PUBLIC HEARING — MAP AMENDMENT APPLICATION (RZ-11-001)
A Public Hearing of the Board of County Commissioners of Washington County,
Maryland was convened at 7:05 p.m. at Courtroom No. 1, Washington County Circuit
Coma, 95 West Washington Street, Hagerstown, to hear testimony on Zoning Map
Amendment Application (RZ-11-001) regarding property owned by Holcim (US) Inc.,
containing 120.11 acres, located on both sides of Old Forge Road, southwest of Herman
Myers Road, and adjacent to the north side of other lands of Holcim. The Application
requests a rezoning change of the above-described property from Agriculture (Rural) to
Agriculture (Rural) with an Industrial Mineral Overlay. Present were County
Commissioners President Terry L. Baker and Commissioners Ruth Anne Callaham, Jeffrey
A. Cline, and William B. McKinley, County Staff present were Steve Goodrich, Chief
Planner and Interim Director -Planning and Zoning Department; Kirk C. Downey, Assistant
County Attorney; Greg Murray, County Administrator; and Vicki Lurnm, County Clerk.
Ivir. Downey reviewed the procedures for the Public Hearing and advised that no further
evidence or testimony would be admitted after the conclusion of the hearing. County Clerk
Vicki Lumm administered the oath to those who planned to give testimony.
Steve Goodrich introduced the Planning Commission file into the record and presented
staff reports regarding the Application. Mr. Goodrich indicated that the Planning
Commission recommended approval of the Application during its meeting on June 6,
2011, stating that the applicant had adequately addressed the items required by the
Washington County Zoning Ordinance and that the request is logical, appropriate, and
consistent with the County's Comprehensive Plan. The Commissioners discussed several
items with Mr. Goodrich.
Attorney John H. Urner, 207 South Potomac Street, Hagerstown, presented the case for
Zoning Map Amendment RZ-11-001, on behalf of the Applicant. He stated that Holcim
had met its requirements for approval of the rezoning request. Mr. Urner entered Exhibit
#5 into evidence.
The public hearing was opened for comment. There were no individuals present who
wished to testify in favor of the Application.
Herman Stockslager of 20122 Old Forge Road, Hagerstown, testified against the rezoning
Application.
Attorney Urner presented a rebuttal on behalf of the Applicant. He offered Exhibit #8 into
evidence and described the eight Exhibits entered into the record thus far: Exhibit #I -
Application, Exhibit #2 - Lyke supplemental letter — Tab 9, Exhibit #3 - Posting photos for

memo dealing with, among other things, rebuttal, items found in the Planning Commission
Record, Review of Staff Comments, Exhibit #7 — Planning Commission Recommendation
of June 6, 2011; and Exhibit #8 — Reclamation Plan — to show what Application Tab 7
drawing connects to.
The Commissioners discussed several items with John Urner and Kirk Downey. Nh•.
Downey advised that the Applicant would have ten days to submit argument.
The public hearing was recessed at 8:18 p.m.
