HomeMy WebLinkAbout870825 August 25, l987 Hagerstown, Maryland 21l740 The Regular Meeting of the Board of County Commissioners of Washington County was called to order at l0:00 a.m. by the President, Ronald L. Bowers with the following members present: Vice President Richard E. Roulette and Commissioners R. Lee Downey and Linda C. Irvin. INVOCATION AND PLEDGE OF ALEGIANCE The Invocation was delivered by Walter Bell, C & P Government Liaison Representative, followed by the Pledge of Allegiance to the Flag by the full Assemblage. PROCLAMATION - ASSOCIATION FOR RETARDED CITIZENS 35TH ANNIVERSARY Motion made by Commissioner Irvin, seconded by Downey to present a proclamation in celebration of the Association for Retarded Citizens 35th anniversary and to commend them for their continuous devotion to a better community. Unanimously approved. REQUEST FOR POLICE SERVICE - AIR SHOW Motion made by Commissioner Downey, seconded by Roulette to approve of funding overtime expenses for Sheriff's Department deputies to handle traffic control off site for the Greater Hagerstown Air Show on September l2 and l3, l987 in a amount up to $ll77 with the Air Show to pay any overtime expenses needed for additional deputies on the Airport grounds. Unanimously approved. APPROVAL OF MINUTES -JULY 28, l987 Motion made by Commissioner Downey, seconded by Irvin to approve the minutes of July 28, l987 as submitted. Unanimously approved. "ON BEHALF OF" PROGRAM ALLOCATION - HOUSING Motion made by Commissioner Roulette, seconded by Irvin to approve the recommendation of the Housing & Community Development Director to designate the $2,l49,088 allocated to Washington County from the State of Maryland to be used for the Mortgage Purchase Program. Unanimously approved. LAND PRESERVATION AND RECREATION PLAN After due consideration of the matters and facts adduced at the public hearing held on August ll, l987 and since no written comments were received within the ten day period, a MOTION was made by Commissioner Roulette, seconded by Downey to approve the Land Preservation and Recreation Plan, which is part of the Comprehensive Plan, as submitted, and to incorporate the amendment of a soccer field at the Board of Education school complex in Boonsboro into the Plan. Unanimously approved HIGHWAY INTERCHANGE STUDY Jack Hawbaker, Executive Director of the Planning Commission, presented the recommendations regarding the Highway Interchange category of the zoning ordinance being studied by Economic Development Commission and Planning Commission members. Mr. Hawbaker recommended that a four-point step to replace the current "HI" zoning be adopted with HI-1 to include BL, BG, PB and IR districts and HI-2 to include BT, RM PUD districts and to create a new district, "IT" - Industrial Transitional. The Commissioners gave their approval to proceed with the study with the results to be reviewed by the Planning Commission before being taken to public hearing. PLUMBING BOARD - HOMEOWNERS PLUMBING PERMIT Paul Sprecher, Plumbing Inspector, and Mike Waugh, representing the Plumbing Board, appeared before the Commissioners to inform them of the problems they are encountering with the Homeowners Plumbing Permit. Mr. Waugh explained that the homeowners are taking out permts and having unlicensed or apprentice plumbers perform the work. The Commissioners asked the Plumbing Board to research this matter taking into consideration the rights of all parties and to check with other counties to see how they handle this problem before making a recommendation. BID OPENING - 24-HR. UNIT DOSE DRUG EXCHANGE DISTRIBUTION SYSTEM - DETENTION CENTER The bids for the 24-hour unit dose drug exchange distribution system for the Washington County Detention Center were publicly opened and read aloud. The firms participating in the bidding and their proposals were as follows: Fishers Pharmacy - 1) Unit Dose - $2.95 x 2520 = $7,434 2) Unit Dose Over the Counter Bulk Purchase = 35%, Total Bid - $l0,584; Eakles Drug Store - 1) Unit Dose - $2.50 x 2520 = $6,300 2) Unit Dose Over the Counter Bulk Purchase - 0%, Total Bid - $6,300. The bids will be reviewed by appropriate officials prior to a decision being rendered. AUGUST 25, l987 MINUTES, CONT'D. BID OPENING - ROOFING, COURT HOUSE The bids for the roofing work at the Court House, including restoration and cleaning of the masonry work, repair of cornices, sealing, painting and replacement of spouting, were publicly opened and read aloud. Firms participating in the bidding and their proposals were as follows: Bonded Applicators - Base Bid - $448,000; Kline Associated Roofing Contractors - Base Bid - $285,000. The bids will be reviewed by appropriate officials prior to a decision being rendered. BID OPENING - COPY EQUIPMENT Due to the complexity of the bids for copy equipment, they were publicly opened but the proposals were not read aloud. Firms participating in the bidding were as follows: Office Suppliers, Inc., Rockwell Business Furniture & Suppliers, Document Solutions (Xerox) and International Business Machines. The bids will be reviewed and a cost analysis prepared prior to a decision being rendered. SEALED BID - SALE OF OLD JAIL SITE Prior to the opening of the bid received for the sale of the Old Jail Site, the County Administrator explained