "Twisters" Volleyball team that will be competing in the 33rd Annual Girls' Junior
National Championships in Columbus, Ohio on June 29 -July 2, 2012. Manager Darin
Lewis introduced team members. The Commissioners congratulated them on the
accomplishment and wished them well in the tournament.
SOLAR ENERGY PROJECT AT FORTY WEST LANDFILL
County Administrator Greg Murray announced that an agreement was recently finalized by
the Commissioners for a solar energy project to be constructed on up to 130 acres of
uncapped property at the Forty West and Resh Road Landfills. Robert Babcock, Partner,
EPG Solar, described the plans for a 25 -megawatt solar facility to be built by his company.
The solar project would contribute a large percentage of the solar power Maryland needs to
meet renewable energy targets. Mr. Murray discussed the positive aspects of the project
including a local benefit of $515,000.00 to the County when completed and $12.9 million
over twenty-five years. The project provides the County an annual payment in lieu of
taxes, or $125,000.00, when the project hits peak electricity generation. Assistant County
Attorney Kirk Downey advised that the Site Lease and Power Purchase Agreement with
EPG Solar has been prepared and is ready for execution.
Commissioner McKinley, seconded by Cline, moved to approve execution of the Site
Lease and Power Purchase Agreement with EPG Solar upon the terms given by the
Commissioners and outlined by the County Administrator. The motion passed
unanimously. (Commissioner Barr was absent from the meeting.)

REAL PROPERTY ACOUISITION —1244 FREDERICK STREET
Joe Kuhna, Real Property Administrator, stated that several properties along Frederick
Street would require either partial or full acquisition to allow for future realignment and
improvements to the Southern Boulevard Project. He advised that acquisition of property
located at 1244 Frederick Street, Hagerstown, would be necessary to the project. Mr.
Kuhna indicated that funds are contained in the Capital Improvement Project budget for
the $105,000.00 purchase price.
Commissioner McKinley, seconded by Cline, moved to approve an option agreement for
real property acquisition located at 1244 Frederick Street for the purposes stated, adopt an
ordinance approving said purchase, and authorize the execution of the necessary
documentation to finalize the acquisition. The motion passed unanimously. (Commissioner
Barr was absent from the meeting.) (Ordinance No. ORD -2012-13 is located in the County
Commissioners' Office.)
BYLAWS UPDATE- WASHINGTON COUNTY LOCAL MANAGEMENT BOARD
Thomas Kline, Manager of the Local Management Board (LMB), and Jim Hovis, Director
of the Office of Community Grant Management, requested approval of Revision 4 of the
LMB bylaws. He advised that the bylaws are required to be reviewed every three years
pursuant to County and State policies. Mr. Kline and Assistant County Attorney Kirk C.
Downey reviewed the proposed revisions with the Commissioners that include, among
other things, updating references to the Washington County Community Partnership for
Children and Families to the current name of the Office of Community Grant
Management. The LMB reviewed and approved the proposed revision during its May 18,
2012 meeting. The Commissioners discussed the proposed revisions.
Commissioner Cline, seconded by McKinley, moved to approve Revision 4 of the Bylaws
of the Washington County Local Management Board as presented. The motion passed
unanimously. (Commissioner Barr was absent from the meeting.)
COMMISSION ON AGING UPDATE
Hilary Lo, Community Educator, Washington County Commission on Aging, provided
information on the senior population in Washington County and services provided at the
current Senior Center location. She presented plans and programs proposed for the Senior
Center planned at Hagerstown Community College. The Commissioners thanked Ms. Lo
and those individuals present from the Commission on Aging for the presentation.

