The Regular Meeting of the Board of County Commissioners of Washington County was
called to order at 9:00a.m. by the President, Ronald L. Bowers, with the following
members present: Vice President Richard E. Roulette, and Commissioners R. Lee
Downey and Linda C. Irvin.
INVOCATION AND PLEDGE OF ALLEGIANCE
The Invocation was delivered by Commissioner Bowers, followed by the Pledge of
Allegiance to the Flag by the full assemblage.
PROCLAMATION - NATIONAL REACT MONTH
Motion made by Commissioner Downey, seconded by Irvin to proclaim the month of
November l987 as National React Month in Washington County and strongly urge all
citizens to recognize the significant contributions the local REACT Teams make to
the welfare of this community. Unanimously approved.
INVITATION TO TEACH - WASHINGTON COUNTY TEACHERS ASSOCIATION
Sherry Koons, representing the Washington County Teacher's Association, appeared
before the Commisisoners to invite them to teach a class during the week of
November l5-2l in recognition of American Education Week and presented each
Commissioner with an apple.
BOND ISSUE - ADOPTION OF RESOLUTION
Jeff Palkovitz from the firm of Miles & Stockbridge, the County's Bond Counsel, and
Victor Dates, Financial Advisor, representing Baker Watts & Company, appeared
before the Commissioners to present the Bond Resolution for their adoption.
Motion made by Commissioner Roulette, seconded by Downey to adopt the Bond
Resolution as proposed, authorizing and empowering the County Commissioners to
issue and sell at public sale, upon its full faith and credit, its General
Obligation Serial Bonds in the aggregate principal amount of $6,000,000 to be known
as the Washington County, Maryland Public Facilities Bond of l987. Unanimously
approved.
MID-EAST MILK LAB- REQUEST LEGISLATION FOR TAX EXEMPTION
Gene Long, representing the Mid-East Milk Lab, located at the Water Pollution
Control plant appeared before the Commissioners to request that they ask the
Delegation to the General Assembly to consider sponsoring legislation to give tax
exempt status to community service and educational organizations. The
Commissioners directed the County Attorney to evaluate this request before adding
it to the list of requested legislation changes.
APPOINTMENT - MENTAL HEALTH ADVISORY BOARD
Motion made by Commissioner Downey, seconded by Roulette to appoint William Wantz
to the Mental health Advisory Board to fill the unexpired term of Judge Glaser
which extends to June 30, l988. Unanimously approved.
BOARD/COMMISSION REPORTS
Commissioner Roulette reported on the Planning Commission meeting, Commissioner
Downey gave a report on the United Way Budget Committee meeting and requested that
a letter be sent to County employees urging them to conribute to the United Way,
and Commissioner Irvin reported on the Airport Commission meeting.
LIVABILITY CODE - HOUSING
Neil Curran, County Housing & Community Development Director, and David Hammerman,
representing the State Department of Housing & Community Development, appeared
before the Commissioners to compare the BOCA National Code regarding housing and
the State Model Code for housing. The Commissioners will have to decide which code
they will implement as the County housing livability code. After discussion, the
Commissioners asked that Mr. Curran and Paul Prodonovich, Zoning Administrator,
study the two codes and make a recommendation to the Commissioners.
SANITARY COMMISSION ANNUAL REPORT
Lynn Palmer, Executive Director, Louise Fahrney, Vice Chairman of the Sanitary
Commission, and Commission members William Winebrenner, William Ryan, and Paul
Waggoner along with Gerrianne Hammond, Secretary/Treasurer, appeared before the
Commissioners to present the Sanitary Commission's Annual Report and to present the
Commissioners with two checks - one in the amount of $l0,607 representing complete
payment of the Maugansville/Orchard Hills project and the second check in the
amount of $40,000 which was part of an advance which the Commissioners provided for
the Highfield project, leaving a balance of $20,800 for Highfield. Mr. Palmer then
highlighted the status of each Sanitary Commission subdistrict in his annual
report.