that he has been informed by the City of Hagerstown that they would not approve a conveyance of the old jail site unless a fee simple right-of-way of 25' is maintained by the County for the Juvenile Detention Facility on the site, which was not in the advertisement for the property. The proposed right-of-way will be on the west side of the property line leading out to Church Street. David Poole, County Attorney, stated that if the bid is accepted, it would be subject to negotiation between the bidder and the County. The bid received was then publicly opened and read aloud. Mr. Orville Adkins submitted a bid of $l00,0l0 for the old jail site with a check enclosed in the amount of $l0,00l as a l0% deposit. The bid will be reviewed by appropriate officials prior to a decision being rendered. BEAVER CREEK ROAD BRIDGE Glenn Dull, County Engineer, presented a preliminary construction cost estimate for the Beaver Creek Road brige as prepared by Associated Engineering Sciences, Inc. Mr. Dull recommended that a one-lane concrete box culvert with stone sides be constructed over the creek. The Commissioners gave their approval to have a structural engineer sketch the proposed structure. CONVENE IN EXECUTIVE SESSION Motion made by Commissioner Roulette, seconded by Downey to convene in Executive Session at ll:35 a.m. in regard to personnel, property and potential litigation in accordance with Section l0.508 of the Annotated Code of Maryland. Unanimously approved. RECONVENE IN REGULAR SESSION Motion made by Commissioner Downey, seconded by Irvin to reconvene in Regular Session at 3:00 p.m. Unanimously approved. HEALTH SYSTEMS AGENCY - BOARD REAPPOINTMENTS Motion made by Commissioner Roulette, seconded by Downey to reappoint Robert Brandt and Luther Phillips to the Governing Body of the Health Systems Agency for a term extending to August 30, l990. Unanimously approved. SELECTION OF BOND COUNSEL Motion made by Commissioner Roulette, seconded by Downey to select the firm of Miles & Stockbridge as bond counsel for their low proposal for services of "not to exceed" $l0,000. Unanimously approved. At this time Commissioner Bowers was excused from the Meeting and Commissioner Roulette assumed the Chair. ELECTRICAL INSPECTION AGREEMENT RENEWAL Motion made by Commissioner Downey, seconded by Irvin to renew the electrical inspection agreement with the Middle Department Inspection Agency for a one-year period to August 3l, l988 under the same terms and conditions as now applies, with the County receiving 20% of fees collected and $l700 for the space rented. Unanimously approved. LETTER OF SUPPORT - FROSTBURG STATE UNIVERSITY Motion made by Commissioner Irvin, seconded by Downey to send a letter endorsing the location of a four-year college in Washington County to Frostburg State University and to offer any assistance which the Commissioners may be able to provide. Unanimously approved. AUGUST 25, l987 MINUTES, CONT'D. ACCEPTANCE OF ROAD - MAR-ROCK DRIVE Motion made by Commissioner Downey, seconded by Irvin to conditionally accept the recently constructed section of Mar-Rock Drive (800'), associated with the Rocky Spring Acres Subdivision, Section A-3, into the County's roadway system with the maintenance bond set at $l600 and the final inspection having been conducted on August 12. Unanimously approved. ELECTION BOARD - VOTING MACHINES Motion made by Commissioner Irvin, seconded by Downey to approve of allocating up to $5000 for the Washington County Election Board to bid for the purchase and delivery of l2 used voting machines being sold by Howard County. Unanimously approved. FUEL OIL CONTRACT - ACCEPTANCE Motion made by Commissioner Downey, seconded by Irvin to accept the bid submitted by A.C.& T. for #2 fuel oil for the price of .5974/gal. with a .0025 superfund tax per gallon. Unanimously approved. EMPLOY COMMUNITY COORDINATOR Motion made by Commissioner Downey, seconded by Irvin to employ Paulette Sprinkle in the position of Community Coordinator to fill an existing vacancy. Unanimously approved. ASBESTOS REMOVAL PROJECT Motion made by Commissioner Irvin, seconded by Downey to hire the firm of Spotts, Stevens and McCoy as recommended by the Coordinating Committee to perform the Asbestos Removal project for seven County buildings for a "not to exceed" price of $8,000 for survey and specifications and to perform monitoring services for $560/day. Unanimously approved. TRANSFER OF MIDFA LOAN Motion made by Commissioner Irvin, seconded by Downey to approve the transfer of a MIDFA loan from Sterling Radiator to MESTEC, Inc. Unanimously approved. SPELLAR/BACON DEED - GORDON CIRCLE Motion made by Commissioner Downey, seconded by Irvin to proceed with advertising for a quit claim deed between the Spellar and Bacon property on Gordon Circle with the conditions that Mr. Baughman, former property owner, and Mr. Bacon share all costs associated with advertising and deed preparation and that the current law suit against the County be dismissed with the understanding that Mr. Baughman pay all costs for the County's defense in the law suit. Unanimously approved. ASSIGNMENT & ACCEPTANCE OF MIDFA LOAN Motion made by Commisisoner Downey, seconded by Irvin to approve the assignment and assumption of a MIDFA loan from Atlantic Cabinet to Alumex.