PUBLIC HEARING - MAP AMENDMENT (RZ-12-001) REZONING
APPLICATION — CORNERSTONE COMMUNITY CHURCH OF HAGERSTOWN
President Baker convened a public hearing at 1:43 p.m. to receive testimony regarding
Zoning Map Amendment Application (RZ-12-001) on property owned by the Cornerstone
Community Church of Hagerstown at 20519 Beaver Creek Road, Hagerstown, Kirk
Downey, Assistant County Attorney, reviewed the procedures for the hearing and County
Clerk Vicki Lumm administered the oath to those who planned to give testimony. Jill
Baker, Chief Planner, Planning and Zoning, summarized the request and entered the Staff
Report and Analysis dated March 16, 2012 and Addendum #1 dated April 26, 2012 into
the record of the hearing. The property consists of 3.28 acres, of which 1.82 acres are
zoned Rural Business -Existing (RBE) and 1.37 acres Rural Village (RV.) Ms. Baker stated
that the applicants believe a mistake was made in the original zoning of the property in that
there is not an underlying zoning district for the property to revert to should the business
fail or want to move. The business that was located on the property has closed and the
Church now owns the property. Ms. Baker advised that the Planning Commission has
recommended approval of the request based on the belief that there was a substantial
change in the neighborhood.
The public hearing was opened for comment. Fred Frederick, Professional Engineer and
Land Surveyor, Frederick, Seibert & Associates, 128 South Potomac Street, Hagerstown,
representing property owner Cornerstone Community Church of Hagerstown, testified in
favor of the rezoning request.
Attorney Downey stated that the record for RZ-12-001 was now closed and the hearing
concluded. The public hearing was closed at 2:13 p.m.
The Commissioners discussed the request. It was their consensus to approve Map
Amendment Application RZ-12-001 and reclassify the entire property to the Rural Village
(RV) district. The County Attorney's Office will return with the Findings of Fact for
formal approval at a future meeting.
BID RESULTS/AWARD UPDATE — NATURAL GAS SUPPLY SERVICES TO
WASHINGTON COUNTY GOVERNMENT AND WASHINGTON COUNTY
VOLUNTEER FIRE AND RESCUE ASSOCIATION
Purchasing Agent Karen Luther and Richard Anderson of CQI Associates, LLC, reported
on bid results of (WCPS Bid #2012-34) for Natural Gas Supply Services, Ms. Luther
stated that on March 31, 2009, the Board approved entering into a cooperative purchasing
effort with the Washington County Public Schools (WCPS) to allow one organization
(WCPS-lead jurisdiction) to issue a solicitation for natural gas supply services, the
specifications of which would represent the needs of both participating organizations; the
natural gas requirements of the Washington County Volunteer Fire & Rescue Companies
were also included. Bids were received from pre -qualified suppliers on February 21, 2012,
but were rejected due to confusion regarding pending changes to Columbia Gas' supplier
Choice Program (Columbia Gas of Maryland is the energy distribution company.) Mr.
Anderson described the bidding process and current pricing trends for natural gas supply,

which are at a ten-year low. The average price the participants have paid for the past three
years is $0.829/therm (Year 1 - $0.6930; Year 2 - $0.8680; and Year 3 - $0.9250). The 36 -
month price option was chosen over the shorter periods based upon anticipated increases of
two percent (2%) per year for the three-year period, and the recommendation by CQI
Associates, Inc.
Commissioner Callaham, seconded by Cline, moved to enter into the record the results of
the contract award made on April 11, 2012 to Washington Gas Energy Services of
Timonium, Maryland of the bid (WCPS Bid #2012-34) for Natural Gas Supply Services at
the following rate: Alternate Bid D — Fixed All Inclusive Price for 36 months of service
beginning July 1, 2012 at $0.4836 Per/Therm. The motion passed unanimously.

2012-2013 PROPERTY AND CASUALTY INSURANCE RENEWALS
Becky Maginnis, Risk Management Administrator, and Ed Seward, Broker, CBIZ
Insurance Services, Inc., provided details regarding the recommendation to renew the
policies in place during the prior policy year for liability policies placed with Travelers
Insurance Company, property and equipment policies placed with Local Government
Insurance Trust, and an airport liability policy placed with AIG Aviation, Inc. Ms.
Maginnis indicated that renewal premiums for all lines of coverage were held to a 1.70%
increase, which is well below budgeted premiums and increases for the insurance market.
Mr. Seward described market conditions and stated that CBIZ was able to negotiate an
overall premium increase of 5.84%. The Commissioners discussed the recommendation.
Commissioner McKinley, seconded by Callaham, moved to renew the policies that were in
place during the prior policy year, i.e., liability policies placed with Travelers Insurance
Company, property and equipment policies placed with Local Government Insurance
Trust, and an airport liability policy placed with AIG Aviation, Inc. The motion passed
unanimously. (Commissioner Barr was absent fi•om the meeting.)
BID AWARD — GROUND MAINTENANCE CHEMICALS FOR VARIOUS
COUNTY DEPARTMENTS (PUR 1182)
Rick Curry, Buyer -Purchasing Department, and John Kain, Superintendent of the Black
Rock Golf Course, recommended bid awards to the responsible companies with the lowest
responsive bids that meet the specifications for each chemical item and that tie bid items be
awarded by drawing lots. Mr. Curry stated that the bids are for various County departments
for a one-year period, tentatively commencing July 1, 2012 through June 30, 2013. The
awards for four tie bids for #14, 915, #20, and #24 were determined by drawing lots,
pursuant to Washington County Purchasing Policy P-2.
Commissioner Cline, seconded by McKinley, moved to award the bid for grounds
maintenance chemicals for various County Departments to the following companies, which
submitted the low responsible, responsive bids meeting specifications for each chemical as
follows, including the tie bid items: Item #1: Agrium - $475.00/gal.; Item #2:
Agrium - $33.90/gal.; Item #3: Genesis - $77.34/gal.; Item #4: Agrium - $332.00/gal.;

