HomeMy WebLinkAbout11.05.2011 MinutesBOARD OF COUNTY COMMISSIONERS OF WASHINGTON COUNTY Hagerstown, Maryland November 15, 2011 JOINT MEETING WITH WASHINGTON COUNTY BOARD OF EDUCATION The Board of County Commissioners met with the Board of Education in Room 255 of the County Administration Building located at 100 West Washington Street, Maryland. County Commissioner President Terry L. Baker called the joint meeting to order at 8:36 a.m. In attendance were Commissioners Ruth Anne Callaham, Jeffrey A. Cline, and William B. McKinley. Board of Education members present were Wayne Ridenour, Paul Bailey, Justin Hartings, Karen Harshman, and Donna Brightman, FISCAL YEAR 2013 CAPITAL IMPROVEMENT PROGRAM REQUEST Boyd Michael, Deputy Superintendent, and Rob Rollins, Director of Facilities, Washington County Public Schools, presented the Fiscal Year 2013 (FY2013) Capital Improvement Program (CIP) request to the County Commissioners. Mi•. Michael stated that the $15.8 million CIP includes funding requests for necessary capital maintenance projects and the Ruth Ann Monroe Primary School, Bester Elementary School, and "West City" Elementary School. The FY2013 CIP request mirrors and supports the WCPS State FY 2013 request. Mr. Michael discussed needed improvements to current schools and recommended the acquisition of land now for future school needs. The Commissioners discussed the information provided with those present, including Superintendent of Schools Dr. Clayton M. Wilcox. RECESS The Commissioners recessed at 9:08 a.m. President Terry L. Baker called the regular meeting of the Board of County Commissioners to order at 10:03 a.m. with the following members present: Commissioners Ruth Anne Callaham, Jeffiey A. Cline, and William B. McKinley. (Vice President John F. Barr was absent fi•om the meeting.) INVOCATION AND PLEDGE OF ALLEGIANCE President Baker gave the Invocation followed by the Pledge of Allegiance to the Flag by the full assemblage. APPROVAL OF MINUTES —November 8.2011 Commissioner Callaham, seconded by McKinley, moved to approve the minutes of November 8, 2011. The motion passed unanimously. COMMISSIONERS REPORTS AND COMMENTS Commissioner Callaham commented that she enjoyed the Country Breakfast fundraiser at the Agricultural Education Center on Saturday. She announced that an oral history presentation would be held on December 2 fiom 6:00-9:00 p.m. at the Rural Heritage November 15, 2011 Page 2 Museum. Ms. Callaham attended a Historical Advisory Committee meeting where members discussed the reuse of historic buildings. She attended a Commission for Women Board meeting. Commissioner Callaham discussed several Veterans Day activities that she attended and recognized the fact that many women have served in the military over the history of our country. Commissioner Cline attended a meeting of the Disabilities Advisory Committee. He was present at a joint meeting of the local Delegation and Washington County Volunteer Fire and Rescue Association (WCVFRA) to discuss funding issues. Mr. Cline commented on several Veterans Day events that he attended and thanked all veterans for their service. He enjoyed the Agricultural Education Center's Country Breakfast last week. Commissioner Cline discussed a Health Seminar at Hagerstown Community College (HCC) given by Dan Hawthorne. He reported meeting with State Planning Secretary Richard Hall to discuss the P1anMaryland document. Commissioner Cline encouraged the Commissioners to visit Parker Plastics on November 23 with EDC members as part of an ongoing business retention program. Commissioner McKinley commented on women in the military, noting that his aunt served as a full Colonel in the Medical Corps. He discussed last week's meeting with local delegation members and business leaders in the community who shared valuable information. Mr. McKinley attended an EDC Board meeting where members discussed multiple topics including the Revolving Loan Fund. He was present at a meeting of the Hagerstown Regional Airport Commission and stated that staff continues to work on acquiring a carrier for southern destinations. Commissioner McKinley attended the meeting between WCVFRA and Delegation members and also several Veterans Day events. He commented on two recent Maryland Symphony Orchestra programs that were excellent. He congratulated Smithsburg High School student and 4-H member Shane Heizer for winning Supreme Champion Heifer and Reserve Champion Heifer at the Maryland State Fair this year. Commissioner Baker attended a meeting of the EDC Board. He also attended the meeting with Delegation members and the WCVFRA and thanked Delegate Andrew Serafrni and WCVFRA President Glenn Fishack for their work done on behalf of their