The Regular Meeting of the Board of County Commissioners of Washington County was
called to order at l0:00 a.m. by the President, Ronald L. Bowers, with the
following members present: Vice President Richard E. Roulette, and Commissioners
R. Lee Downey, Linda C. Irvin and Martin L. Snook.
INVOCATION AND PLEDGE OF ALLEGIANCE
The Invocation was delivered by Ted Wolford, Superintendent of the County Roads
Department, followed by the Pledge of Allegiance to the Flag by the full
assemblage.
VISIT FROM MISS MARYLAND
Lori Ann Windsor, Miss Maryland for l988, and Pat Skebeck representing the Board of
Directors of the Miss Maryland Pageant, met with the Commissioners to thank them
for their support of the Pageant. Commissioner Bowers wished Miss Windsor success
in her reign as Miss Maryland and good luck at the Miss America Pageant in Atlantic
City.
SANITARY COMMISSION - CONOCOCHEAGUE WASTEWATER TREATMENT PLANT
William Ryan, Sanitary Commission Board Member, and Lynn Palmer, Executive Director
of the Sanitary Commission, appeared before the Commissioners to request their
approval of the design engineering firm for the proposed Conococheague Wastewater
Treatment Plant. The Sanitary Commission has negotiated a contract for $500,000
with Buchart-Horn which also includes running an interceptor line from the existing
plant to the Conococheague plant. Mr. Palmer stated that the Sanitary Commission
approved this contract with Buchart-Horn at its meeting on July 25 subject to
approval of advance funding and approval by the County Commissioners.
MOTION made by Commissioner Roulette, seconded by Irvin to support the Sanitary
Commissions' award of the contract for the Conococheague Wastewater Treatment Plant
design to Buchart-Horn in the amount of $500,000 which will include running an
interceptor line from the existing plant to the new Conococheague Wastewater
Treatment Plant. Unanimously approved.
DISCUSSION OF PROPOSED NORTHERN AVENUE ANNEXATION
Josephine Morrow, acting as spokesperson for the group of citizens who oppose the
annexation of Northern Avenue by the City of Hagerstown, appeared before the
Commissioners and stated that the residents of this area are satisfied with the
quality of services received by the County for maintenance, snow removal, etc. on
Northern Avenue and that they do not want the roadway to be annexed by the City.
Ms. Morrow also presented a petition in opposition to the proposed annexation and
asked the Commissioners to reconsider this decision.. Those in attendance
expressed the opinion that they would not have adequate representation since they
are County residents and the City government would have control of the roadway.
Another concern is that the City may add an additional lane to Northern Avenue
which would route additional traffic to that area.
Barry Teach, County Administrator, explained that a committee appointed to study
the Northern Avenue area recommended that one governmental body have jurisdiction
over this roadway. Since the major portion of the road is owned by the City and it
is reasonable for the City Police to have authority to enforce the law on the
entire length of Northern Avenue, the Commissioners requested that the City
government exchange the portion of the roadway owned by the County for the section
of Eastern Boulevard from Jefferson Boulevard to Long Meadow Road owned by the
City.
The matter was taken under advisement at this time.
INTENTION TO CONVEY PROPERTY
Motion made by Commissioner Roulette, seconded by Snook to convey 4.38 acres of
land, located 400' west of Hancock High School, for $2,000 per acre, to Fleetwood
Travel Trailers of Maryland as advertised and to convey at no consideration .369
acres +/- located on the southeast corner of Irvin Avenue and St. Clair Street, as
advertised to the Washington County Student Trades Foundation, Inc. Unanimously
approved.
REVIEW OF HOTEL/MOTEL TAX REMITTANCE FORMS
James Young, Director of Finance, reviewed the Remittance Form and Penalty form
proposed for use in reporting the hotel/motel taxes. The form and remittance must
be submitted to the Washington County Treasurer's office by the 25th day of each
month, less an expense credit of l l/2% if paid by the due date, or a penalty of l%
will be assessed. The Commissioners instructed the County Administrator to set up
a public hearing for mid-September.

COUNTY FLAG ORDER
The Commissioners instructed Paulette Sprinkle, Community Coordinator, to bid a
total of 250 County flags, l50 - outdoor flags and l00 - indoor flags.