OTHER BUSINESS
Countv Attornev
County Attorney John Martirano requested execution of "An Ordinance to Declare Certain
Real Property as Surplus Property and to Approve the Conveyance of Said Real Property."
He stated that the Commissioners previously approved the conveyance of a 0.0582 -acre
parcel of land located on the south side of Fountain Head Road in Hagerstown for no
monetary consideration that was originally obtained for an old roadway that was never
built. The intended conveyance was advertised three times in The Herald -Mail as required
by the Code of the Public Local Laws and the Commissioners now have the ability to
convey the property to a nearby property owner.
Commissioner Cline, seconded by McKinley, moved to convey the property and adopt the
Ordinance as presented. The motion passed unanimously. (Commissioner Barr was absent
from the meeting.) (Ordinance No. ORD -2012-14 is located in the County Commissioners'
Office.)
Countv Administrator Comments
County Administrator Greg Murray reminded the Commissioners to advise Executive
Office Assistant Katie Yoder of calendar events and invitations they receive so that a
record is kept and attendance may be coordinated.
COMMISSIONERS REPORTS AND COMMENTS
Commissioner Cline thanked the Town of Smithsburg for hosting last week's
Commissioners meeting. He missed the meeting due to the passing of friends Jimmy Sease
and Betty Baker. Mr. Cline attended the grand opening of the new swimming pool at the
Best Western Grand Venice Hotel. He noted that the Disabilities Advisory Committee is
planning for Disability Awareness Month in October. He reported on a business forum
held in Hancock and business outreach at BJ's Custom Creations, Commissioner Cline
welcomed young government officials from Leningrad to Washington County. He was
present at the "Relay for Life" cancer fundraiser. Mr. Cline attended the grand opening of
the UPS store at Valley Storage on the Leitersburg Pike which proceeds benefitted the
March of Dimes "March for Babies" event. He visited the fishing rodeo sponsored by

MINI at Pangbom Park and attended an Eagle Scout ceremony for Ronnie Dagenhart at
Downsville Christian Church. Commissioner Cline was in downtown Williamsport for the
"Tour of Washington County" bicycle race.
Commissioner Callaham also attended the Eagle Scout ceremony for Ronnie Dagenhart.
She attended the Civil War Ball kickoff event for the Civil War exhibit at the Washington
County Museum of Fine Arts. She attended the Humane Society of Washington County's
LuHowl and the Hancock business forum. Commissioner Callaham was present at a
Commission on Aging board meeting and business outreach tour of BJ's Custom
Creations. She described a pancake breakfast and fly -in at the Hagerstown Regional
Airport sponsored by the Experimental Aircraft Association. Ms. Callaham congratulated
the Grand Venice Hotel on the new swimming pool and the center's renaissance.
Commissioner McKinley thanked the Town of Smithsburg for hosting the informative
meeting of the Commissioners last week. He attended the Chamber of Commerce "Eggs
and Issues" breakfast where City Economic Development Manager Jill Estavillo presented
information on the proposed downtown Multi -Use Stadium. Mr. McKinley attended the
business forum in Hancock and the annual Economic Development Commission (EDC)
meeting. He announced that the newly elected EDC officers are as follows: Chairman: Dan
Pheil, Vice Chairman: Andy Sargent, and Secretary: Jef Bohn. Executive Board members
are Mike Zampelli, Stuart Mullendore, and Paul Crampton, Jr. Mr. McKinley
complimented the owners of BJ's Custom Creations for their successful business after
touring it last week. He reported on a visit and tour of the local Volvo Powertrain facility
with EDC Deputy Director Rob Ferree to discuss issues and plans of the company. He
stated that Volvo would like to meet with the Commissioners at a future meeting at the
local Volvo plant. Commissioner McKinley also enjoyed the Civil War Ball kickoff event
and the Eagle Scout ceremony for Ronnie Dagenhart.
Commissioner Baker reported on a Recreation and Parks Advisory Board meeting. He
attended a Social Services Board dinner to honor outgoing Chair Delores Harmon and
announced that Dave Pool would serve as the new Chair. Mr. Baker discussed the EDC
annual meeting and thanked outgoing board members for their contributions. He toured
BJ's Custom Creations and thanked EDC staff for the outstanding job done to set up visits
with local businesses. He also thanked the Town of Smithsburg for hosting the
Commissioners' meeting last week.
PROPOSED REPEAL. ENACTMENT. AND ADOPTION OF VARIOUS
ORDINANCESIRESOLUTIONS RELATING TO BUILDING/TRADE CODES
AND FEE SCHEDULES RELATING TO CIVIL CITATIONS AND COLLECTION
OF PERMITTING FEES
Jennifer Smith, Director, and Angela Smith, Deputy Director, Plan Review and Permitting,
distributed comments received during and after the June 5, 2012 Public Hearing to
consider the repeal, enactment, or adoption of the various codes, ordinances, or resolutions.
Jennifer Smith discussed with the Commissioners alternative language proposed for the
agricultural structure occupancy definition in the 2012 International Building Code. It was