organizations. He enjoyed a presentation of "A Visit with Mr. Lincoln" by Jim Getty at the Golden Living Center in Hagerstown. Mr. Baker stated that a coach at McDaniel College, who would like to bring a Division 3 cross-country meet and golfing events to Washington County, had contacted Jim Sterling, Director of the Parks, Recreation, and Facilities Department. Commissioner Baker discussed the meeting with Secretary Richard Hall and State Planner Charles Boyd regarding P1anMaryland. He advised that the document would undergo additional changes before being forwarded to the Governor, who may sign it, delay it, or take it through the legislative process. Commissioner Baker thanked all veterans for their service and stated that his father was present at the Normandy invasion. November 15, 2411 Page 3 CONTRACT AWARDS FOR GASOLINE AND DIESEL FUEL DELIVERIES Rick Curry, Buyer, Purchasing Dcpailment, recommended to award the Gasoline and Diesel Duel Deliveries (PUR 1166) contracts to the responsive, responsible bidders who submitted the lowest bids as follows: 1) Contract for gasoline and diesel tank wagon deliveries to A. C. & T. Company, Inc. of Hagerstown, Maryland at the unit prices stated in its bid; 2) Contract for diesel transport deliveries to Mansfield Oil Company of Gainesville, Georgia at the unit prices stated in its bid; and 3) Contract for gasoline transport deliveries to Petrolcum'1'raders Corporation, of Foil Wayne, Indiana at the unit prices stated in its bid. Mr. Curry discussed the requirements contracts, stating that the County guarantees neither a maximum nor a minimum quantity. He provided specifics of the contracts and stated that the terms are for one-year with no option to renew. Commissioner McKinley, seconded by Callaham, moved to award the bids for Gasoline and Diesel Fuel Deliveries as presented. The motion passed unanimously. REJECTION OF BID — UNIFORM RENTAL SERVICE FOR VARIOUS. WASHINGTON COUNTY DEPARTMENTS AND EXTENSION OF EXIS'T'ING, CONTRACT Rick Curry, Buyer, Purchasing Department, presented the recommendation to reject all bids for Uniform Rental Service for Various Washington County Departments (PUR-1167) and extend the existing contract with Coyne Textile Services of Colonial Heights, Virginia, in the best interest of the County. Mr. Curry provided details on the one bid received from Unifirst of Winchester, Virginia, which was deemed non-responsive due to several issues. He discussed the current contract rates and further indicated that the contract could be extended and the project rebid. The Commissioners discussed the bid process with Mr. Curry. Commissioner Cline, seconded by McKinley, moved to accept the recommendation to reject all bids for PUR-1167 and extend the existing contract with Coyne Textile Services of Colonial Heights, Virginia at the cut -rent rates and to rebid the contract, as presented. The motion passed unanimously. CITIZENS PARTICIPATION Gerry Ditto, 14736 Ditto Road, Clear Spring, reconimended that a person from the agricultural community serve on the EDC Board. Ile also commented on the Urban Growth Area (UGA) rezoning surrunary provided by Stephen Goodrich and distributed an alternative plan. OTHER BUSINESS County Administrator County Administrator Greg Murray stated that each year, the Maryland Association of Counties' (MACo) Legislative Committee requests that each member county recommend a Conunissioner representative and alternate to serve on the Conunittec. He advised that the November 15, 2011 Page 4 current representatives are Commissioner Barr and Commissioner Cline respectively. Mr. Murray stated that Commissioner Barr had indicated his desire to serve again. Commissioner Cline agreed to serve as alternate. Commissioner McKinley, seconded by Callaham, moved to recommend that Commissioner Barr serve as MACo's Legislative Committee representative and Commissioner Cline as the alternate. The motion passed unanimously. Mr. Murray advised of a request from the Hagerstown -Washington County Convention and Visitors Bureau (CVB) for one or more Commissioners to present a proclamation during an event honoring Congressman Roscoe Bartlett on Tuesday, November 22. Mr. Murray stated that a presentation on broadband resources in Washington County would be held on November 17. He indicated that Sheriff Doug Mullendore has compiled figures for review regarding a Day Reporting Center before a scheduled meeting on November 18. Mr. Murray noted that the Capital Budget cycle preparation is now in progress and the Commissioners would see document drafts within the next month. RECESS The Commissioners recessed at 11:05 a.m. to tour the Contemporary School of the Arts and Gallery, Inc. at 4 West Franklin