l987 BOCA PLUMBING CODE - ADOPTION
After due consideration of the matters and facts adduced at the public hearing held
on October l3, l987, and having received no comments regarding this, a MOTION was
made by Commissioner Roulette, seconded by Downey to adopt the l987 BOCA National
Plumbing Code with amendments, as requested by the Commissioners, as the County's
Plumbing Code to become effective December l, l987.
CLOSING OF ANTIETAM DRIVE RAILROAD CROSSING
The County Attorney, David K. Poole, Jr., informed the Commissioners of a letter
which was received by the Engineering Office reminding the County that they agreed
to barricade the railroad crossing at Antietam Drive upon the completion of Eastern
Boulevard. Mr. Poole then advised the Commissioners that due to this l985
agreement, the County is obligated to comply with the terms and to barricade the
railroad crossing. Mr. Poole also stated that in his opinion, since a public
hearing was held on August 4, l987, regarding this, another public hearing would
not have to be held.
Motion made by Commissioner Downey, seconded by Irvin to proceed with closing of
the railroad crossing at Antietam Drive as mandated by the l985 agreement between
the County government and CSX, Inc., and to install a barricade, as recommended by
the County Attorney. Unanimously approved.
LINE ITEM TRANSFER - RECREATION COMMISSION
Motion made by Commissioner Downey, seconded by Roulette to approve the transfer of
$600 from Program Equipment (77-488-000) to Office Equipment (77-487-000) as
requested by the Recreation Commission. Unanimously approved.
MARYLAND CONSERVATION CORP APPLICATION
Motion made by Commissioner Irvin, seconded by Downey to authorize the submission
of an application to the Maryland Conservation Corp for additional construction of
a boardwalk and observation deck at Mt. Briar Wetland Preserve and stabilization
work and upgrading of the nature trail at Devil's Backbone Park for l988.
Unanimously approved.
PRIVATE ROADWAY POLICY - RIGHT-OF-WAY
Motion made by Commissioner Roulette, seconded by Irvin to to expand the policy
regarding private roads to require that a survey plat, prepared by a licensed
surveyor or engineer, be submitted along with the deed showing the location of the
existing roadway. Unanimously approved.
BRIGHTWOOD ACRES EAST - SURETY
Motion made by Commissioner Downey, seconded by Roulette to accept a certified
check in the amount of $2500 as surety posted by Plummer Construction for a portion
of Eastwood Drive, Cherry Hill Drive and Pinewood Circle and Boxwood Circle,
located in the Brightwood Acres East subdivision. Unanimously approved
FUEL OIL, MOTOR AND INDUSTRIAL OILS - BID AWARD
Motion made by Commissioner Downey, seconded by Roulette to award the bids to the
following firms who submitted the low bids meeting specifications: Gasoline -
A.C.& T - $118,537; Diesel and Kerosene - A.C.& T. - $146,463.04; and Motor and
Industrial Oil - Southern States - $18,547.56. Unanimously approved.
BID AWARDS - HIGH GERMANY AND WOODMONT BRIDGES
Motion made by Commissioner Downey, seconded by Roulette to award the bid for the
repair of High Germany Road Bridge to WOCAP Energy Resources for their low bid of
$27,935 and to award the bid for the replacement of the Woodmont Road Bridge to
Building Systems, Inc. who submitted the low bid of $56,770. Unanimously approved.
REQUEST FOR ADDITIONAL FUNDING - HJC ATHLETIC/RECREATION CENTER
The County Commissioners considered the request made by Hagerstown Junior College
for an additional appropriation for this fiscal year of $260,000 to help cover
design fees for the athletic/recreation center. After discussion of funding for
the center, the Commissioners requested that a meeting be scheduled with HJC
officials on November 5 prior to the scheduled meeting with the Delegation.
CONVENE IN EXECUTIVE SESSION
Motion made by Commissioner Irvin, seconded by Downey to convene in Executive
Session at l2:30 p.m. in regard to personnel matters in accordance with Section
l0.508 of the State Government Article of the Annotated Code of Maryland.
Unanimously approved.

RECONVENE IN REGULAR SESSION
Motion made by Commissioner Irvin, seconded by Downey to reconvene in Regular
Session at l2:30 p.m. Unanimously approved.
JUDGE WRIGHT - FUTURE NEED FOR ADDITIONAL JUDGE
Circuit Court Administrative Judge Fred Wright appeared before the Commissioner to
present statistics compiled by the State Circuit Court system which concludes that
3.7 judges are needed for Washington County. Judge Wright informed the
Commissioners that the case load is manageable at present, but if the trend of
increasing case loads continue and if there is a 20% increase in inmate population
as is planned, a fourth Circuit Court Judge will be needed; this will require
additional court rooms, office space, machinery and personnel. Commissioner Bowers
suggested that a committee be appointed to discuss the County's need for space and
short-term goals.
EMPLOY PART-TIME FIRE & RESCUE TECHNICIAN
Motion made by Commissioner Downey, seconded by Roulette to employ Keith Bowen as a
Part-time Fire & Rescue Technician to fill an existing vacancy. Unanimously
approved.
EMPLOY PART-TIME SUBSTITUTE BUS OPERATOR
Motion made by Commissioner Roulette, seconded by Downey to employ Alvin Lynn, Sr.,
Pauline Rohrer, John Guyer and Roy Watts as a Part-time Substitute Bus Operator at
the County Commuter to fill existing vacancies. Unanimously approved.
EMPLOY FULL-TIME MAINTENANCE ASSISTANT
Motion made by Commissioner Roulette, seconded by Irvin to employ David E. Davis as
a full-time Maintenance Assistant at the County Commuter to fill an existing
vacancy. Unanimously approved.

Motion made by Commissioner Roulette, seconded by Downey to adjourn at l:30 p.m.