the consensus of the Commissioners to approve the language submitted by Attorney Jason
Divelbiss on behalf of four farming community clients, as follows:
"No. 14 is added and shall read as follows:
14. A building or structure associated with an agricultural operation, and the primary use
of which is (i) the production, storage, distribution or sale of products associated with
Agriculture; (ii) the keeping, grazing, breeding, or feeding of animals; or (iii) the storage,
repair or maintenance of vehicles, equipment, tools or materials associated with
Agriculture. The presence of bathrooms, office space or similar accessory use areas within
a building or structure shall not disqualify it from the building permit exemption so long as
the primary use of the building or structure meets one or more of the above criteria.
However, any building or structure intended for use as a residential dwelling unit, in whole
or in part, shall not be exempt from the building permit requirement.
SECTION 202, DEFINITIONS:
The following definitions are added and shall read as follows:
AGRICULTURE. The raising of farm products for use or sale, including animal or
poultry husbandry, animal husbandry facilities, aquaculture, and the growing of crops such
as grain, vegetables, fruit, grass for pasture or sod, trees, shrubs, flowers and similar
products of the soil. (Directly from Art. 28A of the Zoning Ordinance for Washington
County, Maryland)
AGRICULTURAL OPERATION. Any parcel of land that has an agricultural assessment
as determined by the Maryland State Department of Assessments and Taxation."
Commissioner McKinley, seconded by Cline, moved to:
1) Repeal the 2009 Maryland Building Performance Standards, with local amendments
(i.e. the International Building Code, with local amendments, the International Residential
Code, with local amendments, and the International Energy Conservation Code, 2009
Editions); and
2) Enact the 2012 Maryland Building Performance Standards, with local amendments (i.e.
the International Building Code, the International Residential Code, the International
Energy Conservation Code, 2012 Editions.)
The motion passed unanimously.
Commissioner Cline, seconded by McKinley, moved to:
3) Repeal the 2009 International Plumbing Code, with local amendments, the 2009
International Mechanical Code, with local amendments, and the 2009 International Fuel
Gas Code, with local amendments; and
4) Enact the International Plumbing Code, 2012 Edition; the International Mechanical
Code, 2012 Edition, and the International Fuel Gas Code, 2012 Edition, all with local
amendments.
The motion passed unanimously.
Commissioner Callaham, seconded by Cline, moved to:
5) Repeal the 2008 National Electrical Code, with local amendments; and
6) Enact the 2011 National Electrical Code, with local amendments;

CONVENE IN CLOSED SESSION
Commissioner Cline, seconded by Callaham, moved to convene in closed session at
3:12 p.m. to discuss the appointment, employment, assignment, promotion, discipline,
demotion, compensation, removal, resignation, or performance evaluation of appointees,
employees, or officials over whom this public body has jurisdiction or any other personnel
matter that affects one or more specific individuals; consider a matter that concerns the
proposal for a business or industrial organization to locate, expand, or remain in the State;
consult with counsel to obtain legal advice on a legal matter; discuss public security,
including (i) the development of fire and police services and staff; and (ii) the development
and implementation of emergency plans, in accordance with Sections 10-508(1),(4),(7),
and (10) of the State Government Article of the Annotated Code of Maryland. The motion
passed unanimously. (Commissioner Barr was absent from the meeting.)
In closed session, the Commissioners discussed the potential appointment/reappointment
of certain individuals to several County boards; the potential appointment of an individual
to a County commission; issues relating to a company's proposal/plan (including a request
for incentives) to locate in the County; and the status and development of certain fire
services and staff in Washington County (10), in accordance with Sections 10-508(1), (4),
(7), and (10).
During Closed Session, the Commissioners directed Staff to schedule the proposed
appointments/reappointments for a future open session discussion. The Commissioners
also provided Staff with direction/parameters relating to the continued discussions with a
company hoping to locate in the County and further directed Staff to meet with
representatives of the Fire and Rescue Association to discuss ongoing issues relating to fire
and rescue services in the County.
Present during closed session were Commissioners Terry L. Baker, Ruth Anne Callaham,