Street, Hagerstown. AFTERNOON SESSION President Terry L. Baker called the afternoon session to order at 1:16 p.m. with the following members present: Commissioners Ruth Anne Callaham, Jeffrey A. Cline, and William B. McKinley. CONVENE IN CLOSED SESSION Commissioner McKinley, seconded by Cline, moved to convene in closed session at 1:16 p.m. to consider a matter that concerns the proposal for a business to locate, expand, or remain in the State, in accordance with Section 10-508 of the State Government Article of the Annotated Code of Maryland. The motion passed unanimously. In closed session, the Commissioners considered a matter that concerns the proposal for a business to locate, expand, or remain in the State. Present during closed session were Commissioners Terry L. Baker, Ruth Anne Callaham, Jeffrey A. Cline, and William B. McKinley. Also present were Gregory Murray, County Administrator; Vicki Lumm, County Clerk; John Martirano, County Attorney; and Joe Kroboth, III, Public Works Director. RECONVENE IN OPEN SESSION Commissioner Cline, seconded by Callaham, moved to reconvene in regular session at 1:54 p.m. November 15, 2011 Page 5 FFY 2009 INTEROPERABLE COMMUNICATIONS GRANT PROGRAM, Kevin Lewis, Director of the Division of Emergency Services, requested approval of a change in the FFY 2009 Interoperable Communications Grant Program (iECGP), previously awarded and approved for $97,042.$0. The components cover the expansion of interoperability of the communications system with Washington, Allegany, and Garrett counties (WAGIN Project.) Mr. Lewis stated that the previously approved IECGP award has been modified to include a matching amount of $26,969.91 for expanding equipment purchases throughout western Maryland. Upon approval by the Commissioners, the new FFY09 award would be $124,012.71. The Commissioners discussed the request. Commissioner Callaham, seconded by Cline, moved to authorize the officers of the Board of County Commissioners to execute a Memorandum of Agreement with the Maryland Energy Management Agency to accept $124,012.71 as presented. The motion passed unanimously. URBAN GROWTH AREA COMPREHENSIVE, REZONING — INFORMA`T'ION, AND DISCUSSION Stephen Goodrich, Director of the Planning and Zoning Department, initiated a discussion of the Urban Growth Area Comprehensive Rezoning (UGA) proposals and the data compiled to date. Mr. Goodrich advised that an additional public hearing would be scheduled regarding the UGA before the Comrrrissioners bring it forward for a final vote. He distributed comments received from Geary Ditto during the latest comment period that were not provided in the Commissioners' review notebook. Mr. Goodrich discussed comments received from owners and representatives of certain properties affected by the rezoning proposals and requested direction from the Commissioners. The Commissioners discussed the zoning proposals for those properties and reached a consensus on their preferred zoning recommendations. Commissioner Baker advocated the inclusion of Transferable Development Rights (TDRs) in the UGA. Commissioners McKinley and Callaham expressed their willingness to discuss TDRs at a fixture time but did not want to delay consideration/approval of the UGA because of the TDR discussion. Mr. Goodrich stated that he would compile a list of proposals discussed today, including updated maps, and forward to the Commissioners before the anticipated public hearing tentatively scheduled for December 13 during the Commissioners' regular meeting. WASHINGTON COUN'T'Y FREE LIBRARY—CENTRAL LIBRARY RENOVATION AND EXPANSION ,Toe Kroboth, III, Public Works Director, requested that the Board of County Commissioners execute an Electric Service Agreement with the City of Hagerstown for the Washington County Free Library -Central Library Building. Mr. Kroboth detailed that the City of Hagerstown's Light Department will provide electric power to the new Central Library building on South Potomac Street. As a matter of policy, whenever a customer requires significant construction and infiastructure investment to meet electric service November 15, 2011 Page 6 needs, the City requires the execution of an Electric Service Agreement. He indicated that the base figure of energy to be purchased annually from the City is $19,168.79 and the estimated annual electric costs exceed $100,000.00, therefore, the minimum will be exceeded. Commissioner McKinley, seconded by Cline, moved to authorize the Board of County Commissioners to execute the Electric Service Agreement with the City of Hagerstown for the Washington County Free Library -Central Library Building. The motion passed with Commissioners McKinley, Cline, and Baker "AYE" and Commissioner Callaham "ABSTAIN."