BID OPENING - HUMP ROAD IMPROVEMENTS
The bids for the improvements to Hump Road were publicly opened and read aloud.
The following firms and their proposals were as follows: P & W Excavating -
$303,55l; E. F. Goetz & Son - $354,78l.50; Hetzer, Inc. - $29l,l38; and Craig
Blacktop and Paving - $276,l34.50. The bid for these improvements includes
widening on one side of the road plus additional paved shoulders, installation of a
water line and construction of a small access road to the north. The bids will be
reviewed by appropriate officials prior to a decision being rendered.
BID OPENING - DEMOLITION OF STRUCTURES - l823 WEST WASHINGTON STREET
The bids for the demoliton of structures located at l823 West Washington Street
were publicly opened and read aloud. The following firms and their proposals were
as follows: Callas Contractors - $7,5l4 and John Merrbaugh - $6,500. The bids
will be reviewed by appropriate officials prior to a decision being rendered.
RZ-375 UPDATE - DILLER PROPERTY
Dick Keeley, developer for the Diller property, appeared before the Commissioners
to inform them that he has not been able to get a response from Mr. Schroeder who
owns several lots on Mesa Terrace near the area where Mr. Keely's cleint will be
constructing a planned unit development. Mr. Keely asked that the Commissioners
delete the contingency that the developer be responsible for improvement of the
road and extension of public facilities on Mesa Terrace.
Motion made by Commissioner Roulette, seconded by Snook to rescind the condition
attached to Rezoning Case RZ-375 that the developer be required to have Mesa
Terrace improved to County standards and extend public facilities, and providing
that the property owners would be responsible for these improvements. Unanimously
approved.
RECESS
The Meeting was recessed at ll:30 a.m. for lunch and a tour and presentation at the
Maryland Theatre.
AFTERNOON SESSION
The Afternoon Session was convened at l:00 p.m. by the President Ronald L. Bowers
with the following members present: Vice President Richard E. Roulette and
Commissioners R. Lee Downey, Linda C. Irvin and Martin L. Snook.
CONVENE IN EXECUTIVE SESSION
Motion made by Commissioner Irvin, seconded by Snook to convene in Executive
Session at l:l5 p.m. in regard to personnel, property and potential litigation in
accordance with Section l0.508 of the State Government Article Annotated Code of
Maryland. Unanimously approved.
At this time Commissioner Bowers was excused from the Meeting and Vice President
Roulette assumed the Chair.
RECONVENE IN REGULAR SESSION
Motion made by Commissioner Downey, seconded by Irvin to reconvene in Regular
Session at 3:30 p.m. Unanimously approved.
REZONING CASE RZ-388
Motion made by Commissioner Snook, seconded by Irvin to call the Question on the
Motion tabled at the Meeting of July 20, l988, and APPROVE rezoning text amendment
RZ-388 as advertised and as recommended by the Planning Commission. Unanimously
approved.
The Commissioners also agreed to readvertise and hold a special hearing amending
the the Zoning Ordinance by making a travel plaza a special exception in the
current HI District.
REQUEST FOR QUIT CLAIM DEED
The Commissioners agreed to advertise for a quit claim deed as requested by
property owners at Dual Place with the condition that the property owners be
responsible for the cost of legal work and advertisement.

REQUEST FOR PROPERTY TAX CREDIT - NEWLY CONSTRUCTED DWELLING
Motion made by Commissioner Irvin, seconded by Downey to approve of a request for a
property tax credit for a newly constructed and unoccupied dwelling unit located on
the west side of Mar Rock Drive by Merle and Anna Holland in the amount of
$ll56.ll. The Motion carried with Commissioners Roulette, Irvin and Downey voting
"AYE" and Commissioner Snook "ABSTAINING".
LEASE - DISTRICT COURT
Motion made by Commissioner Irvin, seconded by Snook to approve extending the lease
with the State of Maryland for the District Court Office at 35 West Washington
Street for five years for $8.50/square ft. for the first year plus a 5% increase
per year for the remaining four years. Unanimously approved.
ADJOURNMENT
Motion made by Commissioner Irvin, seconded by Downey to adjourn at 3:50 p.m.
Unanimously approved.